PUBLIC REMARKS COMMISSION REMARKS REGULAR CITY COMMISSION 4 AGENDA - January 18, 2000 CITY OF SOUTH MIAMI INTER - OFFICE MEMORANDUM REQUEST DATE: January 18, 2000 SUBJECT: Agenda Item # Commission Meeting, January 18, 2000 AUTHORIZATION FOR THE CITY TO DONATE THREE "DEADLINED" CITY VEHICLES TO THE CITY OF S WEETWATER. The attached resolution seeks approval for the City to donate three "deadlined" Ford Crown Victorias to the City of Sweetwater. BACKGROUND The City's fleet of vehicles include older model police cars that have been decommissioned from police use, and are transferred to other municipal departments (e.g., for use as administrative staff cars, Code Enforcement vehicles, Public Works vehicles, etc.) until such a time that they are no longer operationally viable. At that point, due to the age and mileage of these vehicles, they are "deadlined" and set aside for auction. However, because of the poor condition of these vehicles, they have minimal value. Attached is a memo that lists the current inventory of deadlined vehicles. PROPOSAL The City of Sweetwater has requested an emergency donation of three of these deadlined vehicles for use as parts. Specifically, they need two (2) 1992 year model and one (1) 1991 year model Ford Crown Victorian. It is proposed to donate Vehicle No. 92 -03, 92 -04, and 91 -13 (as identified in the attached memorandum to the City of Sweetwater). BACKGROUND The Sargent exit push bar assembly on this door (leading to the lobby where the communications room window is located) requires replacement to ensure the door's full functioning. After an attempt to repair the push bar assembly was unsuccessful, two locking system vendors assessed condition of the assembly. While the two firms agree on the type of repair required, only Sargent Inc. is able to furnish the specific system that is used all over the station building. ANALYSIS Sargent is the sole source manufacturer of the high security lock assemblies in use throughout the building. The required assembly will be purchased and installed by Dade Lock and Key, the vendor typically used by Public Works. The push bar assembly is a "special order" item, requiring approximately eight weeks for delivery and installation (refer to attached quotations). BACKGROUND Introduction and Site Description: The applicant is proposing to build a new two story mixed use building at the southeast corner of Sunset Drive and 58th Avenue. The rectangular shaped property is located at 5796 Sunset Drive and has an area of 5,700 square feet or 0.13 acres. The property currently has a vacant one story lath and plaster building with a courtyard facing Sunset Drive. The existing structure is considered to be a "contributive building" due to a number of significant architectural and design features such as the building face defining public space, presence of the court yard, use of water feature, use of low wall to delineate public and semi- public spaces. However, the construction methods and the structural design of the existing structure do not meet any of the current building codes. The structure is deemed to be unusable because of its inability to be brought up to the present day code and would have to be demolished to make way for a new structure. The proposed project is a two story mixed use building that includes Starbucks Coffee, specialty retail and office 5796 Sunset Drive special exception Page 2 of 6 space. The "L" shaped building is designed to provide a courtyard in the same location as the existing courtyard. The courtyard features shade trees, a low masonry wall, water feature and landscaping. The Land Development Code specifies that construction in the Hometown District must comply with the regulations established for the district. The City Commission may, by special exception after a public hearing by the Planning Board, waive strict compliance of the District provisions. The Planning Board must find by substantial, competent evidence that: (a) The proposed development contributes to, promotes and encourages the improvement of the Hometown District and catalyzes other development as envisioned in the Hometown District regulations; (b) The proposed development is compatible with the land use and development intensities prescribed by all applicable City regulations; (c) The proposed development must possess integrity of design compatible with design criteria established for the Hometown District and with the overall image of the city; (d) The proposed development shall be designed in a manner that provides for effective management of traffic (vehicular and pedestrian), parking, lighting , noise, and waste generated by the development, and for management of the impacts of the development on public facilities and services; (e) The proposed development does not expand the permitted uses within the Hometown District; (f) The proposed development will not have an unfavorable effect on the economy of the City of South Miami; (g) The proposed development, when considered cumulatively with other development, both present and future, within the Hometown District, will not create excessive overcrowding or undue concentration of population. Project Analysis: Staff's analysis of the project for consistency with the above criteria is as follows: (a) The proposed development contributes to, promotes and encourages the improvement of the Hometown District and catalyzes other development as envisioned in the Hometown District regulations. The proposed development provides a mix of uses that create a strong pedestrian oriented building edge along the sidewalk. It contributes to and encourages similar the improvements of other developments as envisioned by the Hometown District regulations. The existing building has been vacant for over a year and is its deteriorating condition is detrimental to the overall economic and physical health of downtown. The project enhances the sense of place by providing ground level pedestrian oriented activities, providing pedestrian related amenities such as a courtyard facing Sunset 5796 Sunset Drive special exception Page 4 of 6 Drive, and the use of projecting balconies, awnings and street trees to provide protection from inclement weather. ° The proposed development will help reduce local commuter traffic demand of the area by providing a mix of uses that will be primarily utilized by the people that are already in the area. The proposed development provides the required parking spaces based on the code requirements after the Hometown District parking incentives is applied. (b) The proposed development is compatible with the land use and development intensities prescribed by all applicable City regulations. All the proposed uses are allowed by the code and the development is within the prescribed FAR and the height limitations of four stories/ 56 feet. (c) The proposed development must possess integrity of design compatible with design criteria established for the Hometown District and with the overall image of the city. The proposed development has received conceptual approvals of the Environmental Review and Preservation and the Historical Preservation Boards. The scale and the architectural treatment of the project reinforce the pedestrian