However, on at least two occasions recently, the Task Force has met but was unable to conduct business because of the lack of a quorum. Because the Task Force was originally comprised of sixteen members, the quorum requirement has been nine (9) members. As the work of the Task Force has progressed, however, a small number of members have been unable to attend at various times, and it has proven difficult to assemble enough members to constitute a quorum. Therefore, the Task Force members have requested that the quorum requirement be reduced to seven (7) members, which is a more achievable number. While every effort will continue to be made to contact members prior to Task Force meetings, and encourage attendance by all, it is felt that it will be much easier to ,attain a quorum of seven members, given the number of members who may have alternative commitments which may conflict with the Task Force's meeting dates. BACKGROUND AND ANALYSIS: The South Miami Police Department and the North Miami Beach Police Department have the authority under Section 23.12, Florida Statutes, et seq., The Florida Mutual Aid Act, to enter into a mutual aid agreement for law enforcement service which provides for rendering of assistance in a law enforcement emergency. BACKGROUND AND ANALYSIS: The State is vulnerable to a wide range of disasters that may exceed the capability or resources of any one local government, including the City of South Miami. Participation in the Statewide Mutual Aid Agreement gives the City the ability to request and coordinate Mutual Assistance in emergencies and insures the timely reimbursement of costs incurred by local governments which render such assistance. BACKGROUND & ANALYSIS We continue in the development and enhancement of all City properties. The Parks & Recreation Department's Landscaping Division is in need of a new lawnmower. A purchase of a Gravely ProMaster Z260ZTR Mower with 60" deck is needed to maintain City properties. The present mowers are aging and "breakdowns" are frequent. The Parks & Recreation Department will "piggy- back" off a Florida State Contract Bid; bid number 4515 -630E. They will purchase the item through Ace Lawnmower Services that recognizes this State bid. Funds will be disbursed from account number 001 - 2050 -519 -6430, "Landscape Maintenance - Operating Equipment ". Available account balance is $10,000.00. RECOMMENDATION Approval is recommended. FOR THE CONSTRUCTION OF SW 41sT STREET PARKING & ROADWAY IMPROVEMENT IN AN AMOUNT NOT TO EXCEED $53,428.00, PROVIDING AN EFFECTIVE DATE. BACKGROUND: The proposed SW 41' Street Parking & Roadway Improvement was advertised for construction bids on Monday, January 7, 2002. Sixteen (16) contractors picked -up bid packages and eleven (11) contractors submitted bids. The bids were publicly opened on Wednesday, February 6, 2002 (the last day to submit bid) at 3:05pm. Since the bid opening, the staff has tabulated the bids, reviewed and evaluated all bids, verified references, verified bid bond and met with the lowest responsive bidder (Budget Construction Co., Inc.) to make sure the scope of work is clearly understood as design and specified. The bid quantities and prices were reviewed and corrected for mathematical errors accordingly. This much needed drainage and street improvement includes, street resurfacing for approximately 500 lineal feet of drainage improvement, thirty-three (33) on street parking stalls, landscaping and pavement marking. The project will be partially funded through a $20,000 impact fee from the adjacent property owner. The balance will be funded through Fiscal Year 2000 Legislative Appropriations grant from account numbers 001- 0000 - 219 -1620 and 111- 0000 -115 -3030, respectively. RECOMMENDATION: It is recommended that the City Commission approve the funding for the work to be performed. BACKGROUND The Land Development Code contains regulations governing "garage sales" (Sec.20- 4.10). The issuance of a garage sale permit is handled by the Finance Department at the cashier's window. The LDC limits garage sales to twice a year in single family and townhouse zoning districts only. The regulations also specify who can apply for a permit, permitted hours of operation, size and location of signs, and notification requirements. Based upon comments received, the City Commission recently expressed concerns that certain requirements in the Code needed clarification, resulting in the legislation proposed in this report. PROPOSED AMENDMENTS (A) Before a permit is issued the applicant must provide proof that they own or lease the property at which the sale is to take place. The Finance Department currently requires the applicant to show a property ownership deed, or a rental agreement. This procedure has proven to be burdensome in some cases, and has prevented legitimate sales from being held. In order to simplify and clarify the regulations, the City's required proof of residency could be satisfied by the showing of a utility bill, or other identification document. The following revision (in bold) is proposed: "(2) Before such permit shall be issued, the applicant shall file with the Finance Department an application containing the following information: (a) Street address or legal description where such sale is to be conducted. (b) Proof of ownership or lease of property (deed, lease, utility bill or other LD.)