DUTIES ON BEHALF OF THE CITY OF SOUTH MIAMI POLICE DEPARTMENT
PURSUANT TO SECTION 23.1225 (3), FLORIDA STATUES; PROVIDING FOR
EFFECTIVE DATE.
BACKGROUND AND ANALYSIS
.Florida State Statutes (Chapter 23) authorize the governing bodies of municipalities to empower
the Chief Executive Officer of the municipality to enter into agreements for shared law
enforcement services in specific times of need. The Florida Department of Law Enforcement, the
agency statutorily charged with the administration of mutual aid within the state, recommends as
a matter of course that these agreements should be renewed every five years.
This agreement allows the Police Department to draw upon a greater range of resources in
furtherance of the law enforcement mission, including personnel and equipment, as well as
providing for reciprocity.
This Mutual Aid Agreement has been reviewed and approved as to form by the City Attorney.

WHEREAS, Florida Statutes Chapter 23, the Florida Mutual Aid Act, requires the
authorization by the governing body of the municipality before a Mutual Aid Agreement may be
entered into by the Mayor or Chief Executive Officer of the municipality on behalf of the law
enforcement agency; and
WHEREAS, there is the existing and continuing possibility of the occurrence of law
enforcement problems and other natural and man -made conditions which are or likely to be
beyond the capabilities of the City of South Miami Police Department alone with its existing
level of services, personnel, equipment or facilities; and
WHEREAS, to meet the department's ongoing responsibility to ensure the public's safety
and provide adequate levels of police services, preparation must be made to obtain assistance
whenever necessary.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the City Manager of the City of South Miami is authorized to enter into a
Mutual Aid Agreement in a form acceptable to the City Attorney, with the Florida Department of
Law Enforcement (FDLE), on behalf of the City of South Miami Police Department pursuant to
Section 23.1225 (3), Florida Statues.
Section 2. That this resolution be effective immediately after the adoption hereof.

MUTUAL AID AGREEMENT BETWEEN THE MEMBER
AGENCIES OF THE CHILD ABDUCTION RESPONSE TEAM
AND THE FLORIDA DEPARTMENT OF LAW ENFORCEMENT
WHEREAS, the below subscribed law enforcement agencies have joined
together in a multi jurisdictional effort to rescue abducted children and under
circumstances allocate their resources to missing /endangered children cases;
and
WHEREAS, the undersigned agencies are all participants in a multi- agency effort
known collectively as the Children Abduction Response Team (CART).
WHEREAS, the undersigned agencies agree to utilize_ applicable state and
federal laws to prosecute criminal, civil, and forfeiture actions against identified
violators, as appropriate; and
WHEREAS, the undersigned agencies have the authority under Part 1, Chapter
23, Florida Statutes, "the Florida Mutual Aid Act," to enter into a voluntary
agreement for cooperation and assistance of .a _routine law enforcement nature
that crosses jurisdictional lines;
WHEREAS, this agreement does not supercede or take the place of any other
agreement entered into by the various members of the Children Abduction
Response Team. Those agreements shall remain in full effect.
NOW THEREFORE, the parties agree as follows:
Pursuant to signing this Agreement, each. of the undersigned law enforcement
agencies approve, authorized and enter into this Agreement at the request of the
member agencies of the Child Abduction Response Team (CART) and the
Florida Department of Law Enforcement,, (FDLE) to implement within the
jurisdictional and other limits as noted herein for the purposes and goals
indicated.
Parties To This Agreement:
The Florida Department of Law Enforcement (FDLE)
Additional parties may, at the request and with the approval of FDLE and the
other Child Abduction Response Team members, enter into this Agreement at a
later date as "evidence by their signing of this Agreement. Any party may cancel
its participation in this Agreement upon delivery of written notice of cancellation
to the Florida Department of Law Enforcement;
CHILD ABDUCTION RESPONSE TEAM GOALS AND COOPERATION TO
BE RENDERED:
The goal of the 'Child Abduction Response Team is to effect dedicated and intensive
'investigative, preventative, and general law enforcement efforts primarily with regard to
abducted children. The Child Abduction Response Team efforts shall include, but are not
limited to, the rescue of the abducted child, the arrest and prosecution of those involved
(utilizing state and federal prosecutions, as appropriate); and the seizure and forfeiture
options, as appropriate.
Nothing herein shall otherwise limit the ability of participating Child Abduction
Response Team member to provide, as provided by or allowed by law, such assistance in
any enforcement action as may be lawfully requested by a law enforcement action as may
be lawfully requested by a law enforcement officer having jurisdiction over an incident,
crime or matter under consideration.
The parties to this Agreement are contributing personnel and resources in support of the
Child Abduction Response Team efforts, with the operations of the Child Abduction
Response Team being coordinated with FDLE and other agency members.

