Mobile, is requesting approval to place a cellular communication facility and three stealth wall mounted telecommunication antennas on the property located at 8512 SW 57th Avenue. The building on which the facility and the antennas will be located is the Gulliver School Gymnasium. The property is zoned Planned Unit Development (PUD). The Land Development Code (LDC) permits the location of stealth building mounted antennas in PUD zoned areas, provided approval is given through the special use hearing process. (Section 20- 10.6(A)(1), LDC) The service facility (electronic equipment cabinets) will be mounted on the flat portion of the roof not visible from the street frontage. The three antennas, each six feet long, will be flush mounted on the south wall of the building near the roof line. The antennas will also be painted to match the building's exterior color. Staff Observations: 1) The school property consists of a main gym building and several accessory structures. The existing zoning on the property is PUD, a court ordered zoning imposed in the 1990's. 2) The applicant states that the facility and the antennas are needed in this area in order to resolve a lack of coverage and capacity. 3) The applicant has made a significant effort to camouflage the antennas and the electronics facility. The proposed antennas will not adversely affect the health or safety of persons in the vicinity nor will it be detrimental to the public welfare or property in the area. Planning Board Action: The Planning Board at its October 9, 2007 meeting adopted a motion by a vote of 6 ayes o nays recommending approval of the special use request. The proposal in this application is considered a stealth facility as defined in Section 20 -10.2 of the LDC: "Stealth Facility —Any telecommunication facility which is designed to blend into the surrounding environment. Examples of stealth facilities include, but are not limited to, architecturally screened, roof - mounted antennas, antennas integrated into architectural elements, and telecommunications towers designed to look like poles, power poles or trees" 2) Section 20 -10.6 of the LDC provides that in certain zoning districts, a telecommunication facility may be approved administratively by the City Manager after review by the ERPB. However, a stealth facility located in a "PUD" zoning district requires a special use approval. Specifically, subparagraph 1(a) states that "stealth rooftop or building mounted antennas, not exceeding 25 ft. above the roofline and 10 feet above the maximum height of the applicable zoning district, shall be permitted as an accessory use pursuant to special use approval in the following zoning districts: ... ... .... PUD. "' Overview of Property and Existing Zoning The Subject Property, zoned PUD, is Iocated at 8512 SW 57fl' Avenue in South Miami in a residential area. The quadrant to the North is zoned PUD -R; the quadrant to the South is zoned PR; the quadrant to the West is zoned RS -3; and property in the quadrant to the East is located in unincorporated Miami - Dade County'. Applicant is not seeking any zoning classification change. Special Use Zoning Rearrest The Applicant seeks approval of a Special Use to locate a camouflaged ( "stealth") wireless supported services facility ( "Facility ') on the rooftop of the Subject Property. Applicant proposes to flush -mount three antennas on the building as depicted in the photo simulations included in this Application. The proposed antennas will be camouflaged by painting them to match the building's exterior. The related electronic equipment that will be connected to the. antennas by means of coaxial cables, will be located in cabinets placed on the rooftop as depicted in the drawings referenced in this Application at item 6 above. The proposed Facility does not alter any previously approved site survey data or survey calculations. General Compatibility The proposed Facility is an unmanned facility that does not use water, sewer, or solid waste. The Facility only requires routine maintenance approximately weekly, thus there is no impact on transportation infrastructure. No easements or rights of way wiII be required for access to the Facility, and as it will be unmanned, a single parking space for the routine maintenance visits is all that will be required. The Facility neither creates nor poses any fire or other dangerous hazard to the public, and as the entire Facility is located on the building rooftop and roof line with its antennas a minimum of 45 feet above ground, it is not readily accessible. Included in this Application are Ietters from T- Mobile RF Engineers attesting to FCC compliance and safety rules and regulations and non - interference with public safety communications systems. . ' Recent changes in naming convention for zoning districts prompted a request to the City of South Miami for the current zoning classifications, which were provided by Lluvia Resendez in the Planning Department Necessity Standards The Applicant requires a Facility in this area due to a lack of in- building and in -car coverage. There are no other available existing wireless supported service facilities or buildings of sufficient height within T- Mobile's search area suitable for collocation of T- Mobile's antennas due to: a. insufficient structural capacity; and b. insufficient height to resolve the lack of coverage and capacity in the area intended to be served. The Applicant selected this site for location of its