FOR ORDINANCES IN CONFLICT; AND PROVIDING AN EFFECTIVE DATE.
Request:
The historic designation of a commercial building at 5893 Sunset Drive was constructed in 1947, is part
of a series of downtown buildings recommended for designation by the Historic Preservation Board. The
attached Designation Report contains a detailed history of the building and includes photographs. The
attached designation report (p.4) describes the following architectural significance of the building: .
"The building, however, is one of the most visible along this stretch of the highway, and the architect was
challenged to create a corner entrance at the apex of the triangle, and two fully articulated facades on the US I
(north) side and on the Sunset Drive /SW 72nd Street] (south) side...... Although a small building, it is one of the
more distinctive buildings, and certainly one of the few remaining from this period of South Miami's history,
making it particularly significant. "
The City's preservation consultant concluded that the building is eligible for historic designation (p.6). In
addition, the property owner has testified at previous public hearings that they are in support of the
designation.
Designation Actions:
The Historic Preservation Board at its September 24, 2007 meeting reviewed the Designation Report,
conducted a public hearing, and adopted a motion by a vote of 7 ayes 0 nay recommending that the
historic designation be approved. The Planning Board at its October 10, 2007 meeting, after a public
hearing, adopted a motion by a vote of 6 ayes 0 nay recommending that the historic designation be
approved.
The property owner in a November 5, 2007 letter to the Planning Department requested a postponement
of the designation. However, the City Attorney ruled that this letter was not a definitive statement of
whether or not the property owner was opposed to the designation, which requires a 4/5 vote of the City
Commission to adopt the designation ordinance. The Planning Department contacted the property owner
on several occasions via certified mail and phone calls in order to advise the owner that a more definitive
notarized statement certifying the objection to the designation be transmitted to the City Clerk.
The designation item was approved by the City Commission on. first reading (3ayes 2 nays) at the
November 6, 2007 meeting. At this meeting, the 4/5 vote was not required because the property owner
had not submitted the appropriate legal document stating their opposition to the historic designation.
Recommendation:
It is recommended that the historic designation and the placement of an "HP -OV district over the
existing zoning district for the building at 5893 Sunset Drive be approved.

WHEREAS, Application No. PB -07 -026 was submitted to the Planning Department by the
Historic Preservation Board , said application requesting to amend the official zoning map of the City of
South Miami by overlaying an "HP -OV" Historic Preservation Overlay zoning district for property
identified as 5893 Sunset Drive and legally described as the West 86.01 feet of Lot 1, Coopers
Subdivision,, as recorded in Plat Book 4, Page 152 of the public records of Miami -Dade County; and
WHEREAS, the Historic Preservation Board at its September 24, 2007 meeting reviewed the
Designation Report for 5893 Sunset Drive and recommended that the proposed site be designated historic;
and
WHEREAS, the proposed historic designation and rezoning is consistent with the goals and
policies and the future Land Use Map of the City of South Miami Comprehensive Plan; and
WHEREAS, on October 10, 2007 after public hearing regarding the application of the HP -OV
zoning to 5893 Sunset Drive, the Planning Board recommended approval by a vote of 6 ayes and 0 nay;
and
WHEREAS, the City Commission desires to accept the recommendations of the Historic
Preservation Board and the Planning Board and enact the aforesaid HP -OV zoning.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA:
Section 1. That the City's Official Zoning Map shall be amended by placing the Historic
Preservation Overlay (HP -OV) zoning district over the existing underlying zoning use district for
property identified as 5893 Sunset Drive and legally described as the West 86.01 feet of Lot 1, Coopers
Subdivision,, as recorded in Plat Book 4, Page 152 of the public records of Miami -Dade County.
Section 2 . That the Designation Report for the building at 5893 Sunset Drive as prepared by the
South Miami Planning Department is identified as Attachment "A" and is attached to and made part of
this ordinance.
Section 3 The Design Review Guidelines set forth in the Designation Report for the building at
5893 Sunset Drive and the provisions contained in the Land Development Code pertaining to review of
building permits, certificates of appropriateness, and demolition are applicable to the property at 5893
Sunset Drive.
Section 4. If any section, clause, sentence, or phrase of this ordinance is for any reason held
invalid or unconstitutional by a court of competent jurisdiction, this holding shall not affect the validity of
the remaining portions of this ordinance.

