Reason /Need: The City's Parking Board held several meetings to discuss amendment to
Section 15 -99 of City's Code of Ordinances. After much discussion and
workshop (field trip with staff), the proposed changes to the code

RELATING TO RESIDENTIAL PARKING; AMENDING THE SOUTH

15 WHEREAS, The City Commission hereby finds and declares that it is in the best interest of the
16 residents of the City to reduce vehicular congestion on residential streets and to facilitate the efficient
17 movement of traffic by providing for residential parking preference during certain hours of the day
18 within certain areas meeting the criteria hereinafter set forth'
19 WHEREAS, the residential permit parking regulation is necessary to promote the health, safety
20 and welfare of the residents of the City by providing adequate parking spaces adjacent to or close by
21 their places or residence;
12 WHEREAS, it is in the public interest to reduce hazardous traffic conditions resulting from the
23 use of streets located within congested residential areas for the parking of vehicles by persons using
24 such residential areas to gain access to other places;
25 WHEREAS, these regulations are to protect the residents of those areas from unreasonable
26 burdens in gaining access to their residences; to preserve the character of those areas as residential
27 districts;
28 WHEREAS, to promote efficiency in the maintenance of the streets in clean and safe
29 conditions; and to promote traffic safety, convenience and welfare of the inhabitants of the City, the
30 mayor and city commission desire to adopt the process for issuing special parking permits within
31 designated residential areas.

33 BE IT ORDERED BY THE MAYOR AND THE CITY COMMISSION OF THE CITY OF
34 SOUTH MIAMI, FLORIDA:

36 Section 1. The City of South Miami Code of Ordinances is amended to create Section 15 -99
37 entitled "CONTROLLED PARKING RESIDENTIAL ZONES" as follows:

39 Sec. 15 -99. Controlled Parking Residential Zones.
40
41 (a) Whenever in this division the words hereinafter defined are used they shall, unless the
2 context requires otherwise, be deemed to have the following meanings:

1 Commuter vehicle shall mean (a) motor vehicle(s) parking in a residential area by a
2 person who is not a resident of the designed controlled parking residential zones.
4 Controlled Residential Parking Zone shall mean the controlled residential parking zone
5 for which specified residential and visitor's permits are valid shall be the designated zone
6 in which the decal holder resides.
8 Controlled Residential Parking Permit shall mean a properly issued and displayed decal
9 issued by the City that authorizes a specific vehicle to park within a specific controlled
10 residential parking zone for which the permit was issued.

12 Resident shall mean a person who owns or leases real property within a controlled
13 parking residential zone and who maintains either a voting residence or bona fide
14 occupancy, or both, at that address.

16 Visitor Parking Permit shall mean a si3eeia r mi* issued hTeuider-f^vr- the

18 issued and displayed parking permit that authorizes a commuter vehicle to park within a
19 specific controlled residential parking zone for which the permit was issued.

21 (b) Signage for and Marking of Controlled Parking Residential Zones. The director of the
22 traffic engineering department, through his/her authorized representative in the op lice
23 department, is hereby authorized to designate "Controlled Parking Residential Zone" in
24 accordance with this Chapter. Appropriate signs and color markings shall be utilized to
25 designate those areas where on street parking of vehicles may be restricted at specific
26 times during the day; and shall provide on- street parking for vehicles bearing a valid
27 residential parking decal and/or a valid visitor parking decal issued pursuant to the terms
28 of this Chapter. All other vehicles shall be precluded from on- street parking within a
29 designated Controlled Parking Residential Zone. The authority to establish these
30 regulations shall be in addition to any other authority of the City to regulate the times and
31 conditions of motor vehicle parking on public streets.

33 (c) Eligibility for Controlled Parking Residential Permits.
34
35 (1) Eligibility. Controlled parking residential permits may be issued only to persons
36 who reside within the permit zone for which the permit is issued; who own and/or
37 have legal control of a motor vehicle, and for those motor vehicles owned by or
38 under the legal control of the resident. For the purposes of this Chapter,
39 "residence" shall be defined as the street address of the structure in which the
40 applicant resides as determined by the U.S. Postal Service. All other vehicles
41 shall be precluded from on- street parking within a designated Controlled Parking
42 Residential Zone.