." (B) The LDC currently requires the applicant to notify residents on both sides of the sale. The regulations do not specify as to the form of the notice, as to when it is to be given or what information is to be LDC Amendment - Garage Sale March 5,2002 Page 2 transmitted. This has led to some misunderstandings and complaints. Notification is basically on the honor system; however, it is probably not feasible for the City to assume an ongoing oversight role as far as notification is concerned. However, the situation could be clarified and improved by having applicants, prior to the date of the sale, be required to distribute to the neighboring properties a City prepared form letter. The form letter would provide standard information about the specific sale and the governing regulations (hours of operation, signage allowed, phone number to call if there are violations, etc.). The following revision (in bold) is proposed: "(2) Before such permit shall be issued, the applicant shall file with the Finance Department an application containing the following information: (e) Notification of residents of properties on both sides of applicant. the annlicant abutting residents prior to the marae sale." It is important to note that the ordinance also requires that the official City Garage Sale permit to be posted prominently at the site of the sale. The combination of the delivery of an official City', notification letter,(see attached draft notification letter), as well as the posted permit, should be enough to fully apprise neighbors of the pending Garage Sale, while helping the applicant to simply and easily comply with the requirements of the ordinance. PLANNING BOARD ACTION The Planning Board at its January 29, 2002 meeting recommended approval of the two amendments set forth above (A) (B), and further recommended that the section of the garage sale regulations limiting the number of sales to two per year be changed to four times per year. (5) A garage sale shall be held only between the hours of 9: 00 a.m. to 5: 00 p.m. Personal property shall be exhibited or displayed only within established setbacks. A sale may be held &w four 4 times only, no more than for one weekend including Friday, per each calendar year. A motion recommending approval of all three amendments was made by Mr. Illas and seconded by Ms. Gibson. The motion was approved by a vote of 7 -0. CITY COMMISSION ACTION The City Commission at its February 19, 2002 meeting approved on first reading an ordinance which contains the two amendments proposed by the Planning Department and the amendment recommended by the Planning Board to increase the number of garage sales permitted from two to four per calendar year. At that time the Commission also requested additional information on how the Finance Department keeps tract of garage sale permits and the methods used to notify other Departments of permits issued. A representative of the Finance Department will be present at the meeting to respond to theses concerns RECOMMENDATION The Administration is concerned about the proposed increase in number of garage sales permitted from two to four per year. Garage sales can generate considerable traffic and parking problems and be overall disruptive to the peace and quite of residential neighborhoods. The additional garage sales permitted may act as an encouragement for residents to sell merchandise or property items which are not from the household where the sale is taking place. For the above reasons, the Administration is recommending that only the amendments pertaining to proof of ownership /lease and notification of neighboring residents be adopted on second reading. That Section 20 -4.10 entitled "Garage Sale," of the City's Land Development 42 Code, is hereby amended to read as follows: 43 44 20 -4.10 Garage Sale. 45 Page I of 3 I (A) Applicability. Garage sales shall be permitted in a RS- Single Family Residential District 2 and a RT- Townhouse District subject to the following conditions and restrictions: 3 4 (1) No garage sale shall be conducted until and unless a permit shall have been obtained 5 from the Finance Department of the City of South Miami. Only the owner or 6 lessee of the property upon which the garage sale is being conducted may obtain 7 such permit. 8 9 (2) Before such permit shall be issued, the applicant shall file with the Finance Department 10 an application containing the following information: 11 12 (a) Street address or legal description where such sale is to be conducted. 13 14 (b) Proof of ownership or lease of property (deed, lease, utility bill or other I.D.). 15 16 (c) Dates of sale. 17 18 (d) Hours of sale. 19 20 feJ Notification of residents of properties on both sides of applicant. The City shall 21 provide the applicant with a standard notification letter which must be 22 delivered by the applicant to the abutting residents prior to the garage sale. 23 24 (3) Upon verification and compliance with the provisions of this section, the Finance 25 Department shall issue a permit the same day which shall designate the location 26 of the sale and the days upon which the sale shall be conducted. 