U 1 Date: June 2, 1994 6/7/94 Commission Agenda Re: Item # 4 Resolution regarding a Variance for ALCA Properties Last year, the main building located on the property at 7400 S.W. 57 Avenue experienced fire damage which the applicant has stated was due to a fire in a dumpster located under the eaves of the main structure which eventually spread to other portions of the building. This building in which Food Spot and other small businesses are located has since been rebuilt under provisions for damage to a non - conforming structure in the Land Development Code. The applicant now desires to provide for screening and a secure location for the dumpster within this existing "grandfathered" development. 0.71961 f.�� 1. Advantage to City: We believe that providing visual screening for the proposed dumpster will improve the walking experience of pedestrians in the Hometown District. Also, the proposed location is the only one available for access by the sanitation trucks. 2. Disadvantages t_ o City: None. 3. Hampton City Manager an imms, A Director of Building, Zoning & Community Development Dept Date: June 2, 1994 Re: Variance Request for Enclosure of Garbage Receptacle at Food Spot Site by ALCA Properties /Carl Lindgren, Jr. Despite the staff opinion (with which I concur) that there is no hardship running with the land, approval of the requested variance is warranted on two counts: 1) the absence of viable alternatives; and, provided that 2) the applicant's stated intention at the Planning Board review on May 31, 1994, to shift the location of the enclosure. The subject property, 7400 S.W. 57 Avenue, has for decades been the home of Food Spot and other retail tenants. The building pre - existed our current Land Development Code (LDC was substantially re- written in 1989), and is dimensionally non - conforming to the LDC, and to the Hometown District Overlay Ordinance. However, the structure is "grandfathered" under Section 20 -4.8, Non - conforming Uses and Structures. The placement of the existing building on the site and the existing vehicular use area and accessways are such that no credible alternative to placing the trash/garbage enclosure area at the west end of the parking lot has been suggested by the applicant, the Planning Board or the staff. As recommended in the discussion at the Planning Board by staff, the applicant has agreed to shift the trash/garbage enclosure away from the 74th Street sidewalk, thus reducing its visual and olfactory impact upon pedestrian traffic along S.W. 74th Street. This shift in location does not obviate the variance request since the enclosure and concrete slab will remain at the property line, rather than five feet away, as required by Section 20-4.5 (13)(1)(a) of the Code. Impingement on the parking space to the south would result from placing the enclosure at the Code - required five -foot distance from the west property line. Reduction in parking would constitute expansion of a nonconformity, which is not allowed by Code. Given the "grandfathered" situation of the subject property and the resultant constraints relative to the proposed enclosure, staff concurs with the Planning Board's approval (3:2) of the requested variance provided that the enclosure is shifted southward away from the public right- of-way. The proposed shift would nullify the direct conflict of the currently proposed trash enclosure location with Goal 2 of the Comprehensive Plan, which is "To preserve and enhance the pedestrian character and comparison shopping function of the City's Sunset shopping area". Mr. Robert Hutcheson, representative for ALCA properties, and Mr. Carl Lindgren, Jr., owner, spoke before the Board. Mr. Hutcheson stated that a correction of the request was necessary, explaining that the existing perimeter landscape buffer would not be replaced. Mr. Hutcheson stated the reasons for the request, primarily the avoidance of any fire hazard to the new building from the dumpster, and allowance for a turning radius for emptying the dumpster. Staff stated they had discussed with the applicant alternatives to a dumpster, i.e, compactor and cans. Mr. Mackey clarified reason for variance as being the new location for a dumpster and trash enclosure. (The new location will not meet setback requirements and will not allow for a landscaped buffer.) Mr. Guitierrez expressed concern regarding close proximity to the sidewalk, particularly spillage and odor problems. Motion: Mr. Parr made a motion to approve the request. COMPREHENSIVE PLAN The proposal does conflict with the City of South Miami Comprehensive Plan. This proposal would directly conflict with Goal 2 of the Comprehensive Plan by placing a trash enclosure immediately adjacent to a pedestrian sidewalk. APPLIC ABLE LAND DEVELOPMENT CODE SECTION: attachments 4 '20-4. 