Mayor Carver noted that the applicant is not present but the public hearing will be held as there are members of the public present to speak on the matter. City Clerk Wascura confirmed that the representative for the applicant had been told that the meeting would be on March 2.1, 1995. 1) Mr. Brian Wexler, 5660 S. W. 59th Drive, voiced opposition and noted that the owners should have known the code requirements before designing the house. Many lots in the area are odd-shaped and the other residents have adhered to the requirements. There are many signatures in opposition to the variance from the neighbors. 13 2) Mr. G. Houston, 5978 Miller Drive, noted that the setback on the property is the setback recommended by Florida Power & Light because there are overhead electrical lines. Building, Zoning & Community Development Director Mimms noted that the staff recommended denial; Planning Board voted 4/1 to deny the request. Mayor Carver noted that there isn't any legal hardship. Also, although the applicant is not present, there are neighbors present to object to the application. Commissioner Cooper agreed that there isn't any hardship with the land. City Manager Cox explained that the form is necessary due to an increase in activities held in the City. The form will let all those involved know the costs involved, i.e. in-kind services. Vice-Mayor Young commended the City Manger for developing the form. The requested and required in-kind services are a substantial cost to the City. Vice-Mayor also expressed concern with adequate liability insurance as those who hold the events should be totally responsible, not the City. The police department should be paid by the promoters of the events. Commissioner Bass asked if there will be delineation between the special events that the City sponsors and those requested from other groups and organizations. She would like the City Manager to investigate the way in which off-duty time payment and overtime payment is handled with regard to the City's special events. Location: 5620 S.W. 59 Place; South Miami, Florida 33143 (A residential property) BACKGROUND & ANALYSIS The subject property is a vacant lot in the Gables Edge subdivision, and is zoned RS-3 (Low- Density Residential). This corner lot exceeds the 10,000 sq.ft. minimum lot area requirement, and is similar in configuration to approximately one-third of the lots in the 63-lot subdivision. The applicant is requesting a variance to allow a 13-foot rear setback where 25 feet are required. The purpose of the request is accommodation of a 12' by 30' open (roofed) porch, which is now proposed in modification of the applicant's plans for a 2,400 + sq. ft. house which was previously approved by the City. Following review of the application, which included,presentation by the applicant's' representative, and testimony from two neighboring property owners opposed to the requested variance, the Planning Board voted 4:1 to deny the request. A petition opposing the variance, signed by owners of the three adjoining properties and by owners of the property directly across the street, was submitted to the Planning Board and is attached. There is no hardship running with the land in this case. Both staff and the Planning Board have accordingly recommended denial of this application. Staff has provided a sketch of the Code-prescribed "ideal" 75'x 133'RS-3 lot with the applicant's proposed house located on that lot (see attached). On the page that immediately follows, the applicant's submitted site plan depicting the house on the existing lot is provided for comparison. Assuming the house were located on the Code-prescribed "ideal" 75' x 133' lot, although the rear setback would be greater than the required 25 feet, the proposed house would not meet side setback requirements. The property owner benefits from the existing configuration in that the proposed house is much wider than would be permitted on the ideal (and orthogonal) lot. This application does not comprise a hardship condition. RECOMMENDATION: Staff recommends that the Planning Board vote to recommend denial of this application. Staff has provided a sketch of the Code-prescribed "ideal" 75'x 133' RS-3 lot with the applicant's proposed house located on that lot (see attached). On the page that immediately follows, the applicant's submitted site plan depicting the house on the existing lot is provided for comparison. Assuming the house were located on the Code-prescribed "ideal" 75' x 133' lot, although the rear setback would be greater than the required 25 feet, the proposed house would not meet side setback requirements. The property owner benefits from the existing configuration in that the proposed house is much wider than would be permitted on the ideal (and orthogonal) lot. This application does not comprise a hardship condition. RECOMMENDATION: Staff recommends that the Planning Board vote to recommend denial of this application. COMPREHENSIVE PLAN: The proposal is consistent with the Goals, Objectives and Policies of the Comprehensive Plan.
