Request: The applicant is requesting a Special Use Approval to operate a general restaurant at the above referenced location. The Shops at Sunset Place is located in the "SR(HD -OV) ", Specialty Retail Hometown Overlay Zoning District. A restaurant use is allowed in the SR(HD -OV) zoning district. The restaurant requires Special Use Approval. The proposed Giggle City Play Cafe restaurant is to be located on the third floor next to the Mall's executive offices. The space consisting of 8,100 square feet has never been occupied. The restaurant will be part of children's entertainment center and will occupy approximately one half of the floor area. The City Commission at its April 1, 1997 meeting approved Resolution No. 64 -97- 10035, allocating to the Shops at Sunset Place a total of 61,250 square feet of restaurant space. Attached to this report is a chart entitled "Current Status of Restaurants located in the Shops at Sunset Place", which has been updated to December, 2006. A total of eight restaurants are currently operating or approved occupying 37,484 sq. ft. After the addition of the Giggle City Cafe restaurant there will still remain 23,766 sq. ft. of allocated restaurant space remaining. The required parking spaces for all restaurants were included in the initial approval of the Shops. Based upon this analysis there are no additional spaces required. The proposed restaurant will not adversely affect the health or safety of persons residing or working in the vicinity; and the proposed use will not be detrimental to the public welfare or property or improvements in the neighborhood. The Planning Board at its January 16, 2007 meeting adopted a motion by a vote of 6 ayes 0 nays recommending approval with conditions of the special use request. Recommendation: It is recommended that the subject application be approved with the following conditions: (1) All signage for the new establishment is subject to approval by the City's ERPB; (2) If the subject general restaurant is, in the future, determined by the Director of Planning, to be adversely affecting the health or safety of persons residing or working in the vicinity of the proposed use, to be (2) detrimental to the public welfare or property or improvements in the neighborhood, or to be not in compliance with other applicable Code provisions, the special use approval may be modified or revoked by the City Commission upon notification and public hearing. A general restaurant is defined as an establishment where the principal business is the sale of food and beverages to the customer in a ready -to- consume state and where the design shall provide a sit -down area for the customers. SPECIAL CONDITIONS APPLICABLE: The LDC provides that special uses must be approved by the City Commission after a public hearing and receipt of a recommendation from the Planning Board. The overall purpose is to determine the compatibility of the proposed use with the surrounding neighborhood. Special uses may also be required to comply with the additional requirements, which are set forth in Section 20- 3.4(13)(4)(b). In the case of a general restaurant the following supplemental requirements are listed: (i) All such establishments shall provide only inside or patio service on private property. Public streets, rights -of -way, sidewalks and required setbacks may not be used for patio or street - side services of any kind. A separate application for outdoor seating would be required. Ownership information Giggle City Play Cafd is a "dba" of Karpa Holdings, LLC. The lease is executed between Karpa Holdings, LLC (referencing the project's working name of Funny Yummy) and Shops at Sunset, LLC (Simon Properties). Lease information included in the application packet. The Managing Partner of Karpa Holdings is Jose Luis Bueno of Key Biscayne, Florida. The Giggle City Play Cafd project is being managed by Amy Madson, General Manager, who will be involved in all aspects of development and operations. Project Overview Giggle City has been conceived to access the family -based upscale population of South Miami, Florida and the surrounding towns. Our Demographic Analysis has shown that there is a very large residential population base of close to 1,200,000 within the 10 mile radius study area. Giggle City will be located in The Shops at Sunset Place, which is a multi -level town/park -like destination where shoppers find specialty retail as well as familiar favorites for fashion, beauty, home and dining. Its distinctive tenant roster features boutiques and restaurants anchored by Barnes & Nobles, Dan Marino's Fine Food & ',spirits and AMC theatres. Maximizing location to help build traffic sources and encouraging word of mouth advertising and targeted effective communication will be a core driver in ensuring future growth and success. Giggle City's key advantage will be their superior location- destination, extraordinary customer service and never - ending quest for fun in a totally unique and parent- friendly environment. Giggle City will provide children and their parents a place where fun is found in every corner. Giggle City will create an environment that is healthy, safe, loving and creative - insuring their celebrated events are extra special for everyone. The main attraction at Giggle City will be a sincere interest in our communities' children: their encouragement, learning, safety and, mostly, FUN! But moreover, Giggle City will be dedicated to the parent's comfort too, by having a large lounge seating area in the center of the facility -- two steps above ground level. Here, parents can be seated in a relaxed environment, enjoying a beverage or sandwich, while having 360' views of their kids at all times, who are enjoying healthy, creative fun. Children and parents who visit Giggle City will know instantly as they walk in the door that they have entered a totally unique and creative environment unlike any other Family Entertainment Center they've ever seen. In state -of -the -art themed amusement zones there will be different play, learning and art activities at each vignette such as: the Computer Corner, Lego Building Zone, Arts & Crafts, Cars & Trains, The Teddy Bear Filling Station and Beauty Boutique. This fun- loving experience will be found in both the d6cor and the people as they will work hand in hand to provide extraordinary customer service. The Giggle City website will highlight both the facilities' unique and creative indoor play activities and