PRESENTING A PROPOSED
STORMWATER USER FEE
BUDGET FOR FISCAL YEAR
1999/2000 TO THE BOARD OF
COUNTY COMMISSIONERS FOR
APPROVAL.
The attached resolution presents a proposed Stormwater User Fee Trust Fund budget to the
Board of County Commissioners for approval.
As you know, the City of South Miami receives from the County stormwater "user fees"
collected through the Miami -Dade Water & Sewer Department billing system. Through our
interlocal agreement with Miami - Dade County, these revenues are to be used for stormwater
drainage capital improvement projects, canal maintenance (a flood control and pollution control
activity), various National Pollutant Discharge Elimination System (NPDES) related tasks,
and/or for payment of employee salaries directly related to these activities.
Inasmuch as these are County- izenerated revenues disbursed to the City. the County must review
and approve how these funds will be utilized. Accordingly, pursuant to the request of the
Miami -Dade County Department of Environmental Resources Management (DERM), the
attached resolution presents a proposed budget for their review. Following approval by the
Board of County Commissioners, the City of South Miami is to then adopt the approved budget.
Any subsequent changes to the budget would have to be ratified by the County.

11 WHEREAS, the City of South Miami is a member of the Miami -Dade County
12 Stormwater Utility, an agency created through County Ordinance 91 -66 for the purpose of
13 providing uniform stormwater management throughout Miami -Dade County, and;
14
15 WHEREAS, per the interlocal agreement with Miami -Dade County, the Board of County
16 Commissioners must approve the City of South Miami's proposed Stormwater User Fee Trust
17 Fund budget, and;

19 WHEREAS, the City of South Miami has a right to propose subsequent changes to the
20 approved budget during our budget review process, whereupon the Board of County
21 Commissioners would have to review and ratify any such requested changes.

The attached resolution seeks approval for the City Manager to enter into a contract with
Aventura Tree Service to remove 11 Australian Pines from the southeast corner of the lake at
Fuch's Park.
This item represents the necessary site preparation for the Fuch's Park landscaping project also
on tonight's agenda. A detailed project description is provided in the commission packet for that
resolution.
Previously, several vendors were invited to provide tree removal quotes for the City. Bidders for
that project included: Aventura Tree Service, Alberto Gonzalez Tree Removal, Tropical
Treeworks, and One Two Tree Inca Aventura Tree service offered the lowest unit cost for tree
removal, and was therefore selected for the Dante Fascell Park project.
Aventura Tree service has agreed to extend the same unit cost for the Fuch's Park project.
Therefore, approval is sought to allow the City Manager to extend a contract to this vendor for
the removal of pines for the Fuch's Park project.
The total expenditure would not exceed $2,750.00, and the disbursement would come from
Account No. 131.000.2210 entitled " Fuch's Park Grant Matching Fund Renovation of Shelter /
Nature Study ". This account currently has a balance of approximately $11, 000 remaining for
fiscal year 1998199.

the need to remove certain hazardous and environmentally undesirable trees for the public good,
and;
WHEREAS, Aventura Tree Service has provided the City of South Miami with the

WHEREAS, the Mayor and City Commission adopted Resolution
No. 48- 98- 10315, on March 3, 1998, creating a five- member Charter
Revision Commission; and
WHEREAS, Resolution No. 48 -98 -10315 was amended by
Resolution No. 119 -98- 10387, adopted May 5, 1998 to increase the
membership from five to nine members; and
WHEREAS, because of the overwhelming community interested
being generated it was the Mayor and City Commission's desire to
increase the membership of this Commission from nine to fifteen
members; and
WHEREAS., it has become increasingly impossible to make
quorum therefore the membership is being decreased from fifteen
to twelve.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

The City of South Miami Charter Revision Commission is
hereby created. The Commission shall consist of twelve members,
who shall be appointed by the Mayor with the advice and consent
of the city Commission. The Commission shall consist of at least
two Attorneys who are licensed to practice law in the State of
Florida and who have expertise in the area of municipal law. The
Mayor is requested, in appointing members to the Commission, to
give due consideration to selecting members based upon principles
of ethnic and gender inclusion, and leadership and professional
capacity. The City Manager shall serve as a non- voting ex-
officio member of the Commission.
Section 2. Resolution No. 48 -98- 10315, as amended by
Resolution Nos. 119 -98- 10387 and 27 -99- 10651 shall remain in full
force and effect as amended.

