BACKGROUND & ANALYSIS
Native Landscaping Service, Inc. has been the City's landscaping and maintenance
contractor for US -1 and Sunset Drive medians. Native Landscaping Service, Inc. had a
maintenance agreement for the past year and maintained both medians. This one year
agreement will be funded through Public Works Department's account number 001-1730 -
541 -34�O with an account balance of $41,206 -42.
RECOMMENDATION
It is recommended that the City Commission authorize the City Manager to execute the
agreement.

FLORIDA, AUTHORIZING THE CITY MANAGER TO EXECUTE A MAINTENANCE SERVICES
AGREEMENT WITH NATIVE LANDSCAPING SERVICE, INC. FOR US -1 & SUNSET DRIVE
MEDIAN MAINTENANCE IN AN AMOUNT OF $38,870 TO BE CHARGED TO PUBLIC WORKS
DEPARTMENT ACCOUNT 001- 1730 -541 -3450; PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Mayor and City Commission wishes to provide much needed landscaping
improvements and maintenance, and;
WHEREAS, Native Landscaping Service, Inc. had a maintenance agreement with the City of South
Miami and;
NOW THEREFCRE, be it RESOLVED by the MAYOR AND CITY Commission of the CITY OF
SOUTH MIAMI, FLORIDA:
Section 1. The City Manager is authorized to extend an existing agreement with Native
Landscaping Service, Inc. for the landscaping improvements and median maintenance until November 30, 2006
pursuant to all of the terms and conditions of the initial agreement made and entered into on November 5, 2002.
Section 2. The City Manager is hereby authorized to release $38,870.00 for 12 month's
worth of landscape maintenance to the City's medians.
Section 3. This resolution shall become effective immediately upon adoption thereof.

Specifications:
u All turf areas shall be mowed with rotary mowers 1 time each 14 days. Total number of mowing cuts per year: 26.
❑ Mowing height shall be no less than 3.0" for St. Augustine grass, as measured on a flat, paved surface. Mowing
height in shaded areas shall be slightly higher.
• All debris and/or litter shall be removed from turf areas prior to mowing.
• Injuries to tree trunks, exposed roots and shrub bases shall be avoided by either mowing at a greater height or by
mowing around them and hand trimming later.
• All edges along bed lines, tree rings, parking lots, driveways, sidewalks, etc. shall be mechanically edged during
each mowing service.
❑ All bed lines, tree rings and free - standing specimens shall be mechanically edged around the perimeter of mulch
applications.
❑ Weeds shall be removed on an on -going basis throughout the year in all landscaped areas, including the removal
of fallen palm fruits, and tree /palm seedlings (volunteers).
❑ Dead and /or diseased plant material will be removed and replaced with materials furnished by the City of South
Miami.
❑ Charges for added materials (i.e. mulch, fertilizer, insecticide, fungicide) are not included in this service: They can
be supplied as per client's request and billed seperately according by time and material.
Terms:
❑ Self- renewing contract: This contract will be automatically renewed every year unless otherwise specified in
writing within 30 days.
❑ Cancellation: This contract may be cancelled by either party with a 30 -day written notice of cancellation:
❑ The billing for bi- weekly payments will commence when first service is performed, with succeeding payments as
services are completed.
u Any monies not paid within 30 days will bear interest at 1.5% per month, annual rate 18.0 %. In the event that
collection becomes necessary, the customer shall become responsible for all costs of collection, including
reasonable attorney's fees.
Conditions:
❑ Contractor is not responsible for unintentional damage to landscape, lawn, pavement or sprinklers which results
from the use of specialized equipment.
Landscape Maintenance — Bi- weekly Fee $ 1,495.00
The above prices, specifications and conditions are satisfactory and hereby accepted. You are authorized to do the work
indicated above for the bi- weekly fee of $1,495.00. Payment will be made as outlined above.
