If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 4. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 5. This ordinance shall take effect upon the written certification by the director of the Planning, Zoning and Community Development Department that DERM will enforce the applicable provisions of county code within the city. WHEREAS, the Dorn brothers, Robert and Harold, arrived in Miami in 1910 and became growers, then agents, which led to the well- established Dorn Brothers Company, packers and shippers; and WHEREAS, Robert Dorn, member of Larkins Town Council and Larkins School Board, was an electrician and during the 1920's and 1930's had Dorn Electric Company. He invented and patented an irrigation system for agricultural use, 1926 emergency tires, and emergency rim - securing lugs for tractors which were all sold and installed by Dorn Manufacturing; and WHEREAS, Mary Dorn, wife of Robert and mother of three children, was a charter member of Cocoplum Womens Club, Larkins School PTA member, WWII Civil Defense aircraft spotter, member and office holder of Manning Dowling Cancer Unit, member and office of Town Club, member and president of South Miami Chamber of Commerce, developed and managed new drug store, new service station and new post office; and WHEREAS, Harold Dorn, elected for one year on South Miami's first City Council, managed the businesses of Riviera Theater and Dorn Brothers Shipping; and WHEREAS, Mabel Dorn, wife of Harold and mother of four children, was a member of Cocoplum Women's Club;l expressed interest and became an authority on indigenous South Florida trees, flowers and vegetables and subsequently wrote and published three books on the subject and counselled people on the use of native foods during the depression when store - bought items were hard to obtain; and WHEREAS, Dorn Properties, partnered by both brothers, had large real estate holdings in the immediate area of South Miami; and WHEREAS, the Dorn Brothers loaned acreage (where the Metrorail is now located) to the town for a baseball field for public use; and WHEREAS, the Dorn Brothers built the Dorn- Martin Drug Store, the first post office in the Town of Larkins, South Florida State Bank (never opened due to 1926 hurricane and national financial bust in 1926), a packing house on the railroad in South Miami, Riviera Theater, a service station on US 1 at 73rd Street and a new drug store (1050) which is now Lee's Pharmacy; and WHEREAS, the history of the City of South Miami (Larkins) shows that a portion of S. W. 59th Place at Sunset Drive was once called Dorn Street; and WHEREAS, S. W. 59th Avenue is directly east of the three most important remaining Dorn Buildings. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That portion of S. W. 59th Avenue between Sunset Drive and S. However, a citizen made a written complaint regarding this type of sale and pursuant to existing Dade County Public Health requirements regarding food sales to the public, our Code Enforcement staff requested each church, synagogue, mosque, or temple not having the required public health permit to stop further sales. Also, the City Code did not authorize this type of sale. The approval of the attached Resolution will permit churches, synagogues, mosques, and temples to hold fund - raising food sales in the City of South Miami as long as the proper Health Department permit is obtained. Recommendation: 1. Advantage to City: I believe it is good Public Policy to permit non - profit churches, synagogues, mosques and temples to sell to the general public, food for fund raising purposes if those bodies have obtained the necessary Health Department permits. By requiring Health Department permits, the public is assured that acceptable public health standards are being used in the preparation and handling of food for public sale. 2. Disadvantages to City: None 3. Staff recommends approval for this Resolution. 4. This Resolution provides for proper enforcement of Article I, Section 14B -11 of the Dade County Code in the City of South Miami. M10 RESOLUTION NO. A RESOLUTION OF THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA REGARDING SERVICE OF FOOD AND NON - ALCOHOLIC BEVERAGES DURING FUND - RAISING EVENTS BY CHURCHES, SYNAGOGUES, MOSQUES, AND TEMPLES. WHEREAS, sponsoring fund - raising events is part of the traditional charitable, community functions of churches, synagogues, mosques, and temples; WHEREAS, service of food and non - alcoholic beverages is a traditional and desirable function during such fund - raising events; WHEREAS, Article I, Section 14B -11, et seq. cf the Metropolitan Dade County Code establishes minimum standards for hygiene for public food service establishments, and provides for permits for temporary food service, and for enforcement; and, WHEREAS, it is desirable for the Mayor and the City Commission to state the city's policy regarding enforcement of Article I, Section 14B -11, et seq. of the Dade County code. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. Dumpsters - P/W Dept. Each year the Public Works Department must purchase new two -yard dumpsters to service some 300 commercial customers. Over years of rough use, dumpsters must be replaced. The average life expectancy for dumpsters is approximately 5- years. Public Works has 90 dumpsters and approximately 15% are replaced each year. Recommendation: 1. Advantage to City: The City is cleaner by not having leaking containers. Broken dumpsters sometimes must be unloaded by hand if the metal is weakened. 