Request: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA, RELATING TO THE CITY OF SOUTH MIAMI
ZONING TASK FORCE ; AMENDING RESOLUTION 253 -99 -10876 IN ORDER
TO - SPECIFY THE QUORUM NECESSARY TO CONDUCT BUSINESS AT
MEETINGS OF THE ZONING TASK FORCE
BACKGROUND
Over the last few months, the Zoning Task Force has been finalizing their review of the City's
Land Development Code, and formulating recommendations to the City Commission. However,
on at least two occasions recently, the Task Force has met but was unable to conduct business
because of the lack of a quorum. Because the Task Force was originally comprised of sixteen
members, the quorum requirement has been nine (9) members. As the work of the Task Force
has progressed, however, a small number of members have been unable to attend at various
times, and it has proven difficult to assemble enough members to constitute a quorum.
Therefore, the Task Force members have requested that the quorum requirement be reduced to
seven (7) members, which is a more achievable number. While every effort will continue to be
made to contact members prior to Task Force meetings, and encourage attendance by all, it is felt
that it will be much easier to ,attain a quorum of seven members, given the number of members
who may have alternative commitments which may conflict with the Task Force's meeting dates.
RECOMMENDATION
It is recommended that the resolution be approved.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION
OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING
TO THE CITY OF SOUTH MIAMI ZONING TASK FORCE ;
AMENDING RESOLUTION 253 -99 -10876 IN ORDER TO
SPECIFY THE QUORUM NECESSARY TO CONDUCT
BUSINESS AT MEETINGS OF THE ZONING TASK FORCE
WHEREAS, On December 7, 1999 The City Commission
approved Resolution No. 253 -99 -10876 creating a Zoning Task
Force for the purpose of reviewing and recommending changes
to the City's Land Development Code; and,
WHEREAS, the membership of the Task Force was
designated in the resolution to consist of sixteen citizens
representing government boards, citizens at large and
community organizations ;and,
WHEREAS, on several occasions it was difficult to have
the required quorum of nine members in order to conduct
business; and
WHEREAS, the Zoning Task Force is in its final phase of
reviewing the revised Land Development Code; and
WHEREAS, an amendment to the resolution creating the
Zoning Task Force to specify that a quorum consists of seven
(7) members would help assure that the Task Force could
complete its assignment;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That Section 2 of Resolution No. 253 -99-
10876 is hereby amended to read as follows:
"Section 2. The City of South Miami Zoning Task Force
shall be charged with the responsibilities of reviewing and
making recommendations to the City Commission regarding
necessary or useful revisions to the LDC. A quorum of seven
(7) members in attendance shall be recuired for the conduct
of Task Force business.
Section 2. This resolution shall take effect
immediately upon approval

Mutual Aid Agreement with the City of North

Staff is requesting approval to renew the Mutual Aid Agreement between the City and the City of
North Miami Beach Police Department.
BACKGROUND AND ANALYSIS:
The South Miami Police Department and the North Miami Beach Police Department have the
authority under Section 23.12, Florida Statutes, et seq., The Florida Mutual Aid Act, to enter into a
mutual aid agreement for law enforcement service which provides for rendering of assistance in a law
enforcement emergency.
RECOMMENDATION:
I recommend the approval of this Mutual Aid Agreement.

WHEREAS, the subscribing law enforcement agencies are so located in relation to each other
that it is to the advantage of each to receive and extend mutual aid in the form of law enforcement
services and resources to adequately respond to intensive situation, including but not limited to natural
or man made disasters or emergencies as defined under section 252.34, Florida Statutes; and
WHEREAS; there is the existing and continuing possibility of the occurrence of law
enforcement problems and other natural and man -made conditions which are or are likely to be
beyond the control of the services, personnel, equipment or facilities of the City of South Miami
and /or the City of North Miami Beach; and
WHEREAS, to meet the responsibility of the respective governments to ensure the public
safety of their citizens by providing adequate levels of police services, preparation must be ensured to
protect the public peace and safety and to preserve the lives and property of the people of the City of
South Miami and/or the City of North Miami Beach;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The City Manager be, and hereby is authorized to renew the Mutual Aid
Agreement between the City of South Miami, and the City of North Miami
Beach.

