RESOLUTION A RESOLUTION OF THE MAYOR & CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO A REQUEST FOR A VARIANCE FROM SECTION 20- 3.5(E) OF THE LAND DEVELOPMENT CODE TO ALLOW THE SECOND STORY INTERIOR SIDE SETBACK OF A BUILDING TO BE 7.5 FEET, WHERE A MINIMUM OF 15 FEET IS REQUIRED ON PROPERTY WITHIN AN "RS -3" SINGLE- FAMILY RESIDENTIAL USE DISTRICT, LOCATED AT 6023 SW 61 SREET, SOUTH MIAMI, FLORIDA, AND LEGALLY DESCRIBED AS LOT 28, BLOCK 1, "CAMBRIDGE LAWNS PARK" PLAT BOOK 50, PAGE 4; AND PROVIDING FOR AN EFFECTIVE DATE SUMMARY OF REQUEST The applicant is requesting approval of a variance from Section 20- 3.5(E) of the Land Development Code to allow the second story side setback on a second story addition to an existing single family house to be 7.5 feet where a minimum of 15 feet is required. APPLICABLE REGULATIONS (See ATTACHMENT) • Land Development Code Section 20-3.5(C)(1) Dimensional Requirement Tables • Land Development Code Section 20-3.5(E) Dimensional Requirements • Land Development Code Section 20 -5.9 Variances Approvals BACKGROUND & ANALYSIS It is important to note that the current setback standard for second stories in residential zones was amended by the City Commission in September of 2003, as part of a lot overcrowding concern expressed by many residents. The resulting ordinance changed the dimensional requirements for all single family zones by mandating that the second story of a home must be setback on the side yard further than the first floor. In the RS -3, Single family use district , the side interior setback for the first floor is 7.5 feet; the setback for the second story is 15 feet. - ____ IT Variance Approval — 6023 SW 61 Str. March 2, 2004 Page 2 of 3 In October, 2001 the applicant submitted plans for a building permit to remodel the existing 1835 sq ft structure by constructing a two story addition (total of 1558 sq.ft.) on the west side of the home. The applicant has stated that the plans submitted met all of the required side setbacks (7.5 feet) existing at that time. The applicant failed to respond to comments made by permit review officers for an extended period (over 2 years) and in accordance with the Florida Building Code, the Building Department voided the permit application. In November, 2003 the applicant re- submitted the same plans including the two story addition. The submitted plans show the west side setback to be 7.5 feet for both the ground floor and second story addition. Based upon the current dimensional requirements adopted by the City Commission on September 2, 2003, the second story setback must be 15 feet thereby resulting in the applicant's variance application. In addition the total square footage of the second floor must not exceed 60% of the ground floor square footage. The size of the applicant's second story, 779 square feet, is below the maximum allowed square footage. The applicant complies with the second story limitation. STAFF OBSERVATIONS • The permit application submitted in November, 2003 is considered a new application requiring adherence to current LDC dimensional standards. The application states that the hardship involved is a result of the City adjusting the setback requirements after their submission of the original permit application, which was voided. The applicant's claim of hardship has been brought about by actions of the applicant / property owner in that the owner failed to implement the permit received in 2001. • The property is located in a residential area where all of the surrounding homes are one story. The addition of the partial second story as shown, would detract from the architecture of the building and would have an adverse impact on the neighboring property owners. • The proposed variance, if granted, would confer on the applicant a special status not being made available to other properties in the immediate vicinity. PLANNING DEPARTMENT RECOMMENDATION Based upon the concerns set forth above the Planning Department staff recommended denial of the variance application. Variance Approval — 6023 SW 61 Str. March 21 2004 Page 3 of 3 PLANNING BOARD ACTION The Planning Board at its January 13, 2004 meeting adopted a motion by a vote of 6 Ayes 0 Nays recommending denial of the application. Side Setback Interior: 15 Second story (above 12' high as measured.... • Land Development Code Section 20 -5.9 Variances Approvals (A) Expiration of Variance Approvals. A variance approved pursuant to Section 20 -5.5 shall lapse after six (6) month if no substantial construction or change of use has taken place in accordance with the request for such variance and if the city commission has not specified a longer approval period for good cause shown. (B) Extension of Variance Approvals. Four (4) affirmative votes of the city commission may grant an extension to a previously approved variance if a proper and timely request is made by the applicant prior to the expiration of the six (6) month period. (C) Hardship Statement. All applications for a variance shall include a letter of intent indicating the specific nature of the hardship upon which the request is based. (D) Property Survey Required. All applications for a variance shall include a current property survey prepared by a registered surveyor. (E) Neighborhood Concurrence. The applicant shall obtain and submit the signatures of at least twenty (20) percent of such property owners, indicating their awareness of the proposed variance request. (F) Proposed Site Plan Required. A site plan shall be required showing all proposed buildings and setbacks and any other features relating to the variance request. (G) Permitted Variance Requests.
