Dear Mayor Porter and Commissioners:
In spite of positive thinking, the results of an accident in
Finn Dixie in May of 1984 has left me with -a painful physical handi-
cap and I seek compassionate relief from the city I dove and serve
in the form of a Home Occupation license.
With the need to administer moist heat, periodic bed rest or
warm baths to relieve painful spasm and pressure on the .sciatic nerve
brought', on by the physical rigors of the job of landscape designer,
I find I am unable to work in conventional office space.
My work takes me out of my home to the job sites of my clients
and at no time do I pursue any business acitivity that mould include
traffic to and from my home. My office equipment sufficient for
designing landscapes is the drawing board, telephone and small table.
The large) studio attached to my home was once used by Joan Wilson for
weaving and I use the remainder to store my personal horticultural
library, slide collection and materials used for part time teaching
which is 'performed at the individual schools.
It is imperative that I continue working in order to survive
as I am now alone and my sole source of support. - By the aforementioned
home treatments and chiropractic care, aided by pain killers when
needed I' am able to continue my practice and support myself. Thankfully,
Rature gives us balance and the creative and knowledge side of my life
has 'on2y;jimproved.
Your help in this difficult and challenging time of my life will
be deeply appreciated.

Mr. Hoffmann stated that he had to recluse himself from
being Chairman due to the fact that the Applicant is his eye
doctor.
John Andrews became the Acting Chairman for this PB -88 -019.
Mr. Gerry F•unari, signed in and, addressed the Board. He said
he opened one year ago. Formerly, UniGlobe Travel Agency
had the 1,000 sq. ft. on the lobby floor. He said the Agency
received a permit to place one sign in the Window.

Mr. Funari said he subleased 450 sq. ft. of space from the
current tenant Martin Travel, which has the remaining 600
sq. ft. He said that Martin Travel received a permit to put
up their sign but he was told that he needed a variance for
his. He said his sign is painted white and is a non-
pertinacious sign and for the purpose of identification.
Mr. Funari said that he had to remove the sign for two weeks
because he was in violation. He was told from the landlord
that since there was a sign up that had a permit he didn't
need to apply for a variance. He said later he discovered
that only one permit was issued based on the 1,000 sq. ft.
which, took up all of the signage and that he would need a
variance. He said he has a hardship because, without a sign
his business cannot be identified.
Mr. Ligammare asked Mr. Funari if he was aware of this

not aware of it because there was a sign there already.
Mr. Carver asked Mr. Funari that he mentioned previously
that there were two signs there in the side of his window.
He said, if he knew whether the signs had permits.
Mr. Funari said that it was not allowed but it was up.
Mr. Andrews opened the Public Hearing at, this time.
There was no public input, therefore the staff report was
given.
Mrs. Goudarzi said that staff recommends approval, since the
Applicant has to identify his business and Advance Tower has
taken up the required square footage with their two signs.
There is no other way for the Applicant to identify his
business, therefore staff recommends approval.
Mr. Ligammare asked Mrs. Goudarzi what other alternatives
the Applicant has. Mrs. Goudarzi said he can move from the
property., be without a signor the Board grant him a
variance.
Mr. Gutierrez said that in the report staff provided, in
Section 635.01 the code allows a 30 sqe ft. sign.
Mrs. Goudarzi stated that each store or each applicant is
allowed 1 sq. ft. with a building total of 30 sq. ft.
Mr. Carver asked Mrs. Goudarzi what signs are there n -ow,'_
other than Advance Tower and Martin Travel. Mrs. Goudarzi
stated that there are two Barnett Signs and a WorldSa sign
also.

Request: Variance to allow a window sign on a building
where no window sign is currently allowed.
Background
Applicant is owner of business located in (C -0) district and requests approval
of window sign to identify his business.
The business located in first floor of Advance Tower, facing 62nd Place, and was
issued Certificate of Use and Occupancy in December of 1987.
Applicant was cited for illegal sign, by City of South Miami Code Enforcement
Officers and paid a double fee to apply for variance.
Analysis
According to Section 6 -3- 5(.02) of the Zoning Ordinance, Advance Tower is allowed
to have two flat signs.
The building already has two flat signs (ADVANCE TOWER 5 WORLDEX), and any other
tenants must request for variance, if they wish to have a flat sign.
On October 6, 1987, the Mayor and City Commission granted two variance requests
for a double -faced cabinet - corner sign and a directional sign for an automatic
teller and denied a variance request for a flat sign for Barnett Bank of South
Florida, at the same building. (Ord. 1 16 -87 -1288)
According to Section 6- 3- 5(.01) of the Zoning Ordinance, "Name plates, not to
exceed one (1) square foot each in area, to identify each occupant within the
development, not to exceed an aggregate total area of thirty (30) square feet,
direct illumination ", are allowed.
Said name plate only identifies the owner or occupant.
The proposed sign is one permanent identification sign, painted white, and about
10 square feet in area.

Recommendation
The purpose of Commercial Office (CO) District is to permit uses which will
accommodate professional and business office space needs in a relatively
intensive centrally located manner.
Optical services are allowed in this district, and the Applicant needs to have
a sign to advertise his business.
Since the building is not allowed to have more than two flat signs (regardless
of its size), and is not allowed to have any identification window sign, staff
recommends granting of variance to allow one permanent identification, window sign,
upon approval of Environmental Review and Preservation Board.

authority to revoke or suspend such hermit. in the
event all conditions of the approval are not complied
with by the applicant. Extensions beyond the °original
thirty 30 day approval shall only be granted by four
affirmative votes of the City Commission.
Section 2. This Ordinance shall take effect immediately
upon adoption.
