CAMBRIDGE LAWNS HISTORIC DISTRICT; :PROVIDING AN EFFECTIVE DATE.
APPLICANT'S REQUEST
The applicants Dr. Jose and Anna Lemus are requesting approval for the installation of new
windows at their home located at 6250 Miller Rd. The subject property is one of thirty properties
within the Cambridge Lawns Historic District which is an "HP -OV" Historic Preservation
Overlay Zone. Pursuant to Section 20- 1.19(E) of the Land Development Code, a "Certificate of
Appropriateness ", is required for applications affecting the exterior (renovation, repair, painting,
demolition or landscaping). The approval process requires review by the Historic Preservation
Board and City Commission. The Commission, after a public hearing may approve, deny,
approve in modified form, or defer a COA application.
HISTORIC BOARD ACTION
The Historic Preservation Board initial review on October 30, 2006 was that the new replacement
windows ( fixed single pane with a horizontal mullion) were not compatible with the architectural
style of the home and distracted from the basic appearance of the house. The Board felt that the
new windows on the front fagade should be multi - paned sash windows which were in place prior
to the current new installation. (see attached staff report). The applicant stated that when he
bought the home this year he did not know it was in an historic district and he agreed to submit a
revised proposal for the window replacement. The Historic Preservation Board at its December
18, 2006 reviewed the applicant's revised window replacement plan (see Exhibit A, dated Dec.
18, 2006) and recommended approval by a vote of 5 ayes 0 nays.
RECOMMENDATION
Approval of a "Certificate of Appropriateness" for window replacement at 6250 Miller Road as
shown on Applicant's Exhibit "A" graphic illustration dated 12/18/06.

WHEREAS, applicants Dr. Jose and Anna Lemus have submitted Historic Preservation
Board Application No. HPB -06 -011 requesting a certificate of appropriateness to allow for the
installation of new windows at their single family residence located at 6250 Miller Road, which
property is within the Cambridge Lawns Historic District which is an "HP -OV" Historic
Preservation Overlay Zone; and
WHEREAS, pursuant to Section 20- 1.19(E) of the Land Development Code, a
"Certificate of Appropriateness ", is required for applications affecting the exterior (renovation,
repair, painting, demolition or landscaping); and
WHEREAS, Section 20- 5.19(E)(3) of the South Miami Land Development Code
requires the City Commission to conduct a public hearing on certificates of appropriateness and
to approve, deny, approve in modified form, or defer a subject application; and
WHEREAS, the Historic Preservation Board at its December 18, 2006 meeting adopted
a motion by a 6 aye 0 nay vote recommending approval of the subject application for the
installation of new windows as shown on a submitted graphic illustration entitled Exhibit "A ",
dated 12/18/06 ; and
WHEREAS, the Mayor and City Commission of the City of South Miami desire to
accept the recommendation of the Historic Preservation Board.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA THAT:
Section 1. Historic Preservation Board Application No. HPB -06 -011 requesting a certificate of
appropriateness to allow for the installation of new windows at their single family residence
located at 6250 Miller Road as shown on a submitted graphic illustration entitled Exhibit "A ",
dated 12/18/06 is hereby approved.
Section 2. This resolution shall be effective immediately after the adoption hereof.

APPLICANT'S REQUEST:
The applicant is requesting approval for the installation of new windows at the above referenced location.
BACKGROUND
On October 5, 2004 the City Commission adopted a new zoning district, the "HP -OV Historic
Preservation Overlay. The subject property, among the thirty properties, is within the Cambridge Lawns
Historic District. Pursuant to Section 20- 1.19(E) of the Land Development Code, a "Certificate of
Appropriateness ", is required for applications affecting the exterior (renovation, repair, painting
demolition or landscaping).

STAFF OBSERVATIONS
(1) The above photo demonstrates the current windows which were installed without a permit. A code
violation was issued in September by the Code Enforcement Division.
(2) The City's Code Enforcement file contains a photo of the multi -paned sash windows which were
in place prior to the current new installation. (see attached).
(3) The new replacement widows appear to be a fixed single pane with a horizontal mullion. The new
windows have become the focal point of the front facade and distract from the basic appearance of
the house.
(4) The applicant also appears to have placed a new sash trim around the front door entrance cove.
RECOMMENDATION
It is recommended that the requested COA be denied.

Roll call was performed. Board members present constituting a quorum: Ms. Clyatt, Mr.
LaMonica, Mr. Ruiz de Castilla, Mr. Kurtzman and Ms. Shelley.
Board members absent: Ms. Chael Ms. Dison.
City staff present: Sanford A. Youkilis (Acting Planning Director), and Patricia E. Lauderman

V. Certificate of Appropriateness Applications
(a) HPB -06 -011: (continuation from 7/31/06)
Applicant /owner: Jose and Anna Lemus
Location: 6250 Miller Road (Cambridge Lawns Historic District)
Request: New windows and door installation
Action: Mr. Youkilis informed the Board that the applicant had been deferred at the November
29, 2006 meeting. In addition, he noted that the applicant has researched an alternative for the
replacement windows. Mr. Youkilis indicated that the applicant has provided Exhibit "A" which
shows a picture of the proposed new windows. The Board stated that the new windows were a
welcomed change and that the proposal is more consistent with the look of the house. Dr. Lemus
thanked the Board for their suggestions and he agreed that the home will look better.
Motion: Mr. Kurtzman moved for approval of the Certificate of Appropriateness for 6250
Miller Road. Mr. Ruiz de Castilla seconded the motion.
Vote: Approved 6 Opposed 0