PROCEDURES AND APPLICATIONS 20 -5.19
shall be pursuant to the provisions set forth in Section 20 -5.5, Applications requiring
public hearings. The recommendation of the Planning Board on the proposed desig-
nation shall be transmitted to the City Commission.
(F) City Commission Public Hearing.
(1) Public Hearing Requirement. The City Commission shall hold a public hearing,
pursuant to the provisions set forth in Section 20- 5.5(G) and notice requirements of
subsection (2) and as required by the provisions of the City Charter, on each proposed
designation within sixty (60) calendar days of the recommendation by the Historic
Preservation Board and/or the filing of the completed designation report.
(2) Notice Requirement. At least ten (10) calendar days prior to the public hearing for each
proposed designation of an individual site, district or zone, the Planning Director shall
mail a copy of the designation report to the owner at the address listed on the most
recent tax rolls as notification of the intent of the City Commission to consider
designation of the property.
(3) Objections. Upon notification, any owner of a property proposed for individual
designation who wishes to object shall submit to the City Clerk's Office a notarized
statement certifying the objection to the designation.

20 -5.18 Historic designation reports.
. (A) Report Format and Contents. Report format designating historic or archeological sites
may vary according to the type of designation. All reports shall address the following.
(1) Historical, cultural, architectural and archeological significance of the property or
properties being recommended for designation;
(2) Projected, proposed or existing public improvements and developmental or renewal
plans;
(3) Boundary recommendations for historic districts and archeological zones and identi-
fication of boundaries of individual sites being designated; and
(4) A signed and sealed survey of the subject property by a registered surveyor.
(B) Nonconforming Properties. Where .a report is filed recommending designation of a
district, the report must identify those properties, if any, within the district which are not
historically or architecturally compatible with structures in the district, and such report shall
provide standards for regulating such nonconforming properties.

20 -5.19 Demolition of designated sites; demolition by neglect and certificates of
appropriateness.
(A) Order Required. Demolition of a designated building, structure, improvement, or site
may only occur pursuant to an order of a governmental agency or a court of competent

ARTICLE VI. ADMINISTRATION AND ENFORCEMENT
20 -6.1 Administrative entities.
(A) City Commission.
(1) Establishment, membership and organization of the city commission shall be in
accordance with the City Charter and the Code of Ordinances of the city.
(2) Powers and duties.
(a) The city commission shall have all such powers and duties as are granted and
conferred by state law, the Code of Ordinances of the city and this Code.
(b) The city commission shall provide for the health, safety, convenience and general
welfare of the citizens of South Miami through the regulations contained in this
Code.
(c) The city commission shall receive recommendations from the planning board and
the environmental review and preservation board, and shall be guided by such
boards.
(d) The city commission shall act in compliance with and furtherance of the city's
adopted Comprehensive Plan.
(e) The city commission may:
i. Amend the provisions of the adopted Comprehensive Plan and this Code;
ii. Change zoning district boundaries;
iii. Authorize home occupational licenses;
iv. Grant variances from the. provisions of this Code;
V. Permit the continuation of nonconforming uses;
vi. Authorize special uses; and
vii. Make final judgment on appeals of administrative decisions.
(f) The city commission shall have the power and the duty to hear and decide the
above matters in accordance with the provisions of this Code.
(3) Procedures.
(a) Voting.
i. Except for those items listed in (ii) below, not less than three (3) affirmative
votes of the city commission shall be required to approve agenda items.
ii. Four (4) affirmative votes of the city commission shall be required to
approve a change to the adopted Comprehensive Plan, a rezoning to a less
restrictive use, a rezoning when a properly written protest is filed, a
variance, a special use, a home occupational license or a planned unit
development.

SUMMARY
The Historic Preservation Board at its September 24, 2007 meeting reviewed an historic designation
report for the commercial building located at 5893 Sunset Drive. Following a public hearing, the Board
adopted a motion recommending that this building be designated an historic site.
APPLICABLE REGULATIONS
The Land Development Code provides that an historic designation recommendation must be enacted as a
zone map change. The "HP -OV" Historic Preservation Overlay zoning district is superimposed as an
overlay over the existing underlying use zone. The procedures in the LDC require the Planning Board to
hold a public hearing on all designations recommended by the Historic Preservation Board. (Section 20-
5.17(E).
HISTORIC PRESERVATION BOARD ACTION
Attached is the Designation Report for 5893 Sunset Drive which was approved by the Board at its
September 24, 2007 meeting by a vote of 7 ayes 0 nays. At the Board's meeting one of the owners of the
building advised that they are totally in support the proposed designation.

