AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO
PROPERTY; ABANDONING A PORTION OF THE RIGHT -OF -WAY
FOR S.W. 84TH TERRACE; PROVIDING FOR REVERTER OF TITLE
TO ADJACENT PROPERTY OWNERS; PROVIDING FOR
SEVERABILITY, ORDINANCES IN CONFLICT, AND AN EFFECTIVE
DATE.
WHEREAS, the Mayor and City Commission of the City of South Miami hold
title to public land in trust and have the power to discontinue the use of streets, and to
abandon and vacate rights -of -way when it is in the public interest; and
WHEREAS, the western 400 feet of the south one -half of the right -of -way of S.W.
84th Terrace was previously abandoned by Resolution no. 136 -97- 10106, approved on
July 22, 1997, in connection with the approval of the Parkside Village PUD; and
WHEREAS, the north one -half of the right -of -way of S.W. 84th Terrace is
currently maintained solely for emergency vehicle access to the rear of the properties that
abut the right -of -way on the north; and
WHEREAS, the east portion of S.W. 84th Terrace is currently utilized as the sole
access to the Parkside Village PUD and to the property owned by Mr. Shaw; and
WHERAS, certain owners of property abutting the right -of -way on the north have
requested the city to abandon the western portion of the right -of -way; and
WHEREAS, the city administration recommends abandoning the right -of -way
lying adjacent to lots 11 through 18, of block 2 of the Sea View Park Amended Plat Book
17, Page 80, as more particularly described below; and
WHEREAS, all adjacent property owners have been notified in writing, by letter
dated July 10, 2002, of the proposed abandonment of the right -of -way; and
WHEREAS, all potentially affected utilities have been notified in writing, by letter
dated July 10, 2002, of the proposed abandonment of the right -of -way; and
WHEREAS, a public hearing on the proposed abandonment of the right -of -way
has been scheduled for August 6, 2002, and a notice of the public hearing has been
advertised in the Miami Daily Business Review on July 29, 2002; and

I WHEREAS, the Mayor and City Commission desire to abandon the described

4 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY
5 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:

7 Section 1. The remaining right -of -way for S.W. 84th Terrace beginning at the
8 right -of: -way at S.W. 58th Avenue to the west and running to a point ending at the east
9 side of lot 11, block 2, of the Sea View Park Amended plat, recorded in the public
10 records of Miami -Dade County at Plat Book 17, Page 80, is hereby vacated and
11 abandoned. The remaining portion of the right -of -way for S.W. 84th Terrace, which lies
12 adjacent to lots 6 through 10, block 2, of the Sea View Park Amended plat, is not
13 abandoned and shall continue to be used as access to properties located to the south of the
14 street. The "Whereas" clauses are incorporated into this ordinance.

16 Section 2. Title to the abandoned right -of -way lying adjacent to lots 11 through
17 18, of block 2 of the Sea View Park Amended Plat Book 1`7, Page 80, shall revert to those
18 lots. The lots are owned by, and more particularly described, as:

responsibility relating to the right-of-way and drainage in the area, and further disclaims
any and all legal liability relating thereto.
Section 4. Notice of the vacation of the described right -of -way shall be
published one time within 30 days of the adoption of this ordinance in the Miami Herald.
A certified copy of this ordinance and proof the publications of notice of hearing and of
the adoption of this ordinance shall be recorded in the public records of Miami -Dade
County. The City Clerk shall provide a copy of these documents to the Miami -Dade
County Tax Assessor.
Section 5. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
shall not affect the validity of the remaining portions of this ordinance.
Section 6. All ordinances or parts of ordinances in conflict with the pro_ visions
of this ordinance are repealed.
Section 7. This ordinance shall be codified and included in the Code of
Ordinances.
Section 8. This ordinance shall take effect immediately upon enactment.

