THE CONTRACT DOCUMENTS
the contract documents consist of the Owner - Contractor
Agreement, these Conditions, the drawings, specifications,
and all Addenda issued prior to and all Modifications
issued after execution of the Contract.
CHANGE ORDERS
A Change Order is a written order to the Contractor
signed by the Owner and the Architect, issued after
execution of the Contract, authorizing a change in the Work
or an adjustment in the Contract Sum or the Contract Time.
THE WORK
The Work comprises the completed construction required
by the Contract Documents and includes all labor
necessary to produce such construction, and all materials
and equipment incorporated or to be incorporated in such
construction.
ARCHITECT
The Architect will be the Owner's representative during
construction and until final payment is due. The Architect will
not be responsible for and will not have control or charge
of construction means, methods, technicjues, sequences or
procedures, or for safety precautions. and programs in
connection with the Work The Architect shall at all times
have access to the Work wherever it is In preparation and
progress.
The Architect will review and approve or take other
appropriate action upon Contractor's submittals such as
Shop Drawings, Product Data and Samples. The Architect's
approval of a specific item shall not indicate approval of
an assembly of which the item is a component.
Upon authorization by the Owner additional compensation,
the Architect will render extensive Construction
Administration as described in the AIA Standard
Documents.
OWNER
The term Owner means the Owner or his authorized
representative.
The Owner shall furnish all surveys describing the physical
characteristics, legal limitations and utility locations for the
site of the Project, and a legal description of the site.
The Owner shall secure and pay for necessary approvals,
easements, assessments and charges required for the
construction,
The Owner, upon written order, may stop the work and
contract the remaining work with another entity deducting
through a Change Order the cost of correcting any
deficiency, including compensation for the Architect's
additional services made necessary by such default,
neglect or failure.
CONTRACTOR
The Contractor shall carefully study and compare the
Contract Documents and shall at once report to the
Architect any error, inconsistency or omission he may
discover. The Contractor shall supervise and direct the
Work, using his best skill and attention.
Unless otherwise provided in the Contract Documents, the
Contractor shall provide and pay For all labor, materials,
equipment, tools, constructing equipment and machinery,
water, heat, utilities, transportation, and other facilities and
services necessary for the proper execution and
completion of the Work, shall secure and pay For the
building permit and for all other permits and governmental
fees, licenses and inspections necessary for the proper
execution and completion of the Work
The Contractor shall maintain at the site for the Owner one
record copy of all Drawings, Specifications, Addenda,
Change Orders and other Modifications, in good order
and marked currently to record all changes made during
construction, and approved Shop Drawings, Product Data
and Samples. The Contractor at all times shall keep the
premises free from accumulation of waste materials or
rubbish caused by his operations.
SUBCONTRACTORS
A subcontractor is a person or entity who has a direct
contract with the Contractor to perform any of the Work at
the site. The Contractor shall furnish to the Owner and the
Architect in writing the name of the persons or entities
(including those who are to furnish materials or equipment
fabricated to a special design) proposed for each of the
principal portions of the Work,
The Owner reserves the right to perform work related to
the Project with his own Forces, and to award separate
contracts in connection with other portions of the Project.
ARBITRATION
All claims, disputes and other matters in question between
the Contractor and the Owner relating to the work shall be
decided by arbitration in accordance with the Construction
Industry Arbitration Rubs of the American Arbitration
Association.
SUBSTANTIAL COMPLETION
The Date of Substantial Completion of the Work is the
Date certified by the Architect when construction is
sufficiently complete, so the Owner can occupy or utilize
the Work
