Dennis Whitt V _ City Manager DATE: May 15 , 1997 RE: Agenda Item # It Commission Meeting, May 20, 1997 Approval of expenditure for repair work for Police Vehicle no. 96 -05 The attached resolution seeks approval of a $2,761.27 expenditure to repair police vehicle no. 96 -05. The patrol car was involved in an accident earlier this year. The repair of the vehicle is essential to the efficient operation of the Police Department. Three quotes for repair were obtained from local vendors. The quote with the best warranty and price was produced by Truck City Body Corp., Inc. The Police Department is in the process of changing all the logos on the marked vehicles. Since patrol car no. 96 -01 will be in the body shop, we will take the opportunity to convert this vehicle as well. Therefore, the additional cost of repainting the entire vehicle and installing the new logo will be charged to the Police Department, while the cost of the repair work associated with the accident will be charged to the "self insurance fund ". This is an important issue in that it affects the strength of the police marked car fleet. Therefore, I recommend approval. Dennis Whitt RE: Agenda Item # City Manager Commission Meeting, May 20, 1997 Approval of purchase and installation of hurricane shutters - Public Works office building The attached resolution seeks approval for a $1,910.00 expense to purchase and install hurricane shutters in the Public Works yard administrative office building. The shutters will help minimize or avert damage to the equipment, furniture and records inside the building in the event of a tropical storm or hurricane. Public Works obtained three price quotes for aluminum shutters from local vendors. The quotations ranged from $1,910.00 to approximately $3,400.00. The shutters are to be installed in accordance with the recently revised Metropolitan Dade County Building and Zoning requirements. Acquiring hurricane shutters is a prudent measure given the value of the assets in the Public Works office building. Therefore, I recommend that the purchase and installation expense of $1,750.00 be approved. The "hardship" must be inherent in the land and not based on the people involved or the circumstances in which they find themselves. A classic example of a hardship concerns a lot, which, because of a peculiar shape or an extreme topographical feature, is virtually unbuildable under the yard requirements of the ordinance. This amounts to a defect in the land which deprives the owner of a right enjoyed by all other owners of adjoining lots. The special conditions which must be found are those which apply uniquely to the property in question and which prevent its being used in the same way as other properties in its vicinity or in the zoning district. Under these conditions, the granting of a variance would not allow a special privilege not enjoyed by other property in the same vicinity or zone. The conditions must be so unusual that the ordinance, as applied to the particular property, would probably be invalid in that a reasonable use of the property is not allowed. An "unnecessary" hardship is one which is not required in order to accomplish the objectives of the zoning ordinance. Some hardship (or limitation of privilege) is unavoidable. For example, restrictions against commercial use of property in a residential district is not an "unnecessary" hardship, for it is the clear intent of the zoning ordinance to so restrict all property in the district for the benefit of the community. Similarly, mere economic loss is not a valid hardship, particularly if the same loss applies generally to other properties in the district. Hardship cannot be self - imposed. The owner of a building constructed in violation of the regulations could not claim "hardship" in being required to remove it. Ignorance of the existence or application of zoning regulations does not constitute legally recognizable hardship.... The variance should never be used to correct improper zoning. The hardship may be real and unnecessary, but, it is also general, the proper approach is through a change of zoning by the legislative body, the City Commission.... This problem is exacerbated by the fact that the City of South Miami's Land Development Code requires a zoned right -of- way of 50 feet for all residential roads. Therefore, these substandard lots are effectively made smaller because setbacks and building coverage figures are calculated by utilizing zoned right -of -way lines. Of the thirteen Habitat -homes constructed or permitted for construction, nine have required variances. rl ANALYSIS The subject property is a substandard Iot with an area of 4,800 square feet. The lot is 50 feet wide by 96 feet long and is an interior lot. Due to a zoned right -of -way, however, the calculated lot dimensions are 50 feet wide by 86 feet long, with a resulting area of 4,300 square feet. Thus, the property has an allowable building envelope of 36 feet long by 35 feet wide or 1,260 square feet. The following table exhibits the allowed dimensional requirements and the proposed dimensional requirements for the subject property. The calculated area of the property is less than the "RS -4" zoning district standard of 6,000 square feet. 4. The proposed front setback is less than the required 25 feet. Attachment III provides a map identifying the subject property and properties which share some or all of these characteristics. The following gives information about the lettered properties: A. The existing duplex at 6288 SW 59 PL is built on a corner lot. The property has two zoned right -of -ways. These zoned right -of -ways reduce the property's calculated area to 3,440 square feet. The front setback is 19 feet. B. The vacant lot at 6257 SW 59 PL has a zoned right -of -way. The zoned right -of -way reduces the property's calculated area to approximately 4,350 square feet. C. The existing duplex at 6273 SW 59 PL is built bn an interior