RESOLUTION
A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI,
FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH TJ
PAVEMENT CORP. FOR THE INSTALLATION OF NEW GUARD -RAIL ALONG THE CANAL
BANKS ON MANOR LANE FOR AN AMOUNT OF $5,800.00, TO BE CHARGED TO PUBLIC
WORKS DEPARTMENT STORM WATER TRUST FUND ACCOUNT NUMBER 111- 1730 -541-
3450; PROVIDING FOR AN EFFECTIVE DATE
BACKGROUND & ANALYSIS
In our continued efforts to provide maintenance and safety within our rights -of -way and along
our canal system, it has been determined that the guardrails along the carnal system at Manor
Lane need to be replaced. In conforming to our construction process on small projects, we
requested proposals from several contractors. TJ Pavement Corp. was the only company willing
to perform the small project. TJ Pavement Corp. is, in part, willing to perform the work because
they are currently engaged on a project in the City close to the site, which means they would not
incur additional costs for mobilization. Other companies are not interested because the project is
too small, complex and not cost effective, especially with the added mobilization cost.
As a result, we recommend executing an agreement with TJ Pavement Corp. as a sole source
contractor for the project. The current balance for the referenced account is $16,265.00.
RECOMMENDATION
It is recommended that the City Commission approve the resolution.

WHEREAS, the Mayor and City Commission wish to replace guardrails along Manor Lane canal
banks and;
WHEREAS, TJ Pavement Corp. is the only contractor interested in performing this small project
and;
WHEREAS, the Mayor and City Commission authorize the City Manager to execute a construction
contract with TJ Pavement Corp. as the sole source contractor for the replacement of 140 lineal feet of guardrail
at the canal on Manor Lane.
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA:
Section 1: That the City Manager is authorized to execute a construction contract for $5,800.00
with TJ Pavement, Corp. for the construction of 140 lineal feet of guard rail along the canal at
Manor Lane;
Section 2: That the amount of $5,800.00 will be charged to Public Works Department Storm
Water Trust Fund Account Numbers 111- 1730 -541 -3450.
Section 3: That this resolution shall become effective immediately upon adoption.

Owner hereby agrees to accept full responsibility for all fences, sidewalks, all underground pipes, wires, septic tanks, drain lines, wells, etc

Owner is liable in full amount of contract in the event owner cancels after work has started.
The co shall not be responsible for damage or delays do to strikes, fires, accidents, or the others cause beyond its control, not for inherent
defects In the premises on which work to be done.
In the event of any default of this contract by owner -owner egress to pay all cost and reasonable attomeys` fees incurred by T J Pavement
Corp as a result of said default.
All materials are guaranteed to be as specified. All work to be completed in a workmanlike manner according to standard practims. Any
alteration or deviation from above spec'if'ication involving extra cost will be executed only upon written orders and will become an extra
charge over and above the estimate.
This proposal subject to acceptance within ,180 days and to void thereafter at the option of the under signed.
Work shall begin within 10 days of this contract being signed by all parties here and return to the oo.
