11-15-05 Item 16i'6 RESOLUTION NO. A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA RELATING TO THE FEBRUARY 14, 2006 GENERAL ELECTION OF THE MAYOR AND CITY COMMISSIONERS FOR GROUPS, I AND IV; PROVIDING FOR ADDITIONAL LABOR HOURS TO CONDUCT EARLY VOTING IN THE AMOUNT OF $3,920.50 TO BE CHARGED TO ACCOUNT NO. 011 -1200 -512 -4920 `ELECTIONS'; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of South Miami desires to schedule the day, place and time of early voting by resolution; and WHEREAS, the early voting requires additional Miami -Dade County Election's Office staff labor hours to conduct early voting; and WHEREAS, the amount of $3,920.50 to pay for the additional labor to conduct early voting will be charged to account no. 011 - 1200 -512 -4920, with a current balance of $ 9,000.00. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA: Section 1. That early voting for the 2006 General Election will be conducted Thursday, and Friday, February 9 and 10, with the polls opening precisely at 7:00 a.m., and closing precisely at 3:00 p.m.; and Saturday, February 11, with the polls opening precisely at 9:00 a.m., and closing precisely at 5:00 p.m.. Section 2. Voting shall be conducted at City Hall, 6130 Sunset Drive, South Miami, Florida. Section 3. The City Clerk shall publish notice of such general election once a week for four consecutive weeks next preceding the general election in a newspaper of general circulation in South Miami. The notice shall contain the date, time, and place of the general election and identify the commission groups. Section 4. This resolution shall become effective upon adoption thereof. The 2413 absent elector shall execute the certificate on the envelope. 2414 (3) In lieu of the voter's certificate provided in this 2415 section, the supervisor of elections shall provide each person 2416 voting absentee under the Uniformed and Overseas Citizens 2417 Absentee Voting Act with the standard oath prescribed by the 2418 presidential designee. 2419 Section 45. Subsection (1) of section 101.657, Florida 2420 Statutes, is amended, present subsection (2) of that section is 2421 renumbered as subsection (4), and new subsections (2) and (3) 2422 are added to that section, to read: 2423 101.657 Early voting.- - 2424 (1)(a) As a convenience to the voter, the supervisor of 2425 elections shall allow an elector to vote early in the main or 2426 branch office of the supervisor by depesiting the veted ballet e 2427 in a veting eleviee— used —by the— shervlse-r te eelleet er tabulate 2428 ballets. In order for a branch office to be used for early 2429 voting, it shall be a permanent full se-rviee facility of the 2430 supervisor and shall have been designated and used as such for 2431 at least 1 year prior to the election. The results or tabulation of votes cast during 2437 early voting may not be made before the close of the polls on 2438 election day. Results shall be reported by precinct. 2439 (b) The supervisor shall designate each early voting site 2440 by no later than the 30th day prior to an election and shall 2441 designate an early voting area, as defined in s. 97.021, at each 2442 early voting site. 2443 (c) All early voting sites in a county shall be open on 2444 the same days for the same amount of time and shall allow any 2445 person in line at the closing of an early voting site to vote. 2446 (d)449-} Early voting shall begin on the 15th day before an 2447 election and end on the 2nd day before an election. For purposes 2448 of a special election held pursuant to s. 100.101, early voting 2449 shall begin on the 8th day before an election and end on the 2nd 2450' day before an election. The 2463 supervisor is not required to conduct early voting if it is 2464 provided pursuant to this subsection. 2465 (f) Notwithstanding the requirements of s. 189.405, 2466 special districts may provide early voting in any district 2467 election not held in conjunction with county or state elections. 2468 If a special district provides early voting, it may designate as 2469 many sites as necessary and shall conduct its activities in 2470 accordance with the provisions of paragraphs (a) -(c). The 2471 supervisor is not required to conduct early voting if it is 2472 provided pursuant to this subsection. 2473 (2) During any early voting period, each supervisor of 2474 elections shall make available the total number of voters 2475 casting a ballot at each early voting location during the 2476 previous day. Each supervisor shall prepare an electronic data 2477 file listing the individual voters who cast a ballot during the 2478 early voting period. This information shall be provided in 2479 electronic format as provided by rule adopted by the division. 2480 The information shall be updated and made available no later 2481 than noon of each day and shall be contemporaneously provided to 2482 the division. 2483 (3) The ballot of each elector voting early shall be 2484 counted even if the elector dies on or before election day. 2485 Section 46. Thank you, Rena A. Salter Accountant 3 Miami-Dade County Elections Department Hi Maria; Regarding the early voting (EV) estimate for $1,200 per site per day that was recently provided to you. Generally speaking,this amount is for an early voting effort involving multiple sites. If a municipality decides to hold EV at only one site, the estimate may be closer to $1,000 per day. The cost of EV increases exponentially when additional sites are added to the effort. Please note that regarding the reimbursement of salary for staff assigned to early voting, it is the Elections Department's practice to only charge the municipality for the overtime cost of permanent . county employees. However, the total salary (regular and overtime hours) of seasonal employees is passed onto the municipalitybolding the election. In 2004, the City of South Miami held early voting at one site for five (5) days (Monday-Friday) leading-up to the General Election held on February loth. Although the municipality was ultimately charged $3,160.57, the originally cost for the 2004 EV was $4,185. You are now requesting a cost estimate for three (3) consecutive eight hour days of Early Voting at one (1) site. The EV days would include one day (Saturday) on the weekend which involves overtime for staff assign to the EV site. The co I st estimate would total $3,920.5. The breakdown of the total is: EV Staff - 8 seasonal employees each working a total of 16 hours of regular time hours, and 11 hours of overtime; hourly pay rate is $12.74 Supervisory staff — 1 permanent employee (only the, overtime salary would be charged to the municipality; 11 hours of overtime at an OT hourly rate of $26.31 Transportation cost $50 (assuming no need to rent trucks to deliver and collect the Your concern of why the cost estimate is much higher than the actual EV cost in 2004 is understandable. Please keep in mind that whenever possible the Elections Department utilizes permanent county staff to work the early voting staff; hence saving the municipality cost of the salary for seasonal employees. Our experience shows that eight employees and one Supervisor must be assigned to each early voting site. WHEREAS, the City Commission sitting as a Canvassing Board, has examined the election results of the General Election of the City of South Miami, Florida, held on February 12, 2002, as certified by the Supervisor of Elections and declares the said election results to be proper and correct and, having counted and recorded the absentee ballots in the manner provided by law; and WHEREAS, there was a provisional ballot cast during the election on February 12, 2002, which was later determined to be a valid ballot by Miami Dade County Election Division to be a valid ballot; and WHEREAS, on February 13, 2002 that ballot was opened by the Miami Dade County Election Division and counted; and WHEREAS, the total votes cast in said election for each candidate is as follows: MA FOR'S RACE Eddie Dominguez Received 220 votes Julio Robaina Received 1,354 votes COMMISSIONER GROUP I Dan McCrea Received 451 votes Craig Z. Sherar Received 274 votes Randy G. Wiscombe Received 841 votes COMMISSIONER GROUP IV Charete Plummer Received 476 votes Mary Scott Russell Received 1,024 votes Willard (Buzz) Williams Received 81 votes NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA; Page 1 of 2 Section 1. That Julio Robaina has been re- elected Mayor for a term- ending February 10, 2004; Randy G. Wiscombe has been reelected for Commissioner in Group I, for a term ending February 14, 2006; and Mary Scott Russell has been elected for Commissioner in Group IV for a term ending February 14, 2006.
