A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA APPROVING A VARIANCE
REQUEST TO ALLOW A 21 FEET REAR SETBACK WHERE 25 FEET
IS REQUIRED REQUESTED BY MARIE VALENTI FROM THE
PLANNING BOARD OF THE CITY OF SOUTH MIAMI, FLORIDA FOR
A SINGLE FAMILY RESIDENCE AT 6865 S.W. 64 STREET,
SOUTH MIAMI, FLORIDA
WHEREAS, Marie Valenti requested the Planning Board of the
City of South Miami for variances from Section 20 -3.5 E of the
Land Development Code to permit a 21 feet set -back where a 25
feet set -back is required for a single family residence in an
RS -3 zoning district at 6295 S.W. 58th Street, South Miami,
Florida, which property is legally described as follows:
Lot 9, Block 3, Tranquility Estates,
according to the Plat thereof, as recorded in
Plat Book 78 at Page 64 of the Public Records
of Dade County, Florida;
WHEREAS, on June 19, 1990 the Planning Board voted to
approve the variance request by a 3 - 2 vote; and
WHEREAS, the City Commission Staff Report recommended
denial of the request;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That variance request of Marie Valenti, to
permit a 21 feet set -back where a 25 feet set -back is required,
for a single family residence at 6865 S.W. 64 Street, South
Miami, Florida be, and the same is, hereby approved.

Attached please find applications for the Planning Board and Environmental Review a
Preservation Board.
I am requesting approval to complete repairs that were needed on the above subject
property. I purchased this property on December 28,1990, after receiving an
inspection report by a licensed company, Inspector Services. The various defects
and needed repairs were noted and a cost estimate was noted for those repaiAC.
With the assistance of friends and relatives I have been doing the work myself,
being on & litited budget and self supporting. I did not realize that since I
was not building anything, that a permit was needed. I have attached a copy of
the inspection report where the patio roof damage was noted.
I hired a company,Pro Maintenance, that was recommended to me by a realtor.After
much expense, they were unable to do a satisfactory job. I cannot afford to give
my hard earned money away and not get what I pay for.
The patio roof was a combination of wood and fiberglass, completely enclosed
with screening in the f ront and one door. In order to make the repairs I tore
down the screen and posts that were rotted, and replaced these with new posts
and 'reinforcing beams.We then replaced the rotted sections with new wood and
scraped off the top gravel and hot tarred the patio roof to seal the leaks.
At this time the work is incomplete,and the roof must be finished. Due to the
recent rains the property is deteriotating rapidly. I need to proceed quickly
to secure my possessions from further damage, therefore I am requesting your
consideration in this matter to secure the necessary approvals to proceed with
the repairs.
In reference to any alteration to the premises that is visible from the street;
I removed a side entry door that was used as -a main entrance. Thishrr'eated
confusion as the legal addresss of the house is S.W.64 Street , notS.W.68Ct.
I closed up this entrance to correct the problem, and it has enhanced the
property.
I would appreciate your consideration in allowing me the needed permits,
variance, etc. to bring my property up to code and retain its value.

ANALYSIS
The applicant seeks approval of a variance to allow the
construction of columns and walls within the setback. The
applicant claims that there were previously columns along the edge
of the roofline. However, after demolition of that structure
(without permits), any new improvements in the setback area are
not allowed. Any such pre - existing columns and structures is only
a claim by the applicant and cannot be substantiated by staff.