assist parents in scheduling party reservations. Another attraction will be a large Birthday Party Area, consisting of a number of specially - themed Party Rooms, as well as a major Soft Structure Play Unit, capable of handling up to 80 children and a spacious Toddler Area. With the four Themed Party Activity Rooms, there will be an overall party capacity of 100 children. It is estimated that the Birthday Party business generated will represent close to 55% of total annual sales. Retail and Souvenir Gift Sales will also be a significant Profit Center, which will allow the business to grow into other profit centers, possibly consisting of signature and/or `branded' item sales and various other seasonal gift items and themed `take home' souvenirs. There will be Food Service dining area, with a capacity of 50 seats, which will offer parent- friendly fare in a themed, tastefully decorated environment. Strong effort will be placed to provide excellent service, high - quality and fresh food products where possible and varied and seasonally- changing menu offerings. The building's interior will be uniquely themed and beautifully decorated, with different activity concepts, like Art and Craft's niches; a Builder's Corner, where the children role -play with con- struction games, toys and play elements; a Computer Corner, where both fun and learning will be encouraged. A 3 and 10 mile radius Demographic Analysis was done to examine the population base and viability for the Family Fun Center activities at the Giggle City proposed site location. A stringent evaluation of competitive -type businesses within the radius study areas was performed to examine the feasibility of success of this type of operation. Specific to the growing visitation to the region, the increased number of major 'chain' hotels and motels within the Radius Study Area indicate a viable market segment available for this type of attraction. It is anticipated that an ongoing 'rack card' advertising campaign will be able to access this market. We have put together a strong management and marketing plan which will allow Giggle City to grow with the additional business potential expected. Jose L. Bueno, along with his General Manager, Amy Madson, will personally oversee the operation, providing an `ownership' presence on site during the construction and initial start-up periods, as well as day -to -day ongoing management. A significant Advertising and Marketing Budget will be put in place to provide ongoing annual growth. In a residential -based market, advertising must be constant and fluid. A sizable advertising budget, 1 % larger than most FEC's, will allow management to saturate all the local markets and take advantage of large volume media purchasing. Finally with Birthday Parties, Child/Parent Interaction and Soft Structured Play as the ANCHOR ATTRACTIONS, there will be a true family synergy! Family Entertainment and Fun Centers have had a long tradition of providing clean, family- friendly leisure fun, education and entertainment activities to communities for more than 3 decades. Security will be maintained with matching parent/child identification bands and a staffed entrance. For the safety of the children, no unaccompanied adults will be admitted. Birthday Parties The bulk of our business will come from hosting children's birthday parties in our uniquely themed party rooms. Retail Gift Shop Our retail area will be accessible to all mall shoppers as it will be located before the security gate entering the activity areas. We will offer educational and fun games and toys along with gift type items. The highlight will be stuffing your own teddy bear or other animal with our "filling station ". Dining We will have dining element for the parent's comfort. We will offer high quality hand food items such as sandwiches, salads and pizzas. The seating area is approximately 848 square foot with 52 seats and the food preparation/storage area is approximately 852 square foot. Both areas combined represent less than 20% of our total venue and we are expecting the revenues to be approximately 17% of total revenues. This dining area is not accessible to the public— it is only for customers who are escorting children in the venue. Kid size cheese or pepperoni pizza Crispy Chicken Tenders Noodles & Sauce Cooking Equipment We will have a gas convection oven to offer fresh baked breads and desserts along with a small cooking line and a pizza preparation area including a conveyor oven. We added this area to the design to ensure we offer fresh, high quality ingredients to our guests. The cooking area will have two floor standing gas fryers to accommodate making French fries and other hand eaten items like mozzarella sticks and chicken fingers — all kid favorites. All equipment will be brand new and we will comply with all fire suppression requirements as well including installing hoods and Ansil systems as required. Clean- up/Trash We will coordinate our own in -house cleaning program using MSDS approved products to ensure we maintain a clean food preparation and storage environment. All plates will be scraped to remove food debris before entering the dishwasher minimizing the food waste /grease in the drains /traps. According the mall operations manager, grease traps are already in place for our location and they are maintained by the mall. Bagged trash collection will be maintained in a back of house area in a "dumpster" cart throughout the day and will be removed from the venue as needed throughout the day, but at the minimum — once per day at closing time. The trash area will be in the back part of the venue with easy access to the service hallway and service elevator. The dumpster cart will be rolled to the approved Mall trash area and emptied based on the route provided by Simon Malls. Deliveries Nearly all deliveries (food, equipment & supplies) will enter the facility through the service elevator and service hallway behind our venue. They will enter the facility through the "back door" directly into the back of house areas. Any extra large deliveries may have to be brought in through the front doors after using the mall freight elevator behind GameWorks. This would be done during mall approved hours or with the mall's special permission. There is a loading dock as needed, but per the Mall Operations Manager, there is a "cut -out" behind our venue on Red Road that can be used for delivery trucks as well as long as it is a quick stop.