Proposed Sales Tax Increase
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA, SUPPORTING THE PROPOSED
SALES TAX INCREASE OF WHICH MUNICIPALITIES WILL RECEIVE
A 20 % SHARE EXCLUSIVELY DEDICATED TO THE
TRANSPORTATION NEEDS OF MIAMI -DADE COUNTY AND THE
MUNICIPALITIES OF MIAMI -DADE COUNTY, FLORIDA;
PROVIDING AN EFFECTIVE DATE.
BACKGROUND AND ANALYSIS
The attached resolution sponsored by Vice Mayor Russell supports the proposed sales tax
increase of which municipalities will receive a 20% o share exclusively dedicated to the
transportation needs of Miami -Dade County and the municipalities of Miami -Dade County,
Florida. If approved by the electorate at a duly called election, municipalities in Miami -Dade
County will receive their fair share, as indicated, on an annual basis, predicated on an additional 1/2
cents sales tax.

12 WHEREAS, Miami Dade County Board of Commissioners wishes to levy
13 and impose a one half of one percent Charter County Transit System Surtax if
14 approved by the electorate of Miami -Dade County, Florida at a duly called
15 election pursuant to authority granted by Section 212.055 (1), Florida Statutes
16 (200 1) and to apply the proceeds of the surtax as provided and
17
18 WHEREAS, if approved by the electorate at a duly called election,
19 municipalities in Miami -Dade County will receive their share, as indicated, on an
20 annual basis, predicated on an additional 1/2 cent sales tax and
21
22 WHEREAS, a Citizens Independent Transportation Trust Fund has been
23 proposed to give oversight to the expenditure and utilization of these funds; and

25 WHEREAS, a 20% direct distribution of the gross sales tax revenues,
26 based upon individual municipal population (adjusted annually), will be directly
27 distributed to all municipalities solely to enhance transportation needs.

29 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
30 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;

32 Section 1. Supports Miami -Dade county's initiative for the one half of
33 one percent charter county transit system surtax authorized by section 212.055(1),
34 Florida statutes (2001) on all transactions occurring in Miami Dade county
35 otherwise subject to the state tax imposed on sales, use, rentals, admissions and
36 other transactions by Charter 212 Florida statutes.

38 Section 2. That 20 % of the gross sales tax revenue will be utilized by the
39 municipalities for transportation needs solely within municipal boundaries.

41 Section 3. The City Clerk is hereby directed to provide a certified copy
42 of this resolution to Miami -Dade League of Cities.

BACKGROUND
• Each of the cities has received the attachment. Expected arrendance
includes Vice Mayor Dan Landeff (Bal Harbour); Council President Julio

Joe Rasco Xey Biscayne); Vice Mayor Mary Scott Russell (South
Miami); Mayor Daisy Black (R1 Portal); Councilman Leslie Bowe
(Pinecrest). Mayors from other cities arc also expected but not yet
confirmed.
PREMISE
• Cities will receive their share, as indicated, on an annual basis, predicated
on an additional %s cent sales tax.
ASSUMPTIONS
• Cities will structure an interlocal agreement with Miami -Dade County,
and, where needed, a JPA to facilitate project inclusion in plans
approved by the MPO.
• The cities will preserve the level of transportation funding currently in
their budgets (i.e., their maintenance of effort dollars). Maintenance of
effort excludes special bond issues for infrastructure improvements.
• The cities will dedicate 20% of their' /2 penny dollars to transit pusposcs.
This would include circulators; bus shelters; bus pull out bays or other
transit - related infrastructure.
• If such utilization is inappropriate, the affected cities will pledge this
percentage (20 %) to Mianu -Dade County who will, in turn, utilize these
funds on a county project that would enhance traffic mobility within the
cities' boundaries.
• A "blue ribbon committee;' consisting of municipal mayors, will be
created to meet regularly on program implementation.