44 2. The Proof of Residence. Proof of residence shall be established bv:

(a) Display of a. valid driver's license reflecting a current address within the zone for
which the permit is issued; or
(b) Display of a deed, lease, rental agreement or other acceptable document showing
residency within the zone for which the permit is issued.
(c) Ownership of Motor Vehicle. Proof of ownership and/or control of a motor vehicle
may be established by _possession of a valid registration in the applicant's name or by
display of a valid registration accompanied by proof that the applicant has legal use
and control of the vehicle.
(d) Application for permits.
Authorization of the Finance Department. The Finance Department is
hereby authorized to issue permits to qualified residents who reside in a
Controlled Parking Zone and who own or have control of a motor
vehicle.
2. Application Form. Application shall be made on forms provided by
city clerk which shall include:
a. The name, address, telephone number and license number of the
applicant
b. Make, model, color and year of the registration of the vehicle for
which the permit is sought.
C. The type of document used to establish eli ig bility for the license
plate number (and state) of vehicle.
d. A statement immediately above where the applicant is to sign
stating that the applicant has been provided with an opportunity to
examine this Chapter and is familiar with the terms thereof.
e. All applications shall be signed by the applicant and notarized.
(e) Fees/Notification to Police Chief.
The annual fee for the residential permit shall be $20.00.
2. Fees and any outstanding penalties levied under this Chapter shall be
collected prior to issuance of the permit. A copy of all permits issued
shall be promptly sent to the cily department responsible for enforcement.

1 (f) Controlled Parking Zone Determination. The Controlled Parking Zone for which the
2 permit is valid shall be the designated zone in which the permit holder residents. Five
3 (5) zones have been created and are as follows:
5 Red Zone: 5770 -5786 S.W. 74th Terrace. Beginning at 5770 S.W. 74th
6 Terrace, ending on the side to the rear of 5786 S.W. 58th Ave.

Blue Zone: 7500 -7530 S.W. 58th Avenue. Located at 58th Avenue & 74th Terrace
9
to the end of 58th Ave where sidewalk ends.

Yellow Zone: 5838 S.W. 74th Terrace. Located on the South Side of 74th Terrace

from 58th Avenue to the end of the property line

Green Zone: 5801 S.W. 74th Terrace. Located on North side of 74th Terrace from
15
58th Avenue to the beginning of f Mayan North's Parking lot.

Orange Zone: 7500 S.W. 59th Avenue. Located from beginning of Shari Gardens
18
Parking lot to the end of the parking lot; and 7430 S.W. 59th Court & 7540 S.W. 59th Court.

Beginning on 59th Court, both sides of street ending on 59th Court at the end of the parking

lots of Brittany Villa Apartments & Villa Fontana Apartments

(g) Residential Parking Permit description. The permit shall contain the following

1. The make, model, color, year, license plate number and registration of the

vehicle;

2. The controlled parking zone for which it is issued; and

3. The expiration date of the permit.

(h) Visitor's Permits.

1. The City Finance Department is hereby authorized to issue visitor's permits
35
which shall be valid for a period of up to one year. The Finance Department
36
may issue one visitor's permit per residential address.

2. The annual fee for visitor permits shall be $40. Any outstanding_ penalty levied
39
under this chapter must be paid prior to the issuance of a visitor's permit.

(i) Use and Validity of Permits.

1. Display. Permits shall be displayed in the lower left hand corner of the
44
vehicle's front window.

Validiiy. Residential permits shall be valid only for the vehicle for which they
2
are issued, only in the zone designated and only so long as the permit holder
3
retains the vehicle and resides at the address specified in his or her application.

3.
Expiration. Permits shall expire one year from the date of issue, so long as the
6
permit holder retains the permit vehicle and resides at the address specified in
7
his/her permit application.

