THE VARIANCE REQUESTED IS TO ALLOW A REAR SETBACK TO BE 23 FEET 10 INCHES
WHERE A MINIMUM OF 25 FEET IS REQUIRED PROVIDING FOR AN EFFECTIVE DATE.
Background:
The applicant, Habitat for Humanity has filled Application No. PB -06 -034, requesting a variance in order to
construct a single family home on a vacant lot located at 6016 SW 63 Street (Lot 78, E.1 /2 Lot 79, Block 14,
Franklin Subdivision). The applicant, a non -profit housing organization, is proposing to build a one story home
with a total of 1317 sq. ft. of floor area. This application is the same application originally filed in October, 2006
and before the Planning Board in December, 2006.
The subject parcel at 6016 SW 63 Street is 6099 sq. ft. (6000 required) and has 73 feet frontage (60 required). The
proposed building plan complies with all of the zoning dimensional standards for the RS -4 Single Family
Residential zone district with the exception of the 23 feet 10 inch rear setback which is below the minimum
required setback of 25 feet. A variance for the rear setback is requested.
In July, 2005, the South Miami Community Redevelopment Agency (CRA) transferred two and half lots (includes
Lots 78 and 79) to Habitat for Humanity for the express purpose of building affordable housing. The warranty deed
transferring the properties requires Habitat for Humanity to build two single family homes, obtain variances if
necessary, and make special efforts to sell the homes to qualified residents of the CRA area.
Unity of Title Issue
This same exact variance application was before the City Commission at its January 9 and 23, 2007 meetings at
which time it was determined that a unity of title document executed earlier in 2006 was a mistake because it
included as one building site all of the lots proposed for the two homes. It was agreed that the unity of title needed
to be released before the City could consider the variances required. The City Commission at its February 20, 2007
meeting adopted Resolution No. 21 -07 -12406 releasing the subject unity of title.
Staff Observations:
(1) The requested rear setback variance of one foot and two inches is a result of the lot being reduced by the
dedication of the north 17.5 feet to be used for corner rounding, new sidewalk, and street reconstruction on
SW 63 Street.

(2) Habitat for Humanity builds homes that have prototypical layout and design that use standardized trusses and
other building components to keep the homes affordable. The applicant in a letter dated October 26, 2006,
claims that the special circumstances of providing an affordable home justifies the granting of the variance.
(3) The City's Comprehensive Plan specifically states that the construction of affordable housing is a major goal of
the City. Attached to the Planning Department staff report is an excerpt from the Plan listing the goals and
policies related to the production of affordable housing.
(4) The variance requested will have minimal impact on surrounding properties. The variance is also necessary to
use the property to create an affordable housing opportunity.
Planning Board Action:
The Planning Board at its December 12, 2006 meeting, after public hearing, adopted a motion by a vote of 6 ayes
0 nays recommending approval of the requested variance with the following condition: that the unity of title, which
mistakenly includes all three properties, must be released before development of the property. The Board also
recommended that the City Commission waive the variance application fee for this application.
It is important to note that a new unity of title document must be prepared and executed for this property at 6016
SW 63 Street. This is necessary because the ]building site consists of one lot plus half of another lot.
Recommendation:
It is recommended that the City Commission approve the requested variance to allow the development of a new
home at 6016 SW 63 Street with the condition that a new unity of title document be executed before development
of the property.
It is further recommended that the variance application fee ($2000) be waived. This is an action routinely done in
the past for non -profit groups.

21 WHEREAS, the applicant wishes to develop the property with a new one story single

26 WHEREAS, the approval of a variance requires a recommendation from the Planning
27 Board and the approval of the City Commission after a public hearing; and

Section 2. The approval of the requested variance includes approval of Architectural Site Plans

labeled Exhibit "A" which is attached and incorporated herein.
Section 3. That the approval of the subject variance is based upon the following findings:
a) The requested rear setback variance is necessary because the property cannot be developed
without a variance which constitutes a hardship;
b) The variance requested is of a small, incremental nature and would have minimal impact on
surrounding properties;
c) The variance requested is a unique situation that would not be applicable to any other properties
in the immediate vicinity;
d) The variance requested will promote the Comprehensive Plan policies of providing affordable
housing opportunities.
Section 4. That the variance application fee of $2000 is hereby waived.
Section 5. This resolution shall be effective immediately after the adoption hereof.

