AN ORDINANCE OF THE M1?4YOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORA, RELATING TO PROCUREMENT OF
PROFESSIONAL SERVICES ; "AMENDING SECTION 2 -78 (A)(B)(C)(E) AND
(F) OF 'FI_Mr,CODE OF ORDINANCES ENTITLED "SELECTION OF PERSONS
QUALIFIED, INTERESTED AND AVAILABLE; PROVIDING FOR
CODIFICATION, PROVIDING FOR CONFLICT, PROVIDING FOR
SEVERABILn Y, AND AN EFFECTIVE DATE."
WHEREAS, it is the desire of this Commission to ensure that impartiality is practiced and
maintained during the selection process for professional services for the City of South Miami; and
WHEREAS, the citizens of this community trust in this elected Body to make the best
possible decisions on his/her behalf, therefore, it is incumbent upon this Commission to ensure
that, that which has been entrusted to them, be protected and preserved for the betterment of the
City.
NOW, THEREFORE, BE IT ORDAII M BY THE CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA. THAT:
Section 1. Section 2 -78 (a)(b)(c)(e) and (f) of the Code of Ordinance, entitled Selection
of persons qualified, interested and available" is hereby amended as follows:
(a) The Mayor and the City Commission shall appoint ye (5) iindij &al% with each
Commission member nominating one candidate for appointment, Lo on an RFP/RFO
Committee, for the sole p=ose of detemining recommending to the c�y Manager and the City
Commission those individuals to be the best qualified to grovi a �;ofessional services under
section 2 -77 of the Code. The _city manazer shall designate_the_snnropriate director to serve as
liaison to the Committee.
(b) The best qualified selection shall be based upon the RFP/RFO Committee's
menagei4 ability to differentiate qualifications applicable to the scope and nature of the services
to be performed.
(c) The city manager RFP/RFO Committee shall determine qualifications, interest, and
availability by reviewing written responses received that express an interest in performing the
services, and when necessary, by conducting formal interviews of selected respondents that are
determined to be the best qualified based upon the evaluation of written responses.

(e) The RFP/RFO Committee upon conclusion of itA task shall submit to

Section 2. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are repealed.
Section 3. This ordinance shall be codified and included in the Code of Ordinances.
S_ e n 4. if any Section, clause, sentence, or phrase of this ordinance is for any reasoa,
held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect
the validity of the remaining portions of this ordinance.
Sectio 5. This ordinance shall take effect immediately upon enactment.

resolution.
Section 2. All ordinances or parts of ordinances in conflict with the provisions
of this ordinance are repealed.
Section 3. This ordinance shall be codified and included in the Code of
Ordinances.
Section 4. If any section, clause, sentence, or phrase of this ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