City Manager Status of Women
The attached Ordinance is on for second reading and public hearing was
sponsored by Commissioner Mary Scott Russell. It changes the name of the
Commission on the Status of Women to Commissions For Women.
BACKGROUND
The Commission on the Status of Women was established by Ordinance No. 7-
97- 1628. Each member has demonstrated a commitment to improve the
condition of women through community and other service. The membership
reflects the racial and ethnic diversity of the residents of the City of South
Miami.
ANAL PSIS
The Commission on the Status of Women is petitioning the City Commission to
change the name of the Commission to "Commissions For Women."
Commissioner Russell is the Commission Liaison to this Board.
CONCLUSION
Given the fact that this is a very active and productive Board it is the
Commission's desire to comply with this request. First Reading was held on
May 18, 1999.

25 (a) Created; composition. There is hereby created a City of South Miami
26 Commissions for Women. The ComwAftee Commission shall
27 consist of 10 members.

29 (b) Appointment and terms of members. Members of the Eenee
30 Commission shall be appointed by the Mayor as provided in the City Charter. Members
31 of the Eemniftee Commission shall be permanent residents or employed in business in
32 the city for two or more years. Each member shall have demonstrated a commitment to
33 improve the condition of women through community and other service. The membership
34 should reflect the racial and ethnic diversity of the residents of the City of South Miami.

36 ( c) Terms of Office. In order that the terms of office of all members of the
37 Eemmiit Commission shall not expire at the same time, the initial appointments to the
38 Committee Commission shall be as follows; 5 members of the Committee shall be
39 appointed for a term of two years from date of its first meeting and 5 members shall be
40 appointed to the Eemm Commission for a term of three years. Appointed members
41 shall thereafter serve for a period of 2 years or until their successor is appointed,
42 whichever occurs later.

44 (d) Chairperson and vice- chairperson. The chairperson and vice -
45 chairperson shall be elected by the members of the Gamn Commission for a term of
46 one year. Appointments to fill any vacancy on the Cemee Commission shall be for

I fails to attend three (3) consecutive meetings without an excused absence, he or she shall
2 be removed by the City Commission. An "excused absence shall be defined as an
3 absence resulting due to personal or family illness, death in family, being out of town
4 because of business, professional, or other commitments subject to the approval of the
5 chairperson.

7 (e) Organization of the Gemmitte Commission; Members of the Committee
8 on the Commissions for c-, of men shall elect such officers, in addition to the
9 chairperson and a vice - chairperson, as may be deemed necessary. Six members shall
10 constitute a quorum necessary to hold a meeting to take any action. Members shall serve
11 without compensation, but shall be reimbursed for necessary expenses incurred in the
12 performance of their official duties as approved by the City Commission. A budget shall
13 be established by the City Manager, as soon as possible, for purpose of funding expenses.
14 Regular and special meetings of the Committer Commission shall be scheduled, and
15 notice of such meetings shall be given, as provide in the City of South Miami Code of
16 Ordinances for meetings of the City Commission; provided, however, that scheduling
17 special meetings shall require the written request of 6 Cem tee Commission members,
18 Minutes shall be kept by city staff of all meetings.

20 (f) Duties and Powers of the Commissions for
21 Women. The powers and duties of the Conunittee. Commission shall include, but
22 not limited to, the following duties, functions, powers and responsibilities.
23
24 (1) To serve in an advisory capacity by making investigations, studies, reports
25 and recommendations to the City Commission, the City Manager and her or
26 his administration, and the community, in respect to all matters pertaining
27 to the status of women in South Miami, including, but not limited to, the
28 fair and equal treatment of women; those policies and practices which
29 discriminate against women whether practiced by public or private persons,
30 individuals or corporations; and, the public and private employment of
31 women, the working and living conditions of women, the delivery of public
32 and private services to women, and the education and training of women
33 and public accommodations for women;
34
35 (2) To make continuing studies with recommendations and reports of all city
36 all city agencies, facilities, boards, services and programs dealing with or
37 affecting women, including equal funding of such facilities, services and
38 programs;
39
40 (3) To study, recommend and report any needed improvements and changes to
41 city codes, boards, ordinances, resolutions, and written and unwritten
42 policies and practices of the city;
43
44 (4) To appear before any governmental or non - governmental agency to present
45 findings and recommendations on behalf of the
46 of Commissions for Women, as well as on behalf of the City with the
47 approval of the City Commission.