There is hereby levied and imposed a one half of
one percent discretionary sales surtax authorized by Section
212.055(1), Florida Statutes (2001) on all transactions
occurring in Miami -Dade County which transactions are
subject to the state tax imposed on sales, use, rentals,
admissions and other transactions by Chapter 212, Florida
Statutes (2001).
See. 29.122. Surtax rate, limitations.
The surtax rate shall be one half of one percent on
the amount of taxable sales and taxable purchases
representing such transactions. The limitations, conditions
and provisions contained in Section 212.054, Florida
Statutes (2001) as the same may be amended and
supplemented from time to time are hereby incorporated
herein.
Sec. 29- 122.1. Exemption from Sales Surtax.
All exemptions applicable to the discretionary sales
surtax contained in Chapter 212, Florida Statutes are
hereby incorporated herein as the same may be amended
and supplemented from time to time including, but not
limited to, the following:
1. The sales amount above $5,000 on any item
of tangible personal property shall not be subject to
the surtax. However, charges for prepaid calling
arrangements, as defined in Sec.212.05(1)(e)l.a.
Fla. Stats., shall be subject to the surtax. For
purposes of administering the $5,000 limitation of

an item of tangible personal properly, if two or
more taxable items or tangible personal property are
sold to the same purchaser at the same time and,
under generally accepted business practice or
industry standards or usage, are normally sold in
bulk or are items that, when assembled, comprise a
working unit or part of a working unit, such items
must be considered a single item for purposes of the
$5,000 limitation when supported by a charge
ticket, sale slip, invoice, or other tangible evidence
of a single sale or rental.
2. The sale at retail, the rental, the use, the
consumption, the distribution, and the storage to be
used or consumed in this State of the following are
hereby specifically exempt from the sales surtax
imposed by this ordinance.
(1) EXEMPTIONS; GENERAL
GROCERIES
(a) Food products for human
consumption are exempt from the
sales surtax imposed by this
ordinance.
(b) For the purpose of this
ordinance, as used in this subsection,
the term "food products" means
edible commodities, whether
processed, cooked, raw, canned, or
in any other form, which are

(2) EXEMPTIONS MEDICAL
(a) There shall be exempt from
the sales surtax imposed by this
ordinance any medical products and
supplies or medicine dispensed
according to an individual
prescription or prescriptions written
by a prescriber authorized by law to
prescribe medicinal drugs;
hypodermic needles; hypodermic
syringes; chemical compounds and
test kits used for the diagnosis or
treatment of human disease, iciness,
or injury; and common household
remedies recommended and
generally sold for intemal and
external use In the cure, mitigation,
treatment, or prevention of illness or
disease in human beings, but not
including cosmetics or toilet articles,
notwithstanding the presence of
medicinal ingredients therein,
according to a'list prescribed and
approved by the Depat4meut of
Health, which list shall be certified

to the Department of Revenue from
time to time and included in the rules
promulgated by the Department of
Revenue. There shall also be exempt
from the sales surtax imposed by this
ordinance artificial eyes and limbs;
orthopedic shoes; prescription
eyeglasses and items incidental
thereto or which become a part
thereof; dentures; hearing aids;
crutches; prosthetic and orthopedic
appliances; and funerals. In addition,
any items intended for one -time use
which transfer essential optical
characteristics to contact lenses shall
be exempt from the sales surtax
imposed by this ordinance, however,
this exemption shall apply only after
$100,000 of the sales surtax imposed
by this ordinance on such items has
been paid in any calendar year by a
taxpayer who claims the exemption
in such year. Funeral directors Aall
pay tax on all tangible personal
property used by them in their
business.
(b) For the purposes of this
subsection (2):
1. "Prosthetic and
orthopedic appliances" means
any apparatus, instrument,
device, or equipment used to
replace or substitute for any
missing part of the body, to
alleviate the malfunction of
any part of the body, or to
assist any disabled person in
leading a normal life by
facilitating such person's
mobility. Such apparatus,
instrument, device, or
equipment shall be exempted

medical treatment are exempt,
(g) Medical products and
supplies used in the cure, rnitigation,
alleviation, prevention, or treatment
of injury, disease, or incapacity
which are temporarily or
permanently incorporated into a
patient or client by a practitioner of
the healing arts licensed in the state
are exempt.
(h) The purchase by a
veterinarian of commonly
recognized substances possessing
curative or remedial properties which
are ordered and dispensed as
treatment for a diagnosed health
disorder by or on the prescription of
a duly licensed veterinarian, and
which are applied to or consumed by
animals for alleviation of pain or the
cure or prevention of sickness,
disease, or suffering are exempt.
Also exempt are the purchase by a
veterinarian of antiseptics, absorbent
cotton, gauze for bandages, lotions,
vitamins, and worm remedies.
(i) X -ray opaques, also known
as opaque drugs and radiopaque,