proposed Facility because it is located within an area identified by T- Mobile RF Engineering that would allow maximum coverage in the areas experiencing a gap in coverage. For the reasons stated herein, the Applicant is requesting approval of its Application for Special Use to permit a camouflaged wireless supported services facility on the Subject Property based upon need, compatibility and its design to minimize and eliminate any adverse visual impact to surrounding properties while providing reliable wireless communications to wireless customers. This includes television stations, radio stations, or other two -way and cellular services to either residential or commercial establishments. RF Statement T- Mobile USA transmits in the E &F PCS frequency band as defined by the FCC (1885 -1895 MHz base receive and 1965 -1975 MHz base transmit). The power levels of the proposed base station installation will not exceed 1640 W EIRP, the power level outlined in the PCS FCC Rule Part 24. Typical General Public Exposure in the near field (defined as less than 10 Meters directly in front of the antenna) of a PCS site is less than 1 uWkni?, again, below the established standard of 1 mW /cm2. Presently all tower and building locations were we have antennas have not exceeded the FCC Uncontrolled / Controlled Environment Maximum Permissible Exposure level. In the case that such situation arises and T- Mobile USA was transmitting at levels above the FCC Uncontrolled / Controlled Environment WE levels, T- Mobile USA would initiate our RF Energy Safety and Health policies and procedures programs to remedy the situation. The entire T- Mobile USA installation, including the antennas, are well within the most conservative safety recommendations of the National Council on Radiation Protection and Measurement (NCRP), the Institute of Electrical and Electronic Engineers (IEEE), and the American National Standards Institute (ANSI). The proposed installation will meet all FCC safety rules for PCS transmission standards including the Non - Ionizing Electromagnetic guidelines for transmission facilities. T- Mobile Wireless transmits in the E&F PCS frequency band as defined by the FCC (1965 -1975 MHz). The power levels of the existing base station installation will not exceed 1640 W EIRP, the power level outlined in the PCS FCC Rule Part 24. Typical General Public Exposure in the near field (defined as less than 10 Metiers directly in front of the antenna) of a PCS site is less than 1 uW /cm2, again, below the established standard of 1 mW /cm2. Mr. Youkilis advised that three stealth antennas will be installed on the flat portion of the roof of Gulliver School Gymnasium located on 8512 SW 57 Avenue. The stealth antenna's approval was required to go through a special use approval because the LDC indicates there are certain types of stealth antenna in certain zoning districts which must have a special use hearing under Section 20 -10.6 of the Land Development Code. There is an electrical room that will be placed at the second level roof line above the ground. As required by the LDC the applicant has met the requirements. They have supplied letters from engineers indicating that this site must be used because there is no other site within half a mile that will serve the purpose, provided an affidavit that there is no interference with other wireless communications, and provided an affidavit related to the wind load criteria. Staff observed that the applicant has made the effort to camouflage the antennas and the electronics facility. The proposed antennas will not adversely affect the health or safety of persons in the vicinity nor will it be detrimental to the public welfare or property in the area therefore, staff recommended approval of the stealth antennas as proposed. Ms. Yates opened the public hearing. They will be one foot and four inches wide mounted 3 3/4" off of the walls. The reason for the flush mount antenna was because we wanted to minimize the number of antennas on the facility therefore a six foot length was required in order to increase the capacity. They will all be located below the roofline. Ms. Yates closed the public hearing. Ms. Young requested that staff clarify the terminology "lack of coverage." Ms. Martohue explained that "lack of coverage" meant there was not enough coverage allowing someone in the area to make a call and a "lack of capacity" meant there were customers in the area not having enough capacity to handle phone calls once they are made. Ms. Beckman questioned the number of antennas which will be installed and if there was a removal policy should the technology change. She also questioned whether or not the school was for profit or non - profit. Ms. Martohue replied that there will be three flushed mounted panel antennas and that most cities have abandonment clauses. To answer Ms. Beckman's question regarding the profit or non- profit, Ms. Martohue advised T- Mobile operates under a lease agreement with Gulliver Academy. She added that the issue should not influence on the decision making process when evaluating the criteria as to whether or not the Board should approve the variance. Ms. Beckman stated that the City should receive some of the monthly rent if it is a profit organization. Mr. Perez offered to research the issue. Ms. Chael questioned if the antennas would be as affective if they were mounted on the roof. Ms. Martohue responded it will not have any influence, however, if mounted on the.