(5) To solicit contributions, services and financial support from other
governmental authorities, private businesses, groups, institutions and trust
funds;
(6) To serve as a liaison or informal mediator among the city Commission, the
city administration, the city employees and the users of city services and
facilities. The Convaission on the Status e Commissions for Women may
consult with representatives of these groups from time to time as necessary
to carry out the Commissions for Women's
duties and functions; and
(7) To perform other duties, functions and services as may be assigned to it by
the City Commission.
Section 2. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 3. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are repealed.
Section 4. This ordinance shall take effect immediately upon approved.

13 WHEREAS, the Florida Building Commission is preparing
14 recommendations to the Florida Legislature for a unified building code to replace
15 county code by the year 2001; and,

17 WHEREAS, the recommendations of the Florida Building Commission
18 will be submitted to the Florida Legislature for consideration. at its year 2004
19 session; and,

21 WHEREAS, state -wide building code standards may eliminate or weaken
22 the tougher standards that were adopted as part of the South .Florida Building Code
23 following the devastation. of Hurricane Andrew; and,

25 WHEREAS, based on property loss experience, due to hurricane - related
26 damage, the State of Florida is ranked as one of the 10 costliest states, and the
27 South Florida Building Code, which was strengthened to increase protection to
28 property from wind and wave damage, is one of the most stringent codes in the
29 country; and,'

31 WHEREAS, any action taken by the Florida Legislature to weaken the
32 South Florida Building Code, or to create a periodic "sunset" provision, which
33 would require periodic re- adoption of the code, would be contrary to South
34 Florida's substantial hurricane experience with inadequate building design,
35 materials and methods of construction; and,

37 WHEREAS, the Mayor and City Commission urge the Florida Building
38 Commission and the Florida Legislature to take no action to weaken the provisions
39 of the South Florida Building Code, but to affirmatively support the requirements
40 of the code.

Washington, D.C. should include modernization of the CRA so that it can
continue to cover lending and traditional banking services where performed by
a bank or one of the new affiliates of the bank holding companies which will be

15 WHEREAS, the CRA should continue to be an important economic
16 development tool to increase homeownership and economic development in low -
17 income urban and rural communities; and a

19 WHEREAS, H.R. 10, the Financial Services Modernization Act, should
20 include modernization of the CRA so that it continue to cover lending and
21 traditional banking services whether performed by a bank or one of the new
22 affiliates of the bank holding companies which will be allowed to form with

31 banking entities will be permitted to shift their assets to their new affiliates, thus
32 reducing the amount of capital covered by the CRA.

FOR FUCH' S PARK AT A COST
NOT TO EXCEED $1,400.00.
The attached resolution seeks approval to recreate an Everglades type environment at one corner
of the Fuch's Park lake. The purpose of this endeavor is to add to the visual variety of trees at
the park, as well as to serve as one of the "themes" along a future nature study trail. This project
is being funded through a Florida Recreation Development Assistance Program grant specifically
earmarked for this purpose. You should also note that the Landscaping Committee has already
reviewed and approved this proposal.
BACKGROUND
In addition to the visual enhancement goals, this project will also remove several nuisance trees,
and thereby result in an improvement to the lake's water quality. As you may know, the Public
Works Department is responsible for a number of environmental issues on behalf of the City,
particularly with respect to the Federal Clean Water Act (CWA) National Pollutant Discharge
Elimination System (NPDES) regulations concerning surface water quality. Inasmuch, Public
Works maintains Fuch's Park Lake, and is also responsible for taking proactive action to
preserve surface water quality.
With regard to water quality, Australian Pines are extremely detrimental. The "pine needles"
from these trees inhibit understory growth, which in turn contributes to soil erosion and
embankment collapse. Furthermore, the decomposition of the leaves in the waterways
contributes to eutrophication (the anaerobic decay of vegetative debris that leads to decreased
dissolved oxygen levels in the water, as well as malodors). Accordingly, Public Works would
like to clear the Australian Pines from one corner of Fuch's Park Lake, and replace them with
native wetland flora species as part of our commitment to the Clean Water Act, as well as to
greatly enhance the appearance of the park.

