EFFECTIVE DATE.
BACKGROUND AND ANALYSIS
After advertising the open position of City Clerk on October 19, 2003, the Human Resources
Department received and reviewed 25 r6sum6s for that post (see the attached). The only one of
those resumes reflecting a person with even the minimum requested qualifications (a CMC —
Certified Municipal Clerk - designation or enrollment in the CMC program) was from our
interim City Clerk Maria Menendez. Since assuming the role of interim Clerk, Ms. Menendez
has performed the day -to -day functions of that position in a thoroughly professional manner. She
has recently endured the most stressful task and day falling under the purview of any municipal
clerk, the running of a city election. She did so in an exemplary manner, allowing no
improprieties or questions of impropriety to taint this exercise at the heart of democracy. She has
been recommended for the position of City Clerk by our current City Manager Maria Davis, and
as Mayor, I heartily endorse Maria Menendez for that position as well.

10 WHEREAS, pursuant to article II, section 7 of the City of South Miami
11 Charter the Mayor and City Commission is vested with the power to appoint a city
12 clerk; and

14 WHEREAS, Maria M. Menendez has been serving as City Clerk for the
15 City of South Miami on an Interim basis since being appointed by resolution on
16 September 16th 2003; and
17
18 WHEREAS, an outside search and review of 25 resumes has been
19 conducted to fill the position of City Clerk, with the only one meeting the
20 minimum qualifications being Maria Menendez; and
21
22 WHEREAS, an evaluation has shown that Ms. Menendez has performed
23 her duties, including conducting a successful and untainted election, and
24 performing the day to day responsibilities of the City Clerk in a proficient and
25 professional manner since assuming the interim position; and
26
27 WHEREAS, based upon the performance evaluation and the review of the
28 other applicants for the position, the Mayor and City Commission desire to
29 appoint Maria M. Menendez to serve as the City Clerk of the City of South Miami.

31 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
32 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;

34 Section 1. That Maria M. Menendez is appointed City Clerk of the City
35 of South Miami and, upon acceptance of the appointment and approval of an
36 employment contract, shall serve in that position. The commencement, salary,
37 benefits and other terms and conditions of the City Clerk's employment shall be as
38 determined in the contract.

A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
CITY OF SOUTH MIAMI, FLORIDA RELATING TO THE CITY
CLERK; ESTABLISHING CRITERIA AND GUIDELINES FOR
SELECTION PROCESS FOR CITY CLERK; PROVIDING AN
EFFECTIVE'DATE.
WHEREAS, the South Miami City Commission wishes to establish a process for the
selection and hiring of a City Clerk; and
WHEREAS, the City Clerk serves at the pleasure of the City Commission and shall be
responsible for giving notice, attending all Commission meetings, keeping the minutes and
records of all of the proceedings of the Commission, preserving all books, papers and writing of
all kinds committed to his or her care during his or her tenure; keep the corporate seal of the City
and affix the seal when lawfully directed; administer oaths; have charge of the conduct of
municipal elections; act as Supervisor of Registration; and perform such other duties as shall be
required by this Charter or by General Laws of the State of Florida unless restricted by the Home
Rule Amendment provisions of Miami -Dade Dade County.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;
Section 1. The following criteria is to be followed in selecting a City Clerk: 1) City
Clerk Selection Committee, which shall consist of Former City Clerk Ronetta Taylor, the
Village Clerk of the Village of Pinecrest and the City Clerk of the City of Miami; Advertisement
shall be placed in the Miami Herald, and Florida Association of City Clerk's Association; 2)
Qualifications skull may include: BA in Public Administration or related field preferred; CMC
(Certified Municipal Clerk) Status or . �� to enroll in and actively attending
classes of CMC Academy; 3) HR will be responsible for the collection and forwarding of
applications to the City Clerk Selection Committee; 4) The Committee shall select up to dH:ee
five candidates for interviews before the City Commission.
Section 2. This resolution shall take effect immediately upon approval.

am currently a doctoral student in public administration at Florida International
University concentrating on management and information technology (IT). So far, my

City of South Miami. In October of 1999 I began to work for Micaela M. Alvarez, Esq.
In this office I was mainly responsible for all the immigration cases, even though I also
drafted divorce complaints and related documents, Wills, C.I.S., Real Estate documents
and others. Usually the clients would come to the office and had an initial interview with
the attorney and then the case will go to me. I interviewed the client for a second time to
be. more accurate in the way of handling the case. I would fill out all the necessary
documentation and basically took care of the client in every need from that point on.
When difficult cases came to my attention, for example an S Visa or an asylum case
without sufficient grounds, the attorney and I would discuss the case to find the correct
approach. I was also in charge of drafting all the Motions to the Bureau of Citizenship
and Immigration Services, Immigration Court, and Board of Immigration Appeals, as
well as some motions going to the Superior Court of New Jersey. In addition, I was in
charge of doing all the legal research in the office by using the AILA and Kurzban
immigration books, Superior Court books and the Internet.
Also, I tvas in charge of ordering office supplies, making the office checks and
maintaining in order all the accounts, as well as answering the phone, filing and general
secretarial Nvork.
I was forced to leave any job due to the fact that my family moved to 1\&ami,
Florida and i decided to follow them. t am a hard worker and a law - abiding citizen. I am
hoping to work in an environment where I could use my knowledge and further my
education. I would like to have an interview with you in order for me to further