Staff is requesting approval to renew the Statewide Mutual Aid Agreement between the City, the State
of Florida, Department of Community Affairs and all other Florida - Local Governments.
BACKGROUND AND ANALYSIS:
The State is vulnerable to a wide range of disasters that may exceed the capability or resources of any
one local government, including the City of South Miami.
Participation in the Statewide Mutual Aid Agreement gives the City the ability to request and
coordinate Mutual Assistance in emergencies and insures the timely reimbursement of costs incurred
by local governments which render such assistance.
RECOMMENDATION:
I recommend the approval of this Mutual Aid Agreement.

cause the disruption of essential 'services and the destruction of the infrastructure needed to deliver
those services; and
WHEREAS, such disasters are likely to exceed the capability of any one local government to
cope with the disaster with existing resources; and
WHEREAS, such disasters may also give rise to unusual technical needs that the local
government may be unable to meet with existing resources, but that other local governments may be
able to offer; and
WHEREAS, the Emergency Management Act, as amended, gives the local governments of the
State the authority to make agreements for mutual assistance in emergencies, and through such
agreements to ensure the timely reimbursement of costs incurred by the local governments which
render such assistance; and
WHEREAS, under the Act of the Department, through its Division of Emergency Management
has authority to coordinate assistance between local governments during emergencies and to
concentrate available resources where needed; and
WHEREAS, the existence in the State of Florida of special districts, educational districts, and
other regional and local governmental entities with special functions may make additional resources
available for use in emergencies;
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The City Manager be, and hereby is authorized to renew the Statewide Mutual
Aid Agreement between the City of South Miami, the State of Florida,
Department of Community Affairs and all the local governments signing the
agreement.
Section 2. That this resolution be effective immediately after the adoption hereof.

The purpose of this memorandum is to recommend the approval of the attached' resolution
to purchase a Gravely ProMaster lawnmower from Ace Lawnmower Services.
BACKGROUND & ANALYSIS
We continue in the development and enhancement of all City properties. The Parks &
Recreation Department's Landscaping Division is in need of a new lawnmower. A purchase
of a Gravely ProMaster Z260ZTR Mower with 60" deck is needed to maintain City
properties. The present mowers are aging and "breakdowns" are frequent.
The Parks & Recreation Department will "piggy- back" off a Florida State Contract Bid; bid
number 4515 -630E. They will purchase the item through Ace Lawnmower Services that
recognizes this State bid.
Funds will be disbursed from account number 001 - 2050 -519 -6430, "Landscape
Maintenance - Operating Equipment ".
Available account balance is $10,000.00.
RECOMMENDATION
Approval is recommended.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH
MIAMI, FLORIDA, RELATING TO AUTHORIZING THE CITY MANAGER TO EXECUTE
AN AGREEMENT WITH BUDGET CONSTRUCTION CO., INC. FOR THE
CONSTRUCTION OF SW 41sT STREET PARKING & ROADWAY IMPROVEMENT IN AN
AMOUNT NOT TO EXCEED $53,428.00, PROVIDING AN EFFECTIVE DATE.
BACKGROUND:
The proposed SW 41' Street Parking & Roadway Improvement was advertised for construction
bids on Monday, January 7, 2002. Sixteen (16) contractors picked -up bid packages and eleven
(11) contractors submitted bids. The bids were publicly opened on Wednesday, February 6, 2002
(the last day to submit bid) at 3:05pm. Since the bid opening, the staff has tabulated the bids,
reviewed and evaluated all bids, verified references, verified bid bond and met with the lowest
responsive bidder (Budget Construction Co., Inc.) to make sure the scope of work is clearly
understood as design and specified. The bid quantities and prices were reviewed and corrected for
mathematical errors accordingly.
This much needed drainage and street improvement includes, street resurfacing for approximately
500 lineal feet of drainage improvement, thirty-three (33) on street parking stalls, landscaping and
pavement marking. The project will be partially funded through a $20,000 impact fee from the
adjacent property owner. The balance will be funded through Fiscal Year 2000 Legislative
Appropriations grant from account numbers 001- 0000 - 219 -1620 and 111- 0000 -115 -3030,
respectively.
RECOMMENDATION:
It is recommended that the City Commission approve the funding for the work to be performed.

WHEREAS, the Mayor and City Commission wishes to provide parking and
roadway improvement for the residents of the City of South Miami, and
WHEREAS, the Mayor and City Commission authorize the City Manager to
execute a construction contract with Budget Construction Co., Inc. for the construction of
SW 41st Street Parking and Roadway Improvement for an amount not to exceed
$53,428.00.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1: The City received eleven (11) bids in response to the Notice of Bid Invitation
advertised in the Miami Daily Business Review on Monday, January 7, 2002.
Section 2: The tabulated bid has been reviewed along with reference check and staff
recommended that the contract be awarded to the lowest responsive bidder: Budget
Construction Co., Inc.
Section 3: That the Mayor and City Commission authorize the City Manager to execute
an agreement with Budget Construction Co., Inc. for the construction of SW 41" Street
Parking and 'Roadway Improvement for an amount not to exceed $53,428.00 from
account numbers 001- 0000 - 219 -1620 and 111- 0000 - 115- 3030.