barium sulphate, when used in
connection with medical X rays for
treatment of bodies of humans and
animals, are exempt.
Gj Parts, special attachments,
special lettering, and other like items
that are added to or attached to
tangible personal property so that a
handicapped person can use them are
exempt when such items are
purchased by a person pursuant to an
individual prescription.
(k) This subsection (2) shall be
strictly construed and enforced.
Sec. 29 -123. Administration, collection and
enforcement.
The Florida Department of Revenue shall
administer, collect and enforce the surtax levied hereu- der
pursuant to the procedures specified in Sec. 212.054(4)
F1a.Stats. (2001) as the same may be amended or
renumbered from time to time.
See. 29.124. Special fund created; uses of surtax
proceeds; and role of Citizens'
Independent Transportation Trust.
The surtax proceeds collected by the State and
distributed hereunder shall be deposited in a special fund
set aside from other County funds in the custody of the
Finance Director of the County. Moneys in the special
fund shall be expended for the transportation and transit
projects (including operation and maintenance thereof) set
forth in Exhibit l to this ordinance, subject to any
amendments thereto made in accordance with the MPO
process or made in accordance with the procedures
specified in subsection (c) of this Section.

Expenditure of surtax proceeds shall be subject to
the following limitations:
(a) Surtax proceeds shall be applied to fund the
costs of the Golden passport Prograrn.
(b) Surtax proceeds may only be expended for
the transportation and transit purposes specified in
§212.055(1)(d)1' -3 F1a.Stats.(2001).
(c) No more than S% of surtax proceeds may be
expended on administrative costs, exclusive of
project management and oversight for projects
funded by the surtax.
(d) The County Commission shall not delete or
materially change any project contained in the list
attacbed as Exhibit 1 to this ordinance nor add any
project to the list except in accordance with the
procedures set forth in this subsection (c). A
proposed deletion, material change or addition shall
be initially reviewed by the Citizens' Independent
Transportation Trust ( "Trust "), which shall forward
a recommendation tbereon to the County
Commission, The County Commission may either
accept or reject the Trust's recommendation. If the
County Commission rejects the recommendation,
the matter shall be referred back to the Trust for its
reconsideration and issuance of a reconsidered
recommendation to the County Commission. The
County Commission may approve, change or reject
the Trust's reconsidered recommendation. A two -
thirds vote of the Commission membership shall be
required to take action other than as contained in the
reconsidered reoommendation of the Trust. The
foregoing notwithstanding, the list of projects
contained in Exhibit 1 may be changed as a result of
the Wo process as mandated by federal and state
law.
(e) No surtax proceeds may be used to pay the
costs of a contract awarded by action of the County
Commission until such action has become final
(either by expiration of ten days after such action

without veto by the Mayor, or by Commission

approved same; or, ii) in response to the Trust's
disapproval, the County Commission re-affirms its
award by two -thuds (2/3) vote of the Commiss'.on's
membership. The bid documents for all contracts
funded in whole or in part with surtax proceeds
shall provide that no award shall be effective and no
contractual relationship shall arise with the County
unless and until approvers by the Trust or re-
affirmed by the County Commission as provided in
this subsection.
Section 2. Severability. If any section, subsection, sentence, clause orprovision of this
ordinance is held invalid, the remainder of this ordinance shall not be affected by such
invalidity.
Section 33. Ordinance Part of Code. It is the intention of the Board of County
Commissioners, and it is hereby ordained that the provisions of this ordinance shall become and
be made a part of the Coda of Miami -Dade County, Florida. The sections of this ordhmce may
be renumbered or relettered to accomplish such intention, and the word "ordinance" may be
changed to "section," "article," or other appropriate word.
Section Scction 4. Effective Date. The provisions of this ordinance shall become effective ten
(10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become
effective only upon an override by thi§ Board, and the sales surtax authorized herein shall take
effect on January 1, , provided that the question of whether the County shall levy a one-
half of one percent sales surtax pursuant to Section 212.055(l), Florida Statutes (200 1) is
approved by a majority vote of the electorate who vote on this proposal in the election to be

