Parcel "A" is 10,311 square feet, more or less, with frontage
of 75 feet.

RECOMMENDATION
The request complies with the Zoning Regulations of the City of
South Miami. Staff recommends approval of the subdivision.

Mr. & Mrs. James Molans spoke for this request stating that
inasmuch as there are no zoning or variance changes being asked for
this property,, and that due to its size, the addition of three new
homes compatible with others existing in the neighborhood would
only serve to allow the best use of this property. The residential
atmosphere will be retained.
Ms. Betty Howie and Mr. Favoright also spoke for this request.
Mr. Cahill, who agreed with this request, asked if sidewalks and
curbings would be included in the plans. Chairman Cooper stated
that these are required in new development unless not to be
included by special waiver.
Staff recommended approval.
Chairman Cooper moved for acceptance of the request.

According to the adopted comprehensive plan, the future land use
for the subject property is medium intensity office ( 4 stories).
The present zoning of the subject property is commercial office
(CO) and minimum rear and side setback (Interior lot) shall be
fifteen (15) feet.
The existing building has side set backs of 8.5' and 7.39' at the
point where the proposed addition may be. It has rear setback of
(15) feet.
The applicant wishes to build the ,addition in accordance to an
existing side setbacks.
RECONMENDATION

LETTER OF INTENT
Dear Planning Board:
Please allow this letter to serve as a letter of intent on
behalf of my client, Circle Security Systems, Inc. in sup-
port of its application for a variance, in accordance with
the procedures adopted by the planning department. As you
may know, Circle Security Systems, Inc. is located across
the street from City Hall at 7340 S.W. 61st Court.
Circle Security Systems purchased the property in January of
1984. At that time, the property was very run down and
Circle Security undertook extensive and expensive renova-
tions, enhancing the neighborhood, and maximizing the usable
space within the existing structure. (See attached
photographs /copies showing before and after conditions of
property).

Since 1984, Circle Security has continued to grow, and the
present building on the property is inadequate to meet both
its present and future needs. As Circle has grown, the
existing structure is no longer able to house its employees
and meet its other business needs. In order to accomodate
its expanded staff and equipment, Circle needs to add to
the existing one -story CBS structure, as set forth on the
site plan filed herewith. Basically, the addition would
simply follow the building's existing set -backs on the north
and south property lines and convert the existing L -shape
structure into a rectangle. In order to accomplish this
Cirle' requests a variance from the city's zoning ordinance,
to allow it to continue its side set -backs of 7.39 feet on
the South and 8.5 feet on the North (so that the addition
would simply continue the existing building structure lines,
as indicated on the site plan) where 15 feet is required.
Neither the front nor the rear set backs would be involved.
As Circle Security Systems, Inc. has grown, it has leased
additional parking spaces from the City of South Miami, and
even sought to buy surrounding property for the purpose of
establishing more on site parking.' Circle does not have
available any more space for additional on site parking. It
remains, however, willing to lease more spaces from the
City, for such term as the City may deem appropriate.
Unless the City grants the requested variances, Circle
Security will be under an extreme hardship. Circle, there -
fore, respectfully requests that the City of South Miami
consider its variance application filed herewith and allow
it a variance for the side set -backs and a "variance which
would 'enable Circle to have 4 parking spaces where 11 would
otherwise be required.
Filed herewith, in accordance with the City's variance pro-
cedure', is Circle's application, the required survey, site
plan, and application fee in the amount of $325.00. Circle
Security Systems would gratefully appreciate the planning
department's consideration of its application for variance,
the hardship experienced by it, and the setting of a hearing
date on the variance application at your soonest con-
venience. There is ample precedent within the City for
granting of the requested variance. For example, please

PROHIBIT THE EXXON CORPORATION FROM DECLARING A TAX WRITE -OFF OF
ANY SUMS EXPENDED I.N CONNECTION WITH THE OIL SPILL IN PRINCE
WILLIAM SOUND, ALASKA.
WHEREAS, on March 24, 1989, the tanker Exxon Valdez was
involved in one of the worst environmental calamities this nation
has ever faced, an oil spill which resulted in untold animal life
being lost and the country's eighth largest commercial fishing
industry being devastated; and
WHEREAS, the Exxon Corporation should be required to
compensate victims of this disaster, clean the spill in Prince
William Sound and other affected areas, and receive the maximum
sanctions that can be imposed by law, without the benefit of
windfall profits resulting from the loss of the product in the
marketplace and without the tax laws of this nation allowing
write -offs in connection with expenses involved in the clean -up
operations; and
WHEREAS, neither the residents of South Miami, nor the
other taxpayers of this nation should be required to absorb one
cent of the expense Exxon should bear in regard to the disaster
which was the Corporation's sole responsibility.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the Congress of the United States is
hereby urged to pass appropriate legislation prohibiting the Exxon
Corporation from receiving any credit or tax write -off benefit in
connection with expenses incurred regarding the Exxon Valdez oil
spill.