27 28 (4) Only one sign complying Section 20- 4.3(I) of the Land Development Code (not 29 exceeding two square feet in size) may be displayed on the property where such 30 sale is being conducted. The sign shall not be erected or placed closer than five 31 feet to the front or side property line. The sign shall not be affixed to a tree or 32 utility pole. 33 34 (5) A garage sale shall be held only between the hours of 9:00 a.m. to 5:00 p.m. Personal 35 property shall be exhibited or displayed only within established setbacks. A sale 36 may be held two four 4 times only, no more than for one weekend including 37 Friday, per each calendar year. 38 39 (B) Enforcement. The garage sale permit shall be prominently displayed from the front of the 40 building from which such sale is conducted. Discussion: The term of the current contract commenced on October 1, 1999 and expires on September 30, 2002. The purpose of extending the contract is to keep the current city manager in place for an additional three years on the basis that the city commission and he have taken the city to a higher level of professionalism. The contract between the city and the city manager represents the third part of an initiative to professionalize the city administration. Part 1 required hiring a city manager based on the individual's professional credentials and accomplishments. Part 2 required raising the city manager's salary and increasing benefits to make the city competitive with other cities in attracting and keeping a professional city manager. Part 3 required entering into a contract to give the city manager greater security in the performance of his responsibilities. Approval of the resolution extending the contract will signify affirmation by the city commission that the program has been successful and that it desires to continue to retain Mr. Scurf as its city manager. Entering into an employment is the third step in professional izing the relationship between the city manager and the city commission. The first two steps were: 1) selecting a city manager based on professional capability; and 2) increasing salary and benefits to attract qualified professionals to the city. Contract review: The contract creates an employment between the city manager and the City of South Miami for an initial term of three years. It provides that the city manager will devote substantial time to the affairs of the city and allows for limited outside employment upon prior approval of the commission. The city manager receives the benefits stated in section 2, including, but not limited to, an indemnification clause that provides for his defense for any claim arising out of his employment with the city. The indemnification clause fills a gap left by various indemnification statutes and avoids the possibility that the city manager might have to fund his own defense until a successful conclusion of the defense to the claim. Upon termination, the city manager will receive up to, but not exceeding, six - months worth of compensation and benefits for the unexpired term of the agreement.' He may elect to be constructively terminated if two commissioners make public pronouncements calling for his resignation. The agreement provides for a due process public hearing within 30 days of being suspended without pay for alleged misconduct. In any litigation, the parties waive jury trial, preferring to be tried before a judge. The agreement does not create a property right to employment. Charter review: The charter provides that the city manager is an "at will" employee of the city. Art. II, §7.A., city charter (the city manager who shall serve at the pleasure of the commission). According to judicial opinions, a contract with the city manager does not change his "at will" employment as long as the commission can terminate the contract for its convenience. The proposed contract allows the commission to do just that. The charter also provides that, upon removal without cause, the city manager "shall receive [his] salary for [30] days" immediately following the adoption of the resolution terminating his employment, Art. III, §3, city charter. The provision is ambiguous: it is either an authorization to pay salary, or a limitation on the ability to pay salary for more than 30 days. I cannot determine the intent of the provision from any interpretation of its words. On one hand, there is no need for authorization in the charter to pay severance benefits (but the charter contains other provisions that are not necessary). On the other hand, in the absence of a clear expression of a limitation, such as "shall pay salary for no more than 30 days," the commission can view the provision as an authorization to pay severance and other benefits for a period exceeding 30 days. Note: The charter review commission viewed this provision as a limitation and declined to change it. I recommend that the commission revise this provision at the appropriate time. SCURR This Agreement, is made and entered into this 5th day of October, 1999, between the City of South Miami, a Florida municipal corporation, and Charles D. Scurr. WHEREAS, the City of South Miami and Charles D. Scurr wish to continue to employ the services of Charles D. Scurr as City Manager of the City of South Miami; and WHEREAS, the City and City Manager desire to provide for certain procedures, benefits, requirements and to set working conditions regarding the employment of the City Manager by the City. The City Manager may engage in outside employment so long as: 1) prior permission is received from the Mayor and City Commission upon disclosure of the nature of the employment, duration and the estimated number of hours per month that will be devoted to the employment, 2) the employment does not violate the prohibition against dual office holding and 3) the employment does not create a potential conflict of interest or detract from the time necessary to accomplish city work, as determined in the discretion of the City Commission. The term "Outside Employment" shall not be construed to mean occasional teaching, publication, pro bono activities or consulting services performed on time off, not exceeding 5 hours a week unless approved by the City Commission. 