Davis GENDA ITEM No.j—X City Manager RE: Ordinance Settins %:riteria for Street Naming ORDINANCE AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA ESTABLISHING GUIDELINES FOR NAMING CITY PROPERTY AND ROADWAYS WITHIN THE CITY; PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE FOR YOUR CONSIDERATION: Commissioner Sherar requested the attached ordinance in order to set specific criteria for the naming of streets and other public property within the City of South Miami. His suggested criteria include that: No public street or piece of public property shall be named for a person unless and until that person has been deceased for at least fifty years. "The attachment of any organizational name or likeness to any piece of public property within the City of South Miami shall not be entertained unless a contribution in money and /or other goods and considerations totaling at least ten percent (10 %) of the value of that property has been made to the City." The proposed ordinance also states that these requirements may only be waived by a unanimous vote of the City Commission. I ORDINANCE NO. 2 3 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF THE 4 CITY OF SOUTH MIAMI, FLORIDA ESTABLISHING GUIDELINES FOR 5 NAMING CITY PROPERTY AND ROADWAYS WITHIN THE CITY; 6 PROVIDING FOR SEVERABILITY; PROVIDING FOR ORDINANCES IN 7 CONFLICT; AND PROVIDING AN EFFECTIVE DATE 8 9 WHEREAS, the Mayor and City Commission feel it prudent and necessary to promulgate 10 rules and or guidelines for the naming of public property within the limits of the City of South 11 Miami in order to ensure that such naming is in the public's interest; and 12 13 WHEREAS, the naming of streets and public properties for people who are still among the 14 living can and may be unduly influenced by politics or personal interests; and 15 16 WHEREAS, it is the feeling of the Mayor and Commission that public property is to be 17 held in the public trust, used for the public good and is not to be unduly commercialized or used 18 to promote any one individual, company or organization without clear and undisputed evidence 19 of actions and /or contributions that have been of major benefit to the people of the City of South 20 Miami; and 21 22 WHEREAS, it has been determined that a time period of fifty years after a person's death 23 is sufficient to insure the non - politicization of the use of an honoree's name, and that a 24 contribution of no less than ten percent (10 %) of the value of a piece of public property 25 represents a substantial value to the City and its residents. 26 27 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY 28 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT: 29 30 Section I No naming of a public street or piece of public property shall be approved unless 31 the person being so honored has been deceased for at least fifty years. 32 33 Section 2 The attachment of any organizational name or likeness to any piece of public 34 property within the City of South Miami shall not be entertained unless a contribution in money 35 and /or other goods and considerations totaling at least ten percent (10 %) of the value of that 36 property has been made to the City. 37 38 Section 3 These requirements may be waived by a unanimous vote of the City 39 Commission. All ordinances or parts of ordinances in conflict with the provisions of this 40 ordinance are hereby repealed. 41 42 Section 4. If any section, clause, sentence, or phrase of this ordinance is for any reason held 43 invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the 44 validity of the remaining portions of this ordinance. 45 46 Section 5.
