I a. ORDINANCE NO. AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIANI, PLORIDA, ADOPTING AN AMENDMENT TO THE SOUTH MIAMI COMPREHENSIVE PLAN ADOPTED JUNE 3RD, 1981. WHEREAS, pursuant to Ordinances No. 13 -81 -1107 and as amended by Ordinance No. 22 -82 -1145 of the City of South Miami Code of Ordinances, the Mayor and City Commission may, by resolution, initiate an amendment to the Comprehensive Plan adopted pursuant to the above-referenced ordinances; and WHEREAS, pursuant to Resolution No. 12 -88 -8028, the 'Mayor and City Commission did initiate an amendment pursuant to this procedure; and WHEREAS, pursuant to these above - referenced Ordinances, applications from the public were received during October and November, 19871 for amendments to the Comprehensive Plan; and WHEREAS, pursuant to Part II, Chapter 163, Florida Statutes, a'public hearing was conducted on March 7th, 1988 by the Local Planning Agency which has made recommendations and modifications to the Mayor and City Commission in regard to the amendment requests from the Commission and the public. With the need to administer moist heat, periodic bed rest or warm baths to r€'aave painful spasm and pressure on the sciatic nerve brought on by the physical rigors of the job of landscape designer, I find I an unable to work in conventional office space. My work takes me out of my bone to the job sites of my clients and at no time do 2 pursue any business acitivity that would include traffic to and from my bome. My office equipment sufficient for designing landscapes is the drawing board, telephone and small table. The large studio attached to my boat was °once used by Joan Wilson for weaving and I use the remainder to store my personal horticultural librarq, slide collection and materials used for part_, time teaching wbiebJ s performed at the individual schools. it is imperative that I continue working in order to survive as I am n,ow alone and my sole source of support. By the aforementioned home treatments and chiropractic care, aided by pain killers when needed, I am able to continue my practice and support myself. Background Applicant is the owner of a business located in C -2 District and requests approval of variance to allow a neon sign on the window of his business to identify it. Chronology of the Request August 2, 1988 9:00 AM, the Environmental Review and Preservation Board (ERPB) denied the sign for aesthetic reasons. - August 2, 1988 at 7:30 PM, the City Commission instructed the Administration to discontinue the practice, established about years ago, to allow neon signs in the C-2 District at the discretion of the ERPB. - September 6, 1988, the ERPB approved the aesthetics of the sign conditional on an administrative appeal to the City Commission. According to the ERPB Minutes of September 6, 1988, Staff Report PB -88 -021 10 -25 -88 Meeting s "Ms. Aran- Spinrad said this Applicant appeared before the Board approximately a_ month ago and his request was denied for aesthetic reasons. She said the very same night that the Applicant appeared before this Board, the City Commission, decided that the practice to allow neon signs in C -2 district be discontinued. She said that regardless of this Board's decision, she will put forth an administrative appeal to the City Commission." - September 19, 1988, the City Commission granted an administrative appeal from a decision of the ERPB which means no permit can be issued for the sign. (Resolution No. 153 -88- 7066) - Now the Applicant is requesting a variance for his sign. Analysis According to Section 6 -2 -4 of the Zoning Ordinance "No sign shall be either directly or indirectly illuminated unless specifically permitted within the district regulations ". The only illuminated signs which are allowed in Downtown Commercial (C -2) are: one hanging sign, one projecting sign and two directional signs. The proposed sign is not adaptable to any of the above mentioned signs. Section 6 -3 -7.08 of the Zoning Ordinance allows one permanent widow sign upon approval of the ERPB. Such a sign is not allowed to be illuminated in the C-2 district. Before the August 2, 1988 instructions of the City Commission, neon signs were allowed in the C -2 district. Records indicate that as early as 1979, the City issued permits for neon signs in the C -2 District. (Attached are examples of illuminated signs which were approved without obtaining any variances. The Applicant feels that he was not treated equally as others who applied for neon sign permits in the past. Also, he claims that no ordinance or resolution has been passed in regard to neon signs that distinguish his request from the others. Recommendation Staff recommends approval of this request, since the application was submitted prior to the City Commission's decision of August 2, 1988 and to maintain equal treatment under law. According to the Plat thereof, as Recorded in Plat Book 3, at Page 198 of the Public Records of Dade County, Florida. Mr. Steve Tandlick, signed