2. Disadvantages to City: None 3. In the past, due to budgetary constraints, we were able to clean -out only one -third of the storm drains annually. This past year, the City and County have signed an interlocal agreement to comply with a Federal mandate by establishing a National Discharge Elimination System. As explained previously, this program was created to eliminate all pollutants from discharging into the aquifer, canals, lakes, waterways and bays. One phase of the program is to maintain clean storm drains and install minor drainage projects. This past year, the County and municipalities (including South Miami) imposed a $7.50 quarterly charge on each water bill. The revenue derived from South Miami is used to pay the County for cleaning canals and canal bank maintenance, trimming of trees along canal banks and aquatic weed control. The balance of funds ($37,000 is budgeted for 93 -94) are for cleaning storm drains and minor drainage projects. Storm drains must be cleaned periodically in order to prevent street flooding and pollution in the system. Recommendation: 1. Advantage to City: By cleaning the City's storm drains, flooding and pollution will be reduced. 2. Disadvantages to City: None 3. Staff recommends approval of this Resolution. 4. This Resolution conforms with the adopted 1993 -94 budget (see page 78 of the 93 -94 budget). Wr RESOLUTION NO. Traditionally, projects of this scope have dedication plaques listing the officials and principals involved. The Commission previously directed that the new building will be designated the "L. Daniel Schulz Memorial Police Facility" in honor of Officer Schulz, who in the fall of 1987 was stabbed by a teenager at the Bakery Centre and shortly thereafter died of his wounds. It is planned that the new Police Station will be dedicated in a ceremony to be held during Police Appreciation Week, which is the week of May 8. We need about four weeks to make the plaque. Accordingly, at the April 5 meeting we will have a plaque mockup for your review. Recommendation: 1. Advantage to City: Police Station will have a dedication plaque. 2. Disadvantages to City: None 3. Staff recommends the Commission approve a plaque format so it can be manufactured in time for the dedication during Police Appreciation Week. 4. We propose a basic package of work in three phases, and offer optional services at additional cost, as described below. SCOPE OF THE WORK (Basic Package of Services): Victor Dover and Joseph Kohl of DOVER, KOHL & PARTNERS ('the Urban Designers') will lead a team of citizens, consultants and staff through a charrette process on behalf of The City of South Miami ('the City'). The Urban Designers will serve as the lead consultant and liaison to you for this work; we will be assisted by Facilitator/Planner Clyde Judson of Judson Partners, by Transportation Planner Peter M. Fernandez, and by Attorney /Planner Samuel Poole of Holland & Knight ('the subconsultants') for portions of the work. We will work under the direction of the Director of Building, Zoning & Community Development or others as you determine. PHASE I - PRE- CHARRETTE WORK. The Urban Designers will accomplish the following tasks: 1. Meetings and Telephone Consultation. The Urban Designers and their subconsultants will work with City staff to confirm project details and for a briefing on the project; will assist the City in explaining the charrette process and the work -in- progress, and in resolving technical matters. 2. These will be combined with photographs of the existing conditions and photos of drawings produced later, for a project slideshow. 5. Desi ng Time. The Urban Designers will begin preliminary on -paper analysis in advance of the charrette, set up advance layout work for charrette drawings, and organize possible illustration viewpoints. 6. Writings. The Urban Designers will assist the City in the editing of a press release, and assist in drafting of a letter of invitation. PHASE II - CHARRETTE. 1. Public Urban Design ` Charrette'. The Urban Designers will lead an intense urban design workshop, or charrette, to design the Plan, solicit ideas from interested citizens and groups, and explain the work -in- progress. CHARRETTE ACTIVITIES: The precise charrette schedule will be worked out with the City prior to the charrette. Typical activities include: round - the -clock design sessions; walking tours) led by the designers; open- microphone sessions with citizens, merchants, and property owners; interviews with involved individuals, groups or boards; drawing sessions with smaller groups at worktables; rough presentations for feedback; a closing presentation on the final evening of the charrette; and other events. CHARRETTE DURATION.