Section 5. Maintenance of Effort. It is the intention of the Board of County
Commissioners that the amount of general fund support for M DTA it fiscal year ending
September 30,2003 and each subsequent fiscal year shall be no less than $111,800,000 which is
the budgeted amount of general fund support for MDTA in fiscal year ending September 30,
2002.
Section 6. State Filings. This Clerk of the Board shall forthwith mail certified copies of
this ordinance to both the Florida Department of State and the Florida Department of Revenue
within ten (10) days after enactment hereof.
Section 7. Amendments. This Ordinance may only be amended or repealed by a two.
thirds vote of the Board, Any amendment or repeal of this Ordinance shall further require a
minimum of six (6) weeks between first and second reading.
Section 8. This ordinance does not contain a sunset provision.

WHEREAS, Commissioner Wiscombe recently requested and
received from the City Administration a year -to -date report
of City revenue accounts; and
WHEREAS, he has reviewed and analyzed the report for
comparison of the year -to -date amounts to the annual
budget and
WHEREAS, from his analysis, the collection rate for most of
these revenue accounts are significantly behind the
expected amounts at this time of the year, specifically the
following accounts:

NORTHSIDE CHARRETTE; ADOPTING THE FINAL REPORT FROM THE
NORTHSIDE CHARRETTE.
BACKGROUND
Attached is the Final Report from the Northside Charrette, held in June 2000. Also attached is a
proposed resolution, adopting the Final Report.
Since the Northside Charrette two years ago, the City of South Miami has progressed on several
fronts. The Charrette results have been used as a blueprint, to guide the City on decisions about
future plans for this area.
For example, the City has recently completed paving and drainage upgrades to several streets in
the Northside Charrette area. Also completed is the new landscaped parking area along 41St
Street west of Red Road. New sidewalks have been installed by Miami -Dade County along
Miller Road.
The City is pursuing the purchase of the vacant property at the northwest corner of Coral Lake.
It is hoped that the property can be purchased, annexed into the City, and made into a park for
the neighborhood.
In the near future, the City expects to embark upon a citywide neighborhood traffic calming
effort. The Northside Charrette report specifies locations in the area which are most in need of
traffic calming, and this document will serve as a guide as the City progresses to fund and
construct new traffic calming features.
The Florida Department of Transportation has commenced with the installation of new
landscaped medians along the Bird Road corridor. This project is a first step towards the
Charrette's recommendations for more and better landscaping in the area.

The first new building on Bird Road is under
construction; a two -story mortgage office, it fronts on the
sidewalk and has parking in the rear, as per the Charrette
recommendations.
5820 Bird Road — Under Construction
Over the long term, new development regulations for the Bird Road commercial area will be
developed. Currently, South Miami is studying the mixed -use zoning concept for application in
other parts of the City. It is anticipated that once these lower- intensity mixed -use development
regulations are formulated through a public involvement process, this type of new mixed -use
zoning could be applied in future to the Bird Road area.
In summary, the Northside Charrette was an effective and worthwhile exercise in public
participation, setting goals for future improvements and development. This document will
continue to be consulted and used by the City to guide decision making for the future of the
Northside area.
RECOMMENDATION
It is recommended that the resolution be approved.

Purpose
The Purpose of the Northside Charrette has been to gather a consensus from the
various stakeholders in the Study Area on how best to shape the future of their
Neighborhood. This Report should serve as a platform from which various parties can
work over time - public and private, City and County, commercial and residential. It is
largely conceptual in nature - but specific enough to guide the processes of amending
Zoning and Land Development Codes and of developing strategies to fund and advance
capital projects.
Process
The Northside Charrette was held in June 2000. Sponsored by the City of South
Miami, with cooperation and participation from Miami -Dade County. It was the
City's 4th charrette.

counterparts in Miami -Dade County and
with area businesses and residents in a
number of ways. It will endeavor to pass
all comments on to the affected decision
makers. Together, we continue to