12 -89 Ms. Valenti purchased the property.
1 -11 -90 Permit # 90- 0019 -08 was issued for the replacement
of a wooden fence around the above referenced
property.
4 -2 -90 B & Z received a complaint that an addition which
violates the 25 foot setback was being constructed
at the property.
-3 -90 Inspection revealed the following work without a
permit (not a complete list):
- A hot tar roof was being finished by 3 workers
- One room to the rear of the house was lengthened
- Doors were sealed up and windows were installed
- New dry wall, tile and siding was either put up
or being put up
- Electrical wiring was done
-3 -90 A Red Tag (stopwork order) was issued.
All work stopped.
4 -4 -90 NOV #4- 90 -V007 was issued for doing work without
permits (certified Receipt Received).
Ms. Valenti came to City Hall. She was informed
that a stopwork order was placed on the entire job.
Moreover, she was informed of all requirements in
reference to ERPB and permits. Ms. Valenti
disagreed with the CEO's determination that permits
were required for the work that was done.
Consequently, an appointment was made for the BO to
meet Ms. Valenti at her home later that afternoon.
-4 -90 At Ms. Valenti's request, the BO and CEO Walker went
to inspect the property.
Ms. Valenti was not there. However, 2 men were
there working on the house. A 2nd Red Tag was issued
and the men informed the BO that Ms. Valenti told
them to continue working, that she would take care
of the permit situation.
The BO determined that major remodelling and
construction had been done. Permits were definitely
required and licensed contractors would have to do

Approximately, one hour later, a re- inspection
revealed that the men were still working at the
house. When CEO Walker showed up with a police
officer, the two men packed up and left.

she did not add anything to the property, and that
a copy of her survey shows this. She faxed said

a likely reason for your pain. Obviously, bone and joint disease
presents a problem with respect to my previous recommendation that
you exercise daily as part of your hypertension therapy program.
Running or other weight bearing exercise may worsen this problem
thus I recvmmend that you substitute swimming instead. As always

Mr. Harry Sasson signed in to speak for the applicant. He stated
the reasons for this request are both medical and the fact that Mr.
Von Wachter has the only small children among those families in
Orr's Pond Subdivision. Mr. Ligammare noted that, had the
applicant researched properly before purchasing this property, he
would have been aware that a request of this type would be
restrictive and is, in fact, a self - imposed hardship. Mr. Sasson
cited a precedent for this request in Orr's Pond. There is a pool
on lot 9, block 3, which was previously allowed for medical
reasons. At the time of this request Orr's Pond was not so
developed and the Commission was wary due to the lack of neighbors
who might be affected by this project later. In this vein, Mr.
Sasson presented documentation from the present neighbors
signifying their absence of objections. This present application
does not affect any trees on the property. Utility easements are
all in the front of the property, hence will not be affected. Most
of the deck will have to be eliminated in order to comply with
impervious coverage requirements. Ms. Gonzalez suggested a
redesign of the deck area to meet impervious coverage requirements
which will eliminate the need for a variance. There was no one
present to speak against the request.
Public Hearing was closed. Staff recommended denial of both
requests. This request is not a major change to a PUD. The
impervious coverage for the entire Orr's Pond project will have
been reached.
Mr. Parr made a motion for the approval of Request #1, seconded by
Mr. Gutierrez.

VING THE NEIGHBORHOOD 'IMPROVEMENT DISTRICT CREATED THEREIN;
PROVIDING FOR SEVERABILITY, PROVIDING FOR ORDINANCES IN
CONFLICT; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, by Ordinance 5--88 -1300, adapted on April 25, 1988,
(which Ordinance was amended by Ordinance 5 -88 -130 -A on May L,
1988), the City of South Miami, Florida created a Neighborhood
Improvement District pursuant to Florida Statutes 163.501 et

WHEREAS, Florida Statute 163.506 (3) specifically provides:
A (neighborhood improvement] district may be
dissolved by the governing body by rescinding the
ordinance creating the district.
and;
WHEREAS, the City of South Miami, Florida does desire to
dissolve the Neighborhood Improvement District as it La
Presently constituted pursuant to Florida Statute 163.501 Mt $ea.
in Ordinances 5 -88 -1300 and 5- 88- 1300 -A;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA.

the same here -by are, rescinded in their entirety.
Section 2. That the City Manager and Administration be,
and hereby are, directed to take all such measures necessary to
reflect the aforesaid recission.

this Ordinance is held to be invalid or unconstitutional by any
court of competent jurisdiction, then said holding shall in no
'gay affect the vaildity of the remaining portions of this

