10-07-08 Item 22as 1 2 ORDINANCE NO.: 3 4 AN ORDINANCE OF THE MAYOR AND CITY COMMISSION OF 5 THE CITY OF SOUTH MIAMI, FLORIDA, AMENDING CHAPTER 6 17 OF THE CITY'S CODE OF ORDINANCES, BY ESTABLISHING 7 AN INTERGOVERNMENTAL COORDINATION AND REVIEW 8 PROCESS FOR PROPOSED COUNTY AND STATE 9 DEVELOPMENT PROJECTS WITHIN THE JURISDICTION OF 10 THE CITY OF THE SOUTH MIAMI; WHICH COORDINATION 11 SHALL ENSURE THAT ALL PROPOSED PROJECTS TAKE INTO 12 ACCOUNT THE CITY OF SOUTH MIAMI'S OBJECTIVES AND 13 GOALS OF MINIMIZING TRAFFIC IMPACTS IN RESIDENTIAL 14 COMMUNITIES AND ENHANCING THE CITY'S BUSINESS 15 DISTRICTS; PROVIDING FOR SEVERABILITY, ORDINANCES IN 16 CONFLICT, CODIFICATION, AND AN EFFECTIVE DATE. 17 18 19 WHEREAS, the City of South Miami devotes considerable effort to coordinating 20 with Miami -Dade County and the State of Florida on infrastructure projects; and, 21 22 WHEREAS, significant growth and development activities in Miami -Dade 23 County and the State of Florida affect traffic volumes, land use patterns, economic 24 development, environmental conditions and other aspects of life in the City of South 25 Miami and the neighboring communities; and, 26 27 WHEREAS, County and State development and infrastructure projects should 28 strive to minimize impacts and effects on the surrounding environment and, where 29 possible, improve existing conditions; and, 30 31 WHEREAS, in order to coordinate planning activities that encourage orderly 32 growth and sound development; to protect the City's natural resources; to insure a safe 33 living environment for the citizens of the City of South Miami; to increase public 34 understanding of planning activities; to facilitate community participation in the planning 35 process; to provide clear and concise information to citizens a formalized review process 36 of State and County development and infrastructure projects that impact the City of South 37 Miami and coordinate how such projects should be developed. 38 39 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY 40 COMMISSION OF THE CITY OF SOUTH MIAMI, FLORIDA, THAT: 41 42 Section 1. Chapter 17, Article 1, of the Code of Ordinances of the City of 43 South Miami is being amended by adding Section 17 -10.2 as follows: 44 45 Sec. 17 -10.2. Rules of procedure for intergovernmental coordination and review 46 process for proposed county and state development projects within 47 the jurisdiction of the City of South Miami 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 (A) The City Manger shall coordinate with Miami -Dade County and the .State of Florida for purposes of receiving reports that identify all funded and unfunded projects that impact the City of South Miami. (B) The City Manager shall coordinate that formal presentations be made at City Commission meetings for all project. (C) The City shall hold workshops with a public hearing to review each project for consistency with the City's Comprehensive Plan. Residents and business owners within five hundred feet of any proposed project will be directly notified by mail of the proposed project. The City will invite the County or State agencies to participate in the workshop. (D) The Commission comments together with all comments made at the workshop shall accompany and be made a part of any resolution transmitted by the City to the County or State. Section 2. This ordinance shall be codified and included in the Code of Ordinances. Section 3 If any section, clause, sentence, or phrase of this ordinance is for any reason held .invalid or unconstitutional by a court of_competent jurisdiction, the holding shall not affect the validity of the-remaining portions of this ordinance.
