A RESOLUTION OF THE MAYOR & CITY COMMISSION OF THE CITY
OF SOUTH MIAMI, FLORIDA, RELATING TO A REQUEST FOR A

PURPOSE OF THE VARIANCE IS TO PERMIT THE CONSTRUCTION OF
A FOUR STORY MIXED USE BUILDING; AND PROVIDING FOR AN
EFFECTIVE DATE
SUMMARY OF REQUEST
The applicant is requesting approval of a variance from Section 20 -3.5G of the Land
Development Code to allow the net area of a building site (NE corner of . SW 71th Street and SW
61St Ave) to be 9,927 square feet where a minimum of 10,000 feet is required and 95 feet frontage
where a minimum of 100 feet is required. The subject property is within the "MO" Medium —
Intensity Office zoning district. The applicant seeks a variance in order to redevelop the property,
which is currently vacant. The applicant is proposing to build a new four story office building
including three residential units and 9500 square feet of office space.

STAFF OBSERVATIONS
(1) The site is a non - conforming property and any new construction must be on a building site
which meets the zoning standards for the MO zone district.

(2) The Comprehensive Plan Future Land Use category for this property is Mixed Use
Commercial- Residential. This category mandates that the all development (new) must be mixed
use, that is a building with at least two of the following three uses : residential, retail or office.
(3) The applicant's representative states in a hardship letter the variance is not self - created and
that the substandard size of the property prohibits the use of the property. It is further stated that
there are other nearby properties with substandard lot size which have been granted variances to
permit development. In October, 2004 the Planning Board and the City Commission approved a
variance for a 5,618 sq.ft. parcel at 7001 SW 61 Ave. to be developed. At that time the Planning
Department opposed the variance, stating the following:
"The variance request is a not a unique situation; other property owners may wish
to request a similar variance. It is important to note that this area (two blocks) is the
only location for the MO zoning district in the City. There are 13 building sites. A
total of 7 building sites are non - conforming as to minimum lot size required for the
MO zone. The staff recognizes that the MO zoning and the Future Land Use
category in this area needs to be re- examined in light of its location close to Metro
Rail and the abutting TODD(MU -5) district. These types of changes can be
addressed as part of Comprehensive Plan `s Evaluation and Appraisal process."
The Planning Department, recognizes the difficulties of the non - conforming status of property in
the MO District. In the subject application the variance request is less than one percent of the lot
size minimum and is supportable.
(4) The applicant has chosen to use the "Joint Use via Special Parking Permit" section of the
LDC (Sec. 20- 4.4(G) to show the amount of parking spaces provided to be 39 spaces instead of
45. The applicant is required to submit a separate special parking permit application if the joint
use parking reduction is being requested. This section of the Code was under moratorium since
1999, which expired in 2004. The Administration is now requesting that the moratorium be
extended an additional nine months.
(5) The Planning Department is opposed to the applicant's decision to use the joint use special
parking permit. Parking reductions in the TODD and Hometown District previously under the
moratorium should not be granted until such time as new parking regulations can be debated and
adopted.
PLANNING BOARD ACTION
At the meeting the applicant withdrew the proposal to use the joint use via special parking permit
element which would have allowed a reduction in required parking spaces. The Planning Board
at its May 10, 2005 meeting, after a public hearing, adopted a motion by a 5 aye 0 nay vote,
recommending approval of the requested variance.
RECOMMENDATION
It is recommended that the lot size variance application be approved subject to the applicant
eliminating the use of the "joint spaces special parking permit" from consideration in the
development of the building.

(1) The use of land and the erection of buildings and other structures on land
shall be subject to the dimensional requirements of the applicable zoning
district, as reflected on the three tables labeled "Dimensional
Requirements, Single- Family Districts" (Section 20- 3.5E), "Dimensional
Requirements, Multi family Districts" (Section 20 -3.5F) and "Dimensional
Requirements, Nonresidential Districts" (Section 20- 3.5G).

(A) Expiration of Variance Approvals. A variance approved pursuant to
Section 20 -5.5 shall lapse after six (6) month if no substantial
construction or change of use has taken place in accordance with
the request for such variance and if the city commission has not
specified a longer approval period for good cause shown.
(B) Extension of Variance Approvals. Four (4) affirmative votes of
the city commission may grant an extension to a previously
approved variance if a proper and timely request is made by the
applicant prior to the expiration of the six (6) month period.
(C) Hardship Statement. All applications for a variance shall include
a letter of intent indicating the specific nature of the hardship
upon which the request is based.
(D) Property Survey Required. All applications for a variance shall
include a current property survey prepared by a registered
surveyor.
(E) Neighborhood Concurrence. All applications for a variance shall
be accompanied by a map which reflects all properties and the

names of all property owners within a five hundred (500) foot
radius of the subject property. The applicant shall obtain and
submit the signatures of at least twenty (20) percent of such
property owners, indicating their awareness of and concurrence
with the proposed variance request.
(F) Proposed Site Plan Required. A site plan shall be required
showing all proposed buildings and setbacks and any other
features relating to the variance request.
(G) Permitted Variance Requests. Applications for variances shall be
restricted to only the following:
(1) Yard setbacks
(2) Lot size
(3) Lot coverage
(4) Building height
(5) Fences and walls
(6) Impervious coverage
(7) Off - street parking
(8) Open space
(9) Signs
(10) Landscaping
'(G) Joint Use Spaces via Special Parking Permit. Two (2) or more uses may be permitted to {

