Vote: 4 - 2 (Cooper) (Ligammare) August 7, 1989 City of South Miami Planning Department South Miami, Florida Gentlemen: Please consider this formal request to permit an eating establishment at 5800 SW 73 Street South Miami, Florida. The property is Zoned C -2. I am requesting your consideration for a Special Use permit for an eating establishment; s variance to permit parking for 13 spaces where 17 are required, and a variance to permit beer and wine to be served on the premises where there is another eating establishment within 1000 feet. I believe the location is excellent for a restaurant in that it is a freestanding building. Although 17 parking spaces are required, we can furnish 13 plus, and there is an abundance of metered street parking, as well as a' potential lease arrangement between myself and my nieghbors for additional parking to the West and to the South of my immediate property. I also feel that since any proposed tenant, "Le' Glacier Restaurant" , has been in business in South Miami for some a years and already has a beer and wine license; it is reasonable to have him be able to move to my location andcontinue providing an inexpensive yet excellent place for the people of South 'Miami to eat lunch - and /or dinner. Miami, Florida 33143 To Whom it may concern: I was in the process of pouring cement around metal poles on the afternoon of November 9th. Mr. Lincoln Benedicto approached me and inquired if I had a permit to do this work. I replied that I did not but that I had obtained one many years ago. The wooden fence had become so rotten that some of it had fallen down and the_ complete fence needed to be replaced. Mr. Benedicto stated that a replacement required a permit, that for me not any additional work on the fence. I was subject to a $100.00 fine under the present circumstances. I was to contact Mr. Bill Mackey in Planning on Monday, as Friday was a holiday. I met with Mr. Mackey on Monday and became more disgusted and irritated with regulations I presented to Mr. Mackey the letter that was mailed to all Property Owner/ Residents on February 21, 1989. There is no mention of fence replacement. I'm unsure if one or both of the individuals stated that I could have replaced the fence with the same type of material and there would not have been a problem. I stated that my plan was to use bamboo in the area surrounding the shed so that it would not be visible from the street. I also inquired why the "Instructions for ERP6 Applicants" was not mailed with the letter of February 21, 1989 regarding Building and Zoning information. I was not aware of this letter of requirements before yesterday. I have attached a copy of the "Sketch of Survey The fence was erected on my property. During the 32 years that I have resided in this location, I have always attempted to improve the appearance and do things that woul l enhance the value of the property. I only request that the City be reasonable in their demands. Very truly yours, /Ae a . t Joe C. Free *You can be assured that if I had any idea that I would have experienced this aggravation, I would have just let the fence collapse and tossed it in the trash pile -- we do have good 10 trash and garbage pick -up.
