2. AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA, EXTENDING THE PROVISIONS OF
ORDINANCE NO. 14 -92 -1509 ADOPTED BY THE SOUTH MIAMI CITY
COMMISSION ON AUGUST 25, 1992, AS AN EMERGENCY ORDINAN -CE,
WHICH ORDINANCE PROVIDES FOR THE IMMEDIATE ISSUANCE OF
PERMITS FOR THOSE APPLYING FOR PERMITS TO MAKE NECESSARY
BUILDING, PLUMBING, - ELECTRICAL AND/OR ROOFING R'EPAI'RS TO
THEIR HOMES AND BUSINESSES IN THE CITY;, WAIVING PERMIT FEES
AND ENVIRONMENTAL REVIEW AND PRESERVATION BOARD FEES FOR

AND PRESERVATION OF THE CITY'S PARKS AND RIGHTS-OF-WAY
FOR DAMAGE INCURRED IN HURRICANE ANDREW
WHEREAS, in the early morning hours of Monday, August 24,
1992, Hurricane Andrew, a category four hurricane, came through
Dade County, Florida, including the City of South Miami, causing
consequent ma.ior damage to roads, utilities, (-(ALLIkuci icot ions, and
property, including specifically the parks and rights -of -way
within the City; and
WHEREAS, an important facet of the quality of life within
the City of South Miami is its parks and tights -of -way, whose
landscaping and canopy provide beauty and shade; and
WHEREAS, the Mayor and City Commission wish to restore and
preserve the City's parks and rights -of -way to pre - hurricane
status and to do so while trees, shrubs, and bushes can still be
saved and, to ensure the funds to do so, wish to create a new,
specific trust fund to be funded with the proceeds of a sale of a
portion of South Miami Field to the Dade County School Board;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section l._ That a nett, specific trust fund be, and hereby
is, created to be funded with the proceeds from the sale of that
portion of south Miami Field authorized by Ordinance No.
to be sold to the Dade County School Board and to be
administered according to the following guide lines;
a. The disbursement of the funds shall be restricted to the
trimming, up- righting, and replarrLlaij of trees in the city's
parks and rights -wf -tray; the clear_inq of dead trees and debris
from the City's parks, and rights -of -way; and the restozation, fnr
example, of shelters, benches; lighting, and restrooms in the

b. It is the City's intention and direction to the
Administration that reimbursement for all. expenditures from this
trust fund be sought from all sources: Federal, State and private
and that all such reimbursements be deposited into the aforesaid
trust fund.
C. upon the expiration of nine months frow, the date of the
passage of this Resolution, all funds in the aforesaid special
trust fund not spent, including all. reimbursements received and
deposited into the said fund, shall be deposited into the
existing revolving trust fund and thereupon the special trust
fund shall be closed.

Miami called an emergency meeting of the City Commission at which
time Ordinance No. 14 -92 -1509 was passed.and adopted providing
for immediate issuance of permits for necessary repairs, waiving
specific 'permit fees, sanitation charges and provisions of the
South Miami, Tree Ordinance for a period of thirty (30) days from
that date of passage; and
WHEREAS, it is the desire of the Mayor and City Commission
of the City of South °iiami, Florida, to extend the provisions of
that emergency ordinance for a period of an additional thirty
(30) days.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That Ordinance No. 14 -92- 1509, providing for
immediate issuance of permits for necessary building, plumbing,
electrical and /or roofing repairs to their homes and businesses
in the City; waving permit fees and environmental review and
preservation board fees for the period of thirty days from August
25, 1992; waiving "per truck load" and "per 1/2 truck load fees"
for a period of thirty days from August 25, 1992; waiving
provisions of the South Miami Tree Ordinance for those trees
damaged or uprooted by Hurricane Andrew to allow residents and
business people to remove trees and urging that replacement trees
be planted in an attempt to recover the trees be planted in an
attempt to recover the trees and canopy that the City has been
known for and that has made South Miami the City of Pleasant
Living, be and the same is hereby extended for an additional
thirty day period until October 25, 1992.
Section 2. That, pursuant to Charter provisions under
Article II, Section 6, "Ordinances ", D (3), this ordinance is to
meet a public emergency affecting life, safety health property or
the public peace and requirements for a second reading public
hearing are hereby dispensed with in view of the emergency.