AN RESOLUTION OF THE CITY OF SOUTH MIAMI, FLORIDA,
CREATING A "SOUTH MIAMI SAFER NEIGHBORHOOD DISTRICT ";
SPECIFYING THE BOUNDARIES THEREOF; AND ESTABLISHING AN
ADVISORY COMMITTEE IN CONJUNCTION THEREWITH.
WHEREAS,, the City of South Miami, Florida is well aware that
the proliferation of crime has rendered many neighborhoods unbafe
and that, in large measure, safe neighborhoods are the product of
planning and implementation of appropriate environmental design
concepts, comprehensive crime prevention programs, land use
recommendations, and beautification techniques, and;
WHEREAS, the City of South Miami, Florida within the area
comprised by the following streets:
on the north: S.W. 40th Street
on the east: S.W. 57th Avenue
on the south: S.W. 88th Street
on the west: S.W. 69th Avenue
(exciuding those areas of unincorporated Metropolitan Dade
County , Florida situated within such borders, more particularly
described in the Oxhibit "A" attached hereto) suffers the illis
set forth above;
WHEREAS, the City of South Miami, Florida desires to aid the
aforesaid area to create for itself a safer neighborhood;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE ^ITY OF SOUTH MIAMI, FLORIDA:

Neighborhood 01stri 4 to be known as the "South Miami Safer
Neighborhood District ", The boundaries of the said District are
those set fotth above.

That the Mayor shall, with the advice and
consent of the City Commission, appoint a Committee of consisting

of no Tess than five (5) citizens who shall be owners of real
property located in the District or residents of the District,
who shall serve until March 1, 1991. Subsequent appointees shall
thereafter saxve a period of two (2) years or until their
successor is appointed.

shall elect a Chairperson and Vice - chairperson.
A quorum for meeting of the Committee shall be
no less than three (3) members of the Committee and all action

the time period specified by the Hoard of Directors, ,a report on

COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That Section 20 -3.3, Permitted Use Schedule be
and the same is hereby amended by deleting subsection (C),
Definition of Uses therefrom.
Section 2. ?'hat Section 2.0 -3.3, Permitted Use Schedule,
Subsection (E), he and the same is hereby amended by deleting the
Standard Industrial Classifications (S.I.C.)_column from the
Permitted Use Schedule Chart and amending Permitted Uses in GR
(General Retail) Districts pursuant to Exhibit "A." attached
hereto.
Section 3. That "Auto Parking Lot" be and the same is
hereby eliimminated and " Auto Parking Structure" be permitted only
as a Special Use in SR (specialty retail) and PI
(public /institutional) Districts as specified in Section 20 -3.3,
Permitted Use Schedule, subsection (F):
Section 4. That "Clinic" be and the same is hereby
deleted fr om Section 20 -3.3 Permitted Use Schedule, subsection
(E) of the Land Development Code.
Section 5. That "Eating Place !accessory) " -be permitted
only as a Special Use in the LO (low intensity office) and MO
(medium intensity office) Districts as specified in Section 20-
3.3, Permitted Use Schedule, subsection(E).

