MENENDEZ; PROVIDING AN EFFECTIVE DATE. BACKGROUND AND ANALYSIS After advertising the open position of City Clerk on October 19, 2003, the Human Resources Department received and reviewed 25 resumes for that post (see the attached). The only one of those resumes reflecting a person with even the minimum requested qualifications (a CMC — Certified Municipal Clerk - designation or enrollment in the CMC program) was from our interim City Clerk Maria Menendez. Since assuming the role of interim Clerk, Ms. Menendez has performed the day -to -day functions of that position in a thoroughly professional manner. She has recently endured the most stressful task and day falling under the purview of any municipal clerk, the running of a city election. She did so in an exemplary manner, allowing no improprieties or questions of impropriety to taint this exercise at the heart of democracy. She has been recommended for the position of City Clerk by our current City Manager Maria Davis, and as Mayor, I heartily endorse Maria Menendez for that position as well. RECOMMENDATION Your approval is recommended. MENENDEZ; 7 PROVIDING AN EFFECTIVE DATE. 8 9 10 WHEREAS, pursuant to article II, section 7 of the City of South Miami 11 Charter the Mayor and City Commission is vested with the power to appoint a city 12 clerk; and 13 14 WHEREAS, Maria M. Menendez has been serving as City Clerk for the 15 City of South Miami on an Interim basis since being appointed by resolution on 16 September 16th, 2003; and 17 18 WHEREAS, an outside search and review of 25 resumes has been 19 conducted to fill the position of City Clerk, with the only one meeting the 20 minimum qualifications being Maria Menendez; and 21 22 WHEREAS, an evaluation has shown that Ms. Menendez has performed 23 her duties, including conducting a successful and untainted election, and 24 performing the day to day responsibilities of the City Clerk in a proficient and 25 professional manner since assuming the interim position; and 26 27 WHEREAS, based upon the performance evaluation and the review of the 28 other applicants for the position, the Mayor and City Commission desire to 29 appoint Maria M. Menendez to serve as the City Clerk of the City of South Miami. 30 31 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY 32 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA; 33 34 Section 1. That Maria M. Menendez is appointed City Clerk of the City 35 of South Miami and, upon acceptance of the appointment and approval of an 36 employment contract, shall serve in that position. The commencement, salary, 37 benefits and other terms and conditions of the City Clerk's employment shall be as 38 determined in the contract. 39 40 Section 2.