- The charrette should be 5 days in length. The day before will be reserved for Setup, and the day after the close of the charrette will be reserved for Takedown. On or before setup day, Victor Dover and/or Sam Poole will conduct private, one -at -a -time interviews with City Commission members. The closing presentation will occur at the end of the fifth day. PUBLIC MEETINGS: The charrette must be widely advertised by the City. In addition, the following items are helpful: public- address system with wireless hand -held microphone; slide projection screen or white wall (10'size minimum); access to photocopier and telephone; large- capacity coffeemaker for the public gatherings. Refreshments are recommended. FOLI OWUP and TOWN MEETING PRESENTATION: After the charrette, the Urban Designers will continue the work in our offices, resolving contradictions, adding detail, and creating final drawings. Approximately 6 weeks following the end of the charrette, the Urban Designers will make another, more polished presentation of the completed work products at a Town Meeting. ONE PLAN: The Urban Designers propose an interactive process with you and others via the charrette, but will produce one version of the Plan. (Special areas may be drawn to illustrate variations, at the Urban Designers' discretion.) 2. Drawines. The Plan will be documented in a package of graphics, including the following (other items may be added at the Urban Designers' discretion): Overall ILLUSTRATIVE PLAN (showing streets, blocks, lots, public spaces, & civic buildings, and overall circulation) at a scale to be determined, rendered and in color suitable for publication - HYPOTHETICAL ROOF PLAN of one or more areas (showing buildings, parking & landscape) at an appropriate scale, and in color suitable for publication - AXONOMETRIC SKETCH of all or part of the core area at 1 "=60' scale - PERSPECTIVE SKETCH or before- and -after COMPUTER LWAGING SIMULATION of significant project elements - SKETCH PLANS or FREEHAND SKETCHES OF DETAILS (approx. 2 -3) 3. Writings. The Urban Designers will write a press release describing the charrette and the results; and a text describing the Plan, the intent of its designers, and ideas for implementation and policy reform. Additional Presentations: The Urban Designers will make additional presentations of the plan and concepts as requested by the City, for audiences you designate, on a price- per-presentation basis. 2. Computerized Base Maps and Project Plans: The Urban Designers will produce a computerized base map prior to the charrette, in Auto CAD Release 12 format. All computer data will be provided to the City on diskette at the close of Phase 1, and will be plotted at a large scale for use in the charrette. Following the charrette, the Urban Designers will use this same format to create the final drawings. 3. Amended Land Development Regulations: The Urban Designers and Attorney /Planner will produce a proposed Overlay District Code, which will work in conjunction with a Regulating Plan, and which could indicate, for example: setbacks or build -to lines; locations for parking; fences, walls & hedges; porches, arcades and encroachments; etc. This Code would be organized into either a poster matrix or booklet format, and could serve as a substitute for conventional 'zoning.' The Regulating Plan will be produced at 1 "= 200'scale or larger, in black -and -white reproducible format and as AutoCAD data. The Urban Designers will also produce a written list of Architectural Standards which will describe a range of appropriate materials and configurations for the construction of new buildings in the district. It is anticipated that these regulations will be a variation on, or an extension of, the existing Hometown District Code. 4. Street Standards. The Urban Designers and Transportation Planner will produce written & graphic Street Standards which will be the technical guide for gradual retro f t of the existing streets and construction of other new streets, and will delineate lane widths, street trees, parking, turning radii for curbs and corners, and other information. 3. kfulti -Modal AVtobility Plan /Neighborhood Traffic Calming Plan: The Urban Designers and Transportation Planner will produce a proposed plan for physical improvements intended to encourage use oj'alternative modes of travel within the area, including bicycle, pedestrian, transit and paratransit travel; and will produce a plan for future physical improvements intended to manage the behavior of motorists in the neighborhood, indicating locations for specific interventions and illustrating their details. TENTATIVE SCHEDULE: Following execution of this agreement, the Urban Designers will collaborate with the City staff and to create a mutually agreeable detailed schedule of events, including the charrette agenda. TERMINATION OF THE WORK: If this project is suspended or delayed for any reason after work has been begun, the Urban Designers shall be paid for all work to date and all reimbursable expenses to date. Grant Request - Tree Cover Replacement SR District & Dante Fascell Park Background On August 24, 1992 the City lost a large number of trees and tree cover throughout the City. It is estimated that the City lost more than 50% in tree coverto Hurricane Andrew. FEMA has provided funds for our basic tree loss, i.e. small trees which will take years to provide the cover in existence prior to the Hurricane. This grant will provide an intensive tree replacement in our SR District. The proposed tree planting is a part of our overall SR - Hometown Plan. The total request is for $35,000 and provides for 170 shade trees and 56 palms. The majority of trees will be for the SR District. A small number will be to enhance the tree cover at Dante Fascell Park. Recommendation: 1. Advantage zo City: The tree planting and tree cover plans for the SR - Hometown will be met if the City obtains this grant. 