STAFF OBSERVATIONS
(1) The building at 5893 Sunset Drive is one of six buildings identified as a "contributing building" in the
Hometown District Plan and Overlay District.
(2) The designation report and the procedures followed by the Historic Preservation Board are in
accordance with the current LDC regulations governing historic site designations.
(3) The designation of historic sites is compatible with several Future Land Use Element goals and
objectives contained in the City of South Miami Comprehensive Plan:
• Objective 1.2 Preserve historic resources by experiencing.no demolition or reconfiguration
of specified resources ........."
(4) The alteration, renovation, remodeling, or landscape change affecting the exterior of a designated
historic building will require special approval in the form of a "certificate of appropriateness" (COA).
This approval requires a review by the Historic Preservation Board and final approval by the City
Commission. The Designation Report contains a section entitled Design Review Guidelines (pp. 6 -7)
which establishes architectural guidelines for the review of future certificates of appropriateness.
(5) The proposed designation will not require changes to any of the dimensional standards or permitted
uses currently applicable to the area's underlining SR(HD -OV) Specialty Retail, Hometown District
Overlay ) zoning district.
RECOMMENDATION:
It is recommended that the historic designation and the placement of an 'TIP-OW district over the
existing zoning district for the building at 5893 Sunset Drive be approved.

II. SIGNIFICANCE

Statement of Significance
The architect for this commercial building faced a most difficult design problem,
resulting from the irregularity of this small lot (roughly triangular in shape, and
measuring 57.630 feet by 70 feet). The building, however, is one of the most
visible along this stretch of the highway, and the architect was challenged to
create a corner entrance at the apex of the triangle, and two fully articulated
facades on the US 1 (north) side and on the Sunset Drive [SW 72nd Street] (south)
side. Built immediately following World War II, when architects began to eschew
historicist styles, architect Newby returned to the Mediterranean Revival
character that dominated much of South Miami in its 1920s boom period.
Although a small building, it is one of the more distinctive buildings, and certainly
one of the few remaining from this period of South Miami's history, making it
particularly significant.
Contextual Histo
The dramatic diagonal created by the Florida East Coast Railway line and the
construction of the South Dixie Highway (US 1) that paralleled it, caused the
creation of a series of pyramidal shaped blocks that were later platted. The
resulting lot shapes were irregular at the three sides of the triangle.
The block on which the building at 5893 SW 72nd Street was created, was
originally platted by Mr. H.D. Cooper and his wife Lovilla, in April, 1919, and
named "Coopers Subdivision ". The subdivision witnessed its fair share of building
activity during the 1920s boom. The building on the north side of SW 72nd Street,
immediately west of the 5893 building (5875 Sunset), was constructed in 1925,
and the next west, "The Shelly Building ", constructed in 1926.
In the Dorn Subdivision, the Dorn- Martin Drugstore and Bank (5900 Sunset Drive)
and the Post Office (5904 Sunset Drive), at the opposite corner to the west of
5893 SW 72nd Street, are also products of the boom in the Greater Miami region.
The real estate boom, had at best, a seven year span, and while great buildings
were constructed; following the ensuing financial collapse, many of the platted
lots were left vacant.

