A RESOLUTION OF THE CITY OF SOUTH MIAMI, FLORIDA, AUTHORIZING
LEGAL COUNSEL TO OFFER THE AMOUNT OF TEN THOUSAND
($10,000.00) DOLLARS AS SETTLEMENT OF A TORT LIABILITY CLAIM
AGAINST THE CITY.
WHEREAS:, the City is presently in litigation regarding a tort
liability claim in the matter of Guidi v. City of South Miami; and
WHEREAS,, the City previously approved an amount of $7,500.00
and City's Insurance Counsel recommends settlement of this matter for the
amount of ten thousand ($10,000.0) dollars.
NOW, THEREFORE, BE IT RESOLVED BY .THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the Mayor and City Commission hereby
authorize insurance counsel to offer the amount of Ten Thousand
($10,000.00) Dollars to settle the tort liability claim of Juan and Maria
Guidi against the City in Case No. 88 -25515 in Dade County Circuit Court.

PERMITS FOR ANY WORK PERFORMED WHICH REQUrRES NEITHER
INSPECTIONS BY THE CITY NOR APPROVAL BY THE ENVIRONMMMAL
REVIEW AND PRESIWATION BOARD; PROVIDING FOR CODIFICATION AND

WHEREAS, the Mayor and City Commission has amended
schedules for building permits and fees in order to more equitably
assess constructiom costs in the City; and
WHEREAS, im accord with this policy, the City wishes to
exempt certain ratters from the requirements of a building permit
when no City administrative time is expended in the permit process.
NOW, THF—IREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY

this subject in order to bring this section into conformity with

SOUTH MIAMI, FLORIDA AMENDING CHAPTER ELEVEN OF THE
CITY'S CODE OF ORDINANCES REGARDING GARBAGE COLLECTION
FEES; AMENDING SECTIONS 11 -2 AND 11 -3 OF CHAPTER ELEVEN
BY PROVIDING FOR FEES AND REGULATIONS REGARDING
COMMERCIAL COLLECTION SERVICES; AMENDING SECTION -11 -9 BY
INCREASING FEES FOR CITY COMMERCIAL COLLECTION SERVICES;
AMENDING SECTION 11 -10 BY DELETING DISCRETIONARY SHARING
OF CONTAINERS AND BY PROVIDING FOR MONTHLY BILLINGS;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of South Miami both maintains a Public Works
Department and oversees private collection services in regard to
refuse and garbage collection in the City; and
WHEREAS, the administration has recommended amendments to
Chapter Eleven of the Code of Ordinances in order to provide for
improved services and collection, and for proper fees being paid
to the City for the services provided
NOW, THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That Section 11 -2 of Chapter Eleven of the Code
of Ordinances is hereby amended as follows:
Sec. 11 -2. Collection by the City.
All garbage, trash and refuse accumulated within the City
limits shall be collected, conveyed, and disposed of by
and through the department of public works of the City
or a private licensed refuse collection firm. No person,
firm or corporation shall, for a fee, collect and dispose
of or transport over the city streets any garbage, trash
or refuse

below.
Section 2. Section 11 -3 of Chapter Eleven of the Code of
Ordinances is hereby amended as follows:
Sec. 11 -3. Permit required for collection, transport and
disposal, regulation of permittees.
No person, firm or corporation shall, for a fee, collect,
transport or dispose of garbage or refuse within the City
limits who does not possess a written permit'. The permit
shall be issued by the City Manager only after
determination that the licensee is capable of complying
with the requirements of this Chapter and with all other
governing laws and ordinances, and is ''subject to
suspension or revocation in the event such, regulations
and laws are not complied with. The Clty shall receive
a permit fee of $3,000 for any permit issued by the City
Manager, payable on October 1st of each ftAr with said
hermit e_�iring September 30 of each year unless sooner
terminated or voluntarily surrendered by permittee. The
permit required by this section shall be in' addition to
any occupational license which may be required by law.
Renewals shall be at the fee in existence at the time of
renewal.