The The City of South; Miami will receive sealed proposals until 3:00 P.M. local time, Wednesday,
February 6, 2002, at the City Clerk's Office, City Hall, 6130 Sunset Drive, South Miami, Florida
33143, for the following project:
SW 41" Street Parking & Roadway
Improvement
The project consists of street resurfacing for approximately 500 lineal feet of drainage
improvement, and thirty-three (33) on street parking stalls, landscaping and pavement marking along SW
41st Street from SW 57`i' Avenue to SW 58`h Avenue.
Bids will be opened publicly at or shortly after 3:05 P.M. on the same date in the City
Commission Chambers in the South Miami City Hall, 6130 Sunset Drive, South Miami, Florida 33143.
Bid documents may be obtained on or after Monday, January 7, 2002 from the offices of City
Clerk and City of South Miami Engineering and Construction Department, 6130 Sunset Drive,
South Miami, Florida 33143. A $20.00 non - refundable deposit per set of plans and specifications is
required.
The bid will be awarded to the lowest responsible bidder. If, however, the City Manager deems it

BACKGROUND AND ANALYSIS
Last summer the City of South Miami submitted a grant application to the Florida Department of
Environmental Protection's Land & Water Conservation Fund (LWCF) Program. This competitive
program awarded funds for park land acquisition and park development projects. In September the City
was awarded a $150,000 LWCF Grant. Any funds spent would have to be matched dollar- for - dollar. The
matching funds will come from the City's $200,000 grant from Miami -Dade County's Trust for Safe
Neighborhood Parks.
The attached resolution would allow the City Manager to execute the contracts and documents necessary
to receive the money and move forward with this important endeavor.

Request: AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA, RELATING TO A REQUEST TO AMEND THE CITY OF
SOUTH MIAMI LAND DEVELOPMENT CODE BY REVISING SECTION 20 -4.10
ENTITLED "GARAGE SALE," IN ORDER TO CLARIFY THE REQUIRED PROOF
OF PROPERTY OWNERSHIP OR LEASE; PROVIDE FOR NOTIFICATION OF
NEIGHBORING RESIDENTS; AND TO INCREASE THE NUMBER OF GARAGE
SALES PERMITTED PER CALENDAR YEAR FROM TWO (2) TO FOUR(4);
PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN
CONFLICT; AND PROVIDING AN EFFECTIVE DATE.
BACKGROUND
The Land Development Code contains regulations governing "garage sales" (Sec.20- 4.10). The issuance
of a garage sale permit is handled by the Finance Department at the cashier's window. The LDC limits
garage sales to twice a year in single family and townhouse zoning districts only. The regulations also
specify who can apply for a permit, permitted hours of operation, size and location of signs, and
notification requirements. Based upon comments received, the City Commission recently expressed
concerns that certain requirements in the Code needed clarification, resulting in the legislation proposed
in this report.
PROPOSED AMENDMENTS
(A) Before a permit is issued the applicant must provide proof that they own or lease the property at
which the sale is to take place. The Finance Department currently requires the applicant to show a
property ownership deed, or a rental agreement. This procedure has proven to be burdensome in some
cases, and has prevented legitimate sales from being held. In order to simplify and clarify the regulations,
the City's required proof of residency could be satisfied by the showing of a utility bill, or other
identification document. The following revision (in bold) is proposed:
"(2) Before such permit shall be issued, the applicant shall file with the Finance Department an
application containing the following information:
(a) Street address or legal description where such sale is to be conducted.
(b) Proof of ownership or lease of property (deed, lease, utility bill or other LD.)."
(B) The LDC currently requires the applicant to notify residents on both sides of the sale. The regulations
do not specify as to the form of the notice, as to when it is to be given or what information is to be

transmitted. This has led to some misunderstandings and complaints. Notification is basically on the
honor system; however, it is probably not feasible for the City to assume an ongoing oversight role as far
as notification is concerned. However, the situation could be clarified and improved by having
applicants, prior to the date of the sale, be required to distribute to the neighboring properties a City
prepared form letter. The form letter would provide standard information about the specific sale and the
governing regulations (hours of operation, signage allowed, phone number to call if there are violations,
etc.). The following revision (in bold) is proposed:
"(2) Before such permit shall be issued, the applicant shall file with the Finance Department an
application containing the following information:
(e) Notification of residents of properties on both sides of applicant.

