Dixie Highway in South Miami is requesting the City to amend the Permitted Use Schedule of the Land Development Code to include "pet care center " as a permitted use in the "GR ", General Retail Use District. The application package submitted, refers to a specific address of 6202 South Dixie Highway on which site the applicant wishes to locate a pet care center. The location is within a "GR" zoning use district. It is important to note that the submitted application is a request to change the general text of the Land Development Code, and is not site specific. If the proposed amendment is approved, it would be applicable to all properties located in the zoning use districts in which the use would be allowed. STAFF OBSERVATIONS (1) Although the subject application is to add the use "pet care center" as a special use in the GR zone, the proposed use is appropriate in the same zoning districts as an Animal Hospital or Veterinarian, which is a current permitted special use in the MO, GR, TODD(MU -4), TODD(MU -5) and the TODD (LI -4) zoning districts (see below). The Department has modified the application to allow the proposed use in the four additional zoning districts (2) At present a "pet sales or grooming service" is a "P" or permitted use (as of right use) in the SR, GR, TODD(MU -4), TODD(MU -5) and the TODD (LI -4) zoning districts. (3) The applicant in a letter of intent states that a pet care center would provide day care service to pet owners. The applicant further suggests that this type of use should have restrictions such as no overnight boarding and that all pet day care must be conducted entirely within a building. (4) The staff concurs with the applicant's suggested conditions. These conditions should be inserted into Section 20 -3.4 (B) Special Requirements. PLANNING BOARD ACTION The Planning Board at its May 31, 2005 meeting adopted a motion by a vote of 5 ayes 0 nays recommending approval of the modified application to allow pet care as a special use with established conditions . RECOMMENDATION: It is recommended that the request to amend the Land Development Code's Permitted Use Schedule to allow pet day care centers as a special use with specific conditions in the MO, GR, TODD(MU -4), TODD(MU -5) and in the TODD (LI -4) zoning districts.
