AN ORDINANCE OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING
CHAPTER 20, ARTICLE 5, SECTION 5 -12 -2 OF THE
ZONING CODE BY ELIMINATING FOOD STORES
(CONVENIENCE TYPE ONLY) FROM THE SCHEDULE OF
PERMITTED USES IN 'C -l' NEIGHBORHOOD COMMER-
CIAL DISTRICTS.
WHEREAS, the City's Zoning Code currently permits
Convenience type Food Store uses in 'C -1' Neighborhood Commercial
Districts; and
WHEREAS, the Mayor and City Corfmission deem it in the
public interest to eliminate this as a permitted use in the district.
NOW, THEREFORE, BE IT ORDAINCED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA..
Section 1. That Food Store (Convenience Type only) use be
eliminated from the schedule of permitted uses in C -1, Neighborhood
Cormercial Districts and that Chapter 20, Article 5, Section 5 -12 -2 be
amended as follows:

An Ordinance of the Mayor and City Commission of the City
of South Miami, Florida, amending Chapter 20, Article 5,
Section 5 -12 -2 of the Zoning Code by eliminating "food
stores (convenience type only)" from the schedule of
Permitted uses in "C -1" Neighborhood Commercial District.
Vice Chairman Hoffmann asked if there was anyone present
who wished to speak on this item.
Carol Se v 1 n g 1 e signed in and addressed the Board. She
asked if eliminating convenience type food stores fros
the C-1 District, would mean that they would
automatically be allowed in the C -2 District and thereby
bake it easier for thes to come into a neighborhood.
Mr. Lopes replied no, that it would mean that there would
be no District open to convenience type food stores.
?here was no one else present who wished to speak on this
Item, and the Public Hearing was closed.
MOTION: John Andrews moved to approve the
Ordinance as presented.
Neil Carver seconded the Motion.
Mr. Andrews said that the existing convenience stores
will be grandfathered, and he thinks prohibiting
convenience type food stores in the C -1 District is a
wonderful idea.
Xr. Cooper thought that convenience stores should be In
the C-1 District, as they are convenient to the
residential areas.
Mr. Andrews said he thought there were enough convenience
food stores in the City.
Mr. Cooper questioned the needs of the City In 50 years
fros now, and would it be more convenient to have
convenience food stores in terms of accessibility or does
the City only want to have large shopping centers. He
said that he would prefer to have convenience stores and
that they belong in the C -1 District.
Carver satd that to have convtnienct typt food stores
in a C -1 designation where, theoretically, they are
across the street froe private homes is not dtsiraDlt.
He said that he d f d not itel that convtnience type food
stores should be in C -1 designations.
A discussion ensued on strvice stations and in what
districts they vere a persitted use. Mr. Lope: said t h a r
all service stations in the City were a special use.
Vice Chairman Hoffmann said that his concern is whether
or not this would entirely eliminate convenience type
food stores from the City of South Misel or whether they
would be permitted In the C- 2- District, and there would
be no delineation on food stores. He said that he
thought the Board should sake thttr position cleat one
way or the other as to whether they are recommending the
elimination of convenience type food stores or whether
they are saying that convenience food stores ate sort
appropriate in the C -2 District.

MOTION: Sell Carver moved to approve with the
proviso that the Commission clarifies

Mr. Carver said that he thinks it is important to take
the convenience - type food stores out of the C -1
designation.
Vice Chairman Roffaann said that his decision to vote
against the ordinance is that C -1 is an appropriate place
for convenience type food store.

AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING
ORDINANCE 526 -A WHICH APPROVED AND AUTHORIZED THE
AMENDMENT OF A GAS FRANCHISE PREVIOUSLY GRANTED BY
ORDINANCES 468, 478 AND 526 FROM CITY GAS COMPANY
TO N.U.I. CORPORATION, AS FRANCHISEE, BY CHANGING
THE FRANCHISEE TO ELIZABETHTOWN GAS CO.
WHEREAS, on September 18, 1962, the City of South Miami
granted a gas franchise which is currently held by City Gas
Company; and
WHEREAS, the franchisee requested that the City approve an
amendment to reflect that the N.U.I. Corporation of New Jersey will
be the franchisee and operating company, with City Gas Company
being a division of N.U.I., which the City approved on April 5th,
1988 as Ordinance 526 -A; and
WHEREAS, the franchisee has requested that a technical
change be made in the Ordinance granting a franchise by listing the
franchisee as Elizabethtown Gas Co., a wholly owned subsidiary of
N.U.I,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the Mayor and City Commission hereby
approve that the franchise originally granted by Ordinance 468 and
as amended by Ordinances 478 and 526 and 526 -A of the City be
amended to reflect that Elizabeth Gas Co., a wholly owned
subsidiary of the N.U.I. Corporation of New Jersey is the
franchisee and operating company with the City Gas Company serving
as a division of Elizabethtown Gas Co.
Section 2. That all other terms and conditions of original
Ordinance 468, as amended, shall remain in full force and effect
through the expiration of the franchise.
Section 3. That this Ordinance_ is conditioned upon
Elizabethtown Gas Co. complying with all Federal, State and local
laws and regulations regarding this franchise, including the
original grant of franchise.
Section 4. This ordinance is further conditioned upon the
transaction between City Gas Co. and N.U.I. becoming final..

Request: Change of zoning from "Low- Density Single- Family Residential
District" (RS-3) to "Medium ?Multi- Family Residential District "(RM -24).
Legal Description: Lot 6 plus the East 10' of lot S block l of "Fairglade
Manor" Subdivision and lot 5 less the East 10', block 1 of
"Fairglade Manor" Subdivision, recorded in plat book S at page 79
of the public records of Dade County, Florida.
Background
On August 11, 1987 the Applicant submitted application PB -87 -022 requesting:
1. An amendment to the current Comprehensive Plan's Future Land Use
Map to designate this property for office use, and '
'2. Rezoning of this property from the RS -3 classification to the
Residential Office classification.
The Local Planning Agency voted unanimously to recomaflend denial of the
Comprehensive Plan amendment at its meeting of February 23, 1988.
The City Commission voted 3 to 1 to deny the requests at its meeting of
April 25, 1988.
The current (1981) Comprehensive Plan designates this property as "High
Density Residential ". This category permits densities ranging from 18 to
24 units per acre, with the more intensive uses nearer the core of the
community.
Section 13 -2 -4 of the City's Zoning Ordinance prohibits reconsideration of
'"change(s), in the same or substantially similar form ", for a period of at
least one year, except when denied without prejudice, in which case recon-
sideration.is possible after six months.
Analysis
The proposed rezoning complies with both the current and proposed Compre-
hensive Plans.
MEMO -2- July 20, 1988,.
Zoning Ordinance section 13-2-4 does not apply to this application because
this request for rezoning is substantially different from the Applicants
previous request for an amendment to the Comprehensive Plan allowing the
office use.
No additional variances should be required to develop this property
according to the regulations of the RM-24 zones
Recommendation
Staff recommends approval of the request as it is in compliance with the
Comprehensive Plan (1981).

Susan Redding signed in and addressed the Board. She said

been approved for historic designation by the Environmental
Review and Preservation Board (ERPB) and once this Board
approves this request, then, the request will go before the
City Commission for approval.

ing with historic preservation. Mr. Sasson stated that when the platting'
of the Orr Estate was done, the street address of the Orr Home was changed
from 6491 to 6463.

nomination of the George Orr Estate for
Historic Designation.

WHEREAS, on October 6, 1987, the Mayor and City
Commission amended Article XI of Chapter 20 of the Code of
Ordinances which addresses mandatory review responsibilities of
the Environmental Review & Preservation Board ("E.R.P.B. "); and
WHEREAS, the Mayor and City Commission wish to delete
certain matters relating to single- family buildings from the
mandatory review process of the E.R.P.B.
NOW, THEREFORE, BE IT`ORDAINED BY THE MAYOR AND THE
CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That Section 11 -2 -2.04 of Article XI of
Chapter 20 of the Code of Ordinances is hereby amended as
follows:
11 -2 -2.04 Notwithstanding anything else contained
in the Code of Ordinances of the City,

employed at his residence, but he could have a partner.
Mr. Cooke - Yarborough said when he got to the point where h
has a partner, he will get a proper office. He said th
clients and consultants will not come to his residence, as h
will go to them.
Chairman Cooper asked if there was anyone present who wishe