ANALYSIS
It is proposed to remove the Australian Pines from a 25' x 40' area along the lake shore, and
plant appropriate Everglade slough and hammock species in their place. The attached plan
shows the planting arrangement; each plant was selected for their overall aesthetics, flowering
characteristics, fragrance, and topographic requirements along the varying shoreline and
embankment elevations. It is also proposed to attach epiphytic bromeliads (et al.) to the Cypress
trees once they become established, and to add appropriate aquatic plants and terrestrial
groundcover. The overall visual effect should be highly aesthetic, particularly when the
Buttonbush trees are in bloom. The restoration project is being proposed next to the park
pavilion, an ideal viewing location.
This shall be the first project toward a greater commitment to creating other landscaping themes
for an eventual nature trail. Future projects can include recreations of various coastal
communities, hardwood hammocks, and pinelands. In this way, such landscaping projects have
the potential to serve environmental education goals in addition to providing greater visual
variety in this community park.

The nurseries contacted for quotes, in addition to the ones listed above, include: Botanics
Wholesale, Sylvan Farms, D.R. Bates Seeds Nursery, Zone Ten Nursery, and Sweet Bay
Nursery. These other nurseries did not have the species desired, or only offered smaller trees
than the vendors listed above.
Therefore, the attached resolution names Native Tree Nursery, Horticultural Systems, Inc., and
Plasencia Nursery for this project.
CONCLUSIONS & RECOMMENDATIONS
This innovative landscaping proposal shall greatly enhance the aesthetics and ambience of
Fuch's Park. Moreover, an ongoing commitment to the creation of a nature trail will not only
provide a exciting new dimension to this community park, but may also establish the City of
South Miami as a leader in environmental preservation.
Approval of this resolution is therefore recommended.
The total expenditure would not exceed $1,400.00 (base bids plus small contingency), and the
disbursement would come from Account No. 131.000.2210 entitled " Fuch's Park Grant
Matching Fund Renovation of Shelter /Nature Study". This account currently has a balance of
approximately $11, 000 remaining for fiscal year 1998199.

doubt enjoy the amenities of Fuch's Park. The City is preparing to install
new trees to add the visual variety at the park. Moreover, the attached
plan has the potential to serve as a part of a future nature trail in the park.
This project will also remove several nuisance trees called Australian
Pines. These trees, besides being environmentally undesirable, are also
very tall and have the potential to damage the homes on the south side of
the street if they fall during a storm.

REQUEST
The attached resolution authorizes the City Administration to enter an agreement with
Don Delaney, doing business as SDI, Inc., Hobe Sound, Florida, extending and
modifying the terms and conditions approved in Resolution #30 -97 -1001. This
resolution and the attached modified agreement places Mr. Delaney on a monthly
retainer with the city to provide consulting services to the South Miami Community
Redevelopment Agency on a reduced level of services to the CRA.
BACKGROUND AND ANALYSIS
The Commission voted on May 4t" to execute the termination clause of the current
contract with reduced level of services.. Due to the highly technical nature of the work
in progress it would not be prudent to reduce services to fewer than 50 hours per
month for the remainder of this fiscal year. The Consultant will continue to serve the
CRA as lobbyist and negotiator with the County Commission in regard to the final
approval of the Interlocal Agreement; serve on the negotiating team with regard to
SMCRA RFP &Q 98-10-01(7l 't Street Joint Development; technical advisor to the CRA
Board and Advisory Board for development of the CRA biannual budget and annual
report; will attend CRA Board meetings as technical advisor; and perform other
services relating to the SMCRA as defined in the attached-Agreement
For the above scope of work the services will be reduced from 3 days per week to 1 -Y2
days per week. The Consultant has agreed to extend the hourly rate of $100.00 per
hour for this contract. The monthly retainer amount will be $4,800.00. This represents a
50 % savings or $4,800.00 per month. This fee will be charged to general ledger
account #001 - 0000 - 132.15.00 titled, "Advances to other funds /CRA Prepaid Expenses."
in accordance with resolution #204 -98- 10472.
It should be noted that the above scope of work includes continued negotiations with
the Simon /Comras group relative to the 71St Street joint development. If these
negotiations cease then the level of work for Mr. Delaney would be reduced to 33% of
the current level or $3,200.00 per month.
It should also be noted that this contract ends at the end of the fiscal year which is
September 30, 1999. Mr. Delaney's responsibilities for next fiscal year will be decided
as part of the FY 1999 -2000 budget process.
All related expenses such as, secretarial support, printing and copying, travel, lodging,
and meal expenses, relating to tasks to be performed under this contract are the
responsibility of the Consultant.

