12-06-05 Item 8I ORDINANCE NO. 2 3 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF 4 THE CITY OF SOUTH MIAMI, FLORIDA RELATING TO THE YEAR 5 2006 GENERAL ELECTION OF THE MAYOR AND CITY 6 COMMISSIONERS FOR GROUPS, I AND IV; SCHEDULING THE 7 DAY, PLACE AND TIME OF THE ELECTION; PROVIDING FOR 8 QUALIFICATION OF CANDIDATES; PROVIDING FOR CLOSE OF 9 ELECTION BOOKS; APPROVING THE OFFICIAL BALLOT; 10 PROVIDING FOR NOTIFICATION; PROVIDING FOR 11 SEVERABILITY, ORDINANCES IN CONFLICT, AND AN EFFECTIVE 12 DATE. 13 14 WHEREAS, Section 2, Article V, of the City of South Miami Charter provides 15 that the City Commission of the City of South Miami shall schedule a general election for 16 February of each even year, and that the Mayor shall be elected for a term of two (2) 17 years and commissioners shall be elected for terms of four (4) years at the general 18 election; and 19 20 WHEREAS, the Charter requires the City Commission of the City of South Miami 21 to schedule the day, place and time of the general election by ordinance; and 22 23 WHEREAS, state law requires election books to close thirty (30) days prior to the 24 election. 25 26 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 27 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: 28 29 Section 1. The 2006 General Election will be held on Tuesday, February 14, 30 2006. On that date, a mayor will be elected to serve a term of two (2) years, and two (2) 31 Commissioners, from Groups I and IV, will be elected to serve a term of four (4) years. 32 33 Section 2. The qualifying period for this election shall open Tuesday January 3, 34 2006 at 9:00 a.m. and close Tuesday, January 10, 2006, precisely at 5:00 p.m. 35 Candidates shall qualify at the office of the City Clerk, 6130 Sunset Drive, South Miami, 36 Florida. 37 38 Section 3. Voting shall be conducted at City Hall in the City Commission 39 Chambers, 6130 Sunset Drive, South Miami, Florida. The official ballot for the 2006 general election is annexed to this ordinance. Section 5. The election books shall close Monday, January 16, 2006. Section 6. The City Clerk shall publish notice of such general election once a week for four consecutive weeks next preceding the general election in a newspaper of general circulation in South Miami. The notice shall contain the date, time, and place of the general election and identify the Commission Groups and proposed Charter revisions to be voted for. Section 7. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 8. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are repealed. Section 9. This ordinance shall take effect immediately upon approved.
