Miami, FL 33143 Dear Mr. Hampton: On February 1988, we entered into an agreement to build a home and swimming pooh for Mr. Kenneth N. Feldman at Orr's Pond.- The home was scheduled to be completed this month. In July of 1988, we applied for a swimming pool permit and were advised that we did not comply with the standard rear setback requirement for a swimming pool. In 1986, as we worked on the Planned Development Ordinance, we did not anticipate a demand for private swimming pools. It is now apparent that we incorrectly assumed that we would have flexibility in locating swimming pools if an owner requested one and that the flexibility inherant in the P.D. ordinance would allow this. We regretfully realize now that this was wrong. Our lots are approximately 6,000 sf. in area as opposed to the 10,000 sf. required in RS -3 and our rear setback is 15' as opposed to the 25' required in RS -3.- We believed that since our lot size and rear setbacks were approximately 60% of those required under RS -3, our pool setback could proportionately be 60% of the requirement or- 7' -6 ". We are requesting a swimming pool rear setback variance to Section 8- 4- 2.01d, to provide a 7i -6" rear setback where a 12' -6" rear setback is required. To the best of our knowledge, we comply with all other requirements. Our total ground coverage is 35% (40% allowed), the side setbacks are 19' -4" and 21' -4" respectively (10' allowed) and we have no screen enclosures. We presently own the lots to the rear and side of thin property and therefore, this request does not directly affect any neighbors. In addition, I would like to point out that, of the eight homes already sold, this is the only one that has requested a swimming pool indicating to us that additional requests for pools, while likely, will not he extensive. My, house was built in 1954 and is located at 5911 S.W. 83rd St. Consequently, the existing structure has a side set back of 5 ft., not the now required 71 ft. (5-3-3.02).