B Applications for a permit shall be. made to the department
of public works upon such form and in such manner as
shall be prescribed by the director, said form to elicit
the following information and to be accompanied by
supporting documents and such o ter information as may
be required by the department fr m— time to time:
(_i) Name of applicant. If the applicant is a
Partnership or corporation, the name ( s ) and business
address(es) of the principal officers and
stockholders and other persons having any financial
or controlling interest in the partnership or
corporation. Provided, however, that if the
corporation is a publicly owned corporation having
more than twenty -five (25, shareholders, then only
the names and business addresses of the local
manaefing officers shall be required.
LLLL Character of applicant. The applicant for a permit
under this section, if an individual, or in the case
of a firm, corporations partnership, association or
organization, and any person having any controlling
or managerial interest herein, shall be of good
moral character. Penal histories and finaerprints`
shall be required with all applications.
(iii) Business history. Whether such applicant has
operated a solid waste collection- removal business
in this or another state under a franchise, permit
or license and if so, where and whether such
franchise, permit or license has ever 'been revoked
or suspended and the reasons therefor...
iv Existence of business entity. If applicant is a
corporation, applicant shall submit proof , of
incorporation in mood standing in the state of
incor2oration and, if a foreign corporation,
applicant shall provide information certifying that
applicant is qualified to _c business in the State
of Florida. If applicant is other than a
corporation and is operating under a fictitious
name', applicant shall he required to submit
information that such fictitious name is registered
and held by applicant.
(V) Equipment and method of operation. The applicant
for', a permit shall possess equipment capable of
providing safe and efficient services. In making
such a determination and approving the method' of
operation for each applicant, the department shall
require the followinq information:
aZ The type number and complete description of
all equipment to be used by the applicant for
providinq service pursuant to this chapter.
bL A statement that applicant will use !only
approved disposal sites for disposing of al
garbage, garden trash, industrial waste, an
solid waste material which applicant collect
and removes. Applicant shall comply with'!al
a2plicable State requirements re'gardlin
recycling of waste and garbage,
c) The names of customers, the addresses of each
location served, and schedule of rates' of the
company.
vi Insurance requirements. The applicant for a permit
shall maintain insurance as specified herein and
shall furnish a public liability policy to the
department and also file with the department a
q!
certificate of insurance for all policies written
in the applicants name. The aL- plicant shall carry
in his own name a policy covering his operations in
an amount not less than three hundred thousand
dollars 300,@00._POL per occurrence for bodily
injury and fifty thousand dollars (550,000.00) per
occurrence for property damage liability regarding
comprehensive eg neral liability. The applicant
shall carry in his own name a policy covering his
operations in an amount not less than one hundred
thousand dollars (5100,000.00, per person, three
hundred thousand dollars (5300,000.00) per
occurrence, for bodily injury and fifty thousand
dollars (550,000.00) per occurrence for property
damage liability regarding automobile liability
insurance.
vii The completed application shall be submitted to the
department. Upon receipt of a completed
application, the director or a designated
representative shall review said application and,
if satisfactory in all respects, and after payment
of required fees, the City Hanager shall issue the
permit.
C) Should the City Manager deny an application for a
permit, he shall notify the applicant of such denial
by certified mail not later than fourteen 14 days
after taking such action. Should the City Manager
issue a permit, the permit for the collection of
solid waste issued under the provisions of this
chapter may be not assigned or transferred. In the
event of any change in ownership and /or name of the
corporation or partnership, formal notification
shall be given 'the City within thirty 30 days
thereof.
Section 3. That Section 11 -9 of Chapter Eleven of the Code
of Ordinances is hereby amended as follows:
Seca 11 -9. Refuse collection fee schedule.
(b'[, Commercial garbage and commercial trash.
(1) The fees for the collection of 'refuse from
commercial establishments including apartments,
hotels and motels from approved domestic garbage
containers as described in this chapter shall be
as set forth herein for the number of containers

shall become effective March 31st, 1989.
