Davis AGENDA ITEM No.� City Manager g RE: Ordinance Setting Criteria for Street Naming ORDINANCE AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA ESTABLISHING GUIDELINES FOR NAMING CITY PROPERTY AND ROADWAYS WITHIN THE CITY; PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE FOR YOUR CONSIDERATION: Commissioner Sherar requested the attached ordinance in order to set specific criteria for the naming of streets and other public property within the City of South Miami. At the first reading of the ordinance, the Commission suggested amendments. The major points of the ordinance now read: "(I)t has been determined that a *ini° period of fifty years after ° per-son's death naming a public street posthumously is sufficient to insure the non - politicization of the use of an honoree's name, and that a contribution of no less than ten percent (10 %) of the value of a piece of public property represents a substantial value to the City and its residents." "No naming of a public street or piece of public property shall be approved unless the person being honored has been deee se for- at least fifty ye is done so posthumously" "The attachment of any organizational name or likeness to any piece of public property within the City of South Miami shall not be entertained unless a contribution in money and /or other goods and considerations totaling at least ten percent (10 %) of the value of that property has been made to the City." "These requirements may be waived by a uimeus four -fifths vote of the City Commission." 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 1 Q_ :_WT4A_ L1 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA ESTABLISHING GUIDELINES FOR NAMING CITY PROPERTY AND ROADWAYS WITHIN THE CITY; PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the Mayor and City Commission feel it prudent and necessary to promulgate rules and or guidelines for the naming of public property within the limits of the City of South Miami in order to ensure that such naming is in the public's interest; and WHEREAS, the naming of streets and public properties for people who are still among the living can and may be unduly influenced by politics or personal interests; and WHEREAS, it is the feeling of the Mayor and Commission that public property is to be held in the public trust, used for the public good and is not to be unduly commercialized or used to promote any one individual, company or organization without clear and undisputed evidence of actions and /or contributions that have been of major benefit to the people of the City of South Miami; and WHEREAS, it has been determined that a timeperiod of fifty yeafs after- ° ^'s a°° naming a public street posthumously is sufficient to insure the non - politicization of the use of an honoree's name, and that a contribution of no less than ten percent (10 %) of the value of a piece of public property represents a substantial value to the City and its residents. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: Section 1 No naming of a public street or piece of public property shall be approved unless the person being se honored has been deeeas °a f at least fifty years is done so posthumously. Section 2 The attachment of any organizational name or likeness to any piece of public property within the City of South Miami shall not be entertained unless a contribution in money and /or other goods and considerations totaling at least ten percent (10 %) of the value of that property has been made to the City. Section 3 These requirements may be waived by a tmanimeus four -fifth vote of the City Commission. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. Section 4. If any section, clause, sentence, or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of the remaining portions of this ordinance. Section 5.
