ORDINANCE NO.
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, TO SUBMIT TO THE
ELECTORATE THE QUESTION OF WHETHER TO CONSTRUCT A NEW
PUBLIC WORKS FACILITY BY BORROWING THE FUNDS OR BY
DISBURSING THE FUNDS FROM THE CITY'S REVOLVING TRUST
FUND: TO CORRECT MANY HEALTH, LIFE, SAFETY AND CODE
VIOLATIONS AT THE PRESENT SOUTH MIAMI PUBLIC WORKS
FACILITY.
WHEREAS, the Mayor and City Commission have heretofore
determined a new facility for the City's Public Works Department
at an estimated cost of $800,000.00 is needed; and
WHEREAS, there are but two alternative means of funding
this construction, to -wit: borrowing the funds or disbursing the
funds from the City's Revolving Trust Fund; to correct many health,
life, safety and code violations at the present South Miami Public
Works Facility.
WHEREAS, the borrowing of the funds is statutorily
equivalent to the issuance of bonds, and the issuance of bonds
requires the question to be submitted to the electorate;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the City Clerk be, and hereby is,
instructed to submit the following questions to the electorate
in the general election scheduled for February, 1992:
The City of South Miami will build a new public works
facility at an estimated cost of $800,000.00. Which
of the following funding alternatives do you prefer:
a. Borrowing the funds for a term not to exceed 15
years to be paid through interest received from
the City's Revolving Trust Fund and through the
General Fund.
b. Disturbing the funds from the City's Revolving
Trust Fund.

1991, the Mayor and City Commission set for Public Hearing on
December 3, 1991, the question of whether to disburse an
approximate $800,000.00 from the City's Revolving Trust Fund to
construct a new Public Works facility; and
WHEREAS, the Mayor and City Commission have now heard the
question at Public Hearing;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the City Administration be, and hereby is,
authorized to disburse the approximate sum of $800,000.00 from
the City's Revolving Trust Fund to construct a new Public Works
facility.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION IN
SUPPORT OF GLOBAL WARMING AWARENESS WEEK AND URGING
OTHER MUNICIPALITIES AND INDIVIDUALS THROUGHOUT THE
COMMUNITY TO JOIN TOGETHER TO LEARN MORE ABOUT THE
CAUSES, CONSEQUENCES AND SOLUTIONS TO THIS PROBLEM.
Whereas, the best scientific data available suggests that the
earth may be experiencing an increase in average global temperature;
and
Whereas, the State of Florida could suffer severe consequences
from the effects of global warming, including a rise in sea level,
frequent and more powerful hurricanes, changing weather patterns,
contaminated drinking water and an increase in days over 90 degrees;
and
Whereas, an increase in average temperature could wreak
extraordinary damage on Florida, both economically and environ-
mentally; and
Whereas, the solution to the threat of global warming depends
upon the efforts of individuals, business and government to reduce
the atmospheric pollution and deforestation that contribute to the
problem.
NOW, THEREFORE, be it resolved by the Mayor and City
Commission of the City of South Miami, FLorida:
Section 1. That the Mayor and City Commission do hereby
go on record in support of Global Warming Awareness Week -
December 8 -14, 1991, and urge other municipalities and individuals
throughout the community to join together to learn more the causes,
consequences and solutions to this problem.

question of whether to reaffirm the present Charter of the City
of South Miami;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY

Section 1. That a separate ballot question in the
February, 1992 General Election appear in substantially the

AN ORDINANCE OF THE CITY OF SOUTH MIAMI, FLORIDA,
AMENDING SECTIONS 20 -3.3 (D) AND 20 -3.4 (B) 19 (c) OF
THE LAND DEVELOPMENT CODE OF THE CITY OF SOUTH MIAMI,
FLORIDA TO CLARIFY THE PARKING REQUIREMENT FOR "SMALL
RESTAURANTS "; PROVIDING FOR SEVERABILITY;
ORDINANCES IN CONFLICT; AND AN EFFECTIVE DATE.
WHEREAS, the City of South Miami, Florida has heretofore
enacted a Land Development Code providing for permitted uses,
Including small restaurants, of real property in the City of
South Miami; and
WHEREAS, pursuant to section 20 --3.4 (B) (19) (c), small
restaurants are a special use condition in the SR district, whose
"on -site parking must satisfy 25% of Land Development Code
Requirements ";
WHEREAS, pursuant to sections 20 -3.3 (D) and 20 -4.4 (B)
(7), the standard restaurant or eating place requirement is one
(1) parking space per one hundred (100) square feet of gross
floor area, but section 20 -3.3 (D) presently designates small
restaurant parking as I'll", which under section 20 -4.4 (B) is
one (1) parking space per 300 square feet; and
WHEREAS, the Mayor and City Commission believe the original
intent of the Code with regard to small restaurants will be
served by amending Section 20 -3.3 (D) of the Land Development
Code to read parking "1211, which is one (1) parking space per
four hundred (400) square feet, and thus comports with the 75%
reduction in parking contemplated;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

Section 2. That the Section 20 -3.4 (a) (19) of the Land
Development Code of the City of South Miami be, and hereby-Is,
amended to add the following to the existing sub - section:
(19) On -site parking requirements must satisfy 25% of
Land Development Code requirements for restaurants
other than those designated small restaurants.
Section 3. If any section, clause, sentence or phrase of
this Ordinance is held to be invalid or unconstitutional by any
rnilr_t of competent Jurisdiction, then said holding shall in no
way affect the validity of the remaining portions of this
Ordinance.
Section 4. All Ordinances or parts of Ordinances in
conflict herewith be, and the same are, hereby repealed.
Section—S.. This Ordinance shall take effect immediately at
the time of its passage.