character of Sunset Drive and 58th Avenue. (d) The proposed development shall be designed in a manner that provides for effective management of traffic (vehicular and pedestrian), parking, lighting, noise, and waste generated by the development, and for management of the impacts of the development on public facilities and services. The applicant has completed the concurrency evaluation for traffic. The evaluation indicates that there are adequate roadway capacities to support the development. The proposed development will be required to dedicate 5 -feet along 58th Avenue at the time a building permit is requested. This additional dedication will allow for on street parking and realignment of the sidewalk along east side of 58th Avenue. The applicant has obtained Sewer Capacity Certification from Miami Dade County Department of Environmental Resources Management (DERM). Solid waste generated by the development is contained within the site. All storm drainage related issues, on and off site will be addressed and designs have to comply with the requirements of the South Florida Building Code at the time of issuance of building permit. Other County concurrency requirements and impact fees for items such as fire, water, schools will have to be satisfied by the developer during the permitting process. (e) The proposed development does not expand the permitted uses within the Hometown District. All the uses proposed are permitted within the Hometown District. (f) The proposed development will not have an unfavorable effect on the economy of the City of South Miami. 5796 Sunset Drive special exception Page 5 of 6 Due to the under utilization and the present condition of the property, the proposed development will substantially increase the tax base generated by the property. (g) The proposed development, when considered cumulatively with other development, both present and future, within the Hometown District, will not create excessive overcrowding or undue concentration of population. The development is within the prescribed regulations for development density, height and use. The suggested mix of uses of the development will not create excessive overcrowding or undue concentration of population that is beyond what is envisioned within the Hometown District. Staff generally finds the requests for Special Exceptions meet the intent of the Hometown District Overlay Ordinance and the requirements set forth in the Land Development Regulations for granting such exceptions. The special exception request to reduce building frontage along Sunset Drive is necessitated by the presence of the courtyard. The staff believes that the courtyard is an important urban element having a contextual significance to the City's past and therefore must be incorporated in the design of the project. The special exception to increase the building depth on the side street is a result of the linear shape of the building along 58'�' Avenue. This condition is created by the placement of the courtyard on Sunset Drive as opposed to the rear of the property as is generally envisioned by the Hometown Plan. The third request to build cantilevered balconies in lieu of the required arcade along Sunset Drive is due to the conflict between the South Florida Building Code (SFBC) and the City's Land Development Code (LDC). SFBC does not currently allow obstructions such as columns to be placed on the public right of way. The cantilevered balconies provide the same intended functions as that of arcades. The development: (a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; (b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and (c) Complies with all other applicable Code provisions. The staff also finds that the requests for special exception do not conflict with the adopted Comprehensive Plan of the City of South Miami. In fact, the development furthers many of the goals of the Future Land Use Element of the City's adopted Comprehensive Plan, including, preservation of the City's small town character, the encouragement of pedestrian oriented developments as envisioned by the Hometown Plan, and increasing the tax base to provide a high level of municipal services. Board Actions: At the request of the applicant the Historic Preservation Board at its meeting of November 29 1999 gave permission to demolish the existing structure. The Board strongly recommended that any new construction on this site maintain some of the architecturally significant elements that made the property "contributive ". These elements are, but not 5796 Sunset Drive special exception Page 6 of 6 The project was presented to the Planning Board on January 11, 2000. The Board, at great length, discussed the viability and the appropriateness of four (4) on street parking spaces on 58th Avenue along the frontage of this property due to the concern about the congested condition at the intersection of Sunset Drive and 58th Avenue. As a compromise, the Board recommended pushing the sidewalk further back to align with the existing sidewalk in front of Hanging Basket. After conducting a public hearing the Planning Board considered the request for three special exceptions. The Board through substantial competent evidence found that the application meets the criteria set forth in the Land Development Code for granting special exceptions. The Planning Board adopted a motion (4 -0) to recommend to the City Commission the waiving of the strict compliance of regulations as requested with certain conditions that have been incorporated into the staff recommendations. RECOMMENDATIONS The staff recommends approval of the all three of the special exception requests subject to the following conditions: • Providing a lease agreement, satisfactory to the City, for the required parking before any demolition or building permit is issued. • Providing enclosed and air- conditioned trash room at least for the restaurant ( Starbucks). • - The sidewalk along 58th Avenue along the side of the project is aligned with the sidewalk located in front of the Hanging Basket. • Sidewalk and on street parking should be configured in a manner not to aggravate the traffic movement at the intersection. Note: At the request of the Planning Board member Ms. Gibson the representative of the Starbucks made a commitment to hire local residents as employees at this location. ( "Starbucks "), the contract lessee of property located in the City addressed as 5796 Sunset Drive and located at the Southeast corner of Sunset Drive and SW 58th Avenue. The zoning application contemplated by Starbucks and the property owners at this location has been previously submitted, together with plans as prepared by Chael Cooper & Associates, P.A. A traffic /concurrency analysis and utility information will be provided separately to the City. The purpose of this letter is to outline the variances from the Land Development Code ( "Code ") of the City of South Miami, and the public policy reasons why we believe that these requests should ultimately be approved by the City Commission. In lieu of the 100% building requirement along this line, a 30% placement on the "Build -To Line" requested. The subject property contains a contributive structure, pursuant to the