Davis City Manager RESOLUTION: South Miami baftild ft 2001 Date: December 6, 2005 Agenda Item # A Re: Requesting Charter Amendments to be Placed on February 14, 2006 General Election Ballot A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO CHARTER AMENDMENTS; PROPOSING AMENDMENTS TO THE CHARTER; SUBMITTING BALLOT QUESTIONS TO THE ELECTORATE OF THE CITY AT THE GENERAL ELECTION SCHEDULED FOR FEBRUARY 14, 2006; REPEALING PROVISIONS IN CONFLICT; PROVIDING AN EFFECTIVE DATE. BACKGROUND & ANALYSIS: Over the past two years of operations, staff and the City Clerk made observations regarding existing charter language which inhibits the efficient and effective operation of the City. Six ballot questions are being suggested by the administration for the February 2006 general election. The questions deal with the following topics: • Including a mandatory attendance provision for members of City boards and committees. This amendment would provide for automatic removal of any board or committee member after three unexcused absences during any one year. This provision would encourage regular attendance and decrease the number of meetings cancelled due to lack of quorum • Reducing the requirements for a quorum for the Planning Board from five members to four members. This provision would also decrease the number of cancelled meetings due to a lack of quorum, particularly important for the Planning Board that is mandated by the City Charter. • Allowing the Finance Director, with the approval of the City Manager to transfer up to $10,000 of available surplus funds from one budget account to another account with deficit within the same fund, at any given time during the fiscal year. Currently, the City charter prohibits the Finance Department from transferring funds from any account with surplus to another account that funds might be needed without a resolution adopted by the City Commission. This current provision is causing unnecessary delay in processing invoices for payment, and sometimes makes it difficult to acquire goods and/or services. We recommend that the attached resolution be adopted, placing the charter amendment questions on the February 14, 2006 ballot.