WHEREAS, the Mayor and City Commission strongly support the expeditious
implementation of the South Miami Community Redevelopment Agency Plan designed
and created to bring economic equity to the city's CRA area, and improve the quality of
life for those South Miami residents who live within its boundaries; and
WHEREAS, the Mayor and City Commission recognize that improving the
declining tax base in the designated area will benefit the entire community, and can be
accomplished if redevelopment efforts are fostered and supported; and
WHEREAS, the City of South Miami's Community Redevelopment Agency has
been created and approved by the Mayor and City Commission, and approved by the
Miami -Dade County Board of County Commissioners in accordance with Chapter 163,
Part III, Florida Statutes; and
WHEREAS, the Mayor and City Commission has determined that Mr.Don
Delaney, dba SDI, Inc., has provided excellent service under the present contract and
possesses unique qualifications and expertise; and
WHEREAS, the Mayor and City Commission has determined that it is prudent to
continue utilizing the professional services of Don Delaney, dba SDI, Inc., to perform
necessary work related to community redevelopment, tax increment financing, pursuit
of private sector funding, CRA related grant writing and lobbying services, and other
CRA related services as requested by the city; and
WHEREAS, Don Delaney, dba SDI, Inc., a Consultant with office in Hobe Sound,
Florida, possesses the requisite skills, knowledge, expertise and resources to perform
the services required;
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the City Administration is authorized to execute a contract with

THIS AGREEMENT, entered into on June 12, 1999, between: City of South
Miami, herein after referred to as the "CITY," and SDI, INC. (EIN # 65- 0320035), a Sub -
Chapter S Florida corporation wholly owned by DON DELANEY, a redevelopment and
tax increment financing consultant with office located at 8422 S.E Royal Street, Hobe
Sound, Florida 33455, hereinafter referred to as "CONSULTANT."
WHEREAS, the CITY desires the CONSULTANT to assist in the implementation
of the approved South Miami Redevelopment Plan (SMCRA Plan) with supporting

programs and a tax increment trust fund, pursuit of private sector funds, grant writing
and lobbying services relating to the CRA, assist in review and analysis of development
proposals, and to represent the when appropriate on issues and policies related to CRA.
WHEREAS, the CITY desires the CONSULTANT to assist in assuring that the
CITY complies with all the necessary requirements as set forth in CHAPTER 163, Part
III Florida Statutes, and with its adopted Community Redevelopment Plan; and
WHEREAS, the CITY desires the CONSULTANT to assist the City of South
Miami in assuring that the it complies with all the necessary requirements as set forth in
Chapter 163, Part III, Florida Statutes as they relate to findings of necessity, community
redevelopment plans, tax increment financing, and redevelopment programs and
activities, and
WHEREAS, the CONSULTANT possesses the requisite skills, knowledge,
expertise and resources to perform these services.
NOW, THEREFORE, in consideration of the mutual terms and conditions,
promises, covenants and payments hereinafter set forth, the CITY and the
CONSULTANT agree as follows:
1. SCOPE OF SERVICES
A. The CONSULTANT shall serve in a technical capacity as required regarding
the implementation of the official SMCRA Plan and supporting programs.
B. The CONSULTANT shall serve as technical expert and financial advisor
regarding all aspects of redevelopment activities as they relate to the
establishment of tax increment financing mechanism, trust fund, and
Redevelopment Bond issues.
C. The CONSULTANT shall coordinate activities regarding the Interlocal
Agreement between Dade County and the City and serve as the CITY'S
lobbyist with the Miami -Dade County Board of Commissioners regarding the
Interlocal Agreement approval process.
D. The CONSULTANT shall serve as lead negotiator for the current proposed
redevelopment project related to SMCRA RFP &Q 98- 10 -01.
E. The CONSULTANT shall serve as technical advisor and financial advisor in
the development of the 1999- 2000/2000 -2001 biannual budget for the
SMCRA, working with staff and advising the SMCRA Board and Advisory
Board as needed.
F. The CONSULTANT shall serve in a technical capacity as required in the
preparation of the 1999 -2000 SMCRA Annual Report to the Auditor General,
the Department of Community Affairs, and the Miami -Dade County Board of
County Commissioners as directed.
G. The CONSULTANT shall attend SMCRA Board meetings as technical
advisor.
H. The CONSULTANT agrees to represent the CITY to private sector
development interests, assist in review and analysis of development
proposals, and provide presentations relating to potential development within
the CRA area as appropriate, and in conjunction with city staff.
L The CONSULTANT agrees to provide Redevelopment and Tax Increment
services in the manner and extent as determined by the Mayor and
Commission and the Office of the City Manager.
2. TIME FOR PERFORMANCE
The CONSULTANT agrees to perform all services in a timely and diligent manner upon
execution of this Agreement.
3. COMPENSATION AND METHOD OF PAYMENT
All payments will be made pursuant to the following schedule.
A. A monthly retainer payment of $5,000, which covers the cost of all travel,
lodging, and meal expenses, printing, secretarial services, and phone
expenses, for the completion of the tasks to be performed under this
contract, beginning June 12, 1999 and ending September 30, 1999. Total
payments under this contract shall total $18,166, at the rate of $100.00 per
hour for 50 hours per month.