are submitted in support of my application to the City for a Home Occupational
License as described in ordinance no. 17 -73 -788, section 19. The Cit of
South Miami describes Home Occupation under X -10 -12.51 (copy enclosedl of
the City's zoning code. I include for your review a copy of Home Occupation
as described in the zoning code of West Miami. Please note the similarities
of the wording.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION
AUTHORIZING THE ACTING CITY MANAGER TO EXECUTE AN
ADDENDUM TO THE LEASE AGREEMENT WITH METROPOLITAN DADE
COUNTY TO EXTEND THE TIME FOR CONSTRUCTION OF THE
FACILITY TO MAY, 1989.
WHEREAS, the City of South Miami has executed an agreement
with Dade County for the construction of a Health Care Clinic,
with substantial construction of the facility to have been
accomplished by May, 1988; and
WHEREAS, the City and the County wish to extend this time
provision of the agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That pursuant to article XIX of the agreement
between the City and the County executed June 16, 1987, the
provision styled: "Construction Responsibilities" found at
Article II of the agreement is amended at paragraph two as
follows:
In the event substantial construction of a health facility
upon the land has not been commenced on or before May 30, 1989,
then this lease shall automatically terminate and be of no other
force or effect.
Section 2. This approval is conditioned upon approval by
the Board of Commissioners of Dade County.

citizens who have contributed public and civic services to South
Miami by street remainings, building dedications, and other forms
of memorializing their accomplishments; and

commemorating the services and memories of those who have
contributed so greatly to the City's history.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA ENDORSING THE VICTIMS OF
CRIME AMENDMENT TO THE FLORIDA CONSTITUTION.
WHEREAS, the Florida Legislature has passed a joint
resolution proposing an amendment to Section 16, Article I of the
State constitution relating to the rights of victims of crime;
and
WHEREAS, the government of Metropolitan Dade County has
expressed its support for victims' rights issues through the
establishment of a new Office of Victim Services in the County
Manager's Office; and
WHEREAS, this amendment provides for victims of crime to be
informed, to be present and to be heard, when relevant, at all
crucial stages of criminal proceedings to the extent that these
rights do not interfere with the constitutional rights of the
accused and this amendment has been placed on the November, 1988
general election ballot.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The Mayor and City Commissioner of the City of
South Miami hereby endorse the.amendment to Section 16, Article I
of the State Constitution relating to the rights of victims of
crime.
Section 2. The Mayor and City Commissioner of the City of
South Miami support the efforts of the government of Metropolitan
Dade County in establishing of the new Office of Victim Services.
Section 3. The City Clerk of the City of South Miami is
hereby directed to forward copies of this Resolution to the
Governor of the State of Florida, the Dade County Board of
Commissioners, the Dade County Manager, the Dade League of Cities
and all other concerned persons.

AN ORDINANCE OF THE MAYOR AND COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA, ADOPTING THE BUDGET FOR THE 1988/89
FISCAL YEAR.
WHEREAS, the City Manager has submitted a proposed
budget together with a budget message and supporting schedules;
and
WHEREAS, pursuant to Chapter 200, Florida Statutes, the
Mayor and City Commission is required to adopt a tentative, and
thereafter, a final budget for the City.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE
CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the Budget for fiscal year 1988/89, as
submitted by the City Manager, attached hereto as Exhibit 111" in
an amount of , be and the same is hereby approved as a
tentative budget, with adoption upon second reading and public
hearing.

AN ORDINANCE OF THE MAYOR AND COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA, FIXING THE MILLAGE AND LEVYING TAXES
IN THE CITY OF SOUTH MIAMI, FLORIDA, FOR THE CALENDAR YEAR
1989.
WHEREAS, pursuant to Section 200.065, Florida Statutes,
tax assessments for all real property within the jurisdiction of
the City of South Miami for the calendar year 1988 has been made
by the property appraiser for Dade County; and
WHEREAS, pursuant to the above -cited statutory
provision, the Mayor and City Commission is required to adopt a
tentative and thereafter a final millage rate for the taxing
jurisdiction of the City of South Miami.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE
CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That there shall be and hereby is levied
upon property in the City of South Miami, Florida, a tax of
mills on the dollar for the calendar year 1989, for the
operational expenses of the government of the City for the fiscal
year beginning October 1st, 1988, and ending September 30th,
1989.
Section 2. This ordinance shall take effect on October
1, 1988.