Hometown Overlay Ordinance and the Future Land Use Element of the Comprehensive Plan of the City of South Miami ( "Comprehensive Plan "). This designation certifies that the subject property contains structures and design elements that have the highest priority for preservation in the Comprehensive Plan. Unfortunately, due to the condition of the existing building on the subject property and the financial and practical infeasibility of bringing the building into compliance with the provisions of the South Florida Building Code, the building cannot reasonably be rehabilitated. In lieu thereof, however, City staff has noted that the contributive significance of the subject property stems not only from the placement of the existing building on the "Build -To Line ", but from the existing courtyard between the subject building and the easterly adjacent commercial area dominated by the First National Bank of South Miami. This courtyard provides architectural, historic, and contextual significance to the City's past. City staff has indicated ,a desire to maintain the courtyard in any future development of the subject property and to incorporate the design features within the City's Hometown District Overlay Ordinance, as a means of providing a bridge between the contextual importance of the courtyard and the future development goals of the City as espoused in the Hometown District Overlay. Accordingly, the applicants have proposed a two -story structure (as required in the Hometown Plan) to be developed on the "Build -To Line ", with the balance of the Sunset Drive frontage preserved in its current open space, courtyard character. In doing so, the applicants have complied with the goal of creative mixed use development in Policy 1.5.1 of the Land Use Element of the Comprehensive Plan, by not only proposing a mixed use project but by retaining the current creativity and form of the courtyard design. In addition, the courtyard, as enhanced by the proposed development, will advance the pedestrian character of the Sunset Drive commercial area in accordance with Goal 2 of the Land Use Element of the Comprehensive Plan. The existing courtyard feature is unique to the subject property along the Sunset Drive commercial corridor, and its retention precludes the use of the property in a manner consistent with the Hometown District Overlay portion of the Code. This request logically accompanies the reduction in development along the Sunset Drive "Build -To Line". Without building development along the street on the Sunset Drive portion of the property, the applicants' ability to create a mixed use development consistent with the Code and Comprehensive Plan is severely limited. The subject property is only about 5,700 square feet in size, one of the smallest commercial properties in the Sunset, Drive commercial corridor, and the placement of the existing building on this historically significant property justifies its redevelopment with a similar building footprint. The applicants will dedicate a portion of their already limited property for additional parking on the east side of SW 58 Avenue, thereby providing the infrastructure needed to serve its development. Rather than orienting pedestrians into the project along SW 58 Avenue, it is more desirable to provide the focal point of the project in the courtyard along Sunset Drive, South Miami's "main street" business center. In effect, the courtyard retention and the required dedication of additional right -of- way for SW 58 Avenue create a situation where compliance with the side street building depth limitation would preclude even the reasonable use of the subject property. The applicants also request a special exception from Section 20 -7.7 of the Code to permit a cantilevered balcony at the front of the Starbucks project in lieu of an arcade as contemplated in the Code. This request is sought as a result of a conflict between the Code requirement that the arcade extend beyond the "Build -To Line," and the provisions of the South Florida Building Code prohibiting columns to be placed in the public right -of -way. This conflict also precludes the encroachment of habitable spaces on upper floors over the arcade into the public right -of -way of Sunset Drive. The applicants have addressed the above conflict by designing a public space in front of Starbucks in the form of a cantilevered balcony, with outdoor seating on the upper level. This solution incorporates the City's goal of providing pedestrian continuity along Sunset Drive, in a covered walkway design. In addition, the solution provides a public gathering space on the second level, further enhancing the proportion of outside public meeting spaces to property size that is unique for this parcel along the Sunset Drive commercial corridor. The traffic Concurrency analysis summarized in this letter uses information from the City's Comprehensive Plan as well as procedures and data provided through Miami -Dade County's concurrency management system. Data contained herein updates our November 23 and December 28, 1999, letter reports to include trip information about recently approved developments in the area as well as the final set of square footage allocations among uses proposed at the Starbucks multi -use site. Existing or as of right uses at the Starbucks site have been ignored. Additionally, a considerable portion of the walk -up patronage that would logically be anticipated for this type of development within a downtown setting is treated as arriving by automobile in a suburban location. These and other assumptions used provide a conservative analysis of roadway Concurrency (i.e., some overestimation of new vehicle traffic generated). Proposed Development The 6,095 sf project will be located on the south side of Sunset Drive.near the center of the City's downtown eonunereial area. The proposed uses in a two -story structure are (1) a 1,982 sf Starbucks restaurant, (2) 1,456 sf of specialty retail use, and (3) a 2,657 sf office. Existing Roadway Network The attached Exhibit 1 shows the location of the site in relation to major roadways in the inunediate area. The three major roadways providing principal access for downtown South Miami and for the site are South Dixie Highway (US 1), Sunset Drive (SW 72nd Street) and Red Road (SW 57 "' Avenue). Site Traffic Generation Data from the Institute of Transportation Engineers' (ITE) Trip Generation sixth edition was used to estimate daily and PM peak hour traffic generated by the multi -use site. To provide a conservative analysis with possible overestimation of site traffic, the potential for some internal satisfaction of trips among the different users at the site as well as between these site uses and multiple other uses within reasonable walking distance of the site were ignored. Jerry B. Proctor, Esq. January 12, 2000 Page 3 The ITE manual provides various rates and equations for estimating traffic for office uses, specialty retail and various categories of restaurants. The ITE information was used directly in estimating traffic to be generated by the office and specialty retail components of the site. However, coffee shops are not a specific category of use listed by ITE, so other land uses which