4. OWNERSHIP OF DOCUMENTS
Reports, services and other data obtained or prepared in connection with the Agreement
are and shall remain the property of the CITY. The CITY and CONSULTANT shall have
the rights to any and all publication efforts resulting from reports, surveys and other data
obtained or prepared in connection with the Agreement.
5. TERMINATION
This agreement may be terminated by the CITY or CONSULTANT for cause or by the
CITY for convenience upon thirty (30) days written notice by the terminating party to the
other party of such termination in which event the CONSULTANT shall be paid its
compensation for services performed to termination date. In the event that the
CONSULTANT abandons this Agreement or causes it to be terminated, any application,

maps, work products and reports prepared by CONSULTANT pursuant to this
Agreement shall become the property of the CITY and shall be delivered by
CONSULTANT to the CITY.
6. NON - DISCRIMINATION
The CONSULTANT agrees that it will not discriminate against any of its employees or
applicants for employment because of their race, color, religion, sex or national origin,
and to abide by all Federal and State laws regarding non - discrimination.

(a) Code enforcement officers.

(l) Code enforcement officers are charged with enforcing the
30
occupational license, building, zoning, sign, and other
31
related: codes and ordinances of the city and all ordinances
32
of Miami -Dade County and statutes of the state of Florida
33
that the city is authorized to enforce.
34
(2) A "code enforcement officer" means any designated
35
employee or agent, including, but not limited to, code
36
inspectors and police officers, of the city whose duty it is to
37
enforce the applicable laws.

(b) Civil offenses. The violation of any applicable law shall constitute a
40
civil offense punishable by civil penalty in the amount prescribed in the
41
schedule of fines included in this section. Failure to correct a violation,
42
pay an administrative fee and fine, or otherwise comply with lawful
43
direction by the code enforcement officer or order of the code

enforcement board may subject a violator and, or, property owner to

civil actions taken in the name of the code enforcement board, upon
3
approval by the city commission, for, including, but not limited to,
4
declaratory and injunctive relief, order to abate a nuisance, to take
5
corrective action, to compel payment, to foreclose a lien on the property
6
that is subject to the citation or order, or to foreclose a lien on any
7
personal or other real property of the violator, or to take any other civil
8
action to compel compliance. The city is authorized to withhold the
9
issuance of any occupational license, land use and development
10
approvals, including, but not limited to,- zoning amendment, special
11
exception, variance, building permit, final inspection approval, and
12
temporary or finafcertificatc of occupancy and use until the violation is
13
corrected.