2. Disadvantages to City: None 3. During the business day, the population swells to over 25,000 people. More than 250,000 vehicles use the roads that intersect the city daily to commute to and from work. The city must keep pace with metropolitan problems utilizing a small city's resources. Substantial commitment to address these issues was made by City administration. Need Statement -------- - - - - -- The City of South Miami, although on the North end of Hurricane Andrew's destruction, sustained significant damage to buildings, plants, and trees. Estimates indicate'that there were sustained wind gusts exceeding 100 miles per hour. On U.S.1, bordering the Downtown area on the West, the City lost twenty -two (221 paims and nine shade (9) trees in the median alone. On Red Road zo the East of Downtown there was a comparable Noss of twelve median shade trees. At Fascell Park 40 trees were _ost, and Downtown experienced nearly a 50% loss of canopy. As cart of zhe City's recovery efforts, the Public Works Department removed 14,432 cubic yards of trash between September 7th and 27th 1993 from _public and private properties. The City's recovery effort, in debris removal, repairs, replanting, labor and related costs has exceeded $1.3 million. The City has received a designation as a "Cool Community" by the American Forest Association Local Advisory Council, the City's administration has made a commitment to actively pursue efforts to maintain and expand this designation. Activities: Program Description The City, with intensive community participation, via the Charrette -town meeting- process has developed a "Hometown Plan" that targets the business district to become a *nixed use, pedestrian friendly neighborhood. and serve as a model of what can be achieved city wide. The downtown area encompasses US1 to the West, Red Road to the East, SW 74th Terrace to the South, and SW 69th Street to the North (see map included) . ,he initial prcects cf this plan incorporates to reduction of through tra -fic, the widening of sidewalks, increased placement cf _rees, restoration of planted :^eaians, and rearranged narking. This project exceeds :ne city's inancial ability, but is viewed as a necessary effort to assure that the canopy is expanded. To increase natural cover on pedestrian walkways;4. To naturally reduce energy consumption; 4. To maintain a pedestrian friendly environment; 5. To provide a model for city wide development. Environmental 'Value Trees are like janitors of the air, they remove carbon dioxide from the atmosphere. The American Forestry Association's study indicates that in a year a tree would save $73.00 in air conditioning, $75.00 controlling erosion and storm water, $75.00 wildlife shelter, and $50.00 controlling air pollution, a total of $273.00 per year. With a fifty year projected life span compounded at 5% this would amount to a total of $57,151.00 for a single tree. Additionallv, recent studies show that trees also filter "particulate matter" (microscopic dust particles) and remove some toxic =ollutants as well. Trees have been shown to "capture" a wide range of chemical compounds .n the air that are produced by fuel combustion and other processes. Ten years ago, people talked of trees only in terms of beautification. Today, we realize that trees provide real dollar benefits to a community that can be measured and placed on a balance sheet. These benefits include energy savings, stormwater management, and air quality, as well as many other physical and social benefits. Up until noW, community managers have not had the information necessary to consider the urban ecosystem's values in their decision making process. The city's urban.infrastructure has not included the "green" component. No one was measuring and analyzing the values of an urban forest in policy makers' language. As a result of Hurricane Andrew, south Florida's residents have an increased awareness of their trees' values, and an opportunity to be on the leading edge of new techniques for measuring, analyzing and improving urban forest ecosystems. AMERICAN FORESTS has developed a practical, cost — effective ecological mapping and evaluation system for urban ecosystems. It is a flexible system that can provide community leaders with accurate visual images at map scales which directly fit their local needs. This new mapping system has the potential to dramatically demonstrate ,the value of urban forests and to help public — policy officials make wise budgeting decisions about these resources. Conducting the Ecological Inventory and Measuring the Benefits A,NERICAN FORESTS introduced the concept of Geographic Information Systems (GIS) to evaluate the entire urban forest and incorporate it into future land -use planning and community design. The analysis done in this community will become a model for other communities in Florida and around the country. AMERICAN FORESTS is- the only organization that can provide this service and is therefore requesting sole source justification. The first step in the inventory and mapping