would be expected to have some of the same,basic trip generation characteristics as a Starbucks were investigated. The ITE land use category under which Starbucks would be classified is a high - turnover sit -down restaurant. However, a Starbucks might also exhibit some of the trip generation characteristics similar to fast food restaurants or convenience stores, particularly during the AM street peak periods but to a much lesser degree during the PM street peak periods. These variations would also affect daily trip rates. The ITE trip generation characteristics of these other uses, as well as for high - turnover restaurant were investigated. To provide a conservative analysis with potential for overestimating trip making, the ITE daily rates for high- turnover restaurant were increased 50 %, and the PM peak hour rate was increased 20% for making trip generation estimates for the Starbucks component of this development. ITE recognizes that. not all trips generated by retail and restaurant uses (i.e., patrons through the door) are necessaa7ly new trips generated onto and impacting the adjacent roadway network. Some patrons are already traveling on the adjacent street for another or associated primary trip purpose, Thus, ITE recognizes that some reduction should be made for this pass -by trip phenomena for those land uses susceptible to this condition. As applied to the Starbucks development, for example, it is easy to imagine a commuter on his journey to work stopping temporarily enroute to pick up a cup of coffee, or a commuter who works in downtown South Miami walking into Starbucks for cup of coffee to carry to the workplace. Update materials to the fifth edition of ITE's Trip Generation explore this topic for shopping centers, restaurants, convenience marts, etc. The pass -by traffic component can be significant. For purposes of this analysis, only a 10 %pass -by component for the specialty retail use is applied to daily and PM peak hour traffic, ITE data for larger retail facilities is two to six times this value. No trip adjustment is made for the development's office component. All office traffic generated is assumed to be new primary trips. For the Starbucks restaurant component of this development, ITE trip data for fast food restaurants show only 29% are primary trips, while 24% are diverted trips and an average of 47 % are pass -by during PM peak hours. For high- turnover sit -down restaurants the percentages are slightly different; 28% primary, 32% diverted- linked trips and 40% pass -by. For convenience markets, only 16 % of the trips to and from the sites during the PM peak hour are primary trips, an average of 18% are diverted- linked trips and 66 % are pass -by. For this analysis, a modest 20 % pass -by rate is used for PM peak hours, and 30% for daily traffic generated by the Starbucks component, Jerry B. Proctor, Esq. January 12, 2000 Page 4 Empirical data reported by ITE regarding trip generation is overwhelmingly drawn from land uses situated in suburban locations, not downtown areas. Further, most trip generation data is for stand- alone facilities that have limited transit service. Due to the proximity of Metrorail service along the South Dixie Highway corridor and given the location of this development in a downtown commercial setting, a modest 5% reduction to ITE values is used in estimating the net new traffic that will be generated by the proposed development onto the surrounding arterial street network and passing through the traffic concurrency stations shown is Exhibit 1. The modest reduction will result in a conservative traffic concurrency analysis (i.e., likely overestimation of vehicle traffic generated). Table 2 summarizes the net calculation of new daily.and PM peak hour traffic estimated to be generated by the three land use components of the proposed development. The information on the cardinal distribution of traffic for the County's traffic analysis zone in which this project is located (TAZ #915) is indicated in Table 3. This information, coupled with known characteristics of the surrounding street network, is used in assigning the site's 335 daily and 28 PM peak hour external trips to specific roadways and through the traffic concurrency monitoring stations in the immediate area. The project trip assignment to specific traffic concurrency stations and the resulting available trip reserve after project trips are deducted are shown in Table 4. Jerry B. The transportation network sites analyzed in this concurrency evaluation and the analysis techniques used are consistent with the sites monitored and the procedures used by governmental agencies. The transportation network sites monitored have sufficient capacity (trip reserve) to absorb the additional new traffic to be generated by the multi -use Starbucks development. A letter from a member of the public, Mr. Peter Previti, supporting the project, and a letter from Hometown Station, Ltd., serving as notice of intent to enter into a parking agreement with the property owners, were both entered into the record. Public hearing was opened. Members of the public who spoke in favor of the item included Mr. David Tucker, Sr., and Ms. Karen Dorfinan. No one was present to speak in opposition to the project. Public hearing was closed. The Board voted on the matter. Motion: Mr. Illas moved approval of the request involving the special exceptions, based on the conditions (1) that the trash area be, or that trash disposal take place in, an air- conditioned container; (2) that the curb be re- aligned and the existing power pole be relocated; (3) that the parking spaces be moved over to the east and the number of parking spaces remain as shown. Report on recent City Commission action appointing a Zoning Task Force to assist in a comprehensive review of the City's Land Development Code. Staff related that the City would be forming a Zoning Task Force for future review of the Land Development Code (LDC), per resolution adopted by the City Commission in December 1999. The Board expressed concern that the area of the City west of US 1, such as the CRA, be adequately represented on the task force. V. BACKGROUND & ANALYSIS The City of South Miami issued the Request for Proposals in June 1997 for the municipal parking lot located at SW 73rd Street and SW 58th Avenue. In September 1997 the City Commission awarded the proposed project for the design, construction, leasing and management of the mixed -use development and parking garage to SPG Phase One. The Project has experienced a number of delays. On September 7, 1999 a Lease Agreement was presented to the Commission and approved on first reading. On October 14, 1999 SPG presented an enhanced project that once again included the Richman property. The enhanced project was to then be presented to the Planning Board and ERPB and brought back to the Commission for second reading and public hearing. However, on November 11, 1999, SPG advised the City that the project, as proposed, was not financially feasible and that, as soon as the financial implications of the market condition were fully analyzed that a modified project would be submitted. In December 1999 SPG submitted the modified proposal. The new proposal