SUMMARY OF REQUEST
The applicant needs variances in order to construct a single family home on a vacant lot located
at 6016 SW 63 Street (Lot 78, E.1/2 Lot 79, Block 14, Franklin Subdivision). The applicant is
requesting approval of a variance for a rear yard setback. The applicant, a non - profit housing
organization, is proposing to build a one story home with a total of 1317 sq. ft. of floor area.
BACKGROUND
At its July 18, 2005 the South Miami Community Redevelopment Agency adopted a resolution
turning over two and half lots owned by the CRA to Habitat for Humanity for express purpose of
building affordable housing. The lots at transfer were joined by a unity of title. The unity of title
must be released by the City before the properties can be developed. The warranty deed
transferring the properties requires Habitat to build two single family homes, obtain variances if
necessary, and make special efforts to sell the homes to qualified residents of the CRA area.
The subject parcel at 6016 SW 63 Street is 6099 sq. ft. (6000 required) and has 73 feet frontage
(60 required). The proposed building plan complies with all of the zoning dimensional standards
for the RS -4 Single Family Residential zone district with the exception of the 23 feet 10 inch rear
setback which is below the minimum required setback of 25 feet. A variance for the rear setback
is requested.

STAFF OBSERVATIONS
(1) The subject site is surrounded on the north, east and west by small single. family homes, many
of which are located on substandard lots (below the RS -4 minimums). To the south of the
property is a second vacant lot which will also be developed as a single family home. The
property has been vacant for over 6 years
(2) The requested rear setback variance of one foot and two inches is a result of the lot being
reduced by the dedication of the north 17.5 feet to be used for corner rounding, new

GOALS, OBJECTIVES AND POLICIES
HOUSING ELEMENT
Objective 1.3 To create and maintain affordable housing for all current and anticipated future
residents of the City and specifically supporting programs such as CRA and other private
organizations which will result in the construction of 30 units of affordable housing and an
additional 100 units anticipated to be part of the proposed Hometown Station project by the
year 2005. It is projected that construction of an additional 150 units of affordable housing
can be achieved through various programs and projects by the year 2010 (reducing the
future deficit of affordable housing by 25 %).
Policy 1.3.3 The City's .Community Redevelopment Agency will implement its New
Housing Program in order to acquire vacant property and provide financial
assistance to construct at least 24 new affordable housing units.
Policy 1.3.4 The City's Community Redevelopment Agency will provide additional
incentives to private developers to construct projects with affordable
housing units.
Policy 1.3.5 The City will support and assist the efforts of private organizations to
construct at least five affordable housing units per year.

• Land Development Code Section 20 -3.5(C )(1) Dimensional Requirement Tables
(1) The use of land and the erection of buildings and other structures on land
shall be subject to the dimensional requirements of the applicable zoning
district, as reflected on the three tables labeled 'Dimensional
Requirements, Single - Family Districts" (Section 20- 3.5E), 'Dimensional
Requirements, Multi family Districts" (Section 20 -3.5F) and 'Dimensional
Requirements, Nonresidential Districts" (Section 20- 3.5G).
• Land Development Code Section 20- 3.5(E) DIMENSIONAL REQUIREMENTS

• Land Development Code Section 20 -5.9 Variances Approvals
(A) Expiration of Variance Approvals. A variance approved pursuant to
Section 20 -5.5 shall lapse after six (6) month if no substantial
construction or change of use has taken place in accordance with
the request for such variance and if the city commission has not
specified a longer approval period for good cause shown.
(B) Extension of Variance Approvals. Four (4) affirmative votes of
the city commission may grant an extension to a previously
approved variance if a proper and timely request is made by the
applicant prior to the expiration of the six (6) month period.
(C) Hardship Statement. All applications for a variance shall include
a letter of intent indicating the specific nature of the hardship
upon which the request is based.
(D) Property Survey Required„ All applications for a variance shall
include a current property survey prepared by a registered
surveyor.