continued participation by FDLE and one or more Child Abduction Response Team member

Child Abductiaan Response 'Team members operating outside the jurisdiction of their respective
Agencies shall not enjoy extra-jurisdictional authutity as law enforcement afficers amass

privileges and immunities as if the employees were performing duties iu-aside the political

Procedure for Requesting and Authorizing Assistance: Activities shall be considered authorized
oply when approved . and directed as provided _ bereian by an ME supervisor or command
d iganee. The CART vd1l no=aally function as a force 1.1multiplier for t%e requesting agency, and
the requesting agency will remain as the lead agency in overall control of the investigation,
unless the requesting agency has formally asked that the CART, under IF`DLE supervision or
anther FDUE approved supervision, assume control of the investigation. The parties stipulate that
in the event that a sii irieant invests ative or junsdi.ctional dispute should arise, the issue will
immediately be forwarded to the relevant agency chief executives for resolution. If at anytime an
FDLE superviseir or PDLE special agent designee(s) detem. ices that an extra =territorial Child
Abduction Response Temn operation purmant to this agreemcut should be terminated, said
operation is to be promptly terminated in a ina cr ' assuring the safety of all involved law

Whenever an operation occurs outside the territorial limits of the FDLE Miami i Regional

or her region. Local lain mforcement in the area of operation wfll be notified, as appropriate.
Nothing herein shall Wiherwise limit the jurisdiction and powers normally possessed by an'
cmaployee as a ,nnernber of the employee's Agency.

Forfeiture actions based upon seizures made by the Child Abduction Respouse Team May be
pur=ed in either~ s° tee or federal actions. Actions shall be based upon current statutory and case

otherwise determined by written agreement,
PROPERTY AND EVIDENCE:
All property and evidence, including ewrency, sei=d in connection with swe violations,
pursanant to this agreement, outside the regular juiisdictionai boundwies of the Child Abduction

Each party to this Agreement agrees to furnish necesmvy personnel, propel, police equipment,
vehicles, resources and facilities to gender services to each other party to this Agreement in order
to erect the purposes of the Child Abduction.. response Team and agrees to bear the cost of loss
or damage to such equipment, vehicles, or property. :par ties -understand and agree that they will

Each Agency f nishing aid p=nant to this Agreement shall compensate its own employees
during the time such aid is rendered and shall defray the actual expenses of its employees while
they are rendering such aid, including ar*ny amounts, if legally applicable, th. at may be determined
to be due for compensation 'due to personal injury or deaf while such employees are engaged in
rendering such aid, The privileges and im munities from` liability, exemption from laws,
ordinances, and rules, and all pmsion, insurance, relief, disability, world' compensation, salary
(including overtime compensation or compensatory time), death and other benefits that apply to
the activity of an employee of an agency when perfdr iang the employee's duties the
territorial limits of the employee's Agency shall apply to the employee to ft same degree,
&nner, and =tent while such employee acts under this Agreement. This prevision shall not
preclude payment of compensation, including overtime compensations, for its personnel utilizing
its legally vested forfeiture _funds or other funding sources to be the extent allowed by law.
Each party agrees to maintain its owm comprehensive general liability, insurance, professional
liability insurance, as required, and a o olive liability insurance or maintain a self- ansuring
fund for the term of this Agreement in the amoums determined by each party to adequately insure
such pi's liability assumed herein.. But for Florida law enforcement officers, in no event shall
such coverage be less than the state statutory Waiver of sovereign immunity limits. IF requested,
each Party agrees to provide the other pages with proof of the insurance or self - insurance
required hereunder. Federal participants will hr- Sovwned by applicable federal lags concerning

TERM OF AGREEMENT.-
This Agreement shall be e5ective as to the executing Parties upon execution by the member
agencies of the Child Abdurtion Response Team and the FDLE. As each additional Party
ecuws this R ent, it shall be effective as to the newly executing Pte. This Agreement
may be dapiicated for disseminatiov to all Parties, and such dupiic m email be of the sic force

This Agreement shall remain in full force as to all parficipaltng Pies until De bar 31, 2008,

upon providing Witten notice to FDLE and all other participating pasties. Any written

for the term of this Agreement by having the new Chief Executive sign and submit a, new

ADDENDUM
This Addendum is made this

WHEREAS, the Mutual Aid Agreement for the Child Abduction Response Team
(CART) was executed on or about May 17, 2005 in order to establish a cooperative effort among
CART participating agencies to provide a pool of specialized investigators which are available to
focus dedicated and intensive investigative, preventative, and general law enforcement efforts
primarily with regard to cases involving abducted children.'