adds approximately 30,000 SF of office space to the third and fourth levels. The first (ground) level remains primarily retail. The second level and roof remain exclusively parking. The modified proposal poses an interesting set op public policy considerations regarding the downtown parking supply. Subrata Basu at the Commission Meeting will present these considerations. Luis Figueredo of the City Attorney's Office has prepared a memorandum outlining the proposed framework for the Lease agreement. This memorandum contains all of the major provisions we anticipate in the Lease. However, as of the date of this memorandum, a draft of the revised Lease Agreement has not been received by the City from SPG. Counsel has agreed to work over the holiday weekend, but it is unclear when the document will be received by the City and whether it will be completed in time to present to the Commission at the January 18 meeting. During review, particularly in consideration that both proposals were rated closely in total number of points, Mayor Price inquired as to whether both teams had the ability to successfully complete the project, and Mr. Salmon responded affirmatively. d. BACKGROUND AND ANALYSIS The City of South Miami issued the Request for Proposals in June 1997 for the municipal parking lot located at SW 73`d Street and SW 58`h Avenue. In September 1997 the City Commission awarded the proposed project for the design, construction, leasing and management of the mixed -use development and parking garage to Phase 1, Inc. The finalization of the contract and implementation of the project have been delayed due to a number of factors. The City Manager set a deadline date of January 30'h, which was subsequently extended to February 28` , to resolve all issues and conclude negotiations. All parties, with the assistance of Commissioner Oliveros, have come to the table and we now believe that all outstanding issues have been resolved. The attached Proposed Framework outlines all of the major parameters of the Lease Agreement for the project. These parameters include a definition of the project, payments to the City, term of the lease, exercise of a lease extension option, air rights development on the adjoining Richmond parcel. financing, signage and a number of other issues. If approved by the Commission the full Lease Agreement will be placed for first reading on the next Commission Meeting. SPG has been advised and understands that .the terms conceptually agreed to are not binding and must be approved by the City commission. 1. Ground Lease. The City, as landlord, and SPG, as tenant, shall enter into a ground lease (the "Lease ") for a parcel of land. (.70 +/- acres) currently used as a municipal parking lot. owned by the City and bounded by S.W. 73'd Street on the south S.W. 58`h Avenue on the east, S.W. 58`h Court on the west and an alleyway on the north (the "Land "). 2. Development. SPG will design, construct, lease, manage and operate a 4 story mixed use retail and garage parking facility comprised of approximately 20,000 ( + / -) square feet of retail space and approximately 378 parking spaces (the "Facility "). SPG shall be responsible for all costs of building the Facility, and the City shall not be responsible for paying any such costs. J. Minimum Rent. SPG shall pay the City $44,000 per year as minimum rent in equal monthly installments. The payment of Minimum Rent shall commence when the City turns over possession and control of the Land to SPG. 4. Additional Rent. SPG shall pay the City an amount equal to five (5 %) percent of the gross income derived from the retail space rental (exclusive of standard tenant pass through expenses such as real estate taxes and insurance) and parking income. 5. Supplemental Rent, Ownership of the Facility, and Ad Valorem Taxes. The Citv shall own the Facility as provided in Paragraph 6 below. Fifty (50 %) percent of the ad valorem real property tax savings from City ownership of the Facility shall be paid by SPG to the City as "Supplemental Rent." SPG shall assure itself that no portion of the real Page 1 of 4 property and improvements will be subject to ad valorem taxation. The City agrees to cooperate with SPG in obtaining appropriate tax rulings with regard to ad valorem tax savings. SPG shall bear the risk and all responsibilities for an adverse decision. 6. Documentary Stamp Tax. Due to the documentary stamp tax on the transfer of the Facility from SPG to the City, the parties agree that: SPG shall build the Facility on behalf of the City so as to not - incur documentary stamp tax. 7. Amenities Fee. SPG shall pay a 1.5% amenities fee which the City recognizes SPG will satisfy with the design elements to be incorporated into the Facility. 8. Term. The initial term of the Lease shall be thirty (30) years with one option to extend the term of the Lease, for an additional twenty (20) year period. 9. Exercise of Lease Option. The City Commission shall vote whether to exercise the lease extension option (effective at the conclusion of the original thirty (30) year term) prior to the commencement of year twenty eight (28) of the Lease. At that time the City shall have the following options: (i) Exercise the lease option extending the term of the original lease an additional twenty years; or Compensate SPG for the value of the improvements of the MRP Properties Air Rights and net present value of the projected revenues which would be lost by SPG if the lease is not extended. The appraisals for the value of the development of the MRP Properties Air Rights and lost revenues shall be conducted in accordance with the then prevailing industry standards. The City and SPG have agreed to each select one appraiser. The two appraisers shall select a third appraiser. The three appraisers shall determine the net present value of the revenues as well as the value of the MRP Properties Air Rights and provide the Commission and SPG with one report. If the two appraisers cannot agree, the City and SPG agree to be bound by an independent appraisal prepared by the third appraiser. 10. MRP Properties Building and Air Rights. SPG will cause the air rights ( "Air Rights ") over the MRP Properties` site property (located at the corner of 58`h Court and 73`d Street) to be deeded to the City as provided in the separate development agreement between SPG and MRP Properties (the ` "MRP Properties Agreement "). Page 2 of 4 11. Financing. SPG shall procure a construction loan to build the Facility from an institutional lender which provides such loans in the normal course of business. The construction loan shall be replaced by permanent financing within 15 months of SPG obtaining the certificate of completion for the Facility. 12. Alleyway Issue. The City and SPG shall cooperate with each other to resolve the alleyway issue on the north side of the land to their mutual satisfaction. 13. Security. SPG shall cause its contractor to provide the City with a Payment and Performance Bond with a good and sufficient surety, naming the City as an obligee in a commercially acceptable form.. 14. Signage. Signage on the Facility shall comply with the applicable codes of the City and any other jurisdiction having authority. The City shall be responsible for providing way- finding signs (not on the Facility or Land but in the vicinity of the Facility). 