It is important to note that the ordinance also requires that the official City Garage Sale permit to be
posted prominently at the site of the sale. The combination of the delivery of an official City', notification
letter,(see attached draft notification letter), as well as the posted permit, should be enough to fully
apprise neighbors of the pending Garage Sale, while helping the applicant to simply and easily comply
with the requirements of the ordinance.
PLANNING BOARD ACTION
The Planning Board at its January 29, 2002 meeting recommended approval of the two amendments set
forth above (A) (B), and further recommended that the section of the garage sale regulations limiting the
number of sales to two per year be changed to four times per year.
(5) A garage sale shall be held only between the hours of 9: 00 a.m. to 5: 00 p.m. Personal
property shall be exhibited or displayed only within established setbacks. A sale may be
held &w four 4 times only, no more than for one weekend including Friday, per each
calendar year.
A motion recommending approval of all three amendments was made by Mr. Illas and seconded by Ms.
Gibson. The motion was approved by a vote of 7 -0.
CITY COMMISSION ACTION
The City Commission at its February 19, 2002 meeting approved on first reading an ordinance which

At that time the Commission also requested additional information on how the Finance Department keeps
tract of garage sale permits and the methods used to notify other Departments of permits issued. A
representative of the Finance Department will be present at the meeting to respond to theses concerns
RECOMMENDATION
The Administration is concerned about the proposed increase in number of garage sales permitted from
two to four per year. Garage sales can generate considerable traffic and parking problems and be overall
disruptive to the peace and quite of residential neighborhoods. The additional garage sales permitted may
act as an encouragement for residents to sell merchandise or property items which are not from the
household where the sale is taking place.
For the above reasons, the Administration is recommending that only the amendments pertaining to proof
of ownership /lease and notification of neighboring residents be adopted on second reading. The two

amendments being recommended are "user- friendly," and will help applicants to comply more easily with
the requirements of the garage sale ordinance.

place governing "dog barking." (7) Mr. Comendeiro asked the City's attorney if a City, in
the absence of a regulation, could enforce a County regulation. Mr. Figueredo advised that

Subject: The extension of the term of the contract with the city manager from October
1, 2002 to September 30, 2005.
Discussion: The term of the current contract commenced on October 1, 1999 and expires
on September 30, 2002. The purpose of extending the contract is to keep the current city
manager in place for an additional three years on the basis that the city commission and he
have taken the city to a higher level of professionalism. The contract between the city and
the city manager represents the third part of an initiative to professionalize the city
administration. Part 1 required hiring a city manager based on the individual's professional
credentials and accomplishments. Part 2 required raising the city manager's salary and
increasing benefits to make the city competitive with other cities in attracting and keeping
a professional city manager. Part 3 required entering into a contract to give the city manager
greater security in the performance of his responsibilities. Approval of the resolution
extending the contract will signify affirmation by the city commission that the program has
been successful and that it desires to continue to retain Mr. Scurf as its city manager.
Recommendation: Approve the resolution.

Subject: This memorandum presents the attached contract between the City Manager and
the City of South Miami. Entering into an employment is the third step in professional izing
the relationship between the city manager and the city commission. The first two steps were:
1) selecting a city manager based on professional capability; and 2) increasing salary and
benefits to attract qualified professionals to the city. The third step is to enter into a contract

of its prior history of experiencing high turn-over in this important position, and will
continue the work toward establishing administrative stability in the city.
Contract review: The contract creates an employment between the city manager and the
City of South Miami for an initial term of three years. It provides that the city manager will
devote substantial time to the affairs of the city and allows for limited outside employment
upon prior approval of the commission. The city manager receives the benefits stated in
section 2, including, but not limited to, an indemnification clause that provides for his
defense for any claim arising out of his employment with the city. The indemnification
clause fills a gap left by various indemnification statutes and avoids the possibility that the
city manager might have to fund his own defense until a successful conclusion of the defense
to the claim. Upon termination, the city manager will receive up to, but not exceeding, six -
months worth of compensation and benefits for the unexpired term of the agreement.' He
may elect to be constructively terminated if two commissioners make public pronouncements
calling for his resignation. The agreement provides for a due process public hearing within
30 days of being suspended without pay for alleged misconduct. In any litigation, the parties
waive jury trial, preferring to be tried before a judge. The agreement does not create a
property right to employment.
Charter review: The charter provides that the city manager is an "at will" employee of the
city. Art. II, §7.A., city charter (the city manager who shall serve at the pleasure of the
commission). According to judicial opinions, a contract with the city manager does not
change his "at will" employment as long as the commission can terminate the contract for
its convenience. The proposed contract allows the commission to do just that.
The charter also provides that, upon removal without cause, the city manager "shall
receive [his] salary for [30] days" immediately following the adoption of the resolution
terminating his employment, Art. III, §3, city charter. The provision is ambiguous: it is
either an authorization to pay salary, or a limitation on the ability to pay salary for more than
30 days. I cannot determine the intent of the provision from any interpretation of its words.
On one hand, there is no need for authorization in the charter to pay severance benefits (but
the charter contains other provisions that are not necessary). On the other hand, in the
absence of a clear expression of a limitation, such as "shall pay salary for no more than 30
days," the commission can view the provision as an authorization to pay severance and other
benefits for a period exceeding 30 days. Note: The charter review commission viewed this
provision as a limitation and declined to change it. I recommend that the commission revise
this provision at the appropriate time.