lot. The property has a zoned right -of -way. The zoned right -of -way reduces the property's calculated area to approximately 4,350 square feet. The front setback is 22 feet. D. The existing duplex at 6289 SW 59 PL is built on an interior lot. The property has a zoned right -of -way. The zoned right -of -way reduces the property's calculated area to 5,481 square feet. The front setback is 22 feet. Attachment IV provides pictures of the properties surrounding 6272 SW 59 PL. These pictures clearly demonstrate that the proposed setbacks will not adversely impact the surrounding properties. The investigation and analysis of the subject property and the surrounding area evidence that the proposed home is in conformity with the surrounding area. COMPREHENSIVE PLAN The application is consistent with the Goals, Objectives, and Policies of the Comprehensive Plan. APPLICABLE REGULATIONS Land Development Code • Section 20-3.5 (E) Comprehensive Plan 0 Housing Element Goal 1 and Objective 1.3 RECOMMENDATION The special characteristics of the subject property inhibit it from being used in the same manner as other properties in the RS -4 zoning district. Shall mean an establishment where the principal business is the sale of food and beverages to the customer in a ready -to- consume state and where the design or principal method of operation consists of either of the following: Sit -down restaurants where customers are normally provided with an individual menu and food and beverages are generally served in non - disposable containers by a restaurant employee at the same table or counter at which said items are consumed; or, Cafeteria -type restaurants where food and beverages are generally served in non - disposable containers and consumed on the premises. All such cafeteria -type establishments shall provide only inside or patio service on private property. Catering service shall be allowed as an additional use in the SR zoning district. In either the case of Sit -down or Cafeteria -type restaurants, public streets, rights -of -way, and sidewalks may not be used for patio or street -side services of any kind. The previous use at this location was Coffee House and More which was also classified as a restaurant and had approval for a seating capacity of 20. Wrapido at a Glance Wrapido is a new sit -down restaurant concept that serves gourmet, moderately - priced wrapped sandwiches. These "hand -held" meals, served in non - disposable containers, are targeted to satisfy the appetite of upscale, health- conscious consumers. Wrapido will offer traditional food items such as seasoned grilled chicken and steak, but will focus the core of its menu on new mixes of international cuisine. For example, our "Hawaiian Grilled Fish" wrap features grilled salmon, avocado, ginger cole slaw, sesame seeds, jasmine rice, scallions and our home -made mango salsa. Entrees are wrapped in an over -sized twelve inch tortilla, typically infused with a distinctive flavor and color such as green for spinach, yellow for curry, red for tomato -basil or tan for whole wheat. We will also feature an array of fresh home -made soups, and nutritious fresh -fruit smoothies. Wrapido would also like to offer premium imported and domestic bottled beer and wine in order to compliment our international cuisine. Operating Plans Wrapido intends to operate seven days a week from the hours of eleven a.m. to ten p.m., and twelve p.m. to nine p.m. on Sundays. The restaurant, which is comprised of 1020 square -feet, is expected to support between 25 to 30 seats. The site is not expected to require any structural renovations. The scope of the proposed renovations will be entirely cosmetic (i.e. painting of walls, changing of ceiling tiles and rearranging the furniture and fixtures). In addition, the restrooms may have to be modified to satisfy current A.D.A. handicap codes. If so, Wrapido is prepared to bring such facilities up to code. 13 Wrapido Management Team Jason Silverman, received his bachelors degree from the University of Florida and his graduate degree in Hospitality Management from Florida International University. In addition to being an honors student, Jason has a wide range of professional experience in the hospitality industry. He has worked for independent restaurants, large corporations such as Host Marriott, as well as the public accounting firm of Ernst & Young LLP. Abe Ng graduated as a Student Agencies fellow at Cornell University. There he completed his degree in Hospitality Management at the Statler School of Hotel Administration. He has an extensive hospitality background which includes work at the Century Hong Kong Hotel, a management internship at Burger International World Headquarters, as well as hospitality consulting experience with Ernst & Young LLP. Our management team includes Allan Ng, the owner and founder of six Canton Chinese Restaurants and one Toyoma Sushi Bar located throughout South Florida. Allan is a highly respected food operator in the community, and has over thirty years of experience in the food and beverage industry. Allan will oversee all back -of -house operations at Wrapido. Wrapido vs. Fast Food Concepts The "Wrap" concept although sometimes coined as a quick- service restaurant, differs significantly from other fast -food operations. First, food is always prepared to order, or a -la- minute, as opposed to pre -made food products that sit under hear lamps or items that are microwaved prior to serving. In addition, whereas most fast food restaurants provide no entertainment to encourage customers to linger, our concept, set in a contemporary atmosphere, makes use of a suspended television, a state- of -the- art sound system and weekly events aimed to attract and captivate customers. Lastly, wraps, soups and smoothies have significantly higher price points than the $0.99 Whopper or the $2.75 Happy Meal. The average ticket per customer at a Wrapido store ranges between $4.95 to $7.50.