5(B)( 1)(a ) r Goal 2 and Related Objectives and Policies Goal2 To preserve and enhance the pedestrian character and comparison shopping function of the City's Sunset shopping area. South Miami's Sunset commercial area east of U.S.1 is one of the most vibrant in south Florida. It serves populations in the city and beyond. The pedestrian character of the Sunset commercial area gives a measure of charm and sophistication that is perfectly compatible with the city's small town character. Preserving a *nd enhancing the vitality of the Sunset commercial area is the second most important goal of the comprehensive plan. Objective 2.1 Discourage urban commercial sprawl by enhancing downtown South Miami as the prime retail and commercial service center, as specified in the Future Land Use Map. Measurability shall be no major commercial rezonings outside of downtown. Policy 2.1.1 Prepare a sidewalk and bikeway plan with special attention to downtown. Policy 2.1.2 Monitor parking usage to determine when and where additional municipal parking areas should be provided. Policy 2.1.3 Oppose street widenings that would either feed more through traffic into the downtown area or adversely impact its pedestrian amenities in downtown South Miami. SECTION 20 -4.5 LANDSCAPING 20 -4.5 LANDSCAPING REQUIREMENTS (A) Applicability All vehicular use areas, except those beneath structures and those serving residential uses, shall conform t requirements of this Section. (B) Landscaping Standards which are located within or single - family or two - family o the minimum landscaping To ensure that required landscaping in vehicular use areas is used to its greatest potential in relieving the monotony of and insuring circulation safety within such areas, the following standards are set forth: (1) Perimeter 1-mprovements (a) The perimeter of all vehicular use areas shall be landscaped with a buffer strip of not less than five (5) feet in width, except for those portions abutting structures, where the buffer shall be not less than two and one -half (2.5) feet in width. (b) Buffer strips, except for those abutting structures, shall include at least one (1) tree for each thirty (30) linear feet, or portion thereof, excluding accessway widths. (c) Within required buffer strips, a hedge, fence, wall, berm or other durable landscaped visual 'carrier of not less than two ( 2) feet in height shall be installed. Concrete louvered fences shall not be permitted. (d) Visual barriers of living material shall be a minimum of two ( 2 ) feet in height and forty ( 40 ) inches on center at the time of planting and shall screen the vehicular use area from adjacent properties or public rights -of -way. (e) If such visual barrier is of a non - living material, its height, design, location and construction material shall be approved by the Environmental Review and Preservation Board and the equivalent of one (1) shrub or vine shall be planted along each ten (10) linear feet of said barrier. As shown in the attached plan, the only logical location for this enclosure is adjacent to the transformer presently serving the office building to the West of ALCA Properties. It is our understanding that a 6 foot high wall may be constructed as shown without a variance; however, the concrete slab area within the enclosure is supposed to be permeable. We are requesting a variance to permit the concrete slab to be constructed in accordance with requirements for trash container enclosures. Previously, the City of South Miami trash containers for this group of stores were located adjacent to the convenience store and, in that location, were the cause of the fire that destroyed this shopping center last March. The previous unsecured location invited tampering by vagrants, which was responsible for the fire. Because of the location of the existing building and the existing parking, it would be a hardship (and unwise) to continue the former method of trash disposal. ALCA Properties has contracted with Waste Management Services of Dade Co., Inc. to provide 2 dumpsters and removal service. Staff recommended denial of the application. Mr. Eisenhart opened public hearing. Mr. Diego Rodriguez, property owner, and his representative, Mr. Earl Cruz, spoke before the Board. Mr. Cruz cited reasons for the masonry wall, specifically noise and privacy from Sunset Drive, and security from break -ins and vandalism. Mr. Eisenhart closed public hearing and opened executive session. Board discussed gate /wall height changes and hedge height limits. Upon Mr. Eisenhart's inquiry, Staff clarified unmistakable case of a hardship as that of an irregular lot size and area, as opposed to an orthogonal lot shape and size. Mr. Gutierrez suggested alternatives for the applicant which may not require a variance. Motion: Mr. Gutierrez moved to deny the request. Mr. Parr seconded the motion. Upon Mr. Eisenhart's request for further discussion, Mr. Parr clarified his position as that of not having a problem with a wall being placed on the property, but that of previously erected walls not enhancing the neighborhood. Vote to deny: Approved: 5 Opposed: 0 Mr. Lefley concluded Board's comments by stating that approval of a solid wall would establish a precedent of a "fortress" look in the City. BACKGROUND On August 17, 1976, Mr. Rodriguez received a variance to construct a pool and screen enclosure within required yard setbacks. Although these variances do not directly affect the request for a fence height variance, it is interesting to note that the applicant already has variance exceptions. 