BETWEEN CITY OF SOUTH MIAMI AND
CHARLES D. SCURR
This Agreement, is made and entered into this 5th day of October, 1999, between
the City of South Miami, a Florida municipal corporation, and Charles D. Scurr.
WHEREAS, the City of South Miami and Charles D. Scurr wish to continue to
employ the services of Charles D. Scurr as City Manager of the City of South Miami; and
WHEREAS, the City and City Manager desire to provide for certain procedures,
benefits, requirements and to set working conditions regarding the employment of the
City Manager by the City.
NOW, THEREFORE, in consideration of the promises, mutual covenants,
conditions, provisions and undertakings contained in this Agreement, and for other good
and valuable consideration, the receipt and sufficiency of which is acknowledged by both
parties, the parties covenant and agree with each other as follows:
1. The

South Miami in accordance with the terms conditions and provisions
contained in this Agreement, the Charter and Code of Ordinances of the
City of South Miami, and as otherwise lawfully directed by motion or
acclamation of the City Commission.
1.2 Time Required. The City Manager recognizes the position is not and
cannot be an hourly -type employment and the City Manager shall work as
required in order to carry out his duties and responsibilities.
1.3 Outside Employment. The City Manager may engage in outside
employment so long as: 1) prior permission is received from the Mayor
and City Commission upon disclosure of the nature of the employment,
duration and the estimated number of hours per month that will be devoted
to the employment, 2) the employment does not violate the prohibition
against dual office holding and 3) the employment does not create a
potential conflict of interest or detract from the time necessary to
accomplish city work, as determined in the discretion of the City
Commission. The term "Outside Employment" shall not be construed to
mean occasional teaching, publication, pro bono activities or consulting
services performed on time off, not exceeding 5 hours a week unless
approved by the City Commission.
2. The City shall:
2.1 Employment. Continue to employ Charles D. Scurr as City Manager
consistent with the Charter and Code of Ordinances of the City of South
Miami, and as otherwise lawfully directed by motion or acclamation of the
City Commission and the terms and conditions of this Agreement.
2.2 Salary. The amount of Ninety three thousand five hundred dollars
($93,500.00) for the period beginning October 1, 1999, payable in
accordance with the regularly scheduled method ofrompensation for other
City employees and subject to adjustment in 'accordance with this
Agreement.
2.3 Annual Adjustment. Annually review the salary of the City Manager as
part of the annual budget annually in accordance with the City Charter.
The City Commission may, in its sole discretion, grant a merit salary
increase and, or, other benefits to the City Manager.
2.4 Cost of Living. COLA as approved by the City for other general
employees.
2_5 Retirement Benefits. Credit in the City retirement - system: for time
employed in other governmental entities and annual contributions to the
system.
2_6 General Expenses: The City shall pay a mont ,.., expense allowance

2.7 Professional Dues. Reasonable and customary dues, training and
subscriptions necessary for the City Manager's continued professional
participation, growth and advancement, including national and state
professional organizations.
2.8 Transportation. A car allowance of $500.00 monthly plus a- gasoline
allowance of $100.00 monthly,
or if requested by the City

car, in which event the City shall be responsible for providing for liability,
property damage and comprehensive insurance and for the purchase,
operation, maintenance, repair and regular replacement of the 'vehicle.
Entitlement to use of the City vehicle shall cease upon the City Manager's
termination or resignation.
2.9 Insurance /Medical Pay family coverage health and dental insurance
under the city plans, long term disability insurance, and life insurance in
an amount equal to annual salary, and an annual physical.
2.10 Leave. Equivalent to other City employees at senior seniority levels as
provided in the City personnel regulations.
2.11 Deferred Compensation. An annual amount equal to 11% of the City
Manager's annual salary , into the Plan on the City Manager's behalf, and
agree to transfer ownership to the City Manager of the Plan's fund upon
the City Manager's resignation or termination.