Section 6. That Section 20 -6.1, Administrative Entities,
subsection (A' City Commission, subsection(4), Procedures,
subsection (e) be and the same is hereby amended to read as
follows:
"When any request requiring a public hearing before the
Planing Board has been acted upon by the Commission and denied or
failed to pass, such proposed change, in the same or substantial
or similar fora shall not be reconsidered by the Commission for a
period of at leas�one (1) year following the date of such action,
in which cane
rec ra ion is possible after six (6) mon ths, the
request of the majority of the Commission sooner than six (6)
months after the date established for the 'prior hearing.
Section 7. That Section 20 -5.6, Applications in General,
be and the same is hereby amended by adding subsection (D)
entitled: Withdrawal of a Petition to read as follows:
"(D) Withdrawal of a Petition.
Any application for an amendment, supplement, or change may
be withdrawn by a request, in writing, from the applicant
at any time before a decision of the Commission, but if
withdrawn after advertisement for a public hearing or
posting of he property, the same or substantially similar
application governing the same property shall not be
resubmitted,* except at the request of a majority of the
Commission, sooner than six (6) months after the date
established for the prior hearing Filing fees shall not
be refunded upon any withdrawal.''
Section 8. That 20 -5.7, Rezonings and Text Amendments,
!'subsection D,, Applications Withdrawal, be and the same is
hereby deleted and subsequent sections (E),(F) and (G) are amended
accordingly.
Section 9. That Section 20 -6.1, Administrative Entities,
A subsection, planning Board, (3), Powers and Duties (h) be and
p� the same is hereby amended by deleting the phrase "and any other
�J provision of this Code ", to -wit:
(h) The Board shall review and make recommendations
on all applications for variances from the
°e} requirements of this Code for yard setbacks,
r' lot size, lot coverage, building height, fences
and walls, impervious coverage, off- street

Recommendations for a variance shall be made
only when necessary to relieve particular
hardships or extraordinary conditions relating
to a specific property, and when the strict
application of a particular regulation would

upon the owner of such property as
distinguished from reasons of convenience,
profit or caprice.
Section 10. That Section 20 -5.9, Variance Approvals, be
and the same is ereby amended to include a subsection (G)
entitled: "PERMITTED 17ARIANCE RFOUF.STS ", to -wit
"(G) PERMITTED VARIANCE REQUESTS
Applications for variances shall be restricted to
only the following:

Yard setbacks
(2)
Lot size
(3)
Lot coverage
(4)
Building height
(5)
Fences and walls
(6)
Impervious coverage
(7)
Off- street parking

Open space

Signs

Landscaping
Section 11. All ordinances or parts of ordinances in
conflictherewit�i be and the same are hereby repealed.
Section 12. If any section, sentence, clause or phrase of
this ordinance is held to be invalid or unconstitutional by any
court of competent jurisdiction, then said holding shall in no
way affect the validity of the remaining portions of this
ordinance.
Section 13. This ordinance shall take effect immediately
at the time of its passage.

WHEREAS, Marie Valenti requested the Planning Board of the
City of South Miami for variances from Section 20 -3.5 E of the
Land Development Code to permit a 21 feet set -back where a 25
feet set -back is required for a single family residence in an
RS -3 zoning district at 6295 S.W. 58th Street, South Miami,
Florida, which property is legally described as follows:
Lot 9, Block 3, Tranquility Estates,
according to the Plat thereof, as recorded in
Plat Book 78 at Page 64 of the Public Records
of Dade County, Florida;
WHEREAS, on June 19, 1990 the Planning Board voted to
approve the variance request by a 3 - 2 vote; and
WHEREAS, the City Commission Staff Report recommended
denial of the request;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That variance request of Marie Valenti, to

Attached please find applications for the Planning Board and Environmental Review a
Preservation Board:
I am requesting approval to complete repairs that were needed on the above subject
property. I purchased this property on December 28,1990, after receiving an
inspection report by a licensed company, Inspector Services. The various defects,
and needed repairs were noted and a cost estimate was noted for those'repaiAr.
With the assistance of friends and relatives I have been doing the work myself,
being on & litited budget and self supporting. I did not realize that since I
was not building' anything, that a permit was needed. I have attached a copy of
the inspection report where the patio roof damage was noted.
I hired a company,Pro Maintenance, that was recommended to me by a realtor.After
much expense, they were unable to do a satisfactory job. I cannot afford to give
my hard earned money away and not get what I pay for.
The patio roof was a combination of wood and fiberglass, completely enclosed
with screening in the f ront and one door. In order to make the repairs i tore
down the screen and posts that were rotted, and replaced these with new posts
and reinforcing beams-We then replaced the rotted sections with new wood and
scraped off the top gravel and hot tarred the patio roof to seal the leaks.
At this time the work is incomplete,and the roof must be finished. Due to the
recent rains the property is deteriotating rapidly. I need to proceed quickly
to secure my possessions from further damage, therefore I am requesting your
consideration in this matter to secure the necessary approvals to proceed with
the repairs.
In reference to any alteration to the premises that is visible frog�, the street;
I removed a side entry door that was used as a main entrance. Thi0treated
confusion as the legal addresss of the house is S.W.64 Street , notS.W.68Ct.
I closed up this entrance to correct the problem, and it has enhanced the
property.
i would appreciate your consideration in allowing me the needed permits,
variance, etc. to bring my property up to code and retain its value.

