A. Roll Call: The following members of the City Commission were present: Mayor Mary Scott Russell, Vice Mayor Velma Palmer and, Commissioners Randy G. Wiscombe, Marie Birts - Cooper and Craig Z. Sherar. Also in attendance were: City Attorney Luis Figueredo, City Manager Maria V. Davis and City Clerk Maria M. Menendez. B. Invocation: The invocation was delivered in silence. C. Pledge of Allegiance: The Pledge of Allegiance was recited in unison. D. Presentations: (NONE) ITEMS (S) FOR THE COMMISSION'S CONSIDERATION: 37 -05 -1859 1. AN EMERGENCY ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, DECLARING A WEATHER EMERGENCY PURSUANT TO SECTIONS 14.05 AND 14.12 OF ORDINANCE NO. 11 -93 -1539; GIVING THE CITY MANAGER THE NECESSARY AUTHORITY AND DIRECTING HER TO TAKE ALL NECESSARY AND APPROPRIATE ACTIONS TO PREPARE FOR AND RESPOND TO HURRICANE WILMA; PROVIDING FOR SEVERABILITY, ORDINANCES IN CONFLICT AND AN EFFECTIVE DATE. 4/5 (City Manager) Moved by Mayor Russell, seconded by Commissioner Wiscombe to approve this item. SPECIAL CITY COMMISSION MINUTES - October 26, 2005 1 P 1 Ms. Davis presented the item. She explained that our Code 2 of Ordinances require that we invoke an emergency ordinance to 3 allow her, as the City Manager, to take appropriate action to 4 respond to the recent natural disaster as the result of 5 Hurricane Wilma. AN EMERGENCY ORDINANCE OF THE MAYOR AND CITY 20 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, 21 RELATING TO PAYMENT OF EXPENDITURES INCURRED DURING A 22 WEATHER EMERGENCY RESULTING FROM HURRICANE WILMA; 23 PROVIDING THE CITY MANAGER THE AUTHORITY TO USE 24 EXISTING CASH RESERVES FOR RELATED EMERGENCY 25 EXPENSES; AND AUTHORIZING THE CITY MANAGER TO APPLY 26 FOR ANY AVAILABLE ASSISTANCE TO REIMBURSE THE CITY 27 FOR THE FUNDS EXPENDED; PROVIDING FOR SEVERABILITY, 28 ORDINANCES IN CONFLICT AND AN EFFECTIVE DATE. 4/5 29 (City Manager) 30 31 Moved by Commissioner Sherar, seconded by Commissioners 32 Wiscombe and Birts- Cooper to approve this item. 33 34 Ms. Davis explained that this ordinance addresses authority 35 for the City Manager to clean up the City and utilize cash 36 reserves to clean up debris from Hurricane Wilma. She said that 37 our expenses are now up to $1.3 million; $200,000 of that came 38 from a balance that we had in our General Fund from our 04/05 39 fiscal year; therefore, that leaves us with $1.1 million in 40 expenditures out of cash reserves. Staff has been meeting with 41 FEMA on a regular basis. We will be getting those reimbursements 42 back, except for 12.5 percent of the $1.1 million. 43 44 Commissioner Wiscombe asked Ms. Davis for an itemized list 45 of the expenditures and the receipts. He also requested that 46 anything that comes back from FEMA goes back into the cash 47 reserves, because this is our hurricane money. Ms. Davis explained that we have approximately $900,000 in the cash reserves. Commissioner Wiscombe then asked from where the rest of the money would be coming from. Ms. Davis said that we anticipate getting our first reimbursement quite shortly. With no further comments or discussion, the motion to approve this item passed by a 5 -0 vote: Commissioner Wiscombe: Yea Commissioner Sherar: Yea Vice Mayor Palmer: Yea Commissioner Birts- Cooper: Yea Mayor Russell: Yea COMMISSION REMARKS Commissioner Sherar expressed concern about the curfew imposed by the County after Hurricane Wilma. He said that this is causing a lot of inconvenience to residents who work during the day and need to try to find gas or other articles of necessity in the evening. Mayor Russell said that during the peak of the hurricane there was a robbery in South Miami. She said this as an illustration for which the curfew is designed to give the police the tool to keep people with ill intentions off the streets and to protect the community. Commissioner Wiscombe added that in North Miami Beach they had a lot of looting and that is what triggered it. Commissioner Birts- Cooper asked the community for patience towards neighbors running noisy generators.