2.12Equipment. Provide the equipment necessary to perform the duties of City
Manager such as cell phone, pager and radio.
2.13 Indemnification and Defense of Claims. The City shall defend, save
harmless and indemnify the City Manager against any tort, professional
liability claim or demand or any and all other legal action arising out of an
alleged act or omission occurring in the performance of the City
Manager's duties. The City will litigate, compromise or settle any such
claim or suit and pay the amount of any settlement or judgement rendered
thereon. The City, or its insurance carrier, will provide legal
representation for the City Manager, suitable to the City Manager, for any
and all claims, proceedings or lawsuits related to or arising out of the City
Manager's affiliation with the City. This indemnification provision shall
survive the termination of this Agreement.
2.14 Bonds. Pay for any cost of bonds required pursuant to law, ordinance or
Charter.
3. Termination. The City Manager shall serve at the pleasure of the City
Commission as defined by the City Charter. Nothing in this Agreement shall
prevent, limit or otherwise interfere with the absolute right of a majority of the
full City Commission to terminate the services of the City Manager at any
times with or without cause, and without prior notice, in accordance ith

resigns his position with the City, then the City Manager shall give the 'City
Commission 60 -days written notice, in advance, unless the parties agree to
waive such notice requirement.' Termination for cause shall mean termination
for the same grounds as would result in the forfeiture of office by a
Commissioner under Article II, Section 4.A. of the City Charter.
4. Severance Terms and Conditions. Severance pay, as authorized by the Charter,
shall not be payable in the event of a voluntary resignation or termination for
cause. In the event the City Manager is terminated without cause by a majority
of the full City Commission, or the City Manager resigns following a
suggestion made in writing or at a public meeting or workshop by any two
members of the Commission that he resign, or the City Commission suspends
the City Manager without cause for more than 90 days, in which events the
City Manager may at his option be deemed terminated without cause, the City
shall pay the City Manager an amount equal 30 -days of the City Manager's
salary and accrued benefits. Any payments due to the City Manager for
severance, accrued leave or other obligations shall be paid in cash in full within
30 days of resignation or termination.

5. Suspension. The City Commission may suspend the City Manager with full
pay and benefits at any time during the term of this Agreement. The
Commission may suspend the City Manager without pay and further benefits,
but only for cause as described in Section 3 and upon giving the City Manager
at least 30 -days written notice of the charges to be heard at a public hearing on
the charges.
6. Term. The term of this Agreement shall be a three (3) year term commencing
October 1, 1999 and ending September 30, 2002.
7. Contract Payment. In the event the City Manager is terminated without cause
or the City Manager- resigns as provided in paragraph 4, the City shall
additionally pay the City Manager the balance of payments and benefits
provided for under this contract up to a maximum of six months plus one
additional month for each year of service.
8. Amendment. The provisions of this Agreement constitute the entire
understanding between the parties. Only the representations and understanding
contained herein shall be binding upon the City Commission and the City
Manager. No other representations or understanding are binding on the City

terms and conditions of this Agreement shall be effective unless approved in
writing by both parties.
9. Severability. In the event any provision of this Agreement is declared by a
court of competent jurisdiction to be invalid, the declaration shall not affect the
validity of the Agreement as a whole. or any part of the Agreement, other than
the part declared to be invalid.
10. No Property Right to Employment. The contract for employment does not
change the nature of the employment from at will employment nor create a
property right to employment under the laws of the State of Florida.
11. No Waiver. The waiver by either party of a breach of any provision of this
Agreement by the other shall not operate or be construed as a waiver of any
subsequent breach by that party.
12. Obligations Personal. The rights and obligations herein granted are personal in
nature and cannot be transferred by the City Manager.
13. Reduction of Compensation. In the event the City Commission at any time
during the employment of the City Manager, reduces the annual financial

benefits of the City Manager in a greater percentage than an applicable across -
the -board reduction for all City employees, or in the event, the Commission
refuses, following written notice, to comply with any other provision
benefiting the City Manager, then in that event the City Manager may at his
option, be deemed to be terminated within the terms outlined in Section 3 and
4 above, at the date of the reduction or the refusal, and the severance pay
provision and other termination provisions shall become applicable at the
annual salary and benefit level in effect prior to the reduction or refusal
14. Florida Law. This Agreement shall be governed by Florida law and any
litigation which may arise under, or relating to this Agreement shall be filed
and litigated in the state circuit court in Miami -Dade County, Florida.
Litigation shall not be initiated in any federal district court, nor shall any party
assert in any proceeding that this employment contract creates a federally
protected property right in employment.
15. Waiver of Right to Jury Trial. The parties knowingly waive their right to a
jury trial in any legal action arising under, or relating to, this Agreement.
16. Effective Date. This Agreement shall become effective on the date of approval
by resolution of the City Commission.