ANALYSIS
The applicant seeks approval of a variance to allow the
construction of columns and walls within the setback. The
applicant claims that there were previously columns along the edge
of the roofline. However, after demolition of that structure
(without permits), any new improvements in the setback area are
not allowed. Any such pre- existing columns and structures is only
a claim by the applicant and cannot be substantiated by staff.
AS OF JUNE 15, 1990, THE APPLICANT HAS NOT SUBMITTED ANY REVISED
PLANS AS REQUESTED BY THE BOARD. IF THE APPLICANT DOES NOT APPEAR,

12 -89 Ms. Valenti purchased the property.
1 -11 -90 Permit # 90- 0019 -08 was issued for the replacement
of a wooden fence around the above referenced
property.
4 -2 -90 B & Z received a complaint that an addition which
violates the 25 foot setback was being constructed
at the property.
-3 -90 Inspection revealed the following work _- without a
permit (not a complete list)
A hot tar roof was being finished by 3 workers
- One room to the rear of the house was lengthened
- Doors were sealed up and windows were installed
- New dry wall, tile and siding was either put up
or being put up
- Electrical wiring was done
4 -3 -90 A Red Tag ( stopwork order) was issued.
All work stopped.
4 -4 -90 NOV #4- 90 -V007 was issued for doing work without
permits (certified Receipt Received).
Ms. Valenti came to City Hall. She was informed
that a stopwork order was placed on the entire job.
Moreover, she was informed of all requirements in
reference to ERPB and permits. Ms. Valenti
disagreed with the CEO's determination that permits
were required for the work that was done.
Consequently, an appointment was made for the BO to
meet Ms. Valenti at her home later that afternoon.
-4 -90 At Ms. Valenti's request, the BO and CEO Walker went
to inspect the property.
Ms. Valenti was not there. However, 2 men were
there working on the house. A 2nd Red Tag was issued
and the men informed the BO that Ms. Valenti told
them to continue working, that she would take care
of the permit situation.
The BO determined that major remodelling and
construction had been done. Permits were definitely
required and licensed contractors would have to do
he work.

house. When CEO Walker showed up with a police
officer, the two men packed up and left.

work without a permit (letter was returned
unclaimed).
4 -6 -90 Ms. Valenti contracted this office. She stated that
she did not add anything to the property, and that
a copy of her survey shows this. She faxed said
surely to this office.
4 -9 -90 At Ms. Valenti's request, a 2nd inspection of her
property was made by the BO. He explained to Ms.
Valenti what was in violation, and what she needed
to do to bring it into compliance.

WHEREAS, the City Commission of the City of South, Miami,
Florida, pursuant to the Municipal Code, meets every other
Tuesday night, such that there are at least 24 meetings per year;

WHEREAS, the minutes of these meetings generate
approximately 360 pages per year; and
WHEREAS, the Municipal Code Corporation has proposed a
contract for preparation of an index of the City Commission
Minutes for the year 1990 for $ 1,800.00, based upon 36 index
pages with additional index pages at the rate of $ 35.00 per
page; and
WHEREAS, an indexing system would greatly aid the present
and future city administrations, as well as the public, in
referring to the minutes;

Section 1. That the City Manager be, and hereby is,

Permitted Use Schedule Chart and amending Permitted Use's in GR
(General Retail) Districts pursuant to Exhibit "A." attached
