08-03-04 Item 1bBACKGRODUND The South Miami City Commission at its June 1, 2004 approved on first reading a' proposed amendment to the Land Development Code that would permit adult entertainment establishments as a permitted use in the City's industrial zoning district. The ordinance also provided for distance requirements between adult establishments and churches, schools, parks, playgrounds and residential uses, and between individual adult establishments. During discussion it was felt that before final adoption of the Adult Entertainment ordinance it would be appropriate for the City to review a survey as to the number and location of adult establishments in surrounding jurisdictions (up to five miles from the City's boundary lines). The City Commission felt that information from the survey would help determine the number of establishments (if any) which could or should be accommodated in the City. Staff was requested to estimate the cost of doing this type of study including an estimate of the distance from the City which should be included in the survey. Staff advised that a limited portion of the survey and data collection could be carried out by in house staff, however, the bulk of the research including field studies would require an outside consultant to assist. It was estimated that the additional cost would be $5250 (70hrs x $75) to be funded from the Contingency Account. The City Commission at its June 8, 2004 meeting approved the expenditure. REQUEST FOR PROPOSAL ISSUED In mid June an RFP was sent out to a number of South Florida planning consulting firms (attached). The local firm of Corradino Group, Inc. submitted a complete response to the RFP and estimated that the work could be completed in 30 days and would cost $8580 (see attached letter). RECOMMENDATION The Planning Director has advised that staff has collected considerable data from abutting municipalities which will be helpful to any consultant hired, and which may allow for the August 3, 2004 Page 2 of 2 negotiation of the remaining work to be done within the approved budget. Staff is requesting direction from the City Commission as to attempting to negotiate with the consultants It is important to note that at the time the ordinance was being considered, the City's attorney advised that this type of survey may be informative, however, recent Court decisions mandate that each municipality must still provide potential locations for adult establishments. SCOPE OF SERVICES In order to provide the information needed the survey should extend five miles out from the City's boundaries and should include in a report format: (1) A map showing all of the zoning use districts in each jurisdiction which potentially would allow an adult establishment; (2) A summary of each jurisdictions' LDC regulations applicable to the location of an adult establishment; (3) A listing by name, address, and type of all of the of adult establishments located within the five mile distance survey area; (4) A map showing the location of each of adult establishment identified in (3) above. The selected consultant will be expected to make one summary presentation of the survey results to the Planning Board or City Commission. RFP Adult Entertainment Page 2 of 2 SCHEDULE The survey work, data collection, map and report should be completed within 30 days of signing a contract for services. The City of South Miami will provide a copy of the proposed adult entertainment ordinance as well as copies of the City's LDC and zoning map. RFP CONTENT (1) Each RFP submission shall provide a task work program, projected costs by tasks, and other costs associated with completing the survey. Responders may add additional tasks or steps necessary to complete the study. (2) A list of personnel and resumes who will participate in the study. (3) A list of recent consultant assignments; and an identification of any consulting assignments similar to the City's RFP. (4) Standard forms identifying any licenses or professional certifications held. (5) Standard forms related to adherence to non — discrimination policies. SUBMISSION REQUIREMENTS (1) Proposals ( five signed and sealed copies) must be submitted to Ms. Maria Menendez, City Clerk, City of South Miami, 6130 Sunset Drive, South Miami, FL., 33143 no later than 3:00 PM on Monday, July 12, 2004. Proposals shall be clearly identified: "RFP — PLANNING CONSULTANT" (2) All proposals will be opened on Monday, July 12, 2004 at 3:15 PM in the South Miami City Commission. (3) All proposals will be evaluated by the City's Planning Director and City Manager. Selection will be based on relevant experience, comprehension of the assignment as evident by the work tasks set forth, and the most appropriate cost estimate. (4) The City of South Miami reserves the right to reject any and all proposals with or without cause; to waive any or all irregularities with regard to the specifications and to make the award to the consultant offering the greatest advantage to the City.
