RESOLUTION
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA SUSPENDING A CONTROLLED PARKING
RESIDENTIAL AREA (CPRA) IN THE VICINITY OF SW 58TH AVENUE AND
SW 74TH TERRACE WHICH AREA WAS DESIGNATED BY THE CITY
MANAGER AS A CPRA AT THE CITY COMMISSION MEETING ON APRIL
22, 2003, AND DIRECTING THE ADMINISTRATION TO REMOVE ALL
RESIDENTIAL PARKING SIGNS AND TO REVOKE ALL RESIDENTIAL
DECALS AND VISITOR PARKING HANGING TAGS; PROVIDING FOR AN
EFFECTIVE DATE.
BACKGROUND
The City Commission, at its August 5, 1986 meeting, adopted Ordinance No. 10-86 -
1255 which established the designation of controlled parking residential areas. This
ordinance allowed for the City Manager, after study, to designate by appropriate
signage, areas in which the parking of vehicles may be restricted on public streets only
to vehicles bearing a valid residential parking permit issued pursuant to the terms set
forth in the ordinance. The 1986 ordinance was re- adopted by the City Commission on
June 3, 2003 via Ordinance No. 14 -03 -1798 and is now incorporated in the South Miami
City Code as Section 15 -99.
During the period February — April, 2003, the City Administration met on a number of
occasions with a group of residents living immediately south of the downtown. The City
Commission at its April 22, 2003 meeting, considered a recommendation from the City
Manager, that for a six month trial period, a controlled parking residential area be
designated in the vicinity of SW 58th Avenue and SW 74th Terrace and that the parking
enforcement be 6 PM to 7 AM, Monday- Friday and 24 hours on the weekend and
holidays. The City Commission concurred with the City Manager's recommendation of
a six month trial period and also concurred with the request of residents that the
enforcement time should be 24 hours every day. The City Manager in May, 2003
implemented the controlled parking residential area.

CURRENT STATUS
The City Manager has conducted a re- evaluation of the controlled parking residential
area in the vicinity of SW 58th Avenue and SW 74th Terrace and has determined the
following:
(1) The recently completed "Downtown Parking Study" (April, 2004) confirmed that
there is a critical shortage of over 1600 parking spaces in the downtown area ;
(2) A significant number of residents and downtown business owners have complained
to the City Administration regarding the loss of parking due to on -going street
construction;
(3) The residential parking restrictions currently in place are underutilized and have had
a negative impact on parking availability and has added to traffic congestion and illegal
parking in the vicinity of the downtown.
RECOMMENDATION
Based upon the above described re- evaluation, the City Manager is recommending the
suspension of the controlled parking residential area in the vicinity of SW 58th Avenue
and SW 74th Terrace and the removal of all residential parking signs in the targeted area.
The need for controlled residential parking in this area should be re- evaluated at a future
date after completion of all downtown infrastructure improvements.
Due to the City Commission's direct involvement in the subject residential parking area,
it would be appropriate for the Commission to concur with the action suggested by
approving the attached draft resolution.

WHEREAS, the above mentioned ordinance allowed for the City Manager, after
study, to designate by appropriate signage areas in which the parking of vehicles may be
restricted on public streets at times during the day only to vehicles bearing a valid residential
parking permits issued pursuant to the terms set forth in the ordinance; and
WHEREAS, the City Commission at its April 22, 2003 meeting, considered a
recommendation from the City Manager that for a six month trial period a controlled parking
residential area be designated in the vicinity of SW 58th Avenue and SW 74th Terrace and
that the parking enforcement be 6 PM to 7 AM, Monday- Friday and 24 hours on the
weekend and holidays; and
WHEREAS, the City Commission at its April 22, 2003 meeting concurred with
the City Manager's recommendation of a six month trial period and also concurred with the
requests of residents that the enforcement time should be 24 hours every day; and
WHEREAS, the City Manager in May, 2003 implemented a controlled parking
residential area in the vicinity of SW 58th Avenue and SW 74th Terrace; and
WHEREAS, the City Manager has recently been informed by the "Downtown
Parking Study" (April, 2004) of the critical shortage of parking in the downtown area; and
WHEREAS, the City Manager has been contacted by residents and downtown
business owners regarding the further loss of parking due to on going street construction; and

WHEREAS, the City Manager has conducted an re- evaluation of the controlled

74t Terrace and has directed the removal of all residential parking signs and to revoke all
residential decals and visitor parking hanging tags.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. The City Commission hereby concurs with the actions of the City Manager to
suspend the controlled parking residential area in the vicinity of SW 58th Avenue and SW
74t Terrace and to have all residential parking signs removed and all residential decals and
visitor parking hanging tags revoked.
Section2. That the need for a controlled parking residential area in the vicinity of SW 58th
Avenue and SW 74th Terrace should be re- evaluated at a future date after completion of all
downtown infrastructure improvements.
Section 3. This resolution shall be effective immediately after the adoption hereof.
