3 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE
4 CITY OF SOUTH MIAMI, FLORIDA, ENCOURAGING THE COUNTY TO
5 LIFT THE COUNTY -WIDE CURFEW IMPOSED FOLLOWING
6 HURRICANE WILMA; AND PROVIDING FOR AN EFFECTIVE DATE.

8 WHEREAS, Miami -Dade County has imposed a curfew effective at 8:00 PM each
9 evening; and

11 WHEREAS, Miami -Dade County's enforcement is arbitrary and capricious in that the
12 government keeps open its distribution points for ice, food and water, but requires private
13 distributors of gasoline and food to close at curfew; and
14
15 WHEREAS, the decision to prevent people and businesses in the middle of a national
16 disaster from having 24 hours a day to recover from the disaster was ill - conceived; and
17
18 WHEREAS, the government discourages self help recovery by imposing a curfew; and
19
20 WHEREAS, the curfew punishes the honest citizens and does nothing to prevent criminals
21 from doing their business.

23 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
24 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:

26 Section 1. There shall be no curfew in the City of South Miami.

28 Section 2. All businesses that can, are encouraged to stay open 24 hours a day.

30 Section 3. South Miami police officers will not do anything to enforce the curfew.

32 Section 4. A copy of this resolution will be sent to Miami -Dade County Mayor
33 Carlos Alvarez to let him know that there are some people with common sense and he should
34 listen to them.

36 Section 5. This resolution shall take effect upon approval.