By 1928, there was virtually no construction activity in the Greater Miami area,
and with the stock market crash in 1929; Florida sunk deeper into economic
despair. Coral Gables actually declared bankruptcy, and the region looked to
Franklin D. Roosevelt's progressive New Deal campaign for work, and the
construction of many public buildings across the county.
By 1933 South Miami's population had grown to 1,500 residents, but its corporate
limits were reduced to an area of approximately four square miles. In the book
"Florida: A Guide to the Southernmost State" produced by The Federal Writer's
Project under Roosevelt's New Deal and published in 1939, South Miami was
described in this way:
SOUTH MIAMI, 9 miles (1,160 population), originally named • Larkins for an
early storekeeper, was given its present name the day after his death.
Several plants here pack tomatoes, truck crops, and citrus for shipment to
market. South of the town are abandoned limestone quarries filled with
clear water and used as swimming pools.
The evidence in the growth of the City of South Miami is reflected in its building
permits. As the nation recovered, South Miami witnessed a revival as well. In
1936 the city reported the value of new construction at $53,700. When the
United States entered World War II in 1941, building virtually ceased, as the war
effort consumed American's efforts. The sacrifices endured perhaps
compensated for what was to follow. The United States and the South Florida
region, would witness meteoric growth, as tens of thousands of returning GIs,
made South Florida home. By 1948, the city reported building permits valued at
over $1.7 million. It was during this period that Mr. MacDonald commissioned the
building at 5893 SW 72nd Street.
III. ARCHITECTURAL DISTINCTION
Permit drawings indicate the sophisticated geometry of the two -story building
E.J. Newby designed, described simply as "Commercial Building for Mr. A.
MacDonald ". The plans are dated December, 1947. Newby designed a
building reminiscent of the Mediterranean Revival buildings in South Miami,
characterized by its:
• Masonry Construction with a stucco finish
• Stucco string courses that separate the first from second floors
• A flat roof and prominent parapet
• Applied ornament (the cast roundels that are evenly spaced across the
parapet wall.
• Use of steel sash windows on the second floor
The first floor contained square plate glass windows, no doubt intended for
merchandise display, although the original plans label the interior space as
"offices ". An exterior staircase on the east elevation accessed the second floor.

Alterations
Over the years, the building had had multiple tenants, who have accomplished
alterations to adapt to their business requirements. For the most part, those
alterations have been limited to the interior, with the exception of the installation
of awnings, signs and canopies.
South Miami's permit records show no permits for major alterations, and the
building remains remarkably intact.
IV. Eligibility for Designation
The South Miami Land Development Code; Section 20.4.9 entitled "Historic
Preservation Standards" lists the following criteria that a property must
meet in order to be considered for local historic designation:
(a) Districts, sties, structures and objects of national, state, and local
importance are of historic significance if they possess integrity of
location, design, setting, materials, workmanship, feeling and
association and:
(b) Are associated with events that have made a significant
contribution of the broad patterns of our history, and
(c) Embodies the distinctive characteristics of a type, period, method
of construction or work of a master, or that possess high artistic
value, or that represent a distinguishable entity whose components
may lack individual distinction.
In our opinion the commercial building at 5893 Sunset Drive is a product of the
Post War Boom that represents one of the key periods in our history. Further, the
building's unique design, responding to a highly irregular site, demonstrates the
skill of the architect in achieving a noteworthy building. The building is eligible for
local historic designation under criteria (a) (b) and (c) above.
V. Design Review Guidelines
In accordance with the procedures set forth in Section 20.5.19 of the City's Land
Development Code, any building permit for exterior alteration, renovation or
demolition of an existing structure, which is designated historic, or is within a
designated historic district shall first require the issuance of a Certificate of
Appropriateness (COA.) The COA is issued after a review by the Historic
Preservation Board and City Commission.
The Historic Preservation Board shall adopt and may, from time to time, amend
the standards by which applications for a Certificate of Appropriateness may be
evaluated. In adopting these guidelines, it shall be the intent of the Board to

In order to assist in the review process for the building at 5893 Sunset Drive, the
following design guidelines should be consulted.

Mr. Perez advised that at its September 24, 2007 meeting, the Historic Preservation Board
adopted a motion recommending that the building located on 5893 Sunset Drive be

designated as an historic site. He advised that during the meeting the owner indicated
complete support of the designation. Staff observed that the building is one of six
buildings identified as a "contributing building" in the Hometown District Plan. The
designation report and the procedures followed by the Historic Preservation Board are in
accordance with the current LDC regulations governing historic designations. The
designation of historic sites is compatible with several Future Land Use Element goals and
objectives contained in the City of South Miami Comprehensive Plan. It was
recommended that the historic designation for the property located on 5983 Sunset Drive
be approved.