3. ANALYSIS This property exceeds the minimum lot frontage and net lot area requirements of the Land Development Code; property has 156 feet of frontage and 20,350 square feet of net lot area; Code requires 100 feet of frontage and 15,000 square feet of net lot area. Therefore, the applicant has no legal grounds to claim a hardship running with the nature of the land. 4. RECOMMENDATION Staff recommends that the Planning Board vote to recommend denial of the application to the City Commission, because there is no hardship running with the nature of the land. 5. COMPREHENSIVE PLAN Although the proposal is not inconsistent with the City of South Miami Comprehensive Plan, it does not further any goal, objective or policy of the Comprehensive Plan. 6. Honorable Commissioners: My intent is to build an architecturally aesthetic fence along the North and West property line of our home. This proposed fence will be five feet in height, but will have considerable open space between four feet and six feet adjacent to the right -of -way, namely, 78 %. The gates will be 17' and 15' respectively. These gates will be made of aluminum rails. In addition, there will be 15' of aluminum fence on either side of the gates. The reasons for this fence are several: First, is the security reason. Sunset Drive is a highly trafficked thoroughfare and an open yard like we now have provides an easy access for a burglar to go into our property and get away very easily. On March 2, 1994, my son's car was broken into while parked in the circular driveway in front of our home (police case # 94- 1239). A considerable amount of personal property was stolen. Second, to prevent vandalism. An accompanying photograph shows my neighbor's fence on the East side of our property with graffiti which was sprayed on it several times within the last couple of months. Again Sunset Drive makes this very convenient for vandals. Third, for reasons of privacy. This highly trafficked thoroughfare deprives me an my family of even a minimum of privacy. A solid four feet fence is not satisfactory because sitting eye level in most vehicles is above four feet. An accompanying photograph will show how traffic is completely stopped bumper -to- bumper in the mornings, especially during school days. There is a school zone just East of our home. Just the simple act of retrieving the newspaper in the morning denies us of even a bare minimum of privacy as hundreds of eyes stare at us. J Page 2 Fourth, the house directly in front of us has a six foot solid wall with no open area at all, not even for the gates. The house East of us also has a six foot solid wood fence on the right -of -way. Several other properties along Sunset Drive have solid six foot fences. My proposed fence will be five feet high, but it will only be solid in certain portions. Fifth, because the fence was designed by an excellent architect with the intent of accomplishing all my stated purposes without detracting from the looks of our home, it will actually enhance the view of our home and of the surrounding neighborhood. Based on all of the above facts, I sincerely believe that I have a hardship that runs with the land. Therefore, I respectfully request that you grant us this variance which is minimal and in no way detracts from the spirit of the ordinance, namely, keeping South Miami beautiful. Mills Police Department- DATE: May 26, 1994 SUBJECT: File Cabinets Pursuant to your request, I have investigated the purchase of lateral file cabinets to replace the old vertical file cabinets which are now in use in the Police Department. I have determined that we can replace the fifty -eight (58) vertical four - drawer cabinets with forty -three (43) lateral four - drawer cabinets. A price under County Government Contract pricing from Decora office Furniture will be $359.05 per cabinet or a total of $15,439.15. The Bid number is 1072 -1/95 OTK -CW. This price is more than $1,000 less than originally quoted and it is for a higher grade unit with stronger suspension and includes the rails for-filing front to back. Justifications for making this purchase are as follows: - Aesthetically, it would be preferable to have the file cabinets throughout the new facility match each other as well as match the decor of the interior. - These units extend from the wall only 19" instead of 26" for the old type. This will result in a substantial increase in usable office space. Of course, there is an increase of wall space required but measurements throughout the station have found the increase to be acceptable. - The price includes "rails" for hanging files which is a substantial expense. - These cabinets offer the option of filing sideways or "front and back ". � /moo ' ..!"�( / � ; `� ' � �`"•- - Most importantly, these cabinets have an "interlocking" feature which prohibits opening more than one drawer at a time. This is a very important safety feature which eliminates the propensity for a file cabinet falling on an employee. We've experienced this type of accident first hand and I can assure you that the cost is justified if only for safety reasons. Aside from the interlocking feature, the drawers are shallower anyway which means less weight projecting out horizontally and better ease of filing for smaller people. Delivery would be 4 - 6 weeks.