process is to identify the boundary of the project and obtain high quality photographs of the area. Two different photograph scales are used: a high altitude image(s) showing the entire community, and several low altitude color or color — infrared images which can provide 1 square foot ground resolution. The low level photography provides the detail needed to survey the trees, conduct ground checks and distinguish- relevant ecological features in the community. Next, an information database is developed, and a spatial mapping system is established. Ecological data is collected and put in a database. The photographs are scanned and turned into digital images which can be stored in the computer's data files and displayed on the computer monitor or in print as a spatial image (or a picture). Information from these two files are combined for analysis. GIS is the terminology for the technology that allows this information to be combined and presented as an analysis. /of The around surveys are conducted using statistical sampling methods so that an accurate picture of the ecosystem can be developed in a timely and cost — efficient manner. The analyses produced from this process demonstrate the benefits of the urban ecosystem and provide the local people with information to participate effectively in public policy decisions. The last step is to create presentation material for local people to use to demonstrate the values, needs, and importance of the urban forest resource to community leaders. Salient urban forest ecosystem data is displayed graphically over aerial photographs so issues can be clearly discussed in public meetings. The goal is to interpret technical information and convert it into a language commonly used by public administrators. AMERICAN FoREsTs will work with the community to develop a presentation package to fit its needs. The data displayed in this presentation will be determined by AMERICAN FORESTS after meeting with the city manager, selected members of the planning department and the local community. Color maps showing the ecological analysis will be provided to the local groups. A computerized version of the presentation will be provided for use with ARCVIEW software, the most commonly used GIS software available for personal computers. AMERICAN FORESTS has conducted this process for the city of Frederick, Maryland and produced an analysis of its urban forest. A sample presentation of the information that was generated for Frederick is enclosed. The full value of urban trees can be illustrated and demonstrated to city managers and decision — makers by analyzing the data attached to the images on the maps. Using GIS for analysis provides an in —depth view of an urban forest and allows us to import different land —use maps, aerial photos, and other data and layer them together. We have added the urban tree layer to evaluate how the urban forest ties into the ecological web of a community. Previously unknown benefits of the urban forest can be incorporated into city planning decisions as we analyze how these different layers of information connect. For example, quantifying canopy cover of the urban forest in relation to building orientation can tell us how much we save on utility bills from summer shading. Adding in tree size and age gives us biomass measurements to determine the amount of rain trees intercept for stormwater management. Costs and Benefits Preliminary data suggest that communities receive substantial benefits from their trees. These benefits can be measured and put on the budget balance —sheet with other city assets so that community leaders can make better management decisions. As we approach the 21st century, we recognize the need to help the public see urban forests as vital economic, as well as environmental importance to the people who live there. Public policy— makers need science to attach real — dollar values to the urban forest. GIS provides an opportunity to create accurate visual maps of the urban forest and attach cost — benefit measures to this resource. Computer models suggest that the benefits provided by the urban forest will be much larger than previously believed. To illustrate the full value of the urban forest as an ecosystem, an accurate accounting of all the trees in a community must be conducted. This includes trees on public and private property. Traditional street tree surveys count only about 10% of the trees in the urban ecosystem. By analyzing the trees in the entire urban ecosystem, a more comprehensive and accurate accounting of the resource can be accomplished. This homeowner wants to be able to construct a single - family home on each of the 50' lots. The RS -4 requirement for a minimum of 60' frontage for single - family lots precludes two homes. A staff survey of the area bounded on the north by Bird Rd., the South by SW 44 Street, East by SW 61 Avenue and the west by SW 62 Court, shows the front footage for the majority (41 of 75) of the properties to be 501. The mean (average) frontage is 57.4 Feet in this area. If an individual owned one 50' frontage lot he would be permitted to build a house on that lot. However, the existing RS -4 zoning mandates that if you own two adjoining lots with less than the required 60' frontage, only one house may be built. Recommendation: 1.