(j)
Unlawful Acts. It shall be unlawful for any person to do any of the following_

1.
To make any false or misleading, statements in application for a permit;
12
13
2.
To transfer the permit to another person or vehicle;
14
15
3.
To fraudulently alter a permit in an T� respect whatsoever;
16
17
4.
To improperly display the permit or visitor's permit or to violate any terms or
18
conditions under which the permit or visitor's permit was issued;
19

5.
Use or place the permit or any other vehicle than that for which the permit is
21
issued;
22

6.
To use or permit to be used a revoked or suspended permit; or

7.
Sell or transfer a visitor's permit to a third party.

(k)
Revocation of Permit. If the City finds that a permit should be revoked for any _of
28
the reasons set forth in this Chapter, a written notice shall be sent by U.S. Mail to
29
the
permit holder at the address contained on the application. The notice shall
30
contain the following information:

Advise the permit holder that the permit will be revoked on a specified date
33
which shall be not fewer than ten (10) dgys from the date of the letter;
34

2.
Advise the permit holder that unless a written notice of appeal setting forth the
36
reasons for the appeal is filed with the City Clerk no later than the date set forth
37
in subsection (a) of this section, the permit will be deemed revoked;
38
39
3.
Advise the permit holder that if a written notice of appeal is filed within the
40
required time, the date, time and place of the hearing will be set; and
41
42
4.
The reasons for the revocation.

(1)
Scheduled of Fines. A fine shall not exceed $250.00 per day for a first violation of

this Chapter and shall not exceed $500.00 per day for a repeat violation. Illegally

parked vehicles shall be fined in the manner presently provided in the QijY for
illegal parking and their vehicles my be towed and stored at their expenses.
(m) Appeal. Upon receipt of the appeal, the City Code Enforcement section shall set a
date for hearing before the City's Special Master within thirty (30) days of receipt
of the notice of appeal and notify the appellant of the date, time and place of
hearing. The Special Master may affirm or reverse the revocation decision or order
suspension for a specified period.
(n) Eligibility and criteria for establishing Controlled Parking Residential Zones is
hereby set forth:
1. A residentially zoned area shall be deemed eligible for designation as a
controlled parking residential zone for residential permit parking if, parking
therein is impacted by commuter vehicles at any time.
2. In determining whether an area identified as impacted and eligible for
residential permit parking shall be designated as a controlled parking
residential zone, the following factors shall be considered.
a. The possibility of a reduction in total vehicle miles driven in the City.
b. The likelihood of alleviating traffic congestion, illegal parking and
related health and safety hazards.
C. The desire and need of the residents for controlled residential permit
parking.
(o) Procedures for establishing Controlled Residential Parking Zones.
1. In order to determine whether a particular area should be designated as a
Controlled Parking Residential Zone, the City Commission can request, or the
Parking Board may conduct, upon his /her own initiative or upon a petition of
a maiority of the households on a proposed residential block addressed to the

1 Section 2. If any section, sentence, clause or phrase of this ordinance is held to be
2 invalid or unconstitutional by any court of competent jurisdiction, then said holding shall in
3 no way effect the validity of the remaining portions of this ordinance.
4 Section 3. It is the intention of the City Commission that the provisions of this
5 ordinance shall become and be made a part of the South Miami City Code; and that the
6 sections of this ordinance may be renumbered or re- lettered and the word "ordinance" may be
7 changed to "section ", "article" or such other appropriate word or phrase in order to accomplish
8 such intentions.

Section 4. Severability. If any section, subsection, clause, phrase or word of this
chapter, or any provision adopted by reference in this chapter is for any reason held to be
invalid or unconstitutional by a court of competent jurisdiction, such invalidity or
unconstitutionality shall not affect the validity or constitutionality of the remaining portions of
this chapter.
Section 5. Effective Date. This Ordinance shall take effect immediately upon its
adoption.