15. Environmental. SPG has performed, at its cost, a Phase One Environmental Assessment of the Land. SPG advises that the Phase One Environmental Assessment has shown no adverse environmental conditions. 16. Late Payments. Maximum penalty is (5 %) of amount overdue. 17. Insurance. SPG will carry the typical forms of insurance normally associated «ith a project of this type. 18. Excess Payments. Project Overview: In November of 1992, members of the community gathered for a public "Charrette" or a design workshop on the future of the downtown area. The design workshop included several days of around- the -clock design sessions and discussions. This public process brought together people from all segments of the community, professionals from all levels of governments and a diverse group of consultants to develop a common vision for the downtown. This common vision is called the Hometown Plan which later was codified in the Hometown. District. The plan is based on the concept that like a traditional, small -town downtown, South Miami downtown ought to be a neighborhood where a full range of uses exist and are juxtaposed to create a synergy that brings life and vitality to downtown. The plan is based on the concept that the streets belong to people and the awareness of how individual buildings relate to each other and how users collectively interact with the sidewalk and the street will determine the success of creating people friendly streets and public squares. The plan identified a series of "Initial Projects" to act as catalyst for re- development. 3. REQUEST FOR PROPOSAL REQUIREMENTS AND GENERAL INFORMATION A. Unified Development: The City is soliciting proposals from private developers or individuals who can provide the City with an integrated improvement package including but not limited to planning, design, construction, leasing and management for the City -owned property currently occupied by the municipal metered parking lot. B. Commitment of Funds: The City shall provide no direct or indirect financing to the development. The City will enter into a long -term property lease agreement with the successful developer for an annual rent payment which may be comprised of a minimum guaranteed rent and a percentage rent based on gross revenues. SPG's opinion was based in part upon its perception of the current lack of parking demand in South Miami. In light of the foregoing, SPG met with City staff and inquired whether the City would be receptive to an alternate proposal. SPG's revised proposal incorporates office space to further diversify the mixed uses in the proposed structure. I. PHYSICAL STRUCTURE The proposed structure would cover the City parcel of land which is currently used as a municipal parking lot founded by S.W. 73rd Street on the south S.W. 58th Avenue on the east S.W. 58th Court on the west and an alley way on the north (the City property) and the air rights over the Mark Richmond property. The building will be four stories. The revised SPG proposal now consists of 19,350 square feet of retail space, 35,000 square feet of office space and 332 parking spaces. The first floor will consist of retail space. The first floor (excluding the Richmond property) will contain approximately of 19,530 square feet of retail space and four parking spaces. The second floor will contain 108 metered parking spaces. The parking revenues of 73 of the metered spaces will go directly to the City. The revenues from the remaining metered spaces on the second floor will be paid to SPG. The City, however, will receive a portion of those revenues as percentage rent. The third and fourth floors will each contain 17,500 feet of office space and 56 parking spaces which will be used by those offices during the day. SPG originally committed to pay $44,000, per annum, to the City as base rent. However, current revenues generated by the municipal parking lot exceed $44,000. In light of the foregoing, the City Commission directed staff during a City Commission meeting to increase the base rent to $76,000 per annum. In lieu of the base rent, SPG now proposes to dedicate the revenue from the 73 metered spaces to the City in an effort to make the City whole for lost revenue from the municipal parking lot. SPG has agreed to install the meters for the 73 spaces at its own expense. The City will receive "percentage rent" of the net revenue from the retail and office space and the 259 parking spaces not controlled by the City. All retail and office leases (including parking associated with the office space) will be triple net (i.e., tenant pass - thru's for real estate taxes, insurance and operating expenses will not be counted for purposes of percentage rent so that the net revenue as to those spaces will be identical to gross revenue received by SPG). The percentage rent will be payable according to the following schedule. SPG Revenue Percent Up to $1,309,800 2.5% Amounts in excess of $1,309,800 7.0% SPG's original proposal provided that SPG would pay the City an amount equal to 5.0% of the revenues received by SPG. SPG now contends that if SPG has to pay the City 5.0% of its revenues, the percentage rent together with the added expense of acquiring the Richmond airspace and construction over the airspace no longer makes the project sufficiently viable to qualify for institutional financing. SPG advises that its financing is dependent on showing a ten percent (10 %) return on equity and 1.20 debt coverage ratio. SPG contends that if it has to pay the City 5.0% of its revenues, it will not meet those thresholds. Based upon our evaluation of SPG's financial projections we have concluded that SPG should realize a 10% return on its equity and a 1.20 debt coverage ratio if it pays the City 2.5% of the first $1,309,800 of revenue realized by the project. At that juncture, SPG would show a 10% return on its equity and an adequate debt coverage ratio. Thus, SPG would presumably be in a position to provide the City with a larger interest in fee sharing in all revenues over and above $1,309,800. SPG has agreed to provide the City with a 7.0% percentage interest in all revenues which exceed $1,309,800. Memorandum to Charles Scurr, City Manager January 14, 2000 Page 3 of 4 The threshold where the City's 7.0% interest in all revenue above $1,309,800 would begin to generate a greater amount of rent than a 5.0% interest in all revenue is approximately $3 million dollars. Under SPG's original proposal, 5.0 %, of $3,000,000, would result in the City receiving $150,000 in additional rent. The revised proposal which is designed to allow SPG to obtain project financing would yield the City $151,059 in additional rent. III. CONSTRUCTION OF FOUNDATION SPG has agreed to construct the foundations of the parking structure to support two additional levels of parking should demand in the future require additional parking. IV. MINIMUM RENT DURING CONSTRUCTION SPG advises that any payment of rent during the twelve month construction period will not allow it to meet the debt coverage ratio required to obtain institutional financing. In lieu of a minimum payment of rent