City Manager Election — Ballot Referendum
Request: A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF
SOUTH MIAMI, FLORIDA, RELATING TO CHARTER AMENDMENT;
PRESENTING AN INITIATIVE TO LIMIT BUILDING HEIGHT AND DENSITY
TO THE ELECTORATE OF THE CITY AT A SPECIAL ELECTION JUNE 18, 2002;
PROVIDING AN EFFECTIVE DATE.
BACKGROUND
The following proposed charter amendment has been submitted to the City of South Miami:
Effective February 13, 2002, all property within the City of South Miami shall retain its
height and density as measured by units per acre for residential and floor area ratio for
commercial areas, as of that date.
However, no building shall exceed 4 stories or 50 feet in height; except that any
development adjacent to (including across any street from) single-family zoned
residential property may not exceed 2 stories or 25 feet in height.
Any increase in height or density as defined above shall be subject to a vote of the
electors of South Miami.
As per Section 9 -1.1 of the City of South Miami Code of Ordinances, and Section 5.03 of the
Miami -Dade County Code of Ordinances, within 60 days of the date the charter amendment
petition was certified (January 11, 2002), the City must set the date of the election. Since no
regular election is scheduled, a special election must be held.
The special election must be held between 60 and 120 days after the meeting at which the special
election date is set. The Administration recommends that the special election be held on

According to the City Code requirements, a public hearing on the proposed charter amendment
must be held at least 60 days prior to the special election. The Administration is proposing that
this public hearing be held at a special Commission meeting, to be held on Tuesday, April 9th. At
this special commission meeting, one or more alternative proposals may be approved for
inclusion on the same ballot, as per Section 9 -1.1. If there is a need for additional time for
discussion, the public hearing may be continued at the regular Commission meeting scheduled
for April 16th and still meet the statutory requirements for the election timetable.
In order to discuss the ballot questions, and inform the Commission, City staff, and the citizenry
of the various issues impacting upon the referendum questions, it is proposed that prior to the
April 91h special Commission meeting, two special public workshops be held. The
Administration proposes that a first public workshop be held on Wednesday, March 27th which
will focus on the Transit Oriented Development District (TODD), and the second public
workshop be held on Wednesday April 3ra, which will focus on the Hometown District and also
on single - family residential area issues.
These two proposed workshops should give the Commission and the citizens enough time to
discuss all the issues related to the charter amendment, in preparation for the Special
Commission meeting public hearing to be held on April 9th. If necessary, additional workshops
could be scheduled for the time period between April 91h and the special election on June 18th.
In summary, if the proposed schedule is approved, the following events and actions would occur:
• March 5, 2002 Setting the date for the special election
• March 27, 2002 Public Workshop (Transit Oriented Development)
• April 3, 2002 Public Workshop (Hometown Plan /Downtown, Single- Family)
• April 9, 2002 Special Commission Public Hearing on Referendum (may include
possible alternative ballot questions)
• June 18, 2002 Special Election
RECOMMENDATION
It is recommended that the resolution be approved.

16 WHEREAS, pursuant to section 5.03 of the Home Rule Charter of Miami -
17 Dade County the city commission shall, within 120 days after the certification of
18 the petition, draft a resolution for presenting the initiative question to the voters
19 and schedule a special election on the question not less that 60 days and not more
20 than 120 days from the date the draft is submitted; and,

22 WHEREAS, pursuant to section 9 -1.1 of the City of South Miami Code of
23 Ordinances, a public hearing shall beheld not less than 60 days before the election
24 and copies of the proposed amendment shall be made available to the public less
25 than 30 days before the election ;` and,

Section 2. The special election shall be scheduled for June 18, 2002. If
a majority of voters voting in the election approve the amendment to the charter,
all provisions of the charter, the land development code and the code of ordinances
in conflict shall be repealed.
Section 3. This resolution shall take effect immediately upon approval.

Sec. 9 -1. State Election Code adopted for municipal elec-
tions.
All general and special elections held in the City of South
iVliami, Florida, shall be held and conducted in accordance with
the provisions of Chapter 4328, Laws of Florida, Acts 18951, and
the acts amendatory thereof and supplementary thereto, as
nearly as practicable; provided, that the city commission shall
perform all acts in relation to such general land special election,
which by state law is made the duty of the county commissioners.
Provided that no person under guardianship, idiotic or insane,
convicted of felony, nor any person convicted of bribery, perjury or
larceny, or of any infamous crime, or being interested in any bet
or wager, the result of which shall depend upon any election; or of
fighting a duel, or of sending or knowingly carrying or accepting
ha'.l`enge to fight a duel, or being a second to either partly tL, r
r'uel, and not restored to civil ri hts shall be qualified tc vote at
any such election.

Sec. 9-1.1. Charter amendment elections.
Pursuant to the requirements of section 5.03 of the Home Rule
Charter of Dade County, Florida, the procedure for the drafting or
having drafted of a proposed charter, amendment, revocation, or
abolition of the government of the city, shall be by the method of:
(1) Accepting for submission to referendum any draft of a
proposed charter, amendment, revocation or abolition
contained in a petition certified to contain the signatures
of ten (10) per cent of the qualified electors of the city.