2. The City shall: 2.1 Employment. Continue to employ Charles D. Scurr as City Manager consistent with the Charter and Code of Ordinances of the City of South Miami, and as otherwise lawfully directed by motion or acclamation of the City Commission and the terms and conditions of this Agreement. 2.2 Salary. The amount of Ninety three thousand five hundred dollars ($93,500.00) for the period beginning October 1, 1999, payable in accordance with the regularly scheduled method ofrompensation for other City employees and subject to adjustment in 'accordance with this Agreement. 2.3 Annual Adjustment. Annually review the salary of the City Manager as part of the annual budget annually in accordance with the City Charter. The City Commission may, in its sole discretion, grant a merit salary increase and, or, other benefits to the City Manager. 2.4 Cost of Living. A car allowance of $500.00 monthly plus a- gasoline allowance of $100.00 monthly, or if requested by the City Manager , a City car, in which event the City shall be responsible for providing for liability, property damage and comprehensive insurance and for the purchase, operation, maintenance, repair and regular replacement of the 'vehicle. Entitlement to use of the City vehicle shall cease upon the City Manager's termination or resignation. 2.9 Insurance /Medical Pay family coverage health and dental insurance under the city plans, long term disability insurance, and life insurance in an amount equal to annual salary, and an annual physical. 2.10 Leave. Equivalent to other City employees at senior seniority levels as provided in the City personnel regulations. 2.11 Deferred Compensation. An annual amount equal to 11% of the City Manager's annual salary , into the Plan on the City Manager's behalf, and agree to transfer ownership to the City Manager of the Plan's fund upon the City Manager's resignation or termination. 2 2.12Equipment. Provide the equipment necessary to perform the duties of City Manager such as cell phone, pager and radio. 2.13 Indemnification and Defense of Claims. The City shall defend, save harmless and indemnify the City Manager against any tort, professional liability claim or demand or any and all other legal action arising out of an alleged act or omission occurring in the performance of the City Manager's duties. The City will litigate, compromise or settle any such claim or suit and pay the amount of any settlement or judgement rendered thereon. The City, or its insurance carrier, will provide legal representation for the City Manager, suitable to the City Manager, for any and all claims, proceedings or lawsuits related to or arising out of the City Manager's affiliation with the City. This indemnification provision shall survive the termination of this Agreement. 2.14 Bonds. Pay for any cost of bonds required pursuant to law, ordinance or Charter. 3. Termination. The City Manager shall serve at the pleasure of the City Commission as defined by the City Charter. Nothing in this Agreement shall prevent, limit or otherwise interfere with the absolute right of a majority of the full City Commission to terminate the services of the City Manager at any times with or without cause, and without prior notice, in accordance ith n ; or be Cite's Charter,'subj -c t to .tie i for it In �ieCtio . 4 of this Agreen. —Int. Termination for cause shall mean termination for the same grounds as would result in the forfeiture of office by a Commissioner under Article II, Section 4.A. of the City Charter. 4. Severance Terms and Conditions. Severance pay, as authorized by the Charter, shall not be payable in the event of a voluntary resignation or termination for cause. In the event the City Manager is terminated without cause by a majority of the full City Commission, or the City Manager resigns following a suggestion made in writing or at a public meeting or workshop by any two members of the Commission that he resign, or the City Commission suspends the City Manager without cause for more than 90 days, in which events the City Manager may at his option be deemed terminated without cause, the City shall pay the City Manager an amount equal 30 -days of the City Manager's salary and accrued benefits. Any payments due to the City Manager for severance, accrued leave or other obligations shall be paid in cash in full within 30 days of resignation or termination. 3 5. Suspension. The City Commission may suspend the City Manager with full pay and benefits at any time during the term of this Agreement. The Commission may suspend the City Manager without pay and further benefits, but only for cause as described in Section 3 and upon giving the City Manager at least 30 -days written notice of the charges to be heard at a public hearing on the charges. 