A RESOLUTION OF THE MAYOR & CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA, RELATING TO A REQUEST FOR A

PROPERTY LOCATED AT 5837 SW 82 STREET, SOUTH MIAMI, FLORIDA
WITHIN AN "RS -3" LOW DENSITY SINGLE - FAMILY RESIDENTIAL
ZONING USE DISTRICT; AND PROVIDING FOR AN EFFECTIVE DATE
SUMMARY OF REQUEST.
The applicant is requesting approval of a variance from Section 20- 3.5(E) of the Land
Development Code to allow a building site to have a lot frontage of 73.47 feet as opposed
to the minimum required frontage of 75 feet in an RS -3 zoning district. The variance is
necessary if a companion application to allow a waiver of plat creating two parcels at the
same address is approved. The lot requiring the frontage variance is identified as Parcel
"A ". In June of 2002 this parcel was part of a waiver of plat application which was
approved by the City Commission after administrative review. At that time the submitted
survey showed the parent parcel to have 150 feet of frontage and each of the two created
lots having the minimum required 75 feet of frontage.
The applicant in following a routine procedure to file an amended plat document (replat)
with the County, discovered that the frontage of the parent parcel was actual 1.53 feet
less than 150 feet, an error made by the surveyor who sealed the waiver of plat document.
The result is that the County would not accept the replat and Parcel "A" actually has a
substandard frontage of 73.47 feet.
The only way for the applicant to correct the situation is to submit a revised plat and
obtain a new waiver of plat approval from the City of South Miami. The revised
application includes the variance allowing for the substandard lot to be used as a building
site.

STAFF OBSERVATIONS
The applicant, in a letter of justification and hardship, indicates that this error was
discovered by the surveyor of record, but was caused by a discrepancy in the legal
description and the site based monuments. These discrepancies are the basis for the
hardship.
• The applicant's claim of hardship has been brought about by errors made on behalf of
the property owner;
• In the original waiver of plat application, the City Administration depended upon the
property owner and the surveyor to present correct measurements;
• The proposed variance, if granted, would confer on the applicant a special status not
being made available to other properties in the immediate vicinity.
PLANNING BOARD ACTION
Based upon the staff observations set forth above, the Planning Board at its August 10,
2004 meeting adopted a motion by a vote of 5 ayes 2 nays (Ms. Gibson, Mr. Illas) to
recommend denial of the application.
RECOMMENDATION
It is recommended that the variance request be denied.

• Land Development Code Section 20 -5.9 Variances Approvals
(A) Expiration of Variance Approvals. A variance approved pursuant to
Section 20 -5.5 shall lapse after six (6) month if no substantial
construction or change of use has taken place in accordance with
the request for such variance and if the city commission has not
specified a longer approval period for good cause shown.
(B) Extension of Variance Approvals. Four (4) affirmative votes of
the city commission may grant an extension to a previously
approved variance if a proper and timely request is made by the
applicant prior to the expiration of the six (6) month period.
(C) Hardship Statement. All applications for a variance shall include
a letter of intent indicating the specific nature of the hardship
upon which the request is based.
(D) Property Survey Required. All applications for a variance shall
include a current property survey prepared by a registered
surveyor.
(E) Neighborhood Concurrence. All applications for a variance shall
be accompanied by a map which reflects all properties and the
names of all property owners within a five hundred (500) foot
radius of the subject property. The applicant shall obtain and
submit the signatures of at least twenty (20) percent of such
property owners, indicating their awareness of the proposed
variance request.
(F) Proposed Site Plan Required. A site plan shall be required
showing all proposed buildings and setbacks and any other
features relating to the variance request.
(G) Permitted Variance Requests. Applications for variances shall be
restricted to only the following:
(1) Yard setbacks
(2) Lot size
(3) Lot coverage
(4) Building height
(5) Fences and walls

extraordinary conditions relating to a specific property, and when

WHEREAS, Mr. Rick Ruiz, representing the owner of the property located at 5837 SW
82"d Street, has submitted Application No. PB -04 -012 to the Planning Department, said
application requesting approval for a variance from Section 20- 3.5(e) of the Land Development
Code to allow the lot frontage of a building site to be 73.47 feet, where a minimum of 75 feet is
required on property within an "RS -3" Single - Family Residential use district; and
WHEREAS, a previous application for waiver of plat for the same property was approved
by the City in June 2002; however said application contained a surveyor's error requiring the
submission of a new waiver of plat application and a variance application pertaining to
substandard lot frontage; and
WHEREAS, the Planning Department recommended denial of the application because the
claim of hardship was based upon errors made on behalf of the property owner; and
WHEREAS, the approval of a variance requires a recommendation from the Planning
Board and the approval of the City Commission after a public hearing; and
WHEREAS, on August 10, 2004 the Planning Board, after public hearing, adopted a
motion by a vote of 5 ayes, 2 nays to recommend denial of the variance request.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA, THAT:
Section 1: That the subject Application No. PB -04 -012 submitted by Mr. Rick Ruiz, representing
the owner of the property located at 5837 SW 82nd Street requesting approval for a variance from
Section 20- 3.5(e) of the Land Development Code to allow the lot frontage of a building site to be
73.47 feet, where a minimum of 75 feet is required on property within an "RS -3" Single - Family
Residential use district, is hereby approved.

In pmducing the plat for recording purpose the city assigned surveyor as well as the sur-
veyor of record found a discrepancy in which the legal description as well as the site based
references, this.discrepancy artered the width of the full frontage parcel frorn 150 feet to
148.47 ft..
One lot will be effected by the requirement of lot frontage of 75 feet that is tract A, tract S
will stay with no change as set in the resolution.
Tract A will be 1.53 ft shorter in width but will still be 1808.09 square feet larger than the
10,000 required with the RS -3 zoned district.
The difference in width for tract A will still provide a suitable and compatible reside. The
setbacks provided will be a§ indurated on the RS-3 zone, no alterations.
Our client had always relied that 1550' ft. was the width from time of purchase as indicated
on surveys.

Action: Mr. Morton read the item into record. Mr. O'Donniley presented his staff report. He

Mr. Ruiz urged the Board members to consider this application on its own and to take into
consideration the hardship caused by the surveyor's error.