REGULAR MEETING
FRIDAY, September 7, 2007

SUMMARY MINUTES
I Shirley Huebner called the meeting to order at 8:30 am
Board members present constituting a quorum:
Shirley Huebner, Sharon McCain, Ken Merker, Michael Miller,
Alex Abril Al Elias absent
II. status on staff support matter and signage money in new budget
It was agreed that Shirley Huebner would follow up with manager and Budget
Committee regarding both matters. Result was as follows:
Due to budget constrains we will not be seeing staff, working records are
to be purchased for our use and summary written min. of meetings would be made
by an appointed secretary for the Board. Consideration for a Board secretary is
on the agenda for September 21.
A presentation was made to the Budget Committee regarding funds for
consistent, professional parking and traffic signage as described in the 2003
Parking Committee Report. The City Manager stated funds would be available
for signage. This matter should be considered with the manager at a future
meeting.
II. Residential Decal Parking
Sharon McCain presented information on residential parking describing how well
the Gables Program works. Handouts included samples for the Gables decals and
visitor tags. There was a discussion regarding the placement of the residential
decal on the rear left bumper as well as the inside left driver side window. Visitor
tags would remain as hanging tags for portability and be one per household. There
was a discussion about the use of zones, which both the Gables and Miami Beach
use. It was decided zones would not be used in our program at this time; this was
a cost and printing concern for such a small area. This matter would have to be
addressed in the future should the program grow to other areas. After discussion
a vote of 5 -0 decided residential decals would be $ 20.00 and Visitor tags would
be $ 40.00. Multiple residential decals could be purchased with proof of
residence per the application and document rules but only one visitor tag would
be purchased per household. The primary resident was the only one to purchase
decals and visitor tag.
III. Meters for the Valencia area were put on hold due to a litigation issue.
Information was brought forth on parking meters and it was agreed meters should be
on the next agenda along with Mr.Mcardle to discussed meter purchased for
garage and status of employee parking request as well as general garage status
update
Motion was made to adjourn and meeting closed.

In attendance were: Shirley Hubner, Sharon McCain, Michael Miller & Al Elias
Previous meeting was not recorded and minutes were put together after reviewing hand
notes.
Concern was raised over the accuracy of the minutes.
Motion filed to take the minutes out of the agenda from last meeting.
Sharon McCain notes that the Residential Decal Parking minutes were apparently
incorrect. On this point, the vote was for colored decals with zones; tzG%s-
Objection to minutes was noted.
Motion filed to move minutes to the end of the meeting.
Sharon McCain brought up that the $250 fine for fraudulent use issue was not in the
minutes. Also, the solutions to the fraudulent use of decals issue were not included in
the minutes.
Michael Miller seconds motion to move minutes to the end.
Al Elias goes on to say that the discussion about Larkin's Area parking issue was not in
the minutes.
Motion made to defer the minutes to next meeting when the meeting can be transcribed
by tape.
Shirley Hubner brings up point that the previous meeting was not recorded. Hand
written notes are all that were taken at said meeting.
Suggestion to move on until Luis comes in to discuss issue of parking decal issue from
last meeting.
Motion passes to move on from the minutes issue until they talk to Luis Figueredo about
parking decal issue.
Discussion about future meeting dates. It was decided that they would be Oct. 5 & Oct.
19. For November, it was decided that the dates would be Nov. 9 & Nov. 23.
Discussion about how commission is requiring the boards to keep better records of the
meetings. Board discusses how to get a hand written and transcribed copy of each
meeting.
Motion to nominate Michael Miller as secretary to summarize minutes.
Unanimous vote to make Michael Miller temporary secretary to prepare the minutes of
the meetings.
Meeting dates for November are changed to Nov.9 & Nov.30 after reviewing the
calendar.
Item #2 regarding parking update including parking meters was removed from agenda
because the speaker Mr. George Mcardle was not able to attend the meeting.
Shirley McCain proceeds to review item #3, parking decals, for Al Elias who had missed
the last meeting.
Order is called after review turns into a discussion that's taking up too much time from
the meeting. Motion was passed to halt parking decal discussion to move onto new
business.
Guest is presented to board. Ms. Jean Larkin Scott, who has been the Lee Park
Condominium Association manager for over 20 years was there and discussed the
possibility of having residential parking decals for the residents of Lee Park on SW 69th
Street, just east of SW 62 Ave.