6. Term. The term of this Agreement shall be a three (3) year term commencing October 1, 1999 and ending September 30, 2002. 7. Contract Payment. In the event the City Manager is terminated without cause or the City Manager- resigns as provided in paragraph 4, the City shall additionally pay the City Manager the balance of payments and benefits provided for under this contract up to a maximum of six months plus one additional month for each year of service. 8. Amendment. The provisions of this Agreement constitute the entire understanding between the parties. Only the representations and understanding contained herein shall be binding upon the City Commission and the City Manager. Severability. No Property Right to Employment. The contract for employment does not change the nature of the employment from at will employment nor create a property right to employment under the laws of the State of Florida. 11. No Waiver. The waiver by either party of a breach of any provision of this Agreement by the other shall not operate or be construed as a waiver of any subsequent breach by that party. 12. Obligations Personal. The rights and obligations herein granted are personal in nature and cannot be transferred by the City Manager. 13. Reduction of Compensation. In the event the City Commission at any time during the employment of the City Manager, reduces the annual financial ii benefits of the City Manager in a greater percentage than an applicable across - the -board reduction for all City employees, or in the event, the Commission refuses, following written notice, to comply with any other provision benefiting the City Manager, then in that event the City Manager may at his option, be deemed to be terminated within the terms outlined in Section 3 and 4 above, at the date of the reduction or the refusal, and the severance pay provision and other termination provisions shall become applicable at the annual salary and benefit level in effect prior to the reduction or refusal 14. Florida Law. This Agreement shall be governed by Florida law and any litigation which may arise under, or relating to this Agreement shall be filed and litigated in the state circuit court in Miami -Dade County, Florida. Litigation shall not be initiated in any federal district court, nor shall any party assert in any proceeding that this employment contract creates a federally protected property right in employment. 15. Waiver of Right to Jury Trial. The parties knowingly waive their right to a jury trial in any legal action arising under, or relating to, this Agreement. 16. Effective Date. BACKGROUND The following proposed charter amendment has been submitted to the City of South Miami: Effective February 13, 2002, all property within the City of South Miami shall retain its height and density as measured by units per acre for residential and floor area ratio for commercial areas, as of that date. However, no building shall exceed 4 stories or 50 feet in height; except that any development adjacent to (including across any street from) single-family zoned residential property may not exceed 2 stories or 25 feet in height. Any increase in height or density as defined above shall be subject to a vote of the electors of South Miami. As per Section 9 -1.1 of the City of South Miami Code of Ordinances, and Section 5.03 of the Miami -Dade County Code of Ordinances, within 60 days of the date the charter amendment petition was certified (January 11, 2002), the City must set the date of the election. Since no regular election is scheduled, a special election must be held. The special election must be held between 60 and 120 days after the meeting at which the special election date is set. The Administration recommends that the special election be held on tH Tuesday, June 18 Resolution - Setting Special Election Date March 5, 2002 Page 2 According to the City Code requirements, a public hearing on the proposed charter amendment must be held at least 60 days prior to the special election. The Administration is proposing that this public hearing be held at a special Commission meeting, to be held on Tuesday, April 9th. At this special commission meeting, one or more alternative proposals may be approved for inclusion on the same ballot, as per Section 9 -1.1. If there is a need for additional time for discussion, the public hearing may be continued at the regular Commission meeting scheduled for April 16th and still meet the statutory requirements for the election timetable. In order to discuss the ballot questions, and inform the Commission, City staff, and the citizenry of the various issues impacting upon the referendum questions, it is proposed that prior to the April 91h special Commission meeting, two special public workshops be held. The Administration proposes that a first public workshop be held on Wednesday, March 27th which will focus on the Transit Oriented Development District (TODD), and the second public workshop be held on Wednesday April 3ra, which will focus on the Hometown District and also on single - family residential area issues. These two proposed workshops should give the Commission and the citizens enough time to discuss all the issues related to the charter amendment, in preparation for the Special Commission meeting public hearing to be held on April 9th. If necessary, additional workshops could be scheduled for the time period between April 91h and the special election on June 18th.
