A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, AUTHORIZING THE CITY MANAGER TO ENTER INTO AN INTERAGENCY AGREEMENT WITH MIAMI SHORES POLICE DEPARTMENT, VIRGINIA GARDENS POLICE DEPARTMENT, AND MICCOSUKEE POLICE DEPARTMENT TO PROVIDE WIRELESS ACCESS TO THE FLORIDA CRIME INFORMATION CENTER NETWORK; AND PROVIDING AN EFFECTIVE DATE. BACKGROUND & ANALYSIS Since June of 2001, the Police Department has had wireless technology to access the State and National Criminal Information Network. This is a key feature of the MDT (Mobile Data Terminal) project. The hardware requirements for the wireless service are one frame relay, one router, wireless air cards for each terminal, and one server. The Police Department has been approached by three law enforcement agencies requesting to share the use of the frame relay and the use of the server being used to operate their MDT's. These agencies are Miami Shores Police Department, Virginia Gardens Police Department and Miccosukee Police Department. These three agencies currently use AT &T wireless for their services; however, they do not have a frame relay. They are currently utilizing Indian River County Sheriffs' Department frame relay service and server. Effective November 2003, Indian River County Sheriffs' Department changed their wireless service provider and these other agencies need to either change carriers or purchase a frame relay and server. There is no cost to our city for other agencies to use our frame relay and server. However, there would be a monthly charge to maintain and support the frame relay and server for each agency. WHEREAS, the South Miami Police Department has used wireless technology since June 2001 to access state and national criminal information networks and WHEREAS, the hardware requirement for wireless technology service are a frame relay, router, air cards, and server, WHEREAS, Miami Shores Police Department, Miccosukee Police Department, and Virginia Gardens Police Department, currently use wireless technology but do not have a frame relay and WHEREAS, the South Miami Police Department has available access to provide those agencies with a frame relay for a monthly user fee per IP address; NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1. The City manager be authorized to enter into an inter - agency agreement with Miami Shores Police Department, Virginia Gardens Police Department, and Miccosukee Police Department to provide wireless access; Section 2. The funds that are obtained from the charges to these three Police Departments would be placed into an account to be used solely to repair, maintain, replace and purchase equipment for the MDT Project within the Police Department. The benefits of this agreement would be a savings of $510 monthly, which would normally come from the Operating Equipment account of the Police Department. I. AGENCY REQUIREMENTS: 1. Abide by all provisions of the standard Florida Department of Law Enforcement (F.D.L.E.) Criminal Justice User Agreement (current and future revisions) that are applicable to access, and affirm through execution of this agreement to abide by all terms and conditions of the same. 2. Obtain and provide the required Law Enforcement Agency ORI and Neumonic Identifier for each IP address requesting access to the system. 3. Provide hardware and software (client and server) and wireless data communications compatible with the Police Department's Aether /Cerulean Mobile Data System. 4. Provide an agency approved listing of Law Enforcement personnel using legal names and social security numbers for account access. 5. Appoint and supply a single point of contact for the agency with the name, rank, telephone number, facsimile number and e -mail address (where possible). IL ACCEPTABLE USE: 1. Utilization of a user account must be in support of law enforcement, associated research and administrative functions and must be consistent with the objectives of a law enforcement agency. 2. Use of other organization's networks or computer resources must comply with the rules appropriate for that network or system. Inclusive of those rules established by FDLE for operation and access to their systems. 3. Publication, ownership or transmission of any material in violation of any U.S., state or local regulation is prohibited. This includes, but is not limited to copyrighted material, threatening or obscene material or material protected by trade secret. 4. All communications and information accessible via the network should be considered private property. 5. Use of the network for product advertising or political lobbying is prohibited. 6. Illegal activities are strictly prohibited and will be investigated and prosecuted to the fullest extent of the law. 7. All communication must use appropriate language, be polite and business related. The use of profanity, vulgarities, and racial /ethnic statements or harassment of other users is prohibited. 8. Electronic mail is not private and can be reviewed without notification to the user. Any user of the e -mail system for the purpose of supporting illegal activities will be investigated and prosecuted. II. PRIVILEGE: The use of the Police Department computer system and network is a privilege. Inappropriate use can result in cancellation of those privileges. Based upon the acceptable use guidelines outlined in this agreement, the system administrator will deem what is inappropriate use of the network and take appropriate actions. All users are expected to abide by the terms and conditions above. If the perspective users cannot abide by any or all of the term and conditions set forth in this document, then they will be advised to acquire access through an alternative information management source. 2. The system administrator(s) will terminate any account, as required, for any violation of this agreement. 3. Electronic mail in the Aether /Cerulean Packet Cluster Patrol system has no expectation of privacy and may be reviewed without notification to the user. I1I. SECURITY — Security on any computer system is a high priority. 1. If you feel you can identify a security problem on the Police Department network you must notify South Miami Police Department's system administrator or send e -mail to bedney_gcityofsouthmiami.n.et. 2. Do not demonstrate the problem to other users. 3. Users may not, under any circumstances, use another individual's account. 4. Do not give your password to any other individual. 5. Attempts to log in to the system as any other user may result in suspension or termination of user privileges. 6. Attempts to log into the system or network as an administrator will result in immediate termination of the user account. 7. Authorized users only may view automated information obtained via the agreement. No user will disseminate or provide information to non -law enforcement persons. Any non -law enforcement request for information will be forwarded to the agencies Records Unit as a public record request. 8. RELIABILITY — The Police Department makes no warranties of any kind, whether expressed or implied, for the service it is providing. South Miami Police Department will not be responsible for any damages you suffer. This includes loss of data resulting from delays, non - deliveries, mis- deliveries, or service interruptions caused by its own negligence or your errors or omissions. Use of any information obtained via the Police Department's computer and network is at your own risk. South Miami Police Department denies any responsibility for the accuracy or quality of information obtained through its computer network services. 9. INDEMNITY — The user specifically agrees to indemnify the Police Department or any if its employees for any loss, costs, or damages, including reasonable attorneys' fee incurred by the User or South Miami Police Department and their employees relating to or arising out of any breech of this agreement. VII. EXCEPTIONS OF TERMS AND CONDITIONS — All terms and conditions as stated in this document are applicable to South Miami Police Department and all subscribers. These terms and conditions reflect the entire agreement of the parties and supersede all prior oral or written agreements and understandings of the parties. These terms and conditions shall be governed and interpreted in accordance with the laws of the State of Florida. Summary: In review, applicants are advised that South Miami Police Department computer system and associated network is provided for the specific purpose of supporting the mission goals and objectives of the law enforcement community. All users are expected to abide by the provisions of this agreement.