in an addressed the Board as the owner of Strictly Tennis. He explained the events which have occured to this date. In Jan. 88 he relocated his business to 7306 Red Road primarily due to the signage permitted in this area. He applied for ERPB in August which was denied due to aesthetic reasons. When he tried to resubmit his application for ERPB, he was told by the Zoning Department they could not accept his application. He was then informed that the City Commission had recently decided they would no longer allow neon signs in C -2 District which, includes Mr. Tandiick's business. After several discussions with the BUD Department it was decided to allow Mr. Tandlick to appear before the ERPB and present his revised plans. These plans were approved with modifications, but the approved was overturned by the City Commission; and now a variance is required. Mr. Tandlick feels he should be grandfathered in, due to the fact that he originally applied before the City Commission decision. Mr. Tandlick informed the Board the other tenants in this development have ,several neon signs. The Board reviewed and discussed the drawings. Mrs. Goudarzi, said the staff recommends approval of-the sign, since it was submitted prior to the City Commission decision of Aug. 2, 1988 to maintain equal treatment under the law for this applicant. This sign would hang in the front window as do the neon signs of my 5 direct neighbors in the same building. My sign would be simpler, and smaller than my neigbmrs.'' I have been a resident of this area for many years, and have been in business for 14 years, serving the community with good service and products. I'have had hard luck finding a good location. .After 4 moves in the last 7 years, I have finally found an excellent location only blocks from my previous one. I have moved at a great expense, but feel this location will be mfr best.-,.ever. I felt this was a good business decision based on the look of the building and the avail - able signagelike my neighbors exhibited. I inquired at City hall where I was given an application and told what was needed to get my neon sign permit. "A permit is given when you follow these instructions" I ' was told. Background /Analysis Applicants are the present owners and a gentleman who has a contract to purchase the subject property. Applicants propose a six -lot subdivision with access provided by a privately owned and maintained access easement. A variance is required to allow two lots that do not have the required lot frontage. Each aspect of the proposed subdivision and variance request is analyses below. ,l A " Variance for Use of Seotic Tanks Applicants have requested and received variance from Dade County's Department of Environmental Resources Management (DERM) for use of septic tanks within the proposed subdivision. Landscaping The new access easement will require the removal of at leant one ficus tree from the SW 67 Ave. side of the subdivision. No permit for tree removal shall be issued until Applicants comply with the requirements of the new Dade County Tree Removal- Ordinance, including any requirements for replacement landscaping. Recommendation Because sidewalks exist to the south of the proposed subdivision along SW 66 and 67 Avenues, Staff recommends that these sidewalks be continued along the outside of the proposed subdivision to its northern boundary. Staff recommends acceptance of the dedication of the west half of the SW 66 Avenue as a 50 foot right -of -way complies with the policies of the current Comprehensive Plan. Staff recommends approval of the proposed subdivision and variance request modified to extend the sidewalks along SW 66 Avenue as mentioned above. Jam „ a 3 Access Easement The access easement is designed as a cul -de -sac thirty feet wide ending in a bulb with radius 37.5 ft. The easement is designed down the center of the subdivision, across the front of each lot. All property lines meet in the center of the subdivision, but building setbacks will be measured from the edge of the easement. Each lot area exceeds the required 10,000 sq.ft. minimum net of the access easement. Variance Request South Miami's Zoning Ordinance does not contain unique area and frontage regulations for lots designed around cud -de -sacs. The current regulations are best applied to rectangular blocks arranged in grid formations. This organization is not desireable for this property because it would allow thru- traffic to use SW 66 as a short cut from Sunset Drive to SW 67 Ave. Minimum "frontage requirements are established to create regular and standarized lots throughout the community. When applied to lots around a cud -de -sac, South Miami's required frontage (75 feet, minimum) stretches the lots to unusual proportions.' When required setbacks are taken from unusually shaped lots!, the resulating buildable "envelope” may be too small for practical use. To avoid the hardship of unusually shaped lots, Applicants have proposed two lots of the subdivision