On Saturday morning, in David
Fairchild Elementary's cafeteria,
with coffee, juice and pastries laid
on, the core work began.
Participants were broken into four
quadrant groups, based on where
their interests lay. So folks from
the southeast quadrant of the
square mile, for instance, sat
and worked together, giving
a very local quality to the
deliberation.

on their quadrant areas.
Along with the public, each
table had facilitators from
the ranks of the volunteer
professionals. Facilitators
assisted the groups to draw
their ideas on tracing paper

maps and scores of enlarged

By the end of the morning, a real sense .of
excitement had joined the charrette. The
beginnings of ideas, hatched looking down
on aerials, took real shape when drawn
onto the photos and given human scale.
Facilitators with seasoned drawing skills
worked with the public, like police sketch
artists, to turn ideas into color renderings
of a community being imagined.
The City laid on sandwiches,
buffalo wings, vegetables
and soft drinks for lunch.

away in shifts for a bite and
a drink, usually carried back
to their tables so they could
carry on in the process.

Purpose
The Purpose of the Northside Charrette has been to gather a consensus from the
various stakeholders in the Study Area on how best to shape the future of their
Neighborhood. This Report should serve as a platform from which various parties can
work over time - public and private, City and County, commercial and residential. It is
largely conceptual in nature - but specific enough to guide the processes of amending
Zoning and Land Development Codes and of developing strategies to fund and advance
capital projects.
Process
The Northside Charrette was held in June 2000. Sponsored by the City of South
Miami, with cooperation and participation from Miami -Dade County. It was the
City's 4th charrette.
A charrette is a proven method for gathering consensus on complex town - planning
issues. The Northside Charrette looked at the study area well into the future: 10+
years.

The Purpose of the Northside Charrette has been to gather a consensus from the
various stakeholders in the Study Area on how best to shape the future of their
Neighborhood. This Report should serve as a platform from which various parties
can work over time - public and private, City
and County, commercial and residential. It is
largely conceptual in nature but specific
enough to guide the more ponderous
processes of amending Zoning and Land
Development Codes and of developing
strategies to fund and advance capital
projects.
Town Planning is a continuing process.
All stakeholders are invited to add their
comments to the process in the months
and years to come. The City of South
Miami has taken the lead in initiating this
charrette and the process that continues
from it. Comments should be directed to
the City's Planning Department. The
City, in turn, is in touch with its various
counterparts in Miami -Dade County and
with area businesses and residents in a
number of ways. It will endeavor to pass
all comments on to the affected decision
makers. Together, we continue to
develop a better Community we can all
share.

the north, Miller Drive to the
Road to the east, and
Ludlam Road to the west. It
also extended across these
streets, to the rear property
lines of street facing

center across Bird Road
from Allen's Drugs, and the
Winn Dixie /Eckerds

with coffee, juice and pastries laid
on, the core work began.
Participants were broken into four
quadrant groups, based on where
their interests lay. So folks from
the southeast quadrant of the
square mile, for instance, sat

the cranks of the volunteer
'Professionals. Facilitators
assisted the groups to draw
their ideas', on tracing paper
placed over blown up aerial
maps and scores of enlarged
photos from the area. They
'were encouraged to draw
hat they ,imagined and not
worry about how it might
get done for now.

By the end of the morning, a real sense of
excitement had joined the charrette. The
beginnings of ideas, hatched looking down
on aerials, took real shape when drawn
onto the photos and given human scale.
Facilitators with seasoned drawing skills
worked with the public, like police sketch
artists, to turn ideas into color renderings
of a community being imagined.
The City laid on sandwiches,
buffalo wings, vegetables
and soft drinks for lunch.
Folks pulled themselves
away in shifts for a bite and
a drink, usually carried back
to their tables so they could
carry on in the process.
Meanwhile, chairs were
assembled at the front of
the room and groups were
given multiple time checks
to finish up their work. They
had large 1 /2" foam boards
on which to pin their work
and were asked to elect; a,
spokesperson from each
group.
The coordinator asked a dozen different
folks to take careful notes during the
presentations, to capture all the ideas in
that moment, when they were fresh, ripe
and clear. Later, those notes would be
consolidated as a thorough inventory and
used in the next step.
