06-08-04 Item 2bBACKGRODUND The City Commission at its June 1, 2004 approved on first reading a proposed amendment to the Land Development Code that would permit adult entertainment establishments as a permitted use in TODD (LI -4), Transit Oriented Development District (Light Industrial -4) Zoning Use District. The ordinance approved also provided for distance requirements between adult establishments and churches, schools, parks, playgrounds and residential uses, and between individual adult establishments. ADDITIONAL STUDY REQUESTED During discussion it was felt that the maximum number of establishments that could be located in South Miami should take into consideration the location of these uses in surrounding jurisdictions. Staff was requested to estimate the cost of doing this type of study including an estimate of the distance from the City which should be included in the survey. It was directed that the information from this study be brought back to the Planning Board for its consideration. It is important to note that in August, 2003, in anticipation of a legal action, the City did a quick survey to determine how many establishments similar to Booby Trap were in nearby jurisdictions. A total of five similar establishments were found within a 5 mile radius of the Booby Trap establishment. This survey was limited to adult dancing establishments. PROPOSED SURVEY In order to provide the information needed the survey should: (1) Include all of the different types of adult establishments permitted (book store, video store, theater). (2) Include and locate on a map all of the zoning use districts in each jurisdiction which potentially would allow an adult establishment;. (3) Include all property a minimum of five miles distance out from the City's boundary lines. LDC Amendment Adult Entertainment Page 2 of 2 A limited portion of the survey and data collection can be carried out by in house staff, however, the bulk of the research including field studies will require an outside consultant to assist. It is estimated that the additional cost would be $5250 (70hrs x $75) This amount would be funded from the Contingency Account which has a current balance of $40,3540 RECOMMENDATION It is recommended that the City Commission authorize the Planning Department to utilize outside consultants, if necessary, to assist in the field and research work for an amount not to exceed $5250.