with more regular lot shapes. and lot widths, measured at the edge of the access easement, of approximately forty feet. Dedication Applicants have agreed to dedicate the east 25 ft. of the parent tract as the west half of the existing SW 66 Ave. Because of the cul -de -sac design of the subdivision, no connection between the access easement and the SW 66 Ave. will be made and no increase in traffic will result. Sidewalks Section 17 -11 of the City "s Code of Ordinances requires that sidewalks be constructed if fifty percent of the existing residences on the same side of the street in the same block have sidewalks. Applicants propose no sidewalks along the cull -de -sac within the subdivision. Because this subdivision will create a new block, no sidewalks are required within the subdivision. Outside the subdivisio sidewalks exist to the south of the proposed development along both SW 66 and 67 Avenues. Applicants propose sidewalks along SW 67 Avenue. In order to satisfy the requirements of Section 17 -11, sidewalks must be provided on both SW 66 and 67 Avenues. He said the land is located between SW 67 -66 Ave. and 69 Street, it is zoned RS -3 which permits single family houses on 10,000 square foot lots. He said he is requesting approval of the waiver of plat and approval of variances in Zoning Ordinance Section 5 -3 -3.01 to allow two 'lots requesting 75 feet frontage. Mr. Roth and his consultants studied the property carefully and he is proposing a plan that he believes is the best plan. He said he submitted a waiver of plat for the property, subdivided into six individual family lots. He said each lot averages 11,981 gross sq. ft. and 10,087 net sq. ft. He plans to build 6 single family homes on the lots. The Proposed Plan is aesthetically attractive, environmen- tally sensitive and contains the largest possible lot size. The plan contains an attractive street by enclosing the cul -de -sac on all sides with houses. He said because the amount of street is minimized-only 10.82 of the property is in streets. Landscape areas and lot 'sizes are maximized. Mr. Roth presented to the Board his Proposed Plan. He said all six homes are arranged around a; property owned and maintained cul -de -sac, accessible from ',SW 67 Ave. A decorative wall will be built along; SW 67 and 66 Ave. To unify the subdivision by providing an attractive and identifiable image, while liaiting, the amount of street noise inside the subdivision and ah „so providing a sense of security for the residents.: 25 f oot strip will be dedicated to the City on the East of the property to complete the SW 66 Ave. right of way. -2_ Mr. Roth said that Alternate Plan B is similar to Plan A, except the cul -de -sac is not as long. It too meets all lot area and frontage requirements. The problems with Plan B, however, are similar to Plan A. Once the property line setback is constructed the resulting building envelopes will still results in a less attractive subdivision then the Proposed Plan. And again, three houses would be on each side of the street. Although the percentage of paved area in Plan B is less than Plan A, 12.3% compared to 14.6X, it is still higher than the Proposed Plan which is only 10.8%. The average net lot sizes are 10,512 sq. ft., still smaller than the Proposed Plan and the percentage of landscape area is still lower than the Proposed Plan. Another Alternate Plan would connect SW 67 Ave. to SW 66 Ave. He said he will not consider that plan. Although no variances would be required, it is not a good plan as it invites through traffic along SW 66 Avenue. In conclusion, Mr. Roth said it is evident that the Proposed Plan is 'better than the Alternative Plans. The Proposed Plan is the most visually attractive, environmentally sensitive and the plan liked by most Homeowners in the area. He said that should the Board deny this variance request, nevertheless he would proceed with one of the less desirable plans. He said he is asking for favorable consideration of the variance request and the waiver of plat to allow his to proceed with what he clearly believes is the best plan. Mr. Gutierrez asked Mr. Roth that he did not see a request in the Notice of Public Hearing to remove the sidewalk on 67 and 66 Ave. Mr. Roth, stated that although it is not on the reau.est he would like to remove the sidewalk. Mr. Gutierrez asked Mr. Roth if there was sidewalk on the North and :South of the property, Mr. Roth stated that there was a sidewalk South of his property. Mr. Gutierrez said if there was any reason why there shouldn't be a sidewalk. Mr. Roth said that none of the homeowners living next to the subdivision would benefit from this. Mr. Gutierrez asked Mr. Roth about the seven ficus trees on 67 Avenue and that in order for Mr. Roth to make his entrance, does he have to remove two of the trees. -4 - Mr. Roth said he thinks he only needs one removed. Mr. Gutierrez asked Mr. Roth if there'was anyway he could save the trees, like making a different entrance. Mr. Roth