03-02-04 Item 11JYO� 5 0 iI T rj7 f EV � U ^" INCOR PORATED ' 1927 + L0RX9 CITY OF SOUTH MIAMI To: Honorable Mayor, Vice Mayor and Commission From: Maria Davis 1 City Manage Dater March 2, 2004 Agenda Item 4 Re: Appeal of ERPB Decision 6141 Sunset Drive; Site Plan RESOLUTION A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO AN APPEAL FROM A DECISION OF THE ENVIRONMENTAL REVIEW AND PRESERVATION BOARD REGARDING THE APPROVAL OF A SITE PLAN AND FOUR STORY BUILDING LOCATED AT 6141 SUNSET DRIVE BACKGROUND In October, 2003 Sunset Development, LLC filed an application with the Environmental Review and Preservation Board (ERPB) for site plan and building design approval for the construction of a 4 story medical office building to be located on a .7 acre heavily wooded vacant tract of land at 6141 Sunset Drive. After review and minor modifications, the ERPB at its December 16, 2003 meeting, gave final approval of the application. The Board did not stipulate any conditions related to the preservation or relocation of the 39 trees located on the site. It is important to note that the plans of a previous developer of this site (Gold's Gym) in 2001 would have required the removal of all trees on the site. That developer was in the process of negotiating a contribution to the South Miami Tree Trust Fund in lieu of preserving or relocating trees when the entire project was abandoned. The donation procedure is allowed by a provision in the landscaping regulation in the Land Development Code. It is generally used as a last resort, when removal or relocation is not feasible. CURRENT SITUATION The Land Development Code assigns the authority to review, modify and approve landscape elements of a site plan to the ERPB. This is the reason for a recent amendment to the ERPB membership section mandating a professional landscape architectural position on the Board. As part of its landscape review authority the Board can regulate the relocation and or the removal of existing trees. The actual tree removal process requires a permit issued by the Planning Department. The appropriate issuance of this type of permit administratively is greatly enhanced if there are recommendations or guidelines from the ERPB. (2) In January, 2004 the new developer of the 6141 Sunset Drive site approached the Planning Department concerning a tree permit to remove 29 of the 39 existing trees on the site. In that the ERPB did not address the issue of tree removal, the Acting Planning Director advised the City Manager of the situation and suggested that the ERPB decision should be appealed. The City Manager on January 30, 2004 appealed the ERPB approval action for this site stating that the decision should be modified to include relocation or replacement of the existing trees on the site which are designated for removal. The appeal stays any development from proceeding on the site. RECOMMENDATION: It is recommended that the City Commission approve the appeal and remand the application back to the ERPB for specific action regarding the removal /relocation of the existing on site trees. At this time, the plans have been resubmitted for final review. The applicant is proposing to build a four -story professional medical office building. The irregular shaped property has an area of 31,134 sf. or 0.71 acres. The site is currently a vacant lot and the zoning classification is the Transit Oriented Development District (TODD MU- 4 /MU -5), in which a medical office use is permitted by right. Please refer to the Zoning Legend for additional information, sheet A -1. Due to the ERPB reviews and comments, the corner building has improved significantly. At this time, the applicant seeks final approval of the site plan and building design from the ERPB.