during the twelve month period, SPG proposes to make office space owned or secured by SPG's principal available to the City for a nominal charge. While staff has reached a conceptual agreement with SPG to accept office space in lieu of minimum rent for the twelve month construction period, the terms, conditions and the amount of office space to be made available, will be negotiated if the Commission approves this proposal. SPG has agreed to pay the City a minimum rent of $76,000, per annum, if it does not complete construction of the parking structure within the agreed upon construction schedule. SPG, however, shall not be required to begin making rental payments if the delays are attributable to the City. V. LEASE AGREEMENT As of this date, we have not yet received SPG's first draft of the lease agreement. However, we anticipate that the lease agreement will provide for the following: A. Initial Term. The initial term of the lease will be for 30 years, with one option to extend the term of the lease for an additional 20 year period. However, if the charter amendments allowing the City to enter into a lease agreement for a 50 year term is approved, the term of this lease agreement will be extended to one 50 year term with no option to extend the term of the lease. B. Ownership Of The Building. SPG will deed the structure including the airights over the Richmond property to the City on or before the end of the lease term. SPG shall procure a construction loan from an institutional lender which provides such loans in the ordinary course of business. The construction loan will be replaced by permanent financing within 15 months of SPG obtaining a certificate of completion for the facility. D. Security. SPG shall provide the City with a payment and performance bond with a good and sufficient surety, naming the City as an obligee and a commercially acceptable form. E. Signage. Signage on the facility shall comply with the applicable codes of the City and any other jurisdiction having authority. The City shall be responsible for providing way finding signs (not on the facility or land but in the vicinity of the facility). F. Late Payments. The maximum penalty of 5.0% of the amount overdue. G. Substation. SPG shall dedicate office space to the City in the parking structure. H. Availability of Parking in Evening Hours and Weekends. SPG has agreed to make available, under conditions and limitations to be agreed on, the non - metered parking on nights and/or weekends required by the City. The conditions and limitations to be agreed on reflect liability and control factors. Any costs associated with providing these parking spaces will be "netted -out" before application of the percentage rent. BACKGROUND Introduction and Site Description: The applicant is proposing to build a new two story mixed use building at the southeast corner of Sunset Drive and 58th Avenue. The rectangular shaped property is located at 5796 Sunset 'Drive and has an area of 5,700 square feet or 0.13 acres. The property currently has a vacant one story lath and plaster building with a courtyard facing Sunset Drive. The existing structure is considered to be a "contributive building" due to a number of significant architectural and design features such as the building face defining public space, presence of the court yard, use of water feature, use of low wall to delineate public and semi - public spaces. However, the construction methods and the structural design of the existing structure do not meet any of the current building codes. The structure is deemed to be unusable because of its inability to be brought up to the present day code and would have to be demolished to make way for a new structure. The proposed project is a two story mixed use building that includes Starbucks Coffee, specialty retail and office space. The "L" shaped building is designed to provide a courtyard in the same location as 5796 Sunset Drive special exception Page 2 of 6 the existing courtyard. The courtyard features shade trees, a low masonry wall, water feature and landscaping. To allow for a cantilevered balcony in lieu of a required arcade on Sunset Drive. The Land Development Code specifies that construction in the Hometown District must comply with the regulations established for the district. The City Commission may, by special exception after a public hearing by the Planning Board, waive strict compliance of the District provisions. The Planning Board must find by substantial, competent evidence that: (a) The proposed development contributes to, promotes and encourages the improvement of the Hometown District and catalyzes other development as envisioned in the Hometown District regulations; (b) The proposed development is compatible with the land use and development intensities prescribed by all applicable City regulations; (c) The proposed development must possess integrity of design compatible with design criteria established for the Hometown District and with the overall image of the city; (d) The proposed development shall be designed in a manner that provides for effective management of traffic (vehicular and pedestrian), parking, lighting , noise, and waste generated by the development, and for management of the impacts of the development on public facilities and services; (e) The proposed development does not expand the permitted uses within the Hometown District; (f) The proposed development will not have an unfavorable effect on the economy of the City of South Miami; (g) The proposed development, when considered cumulatively with other development, both present and future, within the Hometown District, will not create excessive overcrowding or undue concentration of population. Project Analysis: Staff's analysis of the project for consistency with the above criteria is as follows: (a) The proposed development contributes to, promotes and encourages the improvement of the Hometown District and catalyzes other development as envisioned in the Hometown District regulations. The proposed development provides a mix of uses that create a strong pedestrian oriented building edge along the sidewalk. It contributes to and encourages similar the improvements of other developments as envisioned by the Hometown District regulations. The existing building has been vacant for over a year and is its deteriorating condition is detrimental to the overall economic and physical health of downtown. The project enhances the sense of place by providing ground level pedestrian oriented activities, providing pedestrian related amenities such as a courtyard facing Sunset Drive, and the use of projecting balconies, awnings and street trees to provide protection from inclement weather. ' The proposed development will help reduce local commuter traffic demand of the area by providing a mix of uses that will be primarily utilized by the people that are already 5796 Sunset Drive special exception Page 4 of 6 in the area. The proposed development provides the required parking spaces based on the code requirements after the Hometown District parking incentives is applied. (b) The proposed development is compatible with the land use and development intensities prescribed by all applicable City