Discussion begins on different zones and consolidating Zone 6 and Zone 5.
Motion to make Zone 6 into Zone 5. Motion made to accept paper with the amendment
to make Zone 6 into Zone 5. Motion passes.
City Attorney Luis Figueredo is asked what should be done about fraudulent decals. It
was decided that is was an enforcement issue.
Pricing of decals is reviewed.
Residential decals do not have limit to permanent decals, but can only have 1 visitors
decal per household
Ordinance regarding the decals and the penalty for violation is discussed at lengths.
Vote on fraudulent use of decals and ticketing so the decision can be put in the
ordinance is called for.
Motion for ordinance to be revised on how to deal with residential decal parking
violation.
City Attorney Luis Figueredo offers to provide a summary on how to deal with fraudulent
use of decals.
Passionate discussion ensues over the parking decal issue.
Sharon McCain offers her resignation and leaves the meeting.
Meeting adjourned due to lack of quorum.

Parking Board Meeting Oct. 5th, 2007

II. Hand out from city manager, report put together by miami parking authority. Members asked to
read it over to discuss and following meeting.

V. Shirley discussed re- voting on /anyonreoton f residential decal parking. Raised concern over the
clarity of each issue and suggestping thoughts and concerns over each issue. Before
voting, Sharon McCain aske f the board who would possibly benefit financially to
recuse themselves from the vote. Luis Figueredo brought up that if Shirley claims that she does
not in fact benefit financially he basically has to accept that statement. Shirley Huebner made the
determintation that she does not benefit financially from the residential parking decals. Michael
Miller suggests letting another body determine the issue of financial gain' r ey
VI. There was a discussion regarding Zon nd a ncern over how complicated the zoning
would make it for residents to find parking. Shar raised concern over the zones on 74th terrace
only being half a block long. She then enter-eZrrnTo the record a letter written on Oct. 4th to by
the president of the Alca Condominiums regarding the problem of parking decal zoning for his
building. He1She was in favor of decal parking and asked that the board please consider revising
the zones and the number of spaces provided for the condo's in the area so as to avoid conflicts.
Shirley was in agreement with the owner and asked to board to please consider the issue.
VII. Ajibola discussed the ease of enforcement regarding the parking decals issue and re-
enforced the fact that condo's with less units would be receiving fewer spaces than those with
more units and that it was just a matter of being fair and also keeping the enforcement of the
decals as uncomplicated as possible.
Vill. Shirley Huebner raised concern over how many zones would be created in one specific area.
She felt that the point of residential decal parking was to eliminate the intrusion of the business
area into the residential area, not dedicating spaces to particular properties. She then asked the
board to reconsider carving the area into zones and dedicating spaces as sole property of
condo's in the area. Kenny also asked for clarification on the matter.
IX. Shirley Huebner called a motion to reconsider the previous meetings vote on
residential parking. The motion fails and the vote from the previous meeting stays
unchanged.
X. The decision would be considered as part of the resolution to the decal parking situation that
Ajibola would draft for the commission.
XI. Regarding the decals themselves, Lee Costello with Dade Business Systems addressed the
board. She explained that the decals are valid for 3 years and that the stickers themselves are to
go on the back bumper of the car and come in several colors. They are permanent so as to avoid
theft. She also explained the steps to obtain the decals. The building that is asking for decals
needs to sign a petition that clearly states the cost involved and other important information. 75%
of the building has to sign the petition to make it official. She also presented a smaller decal that
goes on a car window. Several members of the board suggested that the placement of the sticker
be the inside of the left windshield. The board was all in favor of the this placement.
XII. Luis would try to get everyone a copy of the ordinance for review by e-mail before the
next meeting. Calling a special meeting to review the ordinance would be decided when
the ordinance was produced.

