FEES; AMENDING SECTIONS 11 -2 AND I1 -3 OF CHAPTER ELEVEN
BY PROVIDING FOR FEES AND REGULATIONS REGARDING
COMMERCIAL COLLECTION SERVICE: AMENDING SECTION 11 -9 BY

WHEREAS, the City of South Miami booth maintains a Public Works
Cepartment and oversees private collection services in regard to
refuse and garbage collection in she City and
WHEREAS, the administration has recommended amendments to
-napter Eleven of the Code of Orcinances in order to provide for
improved services and collection, and for proper fees being paid
t- the City for the services provided.
NOW, THEREFORE BE IT ORDAINEE BY THE MAYOR AND CITY COMMISSION
..' THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That Section _1 -2 cf Chapter Eleven of the Code
cf Ordinances is hereby amended as follows:'
Sec. 11 -2. Collection by the City.
All garbage, trash and refuse accumulated within the City
limits shall be collect -d, conveyed, and disposed of by
and through the department of public works of the City
or a private licensed refuse collection firm. No person,
firm or corporation shall, fcr a fee, collect and dispose
of or transport over the city streets any garbage, trash
or refusertht - €3�

below.
Section 2. Section 11 -3 of Chapter Eleven of the Code of
Ordinances is hereby amended as f-- llows:
Sec. 11-3. Permit required for collection, transport and
disposal, regulation of permittees.
Ail No person, firm or corporation shall, for a fee, collect,
transport or dispose of garbage or refuse within the City
limits who does not possess a written permit. The permit
shall be issued by the City Manager only after
determination that the licensee is capable of complying
with the requirements of this Chapter and with all other
governing laws and' rdinances, and is subject to
suspension or revocati -n in the event such regulations
and laws are not complied with. The City shall receive
a permit fee of $3,000 for any permit issued by the City
Manager, payable on October 1st of each year, with said
permit expiring September 30 of each year unless sooner
terminated or voluntarily surrendered by permittee. The
permit required by this section shall be in addition to
any occupational licenSe which may be required by law.

Applications fora permit shall be made tc:the department

shall be prescribed by the director. said form to elicit
the following information and to be accompanied by
supc:rting documents and such other information as may
be required by the department from time to time:
Name of applicant. If the applicant is a
partnership or corporation, the name i s'j and business
address(es) of the principal officers and
stockholders and other persons having any financial
or controlling interest in the partnership or
corporation. Provided, however, that if the
corperation is a publicly owned corm€cration having
more than twenty -five (25) shareholders, then only
the names and business addresses of the local
manacing officers shall be requ_ red.

Character of applicant. The applicant for a permit
under this section, if an indivi =ual, or in the case
of a firm, corporation, partnership, association or
orcanization, and any person having any controlling
or managerial interest herein, sh.13 be of good
moral character. Penal histories and fingerprints
shall be required with all appl_cations.
(iii) Business history. Whether such applicant has
berated a solid waste collecti::n- removal business
in this or another state under. _ franchise, permit
or license and if so where and whether such
fra.�chise, permit or license has: ever been revoked
or suspended and the reasons therefor.

Existence of business entity. If applicant is a
co- pperation, applicant shall su7 -a t proof of
incorporation in good standir,c ir_ the state of
incorporation and, if a foreiaz corporation,
applicant shall provide ' informat_on. -ertifying that
applicant is qualified to do busine ss in the State
cf Florida. If applicant is other than a
cor;.cration and is operating _nde_ a' fictitious
age,' applicant shall be required to submit
rnf:rmation that such'fictitou= nave is registered
and held by 'applicant.
Equipment and method of operation. The applicant
for a permit shall possess ea-ipne€.t capable of
providing safe and efficient services. In making
such a determination and apprc-.-ina the method of
operation for each applicant, the d_cartment shall
require the following information:
) The type, number and complete d- scription of
all equipment to be used tv the applicant for
providing service pursuant to -his chapter.
A statement that applicant we'll use only
approved disposal sites fc_ d= s-_�osing of all
garbage, garden trash, ind-astrial waste, and
solid waste material which app�cant collects
and removes. Applicant shall z.cmply with all
applicable State regu= reme-ots regarding
recycling of waste and g rcage.

in the applicants Name. The applicant shall carry
in his own name a ;policy covering his operations in
a:: amount not less than three hundred thousand
dollars ($300,03e.00) per occurrence for bodily
injury and fifty thousand dollars $50,000.00) per
occurrence for property damage liatility regarding
comprehensive general liability. The applicant
shall carry in his own name a policy covering his
operations in an amount not less than one hundred
thousand dollars ($100,000.00) per person, three
hu-..dred thousand dollars (S3 =.0,000.00) per
oc_urrence, for ¢odily injury and fifty thousand
dollars ($50,00e.00) per occurrence for property-
damage liabilitv regarding autcm:obile liability
in_srance.
The completed application shall be submitted to V-1-le
decartment. Uvon receipt of a completed
application, the director or a designated
representative shall review said application and,
if satisfactory in all respects, a.-.,d after payment
of required fees, the City Manager shall issue the
permit.

AND AS AN AUTHORIZED SIGNATORY ON ALL BANK

WHEREAS, the City Manager of South Miami, Florida, desires to

AS CONSULTANT TO PREPARE A REVISED ZONING