(2) Having prepared by the city attorney and approved by the
city commission (either with or without the prior prepa-
rations and approval of a charter board or committee), a
resolution or resolutions calling referenda providing for
the adoption, amendment or revocation of the charter to
the city or to abolish its existence.
(3) That alternative proposals may be submitted to the
electors.
(4) That a public hearing to be held on the proposed amend -
ments, revocation or abolition of the charter, not less than
sixty (60) days before the election.
(5) That copies of any proposed amendment or amendments
shall be made available to the electors not less than thirty
(30) days before the election.
(6) That each proposal approved by a majority of the electors
voting on such proposal shall become effective at the time
Fixed in the proposal.
( i') That a copy of each approved amendment shall be certi-
fied by the -city clerk and filed with the Clerk of the
Circuit Court in and for Dade County, Florida.

Sec. 9 -2. Qualifications of electors.
Any person who shall possess the qualifications requisite to an
election at general state elections, and shall have resided in the
City of South Miami six (6) months next preceding any election,
and shall have been registered in the registration book of the city
shall be a qualified elector of the city.

county would maintain continuous right to exercise all powers
whether granted by own charter, by special act or general
state statute was invalid and unconstitutional in part, but not
to such an extent that submission of the amendment to the
electorate was improper. Dade County and Cicero and Girt-

Sec. 5.02. Municipal powers.
Each municipality shall have the authority to
exercise all powers relating to its local affairs not
inconsistent with this Charter. Each municipality
may provide for higher standards of zoning, ser-
vice, and regulation_ than those provided by the
Board of County Commissioners in order that its
individual character and standards may be pre -
served for its citizens.
Sec. 5.03. Municipal charters.
(.A) Except as provided in Section 5.04, any
:'icipality in the county may ad -,pt, amei:rl, c:
revoke a charter for its own government or.abol-
ish its existence in the following manner. Its
governing body shall, within one hundred twenty
(120) days after adopting a resolution or after the
certification of a petition of ten (10) percent of the
qualified electors of the municipality, draft or
have drafted by a,method determined by munici-
pal ordinance a proposed charter, amendment,
revocation, or abolition which shall be submitted
to the electors of the municipalities. Unless an
election occurs not less than sixty (60) nor more
than one hundred twenty (120) days after the
draft is submitted, the proposal shall be submit-
ted at a special election within that time. The

may be submitted. Each proposal approved by a
majority of the electors voting on such proposal
shall become effective at the time fixed in the

(B) All municipal charters, amendments thereto,
and repeals thereof shall be filed with the Clerk of
the Circuit Court.

Sec. 5.04. Changes in municipal boundaries.
(A) The planning director shall study munici-
pal boundaries with a view to recommending
their orderly adjustment, improvement, and es-
tablishment. Proposed boundary changes may be
initiated by the Planning Advisory the
Board of County Commissioners, the governing
body of a municipality, or by a petition of any
person or group concerned.
(B) The Board of County Commissioners, after
obtaining the approval of the municipal govern-
ing bodies concerned, after hearing the recommen-
dations of the Planning Advisory Board; and after
a public hearing, may by ordinance effect bound-
ary changes, unless the change involves the an-
nexation or separation of an area of which more
than two hundred fifty (250) residents are elec-
tors, in which case an affirmative vote of a major -
ity of those electors voting shall also be required.
Upon any such boundary: change any conflicting
boundaries set forth in the charter of such munic-
ipality shall be considered amended.

Sec. 5.05. Creation of new municipalities.
The Board of County Commissioners and only
the Board may authorize the creation of new
municipalities in the unincorporated areas of the
county after hearing the recommendations of the
Planning Advisory Board, after a public hearing,
and after an affirmative vote of a majority of the
electors voting and residing ��ithin the',proposed
boundaries. The Board of County Commissioners
shall appoint a Charter Commission, consisting of
five (5) electors residing Within the proposed

WE THE UNDERSIGNED registered voters of the City of South Miami, Miami -Dade
County Florida, do hereby file this petition to amend the City Charter of South Miami
and request that the following Charter Amendment be submitted to the registered voters
of the City of South Miami:
Effective February 13, 2002, all property within the City of South Miami
shall retain its height and density as measured by units per acre for
residential and floor area ratio for commercial areas, as of that date.
However, no building shall exceed 4 stories or 50 feet in height; except
that any development adjacent to (including across any street from) single-
family zoned residential property may not exceed 2 stories or 25 feet in
height.
Any increase in height or density as defined above shall be subject to a
vote of the electors of South Miami.