(c) Citations.
16

(l) A code enforcement officer is authorized to issue a civil citation to
18
a person when, based upon personal investigation, the officer has
19
reasonable cause to believe that the person has committed a civil
20
violation of an applicable law.
21
(2) A citation shall contain:
22
1. The date and time of issuance.
23
2. The name and address of the person to whom the citation is
24
issued.
25
3. The date and time the violation was committed.
26
4. The facts constituting reasonable cause.
27
5. The section or paragraph of the applicable law violated.
28
6. The name and authority of the code enforcement officer.
29
7. The procedure for the person to follow in order to correct the
30
violation and to request a compliance inspection by the code
31
enforcement officer.
32
8. The procedure for the person to follow in. order to pay the civil
33
penalty or to contest the citation.
34
9. The applicable civil penalty if the person elects to appeal the
35
citation,
36
10. The applicable civil penalty if the person elects not to appeal
37
the citation.
38
11. Whether the civil penalty is a one time fine and or daily
39
continuing fine.
40
12.A statement that if the person fails to pay the civil penalty
41
within the time allowed, or fails to appeal the citation, the
42
person shall be deemed to have waived his or her right to
43
contest the citation and that a lien may be recorded against the

property and the citation may be enforced by initiating an
2
enforcement action in county court.

(3) Continuing fines may be imposed for those violations which
4
remain uncorrected beyond the prescribed time period for
5
correction included in the civil infraction notice. For each day of
6
continued violation after the time period for correction has run, an
7
additional penalty in the same amount as the fine for the original
8
violation shall be added
9
(4) In cases of a repeat violation, or if the code enforcement officer
10
has reason to believe that the violation presents a serious threat to
11
the public health, safety or welfare, or if the violation is irreparable
12
or irreversible, the code enforcement officer does not have to
13
provide the person with a reasonable time period to correct the
14
violation prior to issuing a citation,: and may immediately issue a
15
citation and require immediate corrective action.
16
(5) A "repeat violation" means a violation of the same law by a
17
person, or by someone in contractual privity with the person, or by
18
a member of the person's immediate family, such as the person's
19
mother, father, brother, sister, ` son, daughter, or by someone
20
residing with the person, within the past five years.
21
(6) In cases where a violation. presents a serious threat to the public
22
health, safety or welfare, the code enforcement officer may also
23
request a special meeting of the code enforcement board and the
24 -
city manager for the purposes correcting the violation by, among
25
other things, providing oversight of the corrective action by the
26
violator or property owner, undertaking corrective action by the
27
city in response to the violation, authorizing legal action against
28
the violator and, or, property owner.

(d) Notice of civil infraction. Prior to issuing a citation, the code
31
enforcement officer shall give a' civil infraction notice as a courtesy to
32
the person that a violation of an applicable law has been committed and
33
shall establish a reasonable time period within which the person must
34
correct the violation. Where the violator is not the owner of the real
35
property on which the violation occurs, the code enforcement officer
36
may ' also give notice to the owner or the owner's agent or
37
representative. The time period to correct the violation shall not exceed

30 days. If upon personal investigation, a code enforcement officer
39
finds that the person has not corrected the violation within the time
40
period specified in the civil infraction notice, the code enforcement
41
officer shall issue a citation to the person who has committed the
42
violation, and may issue a citation of the owner of the real property, or
43
to the owner's agent or representative.

(e) Criminal penalty for willful refusal to sign and accept citation. Any
3
person who willfully refuses to sign and accept a citation shall be guilty
4
of a misdemeanor of the second degree, punishable as provided in
5
§ 775.082 or § 775.083, Florida Statutes.

{f} Appeals to code enforcement board.
8

_ (1) A violator who has been served with a civil citation shall ' elect to
to
either:
11
1. Pay the civil penalty in the manner indicated on the citation and
12
to immediately correct the violation; or
13
2. Request a hearing before the code enforcement board to appeal
14
the determination of the code enforcement officer which resulted
15
in the issuance of the civil citation.
16
(2) An appeal to the code' enforcement hoard shall be accomplished by
17
filing a written request with the code enforcement division of the

building department, identifying the citation by the citation number
19
or by the address indicated on the citation, no later than 20 days after
20
the service of the citation.
21
(3) Upon receipt of a timely request for a hearing, the code enforcement
22
division will schedule the appeal on the agenda for the next regularly
23
scheduled meeting of the code enforcement board. A notice of
24 -
hearing will be mailed by certified mail to the alleged violator's last
25
known address and, or, to the address of the property owner that
26
appears on the taX records.

(g) Hearings before code enforcement board.
29

(1) All hearings before the code enforcement board shall be conducted
31
as quasi- judicial hearings. All witnesses shall be sworn to tell the
32
truth under penalty of perjury. Although the Florida Rules of
33
Evidence shall not be applied to the proceedings strictly, due process
34
and fundamental. fairness shall be accorded to all alleged violators.
35
Hearsay testimony may be considered to give weight or credibility
36
to other evidence, but not order shall be entered based solely on
37
hearsay testimony,
38
(2) In determining appeals, the board shall determine whether:
39
1. the person and the property owner were properly served with the
40
civil citation and notice of hearing.
41
2. the citation adequately identifies facts constituting reasonable
42
cause and the section or paragraph of the applicable law violated.

