ORDINANCE NO.
AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF SOUTH MIAMI, FLORIDA, RELATING TO BOARDS;
AND CREATING SEC. 2 -26.11 ENTITLED "THE AFFORDABLE
HOUSING ADVISORY BOARD "; PROVIDING FOR SEVERABILITY,
ORDINANCES IN CONFLICT AND AN EFFECTIVE DATE.
WHEREAS, the City of South Miami Comprehensive plan encourages the
development of affordable housing in order to respond to the housing needs of the
community; and,
WHEREAS, private industry alone has not generated sufficient affordable housing
units to meet community needs and achieve the City's goal of assuring the "availability
of sound and affordable housing" for all City of South Miami residents; and
WHEREAS, an affordable housing advisory committee board created for the
general purpose of researching effective affordable housing measures implemented in
other municipalities and acting as a local resource to the City will help the City respond
to community needs;
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA;
Section 1. The City of South Miami does hereby establish the Affordable
Housing Advisory Board.
Section 2. Sec. 2.26.11 of the City of South Miami Code is created to read:
Sec.2.26.11 The Affordable Housing Advisory Board.
(a) Created, composition. There is hereby created The Affordable
Housing Advisory Board. The Board shall consist of five members.
(b) Appointment and qualifications of Members. The Mayor with the advice
and consent of the Commission shall be responsible for appointing the members to
serve on the Board.
(c) Change in number of members. The number of persons serving on the
Board may be increased or decreased by the city commission. In the event of a

I change in members, the number of members that must be present to constitute a
2 quorum for a meeting shall be half the total members plus one.

4 (d) Chairperson and vice - chairperson. The chairperson and vice - chairperson
5 shall be elected by the members of the Board. The members may elect any
6 additional officers that they deem necessary.

8 (e) Duties. The duties of the Board shall include, but not be limited to:

11 (i) serving in an advisory capacity by identifying and evaluating,
12 successful affordable housing projects and reporting to the
13 City Commission its findings.

16 (ii) consulting with property owners, builders and persons
17 experienced in the development of affordable housing.

19 (iii) assisting the Planning Department by reviewing data and
20 information collected relative to affordable housing statistics,
21 programs, grants and subsidies.

23 (iv) performing other duties, functions and services as may be
24 requested by the Mayor and City Commission.

26 (f) Term. The Term of the board shall be one year, unless extended by
27 the City Commission.

29 (g) Goals. The goal of the Board shall be to submit, for the City
30 Commission's Consideration, one or more affordable housing projects or
31 affordable housing incentive ordinances to meet community needs and achieve
32 the compressive plan's housing goal.

34 Section 3. If any section, clause, sentence, or phrase of this ordinance is for any
35 reason held invalid or unconstitutional by a court of competent jurisdiction, the holding
36 shall not affect the validity of the remaining portions of this ordinance.

38 Section 4. All ordinances or parts of ordinances in conflict with the provisions
39 of this ordinance are repealed.

41 Section 5. The provisions of this ordinance shall be included in the City of
42 South Miami Code of Ordinances.

Section 6. This ordinance shall take effect immediately upon approved