Method of Calculation.
Step 1. For each of the five (5) time periods, multiply the minimum number of parking
spaces required by Section 20- 4.4(B), Space Requirements.
Step. 2. Add the results of each column. The required number of parking spaces shall
equal the highest column total.
Note —Ord. No. 15-03 -1799, § 3, adopted June 3, 2003, amended § 3 of Ord. No. 8 -99 -1682,
adopted May 4, 1999, providing for a suspension of the provisions of 20- 4.4(G) in the
Hometown District for a period of 60 months.
(K) Procedures for Special Parking Permit. Special parking permits may be approved,
disapproved, or approved with conditions by the affirmative vote of four (4) members of the city
commission. Special parking permit procedures shall follow those procedures established for
special use permits as set forth in Section 20- 5.8(B) through (F), and shall follow those
public hearings set forth in general in Sections 20-5.1 through 20 -5.6.

22 SW71 Street and SW 61 Avenue, South Miami Florida; and

24 WHEREAS, the applicant wishes to develop the property with a four story mixed
25 use building, and;

27 WHEREAS, in order to develop the property, a variance is required; and

29 WHEREAS, the approval of a variance requires a recommendation from the
30 Planning Board and the approval of the City Commission after a public hearing; and

32 WHEREAS, on May 10, 2005 the Planning Board, after public hearing, voted 5
33 ayes 0 nay to recommend approval of the variance` request; and

35 WHEREAS, the Mayor and City Commission of the City of South Miami desire to
36 accept the recommendation of the Planning Board.

39 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION OF
40 THE CITY OF SOUTH MIAMI, FLORIDA.

42 Section 1. That the subject application submitted by Custom Design Properties, Inc.
43 requesting approval of a variance from Section 20- 3.5(G)` of the Land Development Code
44 to allow the lot area of a building site to be 9,927 feet, where a minimum of 10,000 feet is
45 required on property specifically located at the northwest corner of SW71 Street and SW
46 61 Avenue, South Miami Florida.

48 Section 2. That the approval of the subject variance is based upon the following findings:

2 a) The existing property is smaller than the minimum site size required by the Land
3 Development Code and cannot be developed without a variance which constitutes a
4 hardship,

6 b) The variance requested is of a small, incremental nature and would have minimal
7 impact on surrounding properties.

Dear Mr. Youkilis:
Please accept this supplemental letter of intent in conjunction with the above- styled
application.
The undersigned represents Robelo -Kelly Holdings, LLC ( "Robelo - Kelly'), contract
purchaser of the parcel of land located at the Northeast corner of SW 71 Street and SW 61 Avenue,
in the City of South Miami (the "Property "). The Property is zoned MO (Medium Intensity Office).
In conjunction with the attached plans, the applicant requests the following variances for the
devc1opnnent of a Mixed -Use project on the Property:
1. Variance to permit lot frontage of 95 feet on SW 61 Avenue and lot size of 9,927
square feet where 10,000 square feet are required in the MO district.
Robelo -Kelly has designed an attractive site plan that embodies the Mixed -Use concept in the
MO district. The plan enhances the streetscape of both SW 71 Street and SW 61 Avenue through the
provision of balconies and an entry plaza at the intersection of the two roadways, In your
consideration of the above variance, please note the following:
1: The applicant does not own additional, adjacent property; accordingly, the variance of
lot area is not self - created, and there is an inconsistency between the underlying zoning district, and

the existence of a property within the zoning category that contains less than the required amount of
lot areas Similar relief has been granted by the City to other property in the area,
2; The provision of the plaza and balconies enhances the pedestrian character of the area,
furthers the creative development envisioned by the underlying Mixed -Use category, and promotes
rational growth in the core area near the South Miami Metrorail Station, all in concert with the City's
Comprehensive Plan,
3. The parking for the proposed building is calculated as required by Section 20 -3.5 of
the South Miami Land Development Code using the following method:
(a) Office space requires a ratio of 1/250. Therefore, 9500 square feet of office space
requires 38 spaces.
(b) The joint use table in the LDC requires 100 % of those spaces to be available from 6
a.m. to 6 p.m.
(c) Apartments require two spaces per 1 -2 bedroom units and l visitor space for every 10
units. Therefore; three (3) 1 -2 bedroom units require 6 spaces plus 1 visitor space for a total of 7
spaces.
(d) The joint use table requires only 10 % of the required residential parking to be
available from 6 a.m. to 6 p.m. Therefore, 1 space will be dedicated to the residential units;
I have also attached an affidavit regarding the 50 percent certified mailings to nearby property
owners. These mailings were sent out March 24, 2005.