Parking Board Meeting Oct. 19, 2007

Also in attendance were:
Laz Parking, Weener Chavez & Ann Eldridge (Resident of South Miami)
II. No minutes available for review.
III. Shirley asked that the board please review the document given to the board by Mr.Noriega,
the head of the Miami Parking Authority, as well as the analysis that was put together by the
parking board itself in 2003. Mr.Noriega would be coming in for a workshop style meeting to
discuss different parking issues in South Miami. The details on enforcement and collection were
also discussed. Al Elias explained that he had the keys to the meters in a vault and that on the
days of collection, the supervision is supervised and then the keys are put back in the vault.
Laz Parking raised concern that there might be a conflict of interest with Mr. Noriega coming in to
speak to the parking board because Miami Parking Authority would be putting in a bid to work for
South Miami. Alex made a motion to deny the request by the City Manager to bring in Mr.Noriega
to speak to the board.
Shirley then made a motion to ammend the previous motion to say that the board denies to
request to have Mr. Noriega meet with the board until such a time when the board is given more
reason why the city manager wants the meeting to happen. The board approves the
ammendment and the motion to deny the meeting.
IV. Because Mr.Mcardle could not attend the meeting, Shirley asked his office to provide some
information on the issue of employee parking, such as:
• The date of the garage opening
• Status for request of employee parking
• Whats being designed in the garage for the employees of the facility itself.
The office had not provided any answers so Alex then made a motion to demand information from
the office. The motion was reworded and submitted by Al Elias to ask the city manager to get
McCardle or Richmond to give answers to the aforementioned questions. The board votes all in
favor of this motion. Laz Parking would provide some technical information regarding
removing some diagonal parking from in front of Casa Larios up to Deli lane and Shirley
would formally ask the city manager in writing.
V. In discussing employee parking further, the board decided to put together a list of the 5 most
pressing issues so that they might be addressed according to priority. The list included:
1. Garage Operation (Security, Employee Parking, etc.)
2. Employee Parking
3. Residential Decal Parking
4. Traffic Flow (Sidewalks)
5. Diagonal Parking
6. Additional Parking for the city, East & West of the highway, where to build?
7. Master Meters
In the spirit of finally discussing the Garage Operations before the opening, Sharon made a
motion to have a special meeting on the Friday after the meeting to speak to McCardle or
Richardson if they were avaialble to come in. All were in favor of this meeting.
VI. In regards to the car that Sharon has been following that is illegally parking, Laz & Weener
would be responding to the board in writing regarding the resolution of the situation.
VII. Ann Eldridge, who lives on 59th place, feels the block has been neglected by the city. She
was concerned because employees are getting free parking on her street after the city placed no
parking signs on the diagonal parking down her street. She was asked to put her thoughts in
writing concering the matter so it would be formally on the record.

III. Regarding the recent commission meeting, Sharon asked the board to confirm that they hadn't
spoken to any of the commissioners before the meeting on Tuesday (date ?). All said they had
not spoken to any of the commissioners. Sharon was concerned because the commission
members had made some remarks about the residential decal parking issue that were very
uneducated. Shirley went on record to say that she was very disappointed in the staff because a
complete document with all of the parking boards issues and suggestions was not put together for
the recent commission meeting. A discussion ensued over possibly attending the next meeting if
the mayor decides to invite them to speak. Shirley made a motion to have Sharon be the
spokesperson for the board if the mayor made such a choice. Al Elias made a motion to amend to
the previous motion that Sharon also read from a list of comments prepared by the remaining
members of the board. The board members unanimously voted yes on both motions.
IV. It was decided to go over the ordinance paragraph by paragraph along with Luis Figueredo.
• It was decided to take "Voting Residency" out.
• Shirley asks that the definition of "Visitors" be reworded to be more specific.
• It was decided to add 24/7 to the definition regarding when during the day decals are
supposed to be in display.
• On the definition of "Proof of Residency ", it needed to be specified that the required proof
be defined as "current" and that it also include "display of deed or current lease, rental
agreement, utility bill, bank statement, credit card statement or other acceptable
documents show residency..."
• On the paragraph that names all the buildings by name, Shirley asked to replace the
names with physical addresses to avoid problems in the future that would arise if a
building changed names.

date of the permit." And that Visitors permits shall only be issued to Residents that