Ms. Anderson identified herself as one of the owners of the building and advised she had
some concerns regarding the designation in the event she would sell the property. There is
a potential buyer and the individual was very negative about the building being designated
historic because they might want to combine it with the building next door.
Mr. Youkilis advised that the designation will not affect the sale. Mr. Perez added that in
the event the building does not get designated and it is sold than the new owner must meet
the parking space requirements as per the Land Development Code.
Ms. Young questioned if Ms. Anderson voiced her concern to the Historic Board. Ms.
Anderson replied with a negative adding that she was not aware until the potential buyer
made those indications.
Ms. Chael questioned whether Miami -Dade County Transit continued to consider the
pedestrian overpass bridge over that building. Mr. Perez advised that the County continues
its consideration of the pedestrian overpass connecting into the 5893 Sunset Drive building.
Motion: Ms. Chael moved to approve the designation of the building located on 5893
Sunset Drive. Ms. Young seconded.

Mr. Youkilis advised that during the previous HPB meeting the Board directed staff to proceed
with the Designation Report for this property. Mr. Youkilis advised that the City's consultant
Ms. Uguccioni indicated the location, structure, and significance of the property in her report.
She found that the structure remains the same with little alteration and recommended historic
designation. Staff agreed and therefore recommended the approval of the designation.
Mr. Hochstim advised that the architectural design is not Mediterranean Revival. He added it
has no stylistic character.

of Title is contingent upon a cessation of the conditions and/or criteria which originally
required the execution of the subject Unity of Title.

20 -5.17 Designation of historic sites.
(A) Report Required. Prior to the designation of an individual historic or archeological site,
an- investigation and formal designation report must be filed with the Historic Preservation
Board.
(B) Historic Preservation Board Recommendation. The Historic Preservation Board shall
make recommendations to the City Commission concerning all properties proposed as historic
sites, districts or archeological zones.
(C) Proposals and Preliminary Evaluation and Recommendation.
(1) Application for designation of individual properties and districts may be made to the
Planning Department by any member of the Historic Preservation Board, the
Environmental Review and Preservation Board, the City Commission, the City
administration or the property owner(s) of the subject property for designation.
(2) The Historic Preservation Board shall conduct a preliminary evaluation of available ;{
data for conformance with the criteria set forth herein and may direct the preparation
of a formal designation report by one of the members of the board. The Historic
Preservation Board may then meet as a body and develop recommendations to
transmit to the City Commission regarding designations.
(D) Historic Preservation Board Findings.
(1) If the board finds that the proposed designation meets the intent and criteria set forth
in this Code, it shall transmit such recommendation to the Planning Board and City
Commission with the designation report and any additions or modifications deemed
appropriate.
(2) If the board finds that the proposed designation does not meet the intent and criteria
in this Code, no further action shall be required, except that the board's action may be
appealed in accordance with the provisions of this Code.
(E) Planning Board Review.
(1) Following a favorable recommendation by the Historic Preservation Board, a proposed
designation shall be implemented by the adoption of an "HP -OW Historic Preservation
Overlay zone for the property set forth in the historic designation report.
(2) The Planning Board shall determine if the designation is compatible with the goals
and policies of the Comprehensive Plan, and if the proposed historic site and/or district
regulations would change any existing zoning district regulations such as, for example,
permitted use, height, floor area ratio, yard setbacks or off - street parking. The review

shall be pursuant to the provisions set forth in Section 20 -5.5, Applications requiring
public hearings. The recommendation of the Planning Board on the proposed desig-
nation shall be transmitted to the City Commission.
(F) City Commission Public Hearing.
(1) Public Hearing Requirement. The .City Commission shall hold a public hearing,
pursuant to the provisions set forth in Section 20- 5.5(G) and notice requirements of
subsection (2) and as required by the provisions of the City Charter, on each proposed
designation within sixty (60) calendar days of the recommendation by the Historic
Preservation Board and/or the filing of the completed designation report.
(2) Notice Requirement. At least ten (10) calendar days prior to the public hearing for each
proposed designation of an individual site, district or zone, the Planning Director shall
mail a copy of the designation report to the owner at the address listed on the most
recent tax rolls as notification of the intent of the City Commission to consider
designation of the property.
(3) Objections. Upon notification, any owner of a property proposed for individual
designation who wishes to object shall submit to the City Clerk's Office a notarized
statement certifying the objection to the designation.
