The applicant is requesting approval of a variance from Section 20- 3.5(E) of the Land Development Code to allow a building site to have a lot frontage of 73.47 feet as opposed to the minimum required frontage of 75 feet in an RS -3 zoning district. The variance is necessary if a companion application to allow a waiver of plat creating two parcels at the same address is approved. The lot requiring the frontage variance is identified as Parcel "A ". In June of 2002 this parcel was part of a waiver of plat application which was approved by the City Commission after administrative review. At that time the submitted survey showed the parent parcel to have 150 feet of frontage and each of the two created lots having the minimum required 75 feet of frontage. The applicant in following a routine procedure to file an amended plat document (replat) with the County, discovered that the frontage of the parent parcel was actual 1.53 feet less than 150 feet, an error made by the surveyor who sealed the waiver of plat document. The result is that the County would not accept the replat and Parcel "A" actually has a substandard frontage of 73.47 feet. The only way for the applicant to correct the situation is to submit a revised plat and obtain a new waiver of plat approval from the City of South Miami. The revised application includes the variance allowing for the substandard lot to be used as a building site. Variance 5837 SW 82 St. November 16, 2004 APPLICABLE REGULATIONS (See ATTACHMENTS) • Land Development Code Section 20- 3.5(E) "Dimensional Requirements" • Land Development Code Section 20 -5.9 "Variances Approvals" • Land Development Code Section 20 -6.1 (B) "Planning Board Duties " STAFF OBSERVATIONS The applicant, in a letter of justification and hardship, indicates that this error was discovered by the surveyor of record, but was caused by a discrepancy in the legal description and the site based monuments. These discrepancies are the basis for the hardship. • The applicant's claim of hardship has been brought about by errors made on behalf of the property owner; • In the original waiver of plat application, the City Administration depended upon the property owner and the surveyor to present correct measurements; • The proposed variance, if granted, would confer on the applicant a special status not being made available to other properties in the immediate vicinity. PLANNING BOARD ACTION Based upon the staff observations set forth above, the Planning Board at its August 10, 2004 meeting adopted a motion by a vote of 5 ayes 2 nays (Ms. Gibson, Mr. Illas) to recommend denial of the application. RECOMMENDATION It is recommended that the variance request be denied. A variance approved pursuant to Section 20 -5.5 shall lapse after six (6) month if no substantial construction or change of use has taken place in accordance with the request for such variance and if the city commission has not specified a longer approval period for good cause shown. (B) Extension of Variance Approvals. Four (4) affirmative votes of the city commission may grant an extension to a previously approved variance if a proper and timely request is made by the applicant prior to the expiration of the six (6) month period. (C) Hardship Statement. All applications for a variance shall include a letter of intent indicating the specific nature of the hardship upon which the request is based. (D) Property Survey Required. Tract A will be 1.53 ft shorter in width but will still be 1808.09 square feet larger than the 10,000 required with the RS -3 zoned district. The difference in width for tract A will still provide a suitable and compatible reside. The setbacks provided will be a§ indurated on the RS-3 zone, no alterations.