3. The board shall consider all the evidence presented during the
2
hearing.

(3) The record shall consist of the code enforcement file, the testimony
4
of the code enforcement officer who issued the civil citation and any
5
other evidence accepted by the board.
b
(4) The code enforcement board shall base its determination on
7
substantial, competent evidence in the record and shall issue an
$
order containing a statement of facts, conclusions of law and order.

The order may affirm in whole or in part, or reverse, the charge of
.10
violation, affirm or modify the fine levied in the ticket, direct
11.
additional corrective action by the violator and, or, property, request
12
corrective action by the city, include the cost of repairs incurred, or
13
that might be incurred by the city, in correcting the violation, request
14
the initiation of enforcement proceedings and take any other action
15
consistent with the powers of the board
16
(5) An audio tape and written minutes 'summarizing the actions of the
17
board shall be made.

(h) Enforcement of orders and liens.
20

(1) At any time, the code' enforcement board, upon its own, at the
22
direction of the city commission, or upon request of any person, may
23
direct the enforcement of its orders, and respond to serious threat to
24 -
the public health, safety or welfare_
25
(2) In any action to enforce an order of the code enforcement board or
26
foreclose a lien, the prevailing party shall be entitled to an order
27
against the other party awarding its reasonable attorney's fees
28
incurred in all stages of the proceeding, and costs.

(i) Liens; priority and foreclosure of liens.
31

(1) A certified copy of an order imposing a fine may be recorded in the
33
public records of Miami -Dade County and shall, upon recording,
34
constitute a lien against the land or which the violation exists and
35
upon any other real or personal property owned by the violator.
36
(2) Liens shall be enforced by foreclosure in circuit court and subject to
37
the provisions contained in subsection ' 162.09(3), as amended,
38
Florida Statutes, provided, however, that the lien shall have the same
39
priority, effect and duration as a special assessment lien.

0) Appeals. An aggrieved party, including the violator, 'property owner,
42
local governing body, and property owners and tenants within 300 feet
43
of the property that is subject to an order of violation by the code

I enforcement board, may appeal the final order to the circuit court. In
2 the case of property owners and tenants, they shall have standing to
3 appeal to the circuit court only if they appeared at the hearing before the
4 code enforcement board and presented evidence in substantial
5 opposition to the final order of the board. The appeal shall not be a
b heating de novo but shall be limited to appellate review of the record.
7 An appeal shall be filed within 30 of rendition of the order.

9 (k) Notices. Notices shall be provided in the manner authorized by section
10 162.12, Florida Statutes, as amended, entitled "Notices."

12 (1) Schedule of fines. Fines shall be imposed for violations of applicable
13 laws as provided below. A fine shall not exceed $250 per day for a first
14 violation and shall not exceed $500 per day for a repeat violation, and,
15 in addition, may include all costs of oversight of repairs, costs of
16 repairs, and reasonable attorneys fees at all stages of proceedings and
17 costs defending appeals before the code enforcement board and in
18 prosecuting orders entered by the board. In the event the board finds
19 that a violation presents a serious threat to the public health, safety or
20 welfare, or the violation is irreparable or irreversible in nature, it may
21 impose a fine not to exceed $5,000 for each violation.

3 enforcement actions and lien foreclosure actions are ratified and are not affected by this
4 ordinance. This ordinance shall not apply to any notices of violation that were issued
5 prior to the effective date of this ordinance, except that actions to enforce orders of the
6 board, or to foreclose liens, resulting from the prior notices of violation, that are
7. commenced after the effective date of this ordinance shall comply with the procedures
K stated, herein.

10 Section 4. If any section, clause, sentence, or phrase of this ordinance is for any
I 1 reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
12 shall not affect the validity of the remaining portions of this ordinance.

14 Section 5. All ordinances or parts of ordinances in conflict with the provisions
15 of this. ordinance are repealed. All ordinances addressing restrictions on the powers of
16 the code enforcement board to compromise fines and settle legal actions are repealed.