(E) Neighborhood Concurrence. All applications for a- variance shall
be accompanied by a map which reflects all properties and the
names of all property owners within a five hundred (500) foot
radius of the subject property. The applicant shall obtain and
submit the signatures of at least twenty (20) percent of such
property owners, indicating their awareness of and concurrence
with the proposed variance request.
(F) Proposed Site Plan Required. A site plan shall be required
showing all proposed buildings and setbacks and any other
features relating to the variance request.
(G) Permitted Variance Requests. Applications for variances shall be
restricted to only the following:
(1) Yard setbacks
(2) Lot size
(3) Lot coverage
(4) Building height
(5) Fences and walls
(6) Impervious coverage
(7) Off- street parking

20- 3.5(E) OF THE LAND DEVELOPMENT CODE IN ORDER TO ALLOW THE
CONSTRUCTION OF A ONE STORY SINGLE FAMILY HOME ON PROPERTY
LOCATED AT 6016 SW 63 STREET, SOUTH MIAMI, FLORIDA, WITHIN THE "RS -4"
SINGLE FAMILY RESIDENTIAL ZONING USE DISTRICT; THE VARIANCE
REQUESTED IS TO ALLOW A REAR SETBACK TO BE 23 FEET 10 INCHES WHERE
A MINIMUM OF 25 FEET IS REQUIRED PROVIDING FOR AN EFFECTIVE DATE
Action: Mr. Farfan read the resolution into the record. Mr. Youkilis indicated that the
applicant needs a variance in order to construct a single family home on a vacant lot
located at 6016 SW 63 Street. The applicant is requesting approval of a variance for a rear

yard setback. Mr. Youkilis noted that the applicant which is a non - profit housing
organization is proposing to build a one -story residence with a total of 1317 sq. ft. of floor
area.
At this point, Mr. Youkilis provided the following staff observations:
(1) The subject site is surrounded on the north, east and west by small single family
homes, many of which are located on substandard lots (below the RS -4
minimums). To the south of the property is a second vacant lot which will also be
developed as a single family home. The property has been vacant for over 6 years
(2) The requested rear setback variance of one foot and two inches is a result of the lot
being reduced by the dedication of the north 17.5 feet to be used for corner
rounding, new sidewalk, and street reconstruction on SW 63 Street. .
(3) Habitat for Humanity builds homes that have prototypical layout and design that
use standardized trusses and other building components to keep the homes affordable
The applicant in a letter dated. October 26, 2006 claims that the special circumstances
of providing an affordable home justifies the granting of the variance.
(4)The City's Comprehensive Plan specifically states that the construction of
affordable housing is a major goal of the City. Attached is an excerpt from the Plan
listing the goals and policies related to the production of affordable housing.
(5) The variance requested will have minimal impact on surrounding properties. The
variance is also necessary to use the property to create an affordable housing
opportunity.
(6) The applicant is requesting that the City Commission waive the variance
application fee ($2000).
Recommendation:
Staff recommended approval of the variance for 6016 SW 63 Street with the following
condition: that the unity if title must be released before development of the property. In
addition, staff also supports a waiver of the variance fees which is an action that has been
routinely done in the past for non - profit groups.
Chairman Morton opened the public hearing.
Applicant: Ida Moralejo
Ms. Moralejo explained she represents the non - for - profit organization Habitat for
Humanity and that the organization is open to recommendations offered by this Board.
Additionally, she noted that any additional design comments that would enhance the home
would be welcomed by the organization.

At this time, the Board and staff discussed the application. Mr. Youkilis informed the
Board about a letter from Ms. Nancy Cobb who was unable to attend this meeting but
wanted the letter to be distributed to the Board members as well as be entered into the
record. Ms. Young asked staff the nature of the letter. Staff replied the letter relates to this
address however, the content involves other topics not specifically related to this request.
Ms. Young expressed that being handed this letter on short notice and not being able to
digest what Ms. Cobb is addressing. She noted that she does not feel right in discussing
Ms. Cobb letter. Ms. Beckman commented in regards to the letter, that it would seem
fitting that since this house is being built in South Miami, a South Miami resident should
be given the opportunity to live there.

Motion: Ms. Beckman made a motion .recommending approval of the variance with
staff's condition. Ms. Young seconded the motion.

Motion: Ms. Young made a motion recommending to the City Commission that the
application fee be waived. Ms. Beckman seconded the motion.