said he would review this with the Planning Board Staff. The Board discussed the construction of new sidewalks. It was established that a sidewalk exists to the South of the subdivision along SW 66 and SW 67 Ave. Mr. Roth stated that he would extend the sidewalk along SW 67 Avenue, but he did not feel that the neighborhood would be served by the installation of a sidewalk on 66 Avenue. Mr. Hoffmann stated he feels the hardship, in this, situation is caused by the way Mr. Roth designed the cul -de- sac. Mr. Roth said that in order to provide the largest lots and the safest street with very little pavement, two of the lots cannot meet the 75 foot frontage. Mr. Hoffman stated that this hardship is due to the engineering of the cul -de -sac that is why they need a variances. At this time the Public Hearing was opened. Mr. John Stimson', signed in and addressed the Board. He said he lives along the North boundary, and disagrees with the request not to build the sidewalk on 66 Ave. He stated that children play on the sidewalk and he wouldn't like to see them playing on the street. He also would like for the wall to be continued along the North side of the property to completely enclose the project. Mr. Robert. Healy, signed in and addressed the Board. He, said he lives across the street from Mr. Stimson. He would not like to have a side walk along SW 66 Avenue because the landscaping will preserve some of the country aspect. Mr. Ed Lassiter, signed in an addressed the Board. He he said lives right against the wall of the proposed subdivision and he agrees with the Proposed Plan. Mr. Hue Wallobee, signed in an addressed the Board. He said he lives South of the development on the East side of the street. He agrees with the Proposed Plan and would like to see it approved. Mr. Hoffmann at this point asked for staff recommendation. Mr. David Henderson stated that staff recommends the sidewalks be extended along both sides of the subdivision, to comply with the Section 17 -11 of the City's Code of Ordinance. Staff recommends the subdivision and the variance request be approved with a modification to extend the sidewalk along SW 66 Avenue. Mr. Ligammare stated that he needs more information, concerning the pavement and the building envelope that the cul -de -sac created. Mr. Roth once again explained the different plans. He stated that he needs more opening and less pavement to create a better and more attractive subdivision. Mr. Roth at this time presented the Board with a diagram to identify the comparison in the lot areas. Mr. Hoffmann stated he agreed with the Propose Plan, until Mr. Roth mentioned the results of the Alternative Plan would be three houses on each side of the subdivision that did not require variance. He stated that from his point of view there is a self- imposed hardship. Mr. Gutierrez stated that the reason there is a code and the reasons that there are variances and the reason the'Board is present tonight is to allow flexibility in the laws that contrl development. Whether a self - imposed hardship exists or not is not as important as approving the best plan. -6- y- 1 • Mr. Hoffmann said that the requirements of the code are very clear as to what the board has to find to grant a variance. A hardship is necessary in this circumstance and the Proposed Plan does not have a legal hardship. When the subdivision has two other alternatives that clearly are within the requirement of the code and do not require a variance. The fact that the preferable looking one requires a variance is a self- imposed hardship. This decision is not from an aesthetic point of view. Mr. Gutierrez stated that he would like to discuss the issue of hardship with the City Attorney. He feels that this hardship issue will go on forever and he needs the Board to be clear on it, so they can make a proper decision. MOTION: Mr. Gutierrez moved for approval on the request on the Proposed Plan by waiving the regular platting procedure and allowing the two East lots to have less than '75 ft. frontage. With the stipulation to follow staff approval to continue the sidewalk on both side of the subdivision on 67 and 66 Avenue. This is not a condition to meet for the but he would 'like for Mr. Roth to meet with the staff to try to maintain the tree. John Andrew seconded the motion. Mr. Carver stated that he does not see the need for a sidewalk to continue.on a dead end street which cannot be built through , since Davis Gardens has been platted and built the way it has which ends 66 Avenue in a dead end street. Ms. Kraich asked Mr. Roth who would own the sidewalk the Homeowners Association or the City. Mr. Roth stated that it would be owned by the City. Ms. Kraich said therefore, the City would have to maintain it. Ms. Kraich said she is not in favor because she knows how the City maintains the sidewalks. She said the City will neglect the sidewalk and at sometime become hazardous. Mr. Hoffman asked if there was any further discussion on the motion.