regulations. All the proposed uses are allowed by the code and the development is within the prescribed FAR and the height limitations of four stories/ 56 feet. (c) The proposed development must possess integrity of design compatible with design criteria established for the Hometown District and with the overall image of the city. The proposed development has received conceptual approvals of the Environmental Review and Preservation and the Historical Preservation Boards. The scale and the architectural treatment of the project reinforce the pedestrian character of Sunset Drive and 58th Avenue. (d) The proposed development shall be designed in a manner that provides for effective management of traffic (vehicular and pedestrian), parking, lighting, noise, and waste generated by the development, and for management of the impacts of the development on public facilities and services. The applicant has completed the concurrency evaluation for traffic. The evaluation indicates that there are adequate roadway capacities to support the development. The proposed development will be required to dedicate 5 -feet along 58th Avenue at the time a building permit is requested. This additional dedication will allow for on street parking and realignment of the sidewalk along east side of 58th Avenue. The applicant has obtained Sewer Capacity Certification from Miami Dade County Department of Environmental Resources Management (DERM). Solid waste generated by the development is contained within the site. All storm drainage related issues, on and off site will be addressed and designs have to comply with the requirements of the South Florida Building Code at the time of issuance of building permit. Other County concurrency requirements and impact fees for items such as fire, water, schools will have to be satisfied by the developer during the permitting process. (e) The proposed development does not expand the permitted uses within the Hometown District. All the uses proposed are permitted within the Hometown District. (f) The proposed development will not have an unfavorable effect on the economy of the City of South Miami. Due to the under utilization and the present condition of the property, the proposed development will substantially increase the tax base generated by the property. 5796 Sunset Drive special exception Page 5 of 6 (g) The proposed development, when considered cumulatively with other development, both present and future, within the Hometown District, will not create excessive overcrowding or undue concentration of population. The development is within the prescribed regulations for development density, height and use. The suggested mix of uses of the development will not create excessive overcrowding or undue concentration of population that is beyond what is envisioned within the Hometown District. Staff generally finds the requests for Special Exceptions meet the intent of the Hometown District Overlay Ordinance and the requirements set forth in the Land Development Regulations for granting such exceptions. The special exception request to reduce building frontage along Sunset Drive is necessitated by the presence of the courtyard. The staff believes that the courtyard is an important urban element having a contextual significance to the City's past and therefore must be incorporated in the design of the project. The special exception to increase the building depth on the side street is a result of the linear shape of the building along 58th Avenue. This condition is created by the placement of the courtyard on Sunset Drive as opposed to the rear of the property as is generally envisioned by the Hometown Plan. The third request to build cantilevered balconies in lieu of the required arcade along Sunset Drive is due to the conflict between the South Florida Building Code (SFBC) and the City's Land Development Code (LDC). SFBC does not currently allow obstructions such as columns to be placed on the public right of way. The cantilevered balconies provide the same intended functions as that of arcades. The development: (a) Will not adversely affect the health or safety of persons residing or working in the vicinity of the proposed use; (b) Will not be detrimental to the public welfare or property or improvements in the neighborhood; and (c) Complies with all other applicable Code provisions. The staff also finds that the requests for special exception do not conflict with the adopted Comprehensive Plan of the City of South Miami. In fact, the development furthers many of the goals of the Future Land Use Element of the City's adopted Comprehensive Plan, including, preservation of the City's small town character, the encouragement of pedestrian oriented developments as envisioned by the Hometown Plan, and increasing the tax base to provide a high level of municipal services. Board Actions: At the request of the applicant the Historic Preservation Board at its meeting of November 29, 1999 gave permission to demolish the existing structure. The Board strongly recommended that any new construction on this site maintain some of the architecturally significant elements that made the property "contributive ". These elements are, but not limited to, courtyard, water feature, low masonry wall defining the public and semi- public spaces. The Environmental Review and Preservation Board reviewed and approved the project by unanimous vote at its November 2, 1999 meeting. 5796 Sunset Drive special exception Page 6 of 6 The project was presented to the Planning Board on January 11, 2000. The Board, at great length, discussed the viability and the appropriateness of four (4) on street parking spaces on 50 Avenue along the frontage of this property due to the concern about the congested condition at the intersection of Sunset Drive and 58th Avenue. As a compromise, the Board recommended pushing the sidewalk further back to align with the existing sidewalk in front of Hanging Basket. After conducting a public hearing the Planning Board considered the request for three special exceptions. The Board through substantial competent evidence found that the application meets the criteria set forth in the Land Development Code for granting special exceptions. The Planning Board adopted a motion (4 -0) to recommend to the City Commission the waiving of the strict compliance of regulations as requested with certain conditions that have been incorporated into the staff recommendations. RECOMMENDATIONS The staff recommends approval of the all three of the special exception requests subject to the following conditions: • - Providing a lease agreement, satisfactory to the City, for the required parking before any demolition or building permit is issued. • Providing enclosed and air - conditioned trash room at least for the restaurant ( Starbucks). • The sidewalk along 58th Avenue along the side of the project is aligned with the sidewalk located in front of the Hanging Basket. • Sidewalk and on street parking should be configured in a manner not to aggravate the traffic movement at the intersection. Note: At the request of the Planning Board member Ms. Gibson the representative of the Starbucks made a commitment to hire